Transportation charges on a shipment diverted to a new destination city, while vehicle is en route to or upon arriving at original destination city, will be assessed at (1) the thru rate from point of origin to point of final destination via the actual point of diversion, or (2) the thru rate from point of origin to point of final destination via the original destination point, whichever is less. (See Note) E. On shipments diverted to a new destination city under provisions of paragraph (D) of this rule, an additional charge of $1.50 per cwt. will apply, based on weight at which transportation is based. If the new destination city is within 10 miles of the original destination city, no diversion charge will apply. 265 (Conluded) NOTE: On shipments diverted to a warehouse for storage at a city other than original destination city, the warehouse will be considered the destination point, and transportation charges to the warehouse will be assessed under the provisions of paragraph (D) of this rule, plus the additional charge provided in paragraph (E) of this rule. ESTIMATES, BINDING: 270 When a shipper specifically requests a binding estimate for transportation and other services pertaining to a shipment and the carrier offers this service to all shippers who request it, the shipment will be weighed and total charges will be based on the binding estimate or on the actual weight and on actual service performed, whichever is lower, as provided below. 1. A cube sheet shall be prepared listing the total contents of the shipper s goods. 2. Weight should be established by multiplying the total cubic feet of the shipment from the cube sheet, times the accepted constructive weight of 7 pounds per cubic foot. 3. Rate shall be established by using the constructive weight, established by Paragraph No. 2 above, and the applicable rate section of this tariff. 4. A binding estimate shall be offered in writing and signed by representatives of both shipper and carrier. All additional or accessorial service charges which are applicable shall be included. 5. Except as otherwise provided in this paragraph, any binding estimate may be revised by mutual agreement between shipper and carrier, at any time on or before the day shipment is loaded, and the revised estimate will be binding 30 days after the revised estimate is made. If any binding estimate includes any rates or charges to which the provisions of an authorized Periodic Rate Adjustment tariff item is applicable, then the estimate shall: (A) Separately disclose and identify the base line-haul transportation charges, the rate adjustment percentage that is currently applicable to those charges, the charge resulting from multiplying the base line-haul transportation charges by the applicable rate adjustment percentage, and the sum of these charges, to be applied to this shipment and (Concluded on following page)

Missouri Movers Association Original Page 28-A RULES AND REGULATIONS SUBJECT ESTIMATES, BINDING (Concluded) 270 (Conluded) (B) Include or be accompanied by the following statement in not less than 10-point type: This estimate includes one or more charges for line-haul transportation service that are subject to semi-monthly rate adjustments (fuel surcharges) authorized by law to reflect increases and decreases in the cost of motor fuel. These periodic rate adjustments may increase or decrease the total amount charged for the line-haul transportation of the shipment described in this estimate. Upon request, the carrier must provide the shipper with copies of: (1) the applicable Periodic Rate Adjustment tariff item contained within the carrier s current tariff schedule, and (2) the MoDOT Fuel Surcharge Table currently in effect. 6. Estimated total charges apply only for quantities and services set forth on the estimate. 7. Any binding estimate issued shall be binding upon the carrier for a period of time not to exceed 60 days. 8. This item will not apply to shipments loaded from a warehouse. 9. Shipment valuation will be based on the actual weight of the shipment. 10. Each shipment will be weighed and confirmed by certified weight tickets. This space intentionally left blank

Missouri Movers Association Original Page 67-A SECTION 4 ADDITIONAL SERVICES Periodic Rate Adjustment Motor Fuel Cost (Surcharge) The following percentage Fuel-Related Cost Price Adjustment (Surcharge) will apply on line-haul transportation charges and transportation charges on shipments picked up and delivered into storage-in-transit, as described below: Applicable only via participating carriers on Page 9-making reference to this item 1700 1. Except as otherwise specifically provided in this section, the rate adjustment authorized by this order shall be recalculated semi-monthly, after 5:00 P.M. on the first and third Monday in each calendar month. (A) After 5:00 P.M. on the first Monday in each calendar month, the applicable Cost of Fuel shown in the MoDOT Fuel Surcharge Table shall be determined by reference to the data published in the Weekly Retail On-Highway Diesel Prices Average All Types (Dollars per gallon, including all taxes) for the Midwest District, as of the date of the first Monday of the same calendar month, as published by the Energy Information Administration (EIA) on its Internet web site. The URL web address for that information on EIA s web site is currently as follows: http://tonto.eia.doe.gov/oog/info/wohdp/diesel.asp. After determining the applicable Cost of Fuel, and finding the row within the MoDOT Fuel Surcharge Table which correctly identifies the applicable Cost of Fuel in the first and second columns of that row, the Rate Adjustment percentage shown in the third column of the same row shall be applicable to the carrier s unadjusted rates and charges for every intrastate shipment loaded on a motor vehicle after 12:01 A.M. on the first Tuesday after the first Monday in the same month, until the next succeeding Rate Adjustment percentage becomes applicable as provided in this section. (B) Likewise, after 5:00 P.M. on the third Monday in each calendar month, the applicable Cost of Fuel shown in the MoDOT Fuel Surcharge Table shall be determined by reference to the data published in EIA s Weekly Retail On-Highway Diesel Prices Average All Types (Dollars per gallon, including all taxes) for the Midwest District, as of the date of the third Monday of the same calendar month. After determining the applicable Cost of Fuel, and finding the row within the MoDOT Fuel Surcharge Table which correctly identifies the applicable Cost of Fuel in the first and second columns of that row, the Rate Adjustment percentage shown in the third column of the same row shall be applicable to the carrier s unadjusted rates and charges for every intrastate shipment loaded on a motor vehicle after 12:01 A.M. on the third Tuesday after the first Monday in the same month, until the next succeeding Rate Adjustment percentage becomes applicable as provided in this section. (C) If EIA s Internet publication of the latest Weekly Retail On-Highway Diesel Prices Average All Types (Dollars per gallon, including all taxes) for the Midwest District for any week that contains the first or third Monday in any calendar month is delayed until any later date, then common carriers shall continue to apply the Rate Adjustment percentage resulting from the preceding semi-monthly Cost of Fuel determination. Whenever EIA next publishes the updated weekly data for the most recent first or third Monday in a calendar month, the periodic rate adjustment (PRA) shall be promptly recalculated in light of the newly published data, and the next applicable Rate Adjustment percentage shall become effective at 12:01 A.M. on the next calendar day after the date when EIA publishes the relevant data. 1. For example, if EIA does not publish the weekly data for Monday, September 1, 2008, on that date because that is the Labor Day holiday but defers publication of that data until Tuesday, September 2, 2008, then the PRA shall be recalculated so that the next Rate Adjustment percentage becomes applicable at 12:01 A.M. on the next following date, i.e., on Wednesday, September 3, 2008. Missouri Movers Association Original Page 67-B SECTION 4 ADDITIONAL SERVICES Periodic Rate Adjustment Motor Fuel Cost (Surcharge) (Continued) 2 However, if the EIA s failure to publish the necessary updated data continues until any later Monday which is either the first or third Monday in a calendar month, then common carriers shall recalculate the applicable PRA with reference to the most recent weekly data available, which has been published for a Monday which is either the first or third Monday of a calendar month. 1700 (Continued) 2. Whenever this authorized PRA is in force and effective with reference to a common carrier, the carrier shall multiply the Rate Adjustment percentage which is applicable as provided above in section (1), times the (unadjusted) distance commodity rates that apply to the shipment, as provided in the other applicable provisions in carrier s tariff schedule, which are in force on the date when the shipment is loaded on the motor vehicle. If applicable, the carrier shall multiply the applicable Rate Adjustment percentage to Pick-up and Delivery Rates currently stated in Section 5 as exceptions to Item 375 within the Missouri Movers Association Tariff No. 2 (MoDOT No. 1). However, this PRA shall not apply with reference to any hourly rate, or any other exception rate that is not a distance commodity rate, which is properly applicable to a shipment in accordance with the relevant provisions in the carrier s tariff schedule. 3. In every binding or non-binding cost estimate, and every freight bill, invoice, or other document issued by a common carrier that estimates, charges, or demands payment for transportation to which this authorized PRA is applicable, the common carrier shall separately disclose and identify the unadjusted charges for the carrier s line haul of the shipment at the applicable distance commodity rate (or pick-up and delivery rate, if applicable), the Rate Adjustment percentage determined in accordance with this order, the additional charge resulting from the multiplication of that Rate Adjustment percentage times that unadjusted line-haul transportation rate, and the total amount of the above charges, which are applicable to the particular shipment. Note Dispose of fractions by dropping fractions of less than one-half cent, and increasing to the next whole cent those fractions of one-half cent or greater. (Continued on following page)
