TUP00049 106A TRANQUILLE ROAD OWNER: GATEWOOD ENTERPRISE LTD. APPLICANT: 1536369 ALBERTA LTD. March 25, 2015 PURPOSE To issue a Temporary Commercial or Industrial Use Permit to allow the sale of motorcycles, scooters, children's personal recreation vehicles, and accessories on the subject property for a period of three years. SUMMARY The subject property is situated on the north side of Tranquille Road at the corner of Larkspur Street. The property is 1,715.1 m 2 in area and is split-zoned. The northern portion of the property is zoned C-4 (Service Commercial) and the southern portion is zoned C-1T (Tranquille Road Commercial). The applicant wishes to operate a business that sells personal motorized vehicles such as motorcycles, electric scooters, children's all-terrain vehicles, and accessories in the southern, C-1T zoned portion of the property. While motorcycle sales and recreation vehicles sales are permitted in the C-4 zone, they are not permitted in the C-1T zone. As the business is intended to be temporary in nature, the applicant has applied for a temporary use permit to allow the business to operate for a three-year period. The entire subject property was zoned C-4 until the southern portion, which fronts Tranquille Road, was rezoned to C-1T in 2009 as part of a series of zoning amendments to implement the policies of the 2008 North Shore Neighbourhood Plan (NSNP). Specifically, the C-1T zoning reflected the NSNP's recommendation that "the City will support pedestrian-oriented uses directly abutting Tranquille Road, such as mixed-use commercial and multiple family developments, cultural and institutional facilities, and office and retail services within the Tranquille South Area." In light of the NSNP's vision of fostering pedestrian-oriented development in the area, staff are reluctant to permanently allow auto-oriented uses through a rezoning application; however, staff recognize the transition to a pedestrian-oriented environment is a long-term process and supporting business development in the area is part of that process. The applicant's intent is to use the location as a starting point to establish business and clientele, after which a more permanent location would be obtained; therefore, the proposed use will be temporary. The proposed use is compatible with the other automobile sales and service businesses in the area; however, the business will not further the auto-oriented nature of the area since it resembles a typical retail operation, occurring primarily within the existing building with limited outdoor display. TUP00049 March 25, 2015 Page 2 As no technical concerns were raised during the review process, staff support the application and advise Council to proceed as outlined in the recommendation. RECOMMENDATION: That Council authorize distribution of Notice of Intent to issue a Temporary Commercial and Industrial Use Permit for Lot A, Plan 24341, D.L. D, K.D.Y.D. (106A Tranquille Road), to allow the sale of motorcycles, scooters, children's all-terrain vehicles, and accessories for a period of three years. COUNCIL POLICY The NSNP designates the area in which the subject property is located as "Tranquille South". The NSNP's Policy Statements in Section 4.2 Tranquille South, state: "2. The City will support the Tranquille South area as an entry to the Tranquille Commercial District and will support development standards that reflect this important role." "4. The City will support pedestrian-oriented uses directly abutting Tranquille Road, such as mixed-use commercial and multiple family developments, cultural and institutional facilities, and office and retail services within the Tranquille South Area." KAMPLAN, the Official Community Plan, Section 5.0 Temporary Use Permits, states that: "City Council, in any area of the City, may issue a Temporary Use Permit for a three-year period, renewable once only, provided that the temporary use: is not noxious or undesirable because of smoke, noise, vibration, dirt, glare, odour, radiation, electrical interference, or an offensive trade within the meaning of the Health Act, as amended from time to time; does not have a negative impact on adjacent lands; does not create a significant increase in the level or demand for services; does not permanently alter the site upon which it is located; is compatible with the property's land use designation; and complies with all the conditions specified by Council in the Temporary Use Permit."
