Aurora Highlands Vista Homeowners Association Rules & Regulations Xeriscape is allowed following City of Aurora Landscape Ordinance, Article 14 of the City of Aurora Zoning Code.* Design (in detail) should be submitted to the Architectural Review Committee for approval before beginning. During times of water use restrictions homeowners should follow consumption allowances, times of watering, and watering days. Homeowners are expected to water the appropriate amount to maintain a healthy lawn while staying within City of Aurora water allowances. Homeowners are not permitted to stop watering altogether allowing their grass to turn brown or die. The display of the American flag and / or homeowner s service flag is permitted with the following guidelines: The American flag is displayed in a manner consistent with the federal Flag code, p.l. 94-344; 90 stat. 810; 4 u.s.c. 4 to 10. Window flag may not be larger than 18 by 26 inches Flag draped on house may not be larger than 3 by 5 feet Flag pole height may not be more than 20 feet with a flag of not more than 3 by 5 feet Political signs not larger than 36 x 48 inches are allowed to be posted on the ground or placed in a window of owner s residence forty-five days before the day of an election and must be removed no later than seven days after an election day. One sign per ballot issue or candidate is permitted. No other signage is allowed per the Declaration of the Covenants dated 8/12/1992 and recorded with Arapahoe County Clerk and Recorder. Parking of an emergency vehicle: Is allowed on the streets and driveway of homeowner when the vehicle is required by owner s employment and the employer is an emergency service provider. The vehicle weight must be 10,000 lbs or less. The vehicle has to have an official emblem. When parked the vehicle does not block emergency access or interfere with other owners use of association streets and driveways. Changes or improvements to property or dwelling with a written defensible space plan by Colorado State Forest Service for fire prevention purposes are to be submitted to the Architectural Review Committee for consideration. 1

VEHICLES Commercial vehicles under 7,000 pounds are allowed only if they are parked in front of owner s house or in their driveway. Commercial Vehicles over 7000 pounds are NOT allowed on the streets or properties unless they are there for temporary service to that residence. No inoperative vehicle, trailer, motor home, camper, including vehicle mounted camper, whether chasses or slide in, pickup coach, tent, boat or truck (except pickup) shall be parked, placed, erected, maintained or constructed on any Lot for any purpose. However, they may be stored completely within attached garages. No Lot or Living Unit on the Properties shall be used for any purpose other than single family residential purposes unless otherwise shown on the official recorded plat. PETS No animals, livestock, reptiles, poultry or insects, of any kind shall be raised, bred or kept or boarded in or on the Properties. Allowed are not more than three (3) dogs, cats, or other domestic animals which are bona fide household pets. Shall not be permitted to run at large and are to be controlled by leash, cord or chain whenever outside the owner s property. Pet excrement must be immediately removed and deposited in airtight container for refuse collections. Excessive barking, howling, or yelping dogs shall be deemed a nuisance violation and will be fined. 2

TRASH No trash, litter, junk, boxes, containers, bottles, cans, implements, machinery, lumber, or other building materials shall be permitted to remain exposed upon any Lot as to be visible from any front or side street. Trash must be in an approved, secure trash container with lid. Lid must be closed. If you have more items they must be in another container with lid or a closed bag. Recycling must be either in the orange container with the lid closed or in 2 x 4 foot bundles tied with string or rope. No loose articles are to be set outside of the container that could blow away. All containers shall be kept inside the living unit, connected garage, or behind a side yard fence as to not be visible from the street. Trash containers may not be stored in the front or side yard, driveway or sidewalk. Trash containers may be placed at the curb after 5:00 PM the day before collection (Sunday evening) and must be removed within 12 hours after pickup (Monday night or Tuesday morning). 3

PAINTING AND MAINTENANCE Except during any period of construction or reconstruction, each Lot at all times shall be kept in a clean, sightly, and wholesome condition. Houses with signs of fading, cracking, peeling or missing paint are to be painted. Color selection changes need Architectural Review Committee (ARC) approval. Painting shall be performed in a professional and generally accepted manner. Paint types must be manufacturer specified exterior paint in satin, semi-gloss or flat sheen only, no gloss is allowed. ARC appeals will require a 1 foot by 2 foot paint sample on house for review. Job from start to finish shall be no more than 45 days. Broken shutters, gutters, doors, house numbers, storm doors, screens and window treatments are to be repaired or replaced in a reasonable period of time. Gates and fencing are to be repaired in a reasonable period of time. Fence materials permitted are six foot cedar privacy (weaved pattern is not allowed) or two or three split rail fence not to exceed four feet in height. No owner may construct fence made of wire or chain link, including chain link which is screened. Garage doors should at all times be in working order and painted to match the house and kept closed when not in use. Color selection needs Architectural Review Committee (ARC) approval. Driveways, sidewalks, porches and steps, are to be maintained by repairing or replacing (if needed), and kept clear of oil spots, debris and weeds. Street gutters also are to be weed and debris free. Snow must be removed from all city sidewalks adjacent to your property within 24 hours after a snowfall ends. Holiday decorations are to be removed within 30 days after the holiday. Air-conditioning window units are to be installed properly and maintained and may not be visible from any street. Swamp coolers should be mounted on the back of houses not to be seen from the front street. A fine of $100.00 every thirty (30) days will be assessed to any homeowner that begins any type of project of construction, improvement, re-design, or maintenance to their property without first having filled out and submitted for review and approval, the Architectural Control Committee (ACC) Request Form. LANDSCAPING Landscaping should be healthy (not brown) and free of weeds and debris. Rocked areas should be kept free of weeds of any size and debris. Dead trees, shrubs, bushes and plants are to be removed. Bushes over sidewalks must be cut back six (6) inches from the sidewalk to clear walkway. The maximum height of hedges in the front yard is 42 inches. Tree branches lower than 8 feet over sidewalks and driveways, 13 feet 6 inches over street, alley or highway are to be cut and removed. Basketball hoops are to be located in driveway only and in an upright position. Blocking sidewalks or in the street are not permitted. Toys, Games, youth apparatus items, bicycles, skate boards, scooters and pet toys are to be removed from view of the street when not in use. Swings or tires hanging in trees and hammocks are not allowed in front or side yards including front porches and patios. Patios shall not be used for storage of items other than patio furniture. Retractable clotheslines (permanent are not allowed), dog runs, wood piles or storage areas are not allowed where they can be seen from any street. STRUCTURES (Require Architectural Review Committee Approval) Additions to house, greenhouses, sheds, storage units, gazebos may require a city building permit and must follow city easement rules. Maximum size for a shed is 10 foot by 10 foot (100 sq. ft.) Maximum height allowed from footing to gable is 7 feet 5 inches. Must be constructed of the same type materials and roofing and colors are to be same as the house. Temporary Rubbermaid storage units, metal, plastic, resin, fiberglass or tarp covered structures are not allowed where they can be seen from any street. All fences must be maintained in good structural condition including pickets, rails, and posts using the same materials and sizes as current fence. No noxious, offensive (annoying lights, sounds or odors) or hazardous activity shall be carried on upon the Properties or any part thereof, nor shall anything be done or maintained thereon which may detract from its value as an attractive residential community. 5

ARTIFICIAL TURF STANDARDS Must follow City of Aurora Artificial Turf Standards dated September 1, 2004. o Sec. 146-1402. Definitions o 146-1414 Artificial Turf Standards o Table 14.3A Home Yard Landscaping Turf Option Minimum and Maximum Artificial Turf per Lot Size are: o Small Lot (3,700sf 5,999sf) 40% Min. and 50% Max. o Standard Lot (6,000sf 8,999sf) 30% Min. and 40% Max. o Large Lot (9,000sf 14,999sf) 25% Min. and 40% Max. Homeowner must submit an Architectural Review Committee (ARC) form for Committee approval. Follow ARC instructions for contents. Turf is to be maintained by keeping it free of weeds and cleaned by hosing. Turf should be replaced when it is worn out. SOLAR PANELS (ELECTRICITY / HOT WATER) Must follow City of Aurora Solar Panel Standards dated 2010. Homeowner must submit an Architectural Review Committee (ARC) form for Committee approval. Follow ARC instructions for contents. Panels are to be Low Profile, Flush Mount and follow the contour of the roof line. Panels are to be mounted flat on top of the house only. o Solar Panels are PROHIBITED in the yard or on fences. o Panels and mechanical parts are to be maintained and repaired in a timely manner. (Timely Manner means: If it is a visible maintenance, repairs should be done as soon as possible. NOTE: Both of these products require City of Aurora Building Permits and are to be completed within 45 days of the start of project. 6
