Background: Secton 122 of the Workforce nnovaton and Opportunty Act (WOA) [PL 113-128] and ts assocated regulatons requre the establshment and dssemnaton of a sngle lst of Elgble Tranng Provders (ETPL) dentfed by the Local Workforce Development Board (LWDB). WOA further requres the establshment of crtera, nformaton requrements and procedures for the purpose of determnng the elgblty of provders of tranng servces to receve funds provded under secton 133 (b) of W OA for the provson of tranng servces n local areas n the State. Polcy: Consstent wth Secton 122 of WOA and ts assocated regulatons, WC shall dentfy provders of tranng servces and ther offerngs wthn the Local Workforce Development Area (LWDA). The ETPL must be made wdely avalable to elgble program partcpants engaged n employment and tranng actvtes through the One-Stop Delvery System (OSDS), the One Stop Career Center (OSCC), and the network of funded servce provders. Program partcpants elgble to receve tranng servces may, through guded customer choce, select a tranng provder that s ncluded on the ETPL. At the same tme the workforce development system establshed under WOA emphaszes nformed customer choce, job drven tranng, provder performance, and contnuous mprovement. The qualty and selecton of provders and programs of tranng servces s vtal to achevng these core prncples. The ETPL process s part of the strategy for achevng these goals. n order to maxmze customer choce and assure that all sgnfcant populaton groups are served, the LWDB wll admnster the elgble tranng provder process n a manner that assures that sgnfcant numbers of competent tranng provders, offerng a wde varety of tranng programs and occupatonal choces, are avalable to all OSDS customers. The LWDB, n partnershp wth the State, dentfes provders of tranng servces whose performance qualfes them to receve WOA Ttle funds. The ETPL and related elgblty procedures ensure the accountablty and qualty of programs of tranng servces that receve funds under Ttle of WOA. The ETPL s also a tool for ensurng nformed customer choce through the gatherng and dsplayng of useful nformaton wth respect to tranng provders, ther servces, and the qualty of ther programs. Elgble provders of tranng servces are subject to the equal opportunty and nondscrmnaton requrements contaned n Sec. 188 ofwoa, whch prohbts dscrmnaton aganst all ndvduals n the Unted States on the bass of race, color, relgon, sex (ncludng pregnancy, chldbrth and related medcal condtons, transgender status, and gender dentty), natonal orgn (ncludng lmted Englsh profcency), age, dsablty, poltcal afflaton or belef, and aganst benefcares on the bass of ether ctzenshp/status as a lawfully admtted mmgrant authorzed to work n the Unted States or partcpaton n any WOA Ttle fnancally asssted program or actvty. A. ntal elgblty s determned based on meetng State and WC establshed crtera. WC s responsble for revewng and verfyng applcatons submtted by provders of tranng servces, and determnng f the applcant(s) meets the State and WC's crtera for ntal elgblty. 1. Consstent wth State requrements, n order to provde tranng servces to elgble adults, dslocated workers and youth, a provder of tranng servces must be approved to be lsted on the ETPL and fulfll the followng crtera: a) A post-secondary educatonal nsttuton; or b) Regstered Apprentceshp (RA) programs; or c) Other publc or prvate provder of a program of tranng servces, whch may nclude jont labor-management organzatons, and elgble provders of adult educaton and lteracy actvtes under Ttle, f such actvtes are provded n combnaton wth occupatonal sklls tranng; or d) Accredted by the Northwest Accredtaton Commsson to provde tranng n the careers or certfcaton programs dentfed as beng vable wthn one of the desgnated ndustry sectors; or e) Local Boards, f they meet the condtons of WOA Sec. 107 (g)(1); and f) Communty Based Organzatons (CBOs) or prvate organzatons of demonstrated effectveness that provde tranng under contract wth the Local Board. 2. Enttes carryng out programs regstered under the Natonal Apprentceshp Act, of August 16, 1937 or under a recognzed State apprentceshp agency, are granted ntal elgblty upon recept of a properly RA regstraton form. RA programs wll reman on the lst as long as the program s regstered or untl the RA program notfes WC that t no longer wsh to be ncluded n the ETPL. Consstent wth establshed requrements elgble provders of tranng servces must provde a program of tranng servces through one (1) or more courses or classes that upon successful completon leads to: 1. A recognzed post-secondary credental; or 2. A secondary school dploma or ts equvalent; or 3. Employment; or 4. Measurable sklls gans toward such a credental or employment. C. Consstent wth State establshed requrements, WC wll post publc notce of request for qualfcatons annually, at a mnmum, for potental new provders of tranng servces. D. The Nevada Department of Employment, Tranng and Rehabltaton (DETR) admnsters a State-wde ETPL. The Workforce nvestment Support Servces (WSS) dvson of DETR wll perform approvals for provders of tranng servces to be ncluded on the State ETPL. Provders of tranng servces that have been approved to be ncluded on ths lst wll be approved to receve WOA Ttle funds. E. Any and all exceptons to the use of any other ETPL n whch WC may have a recprocal agreement, shall be only wth wrtten pror approval by WC. F. For enttes other than the one descrbed on secton (A)(1)(b) above, they must comply wth the crtera, nformaton requrements and procedures as establshed n ths polcy n order to be consdered for ntal elgblty determnaton and ncluson on the ETPL.. Applcaton to lst a tranng program on the ETPL A. n order to be lsted on the ETPL, a provder of tranng servces must submt an applcaton to the LWDB/WC to present nformaton on the tranng and servces they wsh to provde. The applcaton must descrbe each unque program of tranng servces to be offered. B. New tranng provder applcaton, addng a tranng applcaton, annual subsequent elgblty applcaton. and RA regstraton form can be located under the ETPL lnk at WC webste: http://nvworkforceconnectons.org/ C. Applcatons wll be revewed by WC staff to ensure they are complete and that all requred nformaton and support documentaton s ncluded. D. Estmated tme for the revew process at WC s sx (6) busness days upon recept of ntal applcaton. Revewed applcatons wll then be forwarded to the State for fnal approval and potental postng n the ETPL. E. Once approval s granted by the State agency a wrtten notfcaton wll be sent to the provder of tranng servces va e-mal. Descrpton of each program of tranng servce to be offered ncludng nternshps, lab fees, and materals to nclude costs assocated for each tem and as ndcated on the ETPL applcaton; 2. nformaton addressng factors related to performance ndcators, as descrbed n Sec. 116 (b)(2)(a)()()-(v) of WOA, whch nclude: a) Percentage of program partcpants who are n unsubsdzed employment durng the second quarter after ext from the program; b) Percentage of program partcpants who are n unsubsdzed employment durng the fourth quarter after ext from the program; c) The medan earnngs of program partcpants who are n unsubsdzed employment durng the second quarter after ext from the program; d) The percentage of program partcpants who obtan a recognzed postsecondary credental, or a secondary school dploma or ts recognzed equvalent, durng partcpaton n or wthn one (1) year after ext from the program. For those partcpants who obtaned a secondary school dploma or ts recognzed equvalent, the partcpant must also have obtaned or retaned employment or be n an educaton or tranng program. 3. A descrpton of whether the tranng provder s n a partnershp wth a busness ncludng qualty and quantty of employer partnershps and as ndcated on the ETPL applcaton; 4. Other factors that ndcate hgh-qualty tranng servces leadng to a recognzed postsecondary credental; 5. nformaton addressng the algnment of the tranng servces wth n-demand ndustry sectors and occupatons, to the extent practcable; 6. State lcensure requrements; 7. The ablty of the tranng provders to provde tranng servces that are physcally and programmatcally accessble for ndvduals who are employed and ndvduals wth barrers to employment, ncludng ndvduals wth dsabltes. H. Addtonal Crtera for the ntal revew process has been establshed by WC. The lst may change based on local or regonal need: 1. Tranng supports employment n Nevada's targeted ndustry sectors; or 2. Tranng leads to an ndustry-recognzed credental/skll set; or 3. Tranng algns wth local labor market nformaton; or 4. Tranng algns wth ntellgence gathered from WC's advsory panels and the Governor's ndustry sector councls; or 5. Tranng s provded n accordance wth tranng provder elgblty crtera wthn ths polcy; or 6. Tranng results n measurable sklls obtanment that makes the partcpant more employable (ths wll be supported by performance data suppled by the tranng provder n the ETPL applcaton: percentage of tranees who obtan employment after tranng completon).. n the event ntal elgblty for the ETPL s declned by WC durng the ntal process, a wrtten notfcaton wll be sent to the provder of tranng servces wthn 15 days. ncluded n the wrtten notfcaton wll be the reason(s), and nformaton related to the appeal process. There wll be a subsequent elgblty process each year for exstng provders of tranng servces wth the excepton of RA programs. WC has establshed that, n order to reman on the ETPL, provders of tranng servces must adhere to the followng: 1. Performance ndcators: Consstent wth Sec 122 ofwoa, the provder of tranng servces shall provde tmely and verfable program-specfc performance nformaton that must be consdered by WC n determnng the subsequent elgblty of provders of tranng servces and ther programs to reman on the ETPL. The followng wll be requred n order to determne subsequent elgblty - State Requrement: a) Performance accountablty measures as descrbed n tem G(2) above; b) Access to tranng servces throughout the State ncludng rural areas and through the use of technology; c) nformaton reported to State agences on Federal and State tranng programs other than programs wthn WOA Ttle ; d) The degree to whch tranng programs relate to n-demand ndustry sectors and occupatons n the State; e) State lcensure requrements of tranng provders, and lcensng status of provders of tranng servces, whenever applcable; f) The provder's ablty to offer ndustry-recognzed certfcates and/or credentals; g) The ablty of provders to offer programs that lead to post-secondary credentals; h) The qualty of the program of tranng servces ncludng a program that leads to a recognzed post-secondary credentals; ) The ablty of the tranng provders to provde tranng servces that are physcally and programmatcally accessble for ndvduals who are employed and ndvduals wth barrers to employment, ncludng ndvduals wth dsabltes. 2. Addtonal crtera for the subsequent elgblty revew process gathered through ether the subsequent elgblty applcaton or by other means may nclude some of the followng factors: a) Completon rates for all ndvduals partcpatng n the tranng program conducted by the provder of tranng servces; b) Total number of tranees that completed the lsted tranng program and obtaned a credental/ certfcate, or other measurable sklls; c) Total number of tranees that completed the tranng program and obtaned unsubsdzed employment; d) Total number of tranees who obtaned unsubsdzed employment related to the completed tranng program. 3. Consstent wth State requrements WC wll also take nto consderaton the followng: a) The specfc economc, geographc and demographc factors n the local areas n whch provders seekng elgblty are located; and b) The characterstcs of the populatons served by programs seekng elgblty, ncludng the demonstrated dffcultes n servng these populatons, where applcable. lf') Q) l:l.o res 0... For a provder of tranng servces to be determned to be subsequently elgble under Sec. 122 ofwoa, and receve funds as descrbed n Sec. 133 (b) ofwoa, such provder of tranng servces shall submt to WC verfable program-specfc performance nformaton as ndcated n tem (A)(1) and (2). 2. WC s responsble for submttng the performance reports to the State on an annual bass wthn 45 days from the date that the nformaton s due from provder of tranng servces. C. The LWDB/WC expects 100% completon rate and 100% attanment of a credental/certfcate by WOA Ttle program partcpants, by program. WC has establshed the followng addtonal crtera for determnng elgblty to reman on the ETPL: 1. Annual subsequent elgblty applcaton located at: www.nvworkforceconnectons.org; 2. Verfable demand occupatons n the feld of tranng program; 3. Complance wth Federal, State and local regulatons, e.g., Equal Opportunty provsons (EO), Amercans wth Dsabltes Act (ADA), and health and safety standards. V. Addtonal Provsons A. A provder of tranng servces must delver results and provde accurate nformaton n order to retan ts status as an elgble provder of tranng servces. f the provder's programs do not meet the establshed performance levels, the programs wll be removed from the ETPL. B. WC may conduct on-ste vsts for the purpose of mprovng the management, effectveness and mprovement of employment and tranng actvtes carred out under Ttle ofwoa. C. WC wll determne, durng the subsequent elgblty determnaton process, whether or not a provder of tranng servces wll mantan ts elgblty to reman n the ETPL. f a program fals to meet establshed requrements, the program must be removed from the local lst. f all of the provder's programs fal to meet such levels, the provder must be removed from the local lst. D. The desgnated State agency, upon recept of performance nformaton, may remove programs from the State lst f the agency determnes the program faled to meet the levels of performance establshed by the State and WC. f all of the provder's programs are determned to have faled to meet the performance levels, the desgnated State agency may remove the provder from the State lst. E. Provders of tranng servces must nform WC wthn fve (5) busness days of any change and/or update n all applcable nformaton related to ther tranng offerngs, courses, lcenses, accredtatons, or any or all nformaton as provded wthn ther ntal applcaton for elgblty. Noncomplance - f WC, workng together wth the State agency, determnes that an elgble provder of tranng servces substantally volates any requrement under WOA, WC, workng wth the State agency, may termnate the elgblty of such provder to receve funds for the program nvolved or take such other acton(s) as WC determnes to be approprate [WOA Sec. 122 (f) (1) (A)]. B. Enforcement: 1. ntentonally Provdng naccurate nformaton: Upon a determnaton by WC that a provder of tranng servces, or ndvdual provdng nformaton on behalf of the provder of tranng servces, volated Sec. 122 of WOA (or secton 122 of the Workforce nvestment Act of 1998 (WA), as n effect on the day before the date of enactment of ths Act) by ntentonally supplyng naccurate nformaton under Sec. 122 of WOA, the elgblty of such provder to receve funds shall be termnated for a perod of tme that s not less than two (2) years. 2. Substantal Volatons: Upon a determnaton by WC that a provder of tranng servces substantally volated any requrement under WOA (or ttle of WA, as n effect on the day before such date of enactment), the elgblty of such provder to receve funds for the program nvolved shall be termnated for a perod of not less than two (2) years. 3. Repayment: A provder of tranng servces whose elgblty s termnated under subparagraph (1) or (2) of ths secton shall be lable for the repayment of funds receved durng the perod of noncomplance. C. WC has establshed the followng addtonal crtera for determnng termnaton of a provder of tranng servces: 1. nformaton gathered from montorng reports completed after on-ste revews; 2. Performance accountablty nformaton; 3. nformaton conveyed through partcpant ntaton or customer satsfacton survey; 4. Subsequent elgblty determnatons, tem of ths polcy. D. Enforcement of termnaton of an elgble provder of tranng servces shall proceed as follows, [SCP.13 ()(A)(B)]: 1. WC wll submt a recommendaton to the State agency to remove the provder of tranng servces from the ETPL; 2. The desgnated State agency, upon recept of WC's recommendaton for termnaton wth support documentaton, may recommend removal of the provder of tranng servces from the State lst: a) f the desgnated State agency determnes the provder of tranng servces faled to meet the establshed performance levels; b) f the desgnated State agency determnes that provder of tranng servces has ntentonally provded naccurate nformaton; or c) The desgnated State agency determnes the provder of tranng servces has volated any provson of the Act or regulatons. E. WC wll make a recommendaton to the desgnated State agency whch shall determne what dscplnary acton s most approprate for those elgble provders of tranng servces found to be n volaton of any requrement under Federal, State regulatons. Appeals Ths procedure apples to appeals by provders of tranng servces to WC for the followng factors: 1) WC declnes ntal applcaton for lstng on the ETPL; or 2) Any elgble provder of tranng servces found to be n volaton of any requrement under WOA, State regulatons and WC polces/procedures, for whch dscplnary acton has been determned to be approprate. A provder of tranng servces wshng to appeal a decson by WC must submt an appeal wthn 15 busness days upon recept of WC wrtten notfcaton. Appeal Procedure A. The wrtten appeal shall state wth accuracy the name, address, and contact nformaton of the entty flng the appeal. B. The wrtten appeal shall be drected to WC Executve Drector. C. The wrtten appeal must nclude detaled reason(s) or factors the provder of tranng servces deems necessary to be consdered by WC, and must nclude any support documentaton needed to valdate the bass of the appeal. D. WC wll then have 30 busness days upon recept of the appeal to conduct a revew. E. WC wll make a recommendaton to the desgnated State agency regardng the appeal. F. A fnal determnaton wll be made by the desgnated State agency. V. Compensaton A. The provder of tranng servces shall be pad for the cost of tranng on the bass of the fees for tuton, books, supples, and other costs as proposed n vendor's applcaton for the ETPL, whch n no case shall exceed the WC establshed cap amount of $15,000 unless a wrtten approval by WC Executve Drector or desgnee s provded. B. The provder of tranng servces shall not nvoce a program partcpant nor shall request payment/rembursement for amounts that exceed the establshed cap amount of $15,000. V. Tranng Program Refunds A. Provders of tranng servces wll be requred to provde ther refunds polcy durng the ntal elgblty process. Refunds for tranng program costs shall be calculated as stpulated on the provder of tranng servces polcy. B. Provders of WOA Ttle servces wll ensure that the refund polcy from provders of tranng servces s taken nto consderaton at the tme of approvng an TA. C. Provder of tranng servces must notfy WC wth respect to any fnancal ad receved by program partcpant after WOA funds are dsbursed. D. The provder of tranng servces must remburse WC the amount of the WOA funds used to pay for the tranng costs covered by any other funds (e.g., Pell Grants) n the event such funds are approved after WOA-funded tranng has begun. X. The lst and the accompanyng nformaton shall be made avalable to such partcpants and to members of the publc through the OSDS n the State, n a manner that does not reveal personally dentfable nformaton (P) about an ndvdual partcpant. X. n carryng out the requrements of Sec. 122 of WOA, State and WC polces, no personally dentfable nformaton regardng a program partcpant, ncludng a Socal Securty number, student dentfcaton number, or other dentfer, may be dsclosed wthout the pror wrtten consent of the program partcpant n complance wth secton 444 of the General Educaton Provsons Act (20 U.S.C. 1232g). X. n carryng out tranng actvtes authorzed under ths polcy, WC encourages ts subrecpents to use ther best efforts to stop any actvty or transacton wth a provder of tranng servces when any alleged napproprate practce or actvty occurs. WC must be nformed mmedately of any ssue and wll research/ determne f any course of actons s needed by the sub-recpent or the provder of tranng servces.
