BIM Contracts & Risk Allocation for Mechanical Contractors Monday, October 17, 2011 Baltimore, MD Course Description BIM is a dramatic change agent in mechanical design and construction. As it grows in popularity and use, it also grows increasingly obvious that the legal universe in which mechanical contractors do their work is a perilous one. How should they manage the emerging risks associated with the electronic representation or transmission of project data? While some of the legal hazards associated with BIM are obvious (for example, what are the legal liabilities of participating and collaborating in a digital building model?), others are not as clear and are only now starting to surface and crystallize. How to identify and resolve emerging BIM legal issues is a critical question. Another equally critical question is will the fear of BIM liability issues, risk allocation, shifting leadership roles and the sharing of valuable data inhibit the industry from valuable experimentation? Will it deny mechanical contractors the chance to improve and profit from building information modeling? Here is a sampling of important legal concepts and concerns that BIM Contracts & Risk Allocation for Mechanical Contractors will address head-on: Is the mechanical contractor s risk greater just because BIM risks are different? Reaching an understanding with all parties about the ability and right to rely upon the model. Should the same risk allocation principles that apply to traditional two-dimensional design apply to a BIM model? Applying strict rules to police the model so that access rights are reasonably restricted or logically granted. The traditional tri-party approach to design and construction is shifting toward Integrated Practice and collaboration. Specific privacy and security requirements. Storage and retrieval requirements for electronic documents and data. Contract provisions in the design and construction agreements that address the line and flow of communications among the project parties. Contractual reporting requirements for known or observed errors or omissions in contract documents. Confidentiality provisions. Who is responsible for inputting which information into the model? Following this course, participants will be able to: Explain contract liability and standards of care related to BIM for mechanical contractors. Negotiate BIM Addendum terms for BIM execution plan development. Use BIM contract negotiation to establish proactive, collaborative BIM. Identify intellectual property rights and licensing issues related to BIM model use. Recognize BIM coverage limitations in existing insurance and bond products. About the Instructors David Morris, Director of Virtual Construction for EMCOR, has over thirty years of experience performing and directing all phases of piping and mechanical systems for Commercial, Hospitality, Industrial, and Power Generation construction. Current duties include improving BIM processes and sharing best detailing and virtual design practices across the 80 EMCOR group companies. Dave is actively involved with the Construction Users Roundtable Process Transformation Committee, is Chairman of the Associated General Contractors BIM Forum Subcontractors Subcommittee, and Vice Chairman of the BuildingSmart Alliance Board of Directors and brings a practical perspective to the use of technology in construction. Frank Musica is Senior Risk Management Attorney for Victor O. Schinnerer & Company, Inc. which he joined in 1991 to assist the program in identifying the transformations in construction-related professional services, the liability exposures created by contractual language, legislation, regulations and court rulings, and management processes and procedures to reduce the risk profiles of firms.
