Terms of Reference For Preparation of "Initial Environmental Examination (IEE) Study for Mini Hydro Projects 1. Introduction Alternative Energy Promotion Centre (AEPC) is the apex government body under the Ministry of Population and Environment established for promotion of Renewable Energy Technologies. Under AEPC, UNDP GEF RERL, is a program that has been under implementation, from 1 st July, 2014 upon the successful completion of Rural Energy Development Program (REDP) and Renewable Energy for Rural Livelihood (RERL). The objective of the program is to remove barriers to increased utilization of renewable energy resources in rural Nepal in order to support technical, economic, environmental and social development of people in the rural areas and to reduce GHG emissions. RERL has been providing technical assistance to mini hydro power promotion activities. In this regards RERL intends to conduct Environment Assessment/IEE in line with the ADB Environmental and Safeguard Policy to facilitate implementation of some mini hydro project 2. Objectives The main objective of this study is to carry out Initial Environmental Examination (IEE)/ Environment Assessment study as per Asian Development Bank, Nepal (ADB) Environmental Safeguard Policy assessment requirements of the following two mini hydro projects. 1. Giri Khola Mini Hydro Project Haku VDC, Jumla District 2. Phawa Khola Mini Hydro Project Sikaicha VDC, Taplejung District This study will facilitate the implementation of these two mini hydro projects. More specifically, the consulting firm should perform following task Study of relevant potential impacts and risks associated with the proposed project Study of compliance of the proposed project against applicable ADB requirements and environmental laws and regulations of the jurisdictions in which the project operates Study to incorporate impact avoidance and mitigation measures early into the project design process so that they can be easily accommodated 3. Scope of Work (Activities) a) Environment Assessment of the previous project literature review and interaction with AEPC for a good understanding of the assignment. b) The Consultant has to prepare the Environment Assessment/Initial Environment Examination study in accordance with ADB's Safeguard policy Statement (SPS, 2009). c) Provide an environmental and social baseline description of the Project; d) Identify and describe the Project s potential environmental and social impacts; e) Design mitigation measures to minimize adverse impacts; f) Describe the Project s public consultation process and Grievance Redress Mechanism. g) Provide Environmental Management and Monitoring Plans for the overall Project (including defining institutional responsibilities, capacity building and training, and the required budget). 1

Inputs from AEPC/NRREP/RERL a) AEPC/ RERL provides relevant documents /materials and information. b) Environmental Assessment and Review Framework for mini & Solar mini grid projects under AEPC/SASEC. 5. Human Resources Requirement 5.1 Team leader and Environmental Specialist: (One) Environmental Specialist shall preferably have a Master's degree in environmental science/environment management/environmental engineering with minimum of 5 years experience in EIA, IEE study and report preparation. 5.2 Civil/Electrical Engineer: (One) At least Bachelor Degree in Civil/electrical engineering with at least 5 years of professional experience in the field of hydropower. Experience as a team member in preparation of EIA and IEE will be an added advantage. 6. Qualification of Firm a) Must be working in the field related to EIA, IEE preparation for at least 2 years. b) Demonstrated Experience in preparation of EIA and IEE reports, preferably in hydropower. 7. Terms of Payment The payments shall be done as shown below (i) 30% of the contract amount Immediately after contract signing (ii) 50% after submission of draft report Approval from concerned Authority (iii) 20% after submission of final report Approval from concerned Authority 8. Deliverables The consultant will submit the following to RERL in the timeline stipulated below: IEE Draft report : Within 1.5 months after signing the contract IEE Final report : Within 2 month after signing the contract. 9. Time The duration of this task shall be 2 months from the date of signing the contract agreement with AEPC/RERL. 10. Selection/Evaluation Process The detailed technical and financial evaluation criteria are attached in Annex. 11. Duties and Taxes The consultant shall pay all tariffs, duties, other taxes or charges levied by the GoN at any stage during the execution of the work. 12. Acceptance of Proposal All rights are reserved with AEPC/RERL either to approve or disapprove any proposal without giving any reasons whatsoever. If needed, the consultant will be asked for modifications and presentations of the proposal before approval. 14. Force Majeure Without prejudice to their rights the Government and the service provider shall not be held responsible nor suffer any financial loss should the performance of the contract be delayed or prevented by an event of Force Majeure, which shall include, but not limited to strikes, riots, civil commotion, fire accident or any other incident beyond the control of either party hereto which neither party was aware of or could have foreseen at the time of signing of this contract.
