THE MINISTRY OF FOREIGN AFFAIRS Decree N 593 of November 7, 1995 Regulations governing prizes and grants awarded to promote the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication. The Minister of Foreign Affairs, in conjunction with the Minister of the Treasury, the Minister for Public Education, the Minister for the Preservation of Culture and the Environment, the Minister for Universities, Scientific and Technologic Research Art. 20, Paragraph 2, Letter C) of Law N 401 of December 22, 1990, governing prizes and grants awarded to promote the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication; Paragraph 5 Art. 20 of Law N 401 of December 22, 1990 mentioned above; Paragraph 4 of Law N 401 of December 22, 1990 that established the National Committee for the Promotion of Italian Culture abroad; Royal Decree N 2440 of November 18, 1923 on the General Accounting of the Italian State with the set of Regulations passed with Royal Decree N 827 of May 23, 1924 including all subsequent amendments; Law N 416 of December 31, 1991 that provides for Chapter 2692 titled Prizes and Grants awarded to promote the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication within the general accounting of the Ministry of Foreign Affairs; Bill N 29 of February 3, 1993, including all subsequent amendments;

The Decree of March 12, 1994 issued by the Prime Minister establishing the Department for the Performing Arts; Bill N 661 of November 30, 1994 governing the power of the Council of Ministers in the field of the Performing Arts; Art. 17, Paragraph 3 of Law N 400 of August 23, 1988; Having heard the Opinion of the State Council as expressed during the Assembly of November 17, 1994; Notice N 143/40B of January 3, 1995 issued by the Prime Minister in accordance with Art. 17, Paragraph 3 of above-mentioned Law N 400 of August 23, 1988, ADOPTS the following regulations on Prizes and Grants awarded to promote the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication. ARTICLE 1: SCOPE OF APPLICATION OF REGULATIONS 1. Prizes and Grants awarded to promote the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication as expressed in Law N 401, Art. 20, Paragraph 2, Letter C) are aimed at promoting the Italian language and culture abroad. The work done with the prizes and grants awarded must contribute toward this end and should be done in a foreign language, with the exception of literary anthologies and Italian non-fiction publications written abroad as well as Italian-language dictionaries in a foreign language and vice-versa. 2. Prizes will only be awarded for work that has been disseminated, translated, produced, dubbed and subtitled on or before January 1 st of the year preceding the prizes and grants awarded. During the first two-year period in which financing is provided, the term mentioned earlier refers to the year Law N 401 of December 22, 1990 went into effect.

3. Grants will only be awarded for work that is to be disseminated, translated, produced, dubbed and subtitled. ARTICLE 2: APPLICATION SUBMISSION 1. Applications for Prizes and Grants, as described in Art. 1 above, are submitted by publishers, translators, production, dubbing, subtitling and distribution companies as well as cultural and international institutions headquartered in Italy or abroad on or before March 31 st and September 30 th every year. Applications should be submitted to the Italian Embassies through the competent Italian Cultural Institutes operating in that territory, whenever present. The Institutes, in turn, provide their imput on the applications submitted and the likelihood that the work described in them will promote Italian culture in their territory of competence. For work that is or will be used in various countries, applications must be sent through the competent Italian Cultural Institutes to the Embassy in the country where the work has been disseminated or should be disseminated the most with a list stating the countries where the work itself has been disseminated or is likely to be disseminated the most. 2. Applications should contain all the material necessary for the work for which a prize or grant is being requested. In the case of grants, the work must include a written plan for its practical use and a report stating how funds received previously will be used, in accordance with the regulations herein. 3. Applications can still be submitted within the last deadline for submission during the year these regulations enter into effect, although the first deadline for submission mentioned in Paragraph 1 expires before the 60 th day from this date. ARTICLE 3: LIMITS SET ON ALLOCATION OF PRIZES AND GRANTS 1. The prizes and grants mentioned in Art. 1 are available to the same beneficiary for a period not exceeding three years within a ten-year period; the amount should not exceed 20% of the entire amount allocated, as described in Chp. 2692 in the relevant fiscal year. This limit does not apply when the applicant sets forth a number of initiatives to be carried out in a time period in excess of three years. 2. The limits contained in Paragraph 1 can be overcome as described in the previous Paragraph for work having a particular relevance, once the National Committee for the

Promotion of the Italian Culture Abroad expresses its opinion in accordance with Art. 4 of Law N 401 of December 22, 1990. ARTICLE 4: EXAMINATION OF APPLICATIONS FOR PRIZES AND GRANTS 1. Given Art. 2. Paragraph 2 of Law N 241 of August 7, 1990, the allocation procedure of prizes and grants must end on or before the 90 th day from the date the procedure begins. 2. Given Art. 12 of Law N 241 of August 7, 1990, the Ministry of Foreign Affairs establishes the criteria used to allocate prizes and grants, having heard the opinion of the National Committee for the Promotion of Italian Culture Abroad. 3. The competent diplomatic representation in the specific territory examines the applications submitted and makes its suggestions based on the imput from the Italian Cultural Institutes, whenever present, to determine whether the work being proposed is adequate to disseminate the Italian language and culture abroad and in the geographic area they are aimed at, in particular. 4. All applications and the proposals set forth by the diplomatic representation in that territory are submitted to the Ministry of Foreign Affairs within the following two months in compliance with Art. 2, Paragraph 1 of these regulations. 5. The Minister of Foreign Affairs hears the suggestions expressed by the National Committee for the Promotion of Italian Culture Abroad every six months on the projects proposed by the Embassies. Suggestions are to be submitted within 45 days from the Minister s request. Based on the general criteria set forth as well as the Committee s view, the Ministry of Foreign Affairs must then approve an allocation plan of prizes and grants within 30 days. Applicants are informed of this decision through the Italian Cultural Institutes, and, in their absence, through the Diplomatic Representation in that territory. 6. Work that has been included and considered in other applications, and has been allocated funds that are part of a separate fiscal year, as stated in these regulations, will not be considered unless there have been changes locally such as to warrant its re-examination.

ARTICLE 5: Assignment of Prizes and Grants 1. The assignment of Prizes, as set forth in Art. 4, is done by the Minister of Foreign Affairs, on or before the 30 th day from the approval of the allocation plan. 2. The assignment of Grants, as set forth in Art. 4, is done by the Minister of Foreign Affairs within 30 days from the date the Ministry receives the documentation that proves that the work has been disseminated, translated, produced, dubbed and subtitled. This documentation is provided by the beneficiary to the Italian Cultural Institute, or, in its absence, to the Diplomatic Representation that had originally received the Prize and Grant application. 3. The assignment of Prizes and Grants is done in compliance with Paragraphs 2 and 3 and the Minister of Foreign Affairs then issues the relevant allocation orders for the beneficiary. If the beneficiary resides overseas, allocations orders are accredited to the competent Italian Cultural Institute. In absence of an Italian Cultural Institute, due to specific local needs, included in the regulations governing Prizes and Grants, orders will be accredited to the Diplomatic Representation competent in that territory. ARTICLE 6: Verification of Work Accomplished with Prizes and Grants Awarded 1. The Italian Cultural Institute, or the Diplomatic Representation that receives the Allocation Orders mentioned earlier, in Article 1, draws up a report on the use of the amount allocated in view of the particular way in which Italian culture has been disseminated in its area of competency within 90 days before the end of the year in which the funds were allocated. The Italian Cultural Institute or the Diplomatic Representation is to submit a similar report on the work done by residents in Italy who submitted an application to receive Prizes or Grants through it, in compliance with Art. 2, Paragraph 1 of these Regulations. 2. The report mentioned in Paragraph 1 is sent to the Ministry of Foreign Affairs, which, in turn forwards it to the National Committee for the Promotion of Italian Culture Abroad, to the President of the Council of Ministers, to the Ministry of the Treasury, to the Ministry of Public Education, to the Ministry for the Cultural Heritage and the Environment and to the Ministry for Universities and Scientific and Technologic Research. This

decree, bearing the Seal of the Italian State, will be included in the Official Register that holds the Norms and Rules governing the Italian Republic. All are to comply with such rules and make sure others comply with them as well. NOTES ON THIS PREMISE: Law N 401 of December 22, 1990, contains the following: Reform of the Italian Cultural Institutes and actions to promote the Italian Culture and Language Abroad. Art. 20, Paragraph 2, Letter C) of Law N 401 of December 22, 1990, authorizes the assignment of Prizes and Grants for the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication. Paragraph 5 of Art. 20 of Law N 401 of December 22, 1990, (provided the competencies assigned to the Institutes do not change), rules the actions contained in Paragraph 2 mentioned above by a Ministerial Decree in conjunction with the Minister of the Treasury and all other competent Ministries. Article 4 of Law N 401 of December 22, 1990, establishes the National Committee for the Promotion of Italian Culture Abroad. Royal Decree N 2440 of November 18, 1923 sets forth the rules that govern the Italian State s General Accounting. Royal Decree N 827 of May 23, 1924, including all subsequent amendments, approves the regulations to manage the National Treasury and the

Country s General Accounting Practices. Law N 416 of December 31, 1991 establishes Chp. 2692 titled Prizes and Grants for the dissemination of Italian books, translation of literary and scientific material, production, dubbing and subtitling of short films, feature films and television series for mass communication as part of the Country s 1992 Estimated Balance as well as the Estimated Balance for the Ministry for Foreign Affairs. Bill N 29 of February 3, 1993, with all subsequent amendments, organizes public administration practices and regulates public employment based on Art. 2 of Law N 421 of October 23, 1992. The Presidential Decree of March 12, 1994, establishes the Department for the Performing Arts. Legislative Decree N 219 of March 31, 1994, reiterates previous Legislative Decree N 80 of February 2, 1994 that sets forth the functions and responsibilities of the Prime Minister within the field of the Performing Arts. Art. 17, Paragraph 3 of Law N 400 of August 23, 1988, through a Presidential Decree stemming from deliberations with the Council of Ministers and the Council of State, which, in turn, must provide its decision within 90 days from submission of the Application, establishes regulations governing matters that have not been regulated, provided such matters are not strictly pertinent to Law.
