A sheriff travels to a law enforcement conference in his agency vehicle. Following the conference he drives to North Carolina for a week of vacation. While agency policy precludes using an agency vehicle for personal use, he contends he is on duty 24-7 and may be called to return at any moment to attend official business. He may be subject to a complaint for misuse of public position. Section 112.313(6), F.S.

Deputy conducts private surveillance on unfaithful spouses for compensation. His work is off-duty. A conflict of interest arises under section 112.313(7)(a) because it may compromise criminal investigations.

A sheriff has delegated authority to a promotional board. The board selects the sheriff s son as the top candidate for sergeant. The sheriff signs the personnel action form and related documents appointing the son as a sergeant. The anti-nepotism law prohibits the promotion.
