UNITED NATIONS United Nations Interim Administration Mission in Kosovo UNMIK NATIONS UNIES Mission d Administration Intérimaire des Nations Unies au Kosovo UNMIK/REG/2002/10 6 May 2002 REGULATION NO. 2002/10 ON THE ESTABLISHMENT OF THE ECONOMIC AND FISCAL COUNCIL The Special Representative of the Secretary-General (SRSG), Pursuant to the authority given to him under United Nations Security Council resolution 1244 (1999) of 10 June 1999, Taking into account United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 1999/1 of 25 July 1999, as amended, on the Authority of the Interim Administration in Kosovo, Taking into account also UNMIK Regulation No. 2001/9 of 15 May 2001 on a Constitutional Framework for Provisional Self-Government in Kosovo and UNMIK Regulation No. 2001/19 of 13 September 2001, as amended, on the Executive Branch of the Provisional Institutions of Self-Government in Kosovo, which refer to the Economic and Fiscal Council, For the purpose of establishing the Economic and Fiscal Council, Hereby promulgates the following: Section 1 Economic and Fiscal Council 1.1 The Economic and Fiscal Council (hereinafter the Council ) is hereby established as an advisory body to the SRSG. The composition of the Council shall be as set out in the Annex to the present Regulation. 1.2 The Council shall advise on economic, financial or fiscal matters requiring consultation with the Council and the Provisional Institutions of Self-Government (hereinafter the PISG ), including the following:
2 (a) Setting the financial and policy parameters for and approving the Kosovo Consolidated Budget; (b) Regulating public and socially owned enterprises; and (c) Such other economic, financial or fiscal matters that may be referred to the Council by the SRSG on his own initiative or on the request of other members of the Council. 1.3 The SRSG, or in his absence his designated representative, shall preside over the Council and convene its meetings. 1.4 The SRSG may at his discretion or pursuant to a proposal by the Council or by one or more of its members invite UNMIK and PISG officials, as well as experts, to participate on ad hoc basis in the work of the Council on one or more specific matters. 1.5 The Council s advisory functions shall be without prejudice to the prerogatives and authority of the SRSG under UNSCR 1244 (1999). Section 2 General Provisions 2.1 The SRSG shall approve the agenda for each meeting of the Council. 2.2 Secretariat support services to the Council (hereinafter the Secretariat ) shall be provided by the staff of UNMIK Pillar IV (Economic Reconstruction) designated for this purpose by the Deputy SRSG for Economic Reconstruction. The Secretariat, inter alia, shall: (a) Receive, process and present to the Council documents and information on matters to be considered by the Council as set out in section 1.2; (b) Prepare and present for the SRSG s approval draft agenda for meetings of the Council, including items proposed for discussion by members of the Council; and (c) Coordinate with relevant UNMIK authorities and the PISG concerning any matters under consideration of or to be considered by the Council. 2.3 The Ministry of Finance and Economy shall present records and reports on the expenditures and revenue of the budget of the PISG directly to the Council. 2.4 Following the Council s deliberations on matters under its consideration, the SRSG may determine the sense of such deliberations and any conclusions that may be drawn therefrom.
3 Section 3 Implementation The Special Representative of the Secretary-General may issue administrative directions for the implementation of the present Regulation. 4 ANNEX Composition of the Economic and Fiscal Council The Composition of the Council shall include the following: (a) (b) The Special Representative of the Secretary-General (Chairman); The Principal Deputy Special Representative of the Secretary-General; (c) The Deputy Special Representative of the Secretary-General for Civil Administration; (d) The Deputy Special Representative of the Secretary-General for Economic Reconstruction; (e) (f) (g) (h) (i) SRSG. The Prime Minister; The President of the Assembly of Kosovo; The Minister of Finance and Economy; The Minister representing the Kosovo Serb community; and Another Minister nominated by the Prime Minister and confirmed by the
