1. INTRODUCTION : Software Technology Parks of India (STPI) was established and registered as an Autonomous Society on 6 th June 1991 under the Societies Registration Act 1860, under the Department of Information Technology, Ministry of Communications and Information Technology, Government of India. It undertook the responsibility of managing data communication infrastructure facilities and providing other services like technology assessment and professional training to software exporters. High Speed Data Communication Services One of STPI s remarkable contributions to the software-exporting sector is providing of High-Speed Data Communication (HSDC) services. SoftNET, state-of-the-art HSDC network, designed and developed by STPI is available to software exporters at internationally competitive prices. From its inception to 2006-07, STPI boasts of setting up its own International Gateways at 49 locations for providing HSDC links to the software industry. Local access to International Gateways at STPI centres is provided through Point-to- Point & Point-to-Multipoint microwave radios for the local loop which has overcome the last mile problem and enabled STPI to maintain an up time of nearly 99.9%. The terrestrial cables (fibre/copper) are also used wherever feasible. These communication facilities mark the success in the development of offshore software activities. STPI is having working relations with major international telecommunication operators, namely AT&T, MCI, Sprint, Intelsat, New Skies Satellite & British Telecom etc. STPI provides the following HSDC services through this network: International Private Leased Circuits (IPLCs) in the bandwidth of 64 KBPS to 8 MBPS(Soft POINT) Shared Internet Services Web Hosting Services Other value added services 5
STPI CHENNAI In June 1995, STPI opened a small field office in Chennai to co-ordinate the statutory services to 100% EoUs under STP scheme for software exports. From 1995 to 2007, the number of software exporting companies have grown from 23 units to 993 units and in addition is supporting 191 units, who are not 100% EoUs under STPI. The software exports grew from Rs.12.17 crores in 2006-2007 to Rs. 20745 Crores from Tamil Nadu in 2006-07. Extensive promotional seminars have been undertaken in potential places like Chennai, Coimbatore, Madurai, Trichy, Pondicherry etc., with an objective to disperse the IT activity across its jurisdiction of operation. The main services rendered by STPI-Chennai for the software exporting community have been statutory services and data communication services (SoftNet). STPI- Chennai has also played a catalytic role in the promotion of software exports, with a special focus on SMEs and start up units. STPI-Chennai has also been providing datacom services since 1999. 2. MODE OF SUBMISSION : a) Tenders should be addressed to the DIRECTOR by Designation only. Tender shall be placed in sealed envelope. b) Tenders can be submitted in person on or before the due date and time specified in the Tender Notice. Such tenders shall be dropped in the tender box only, kept at Software Technology Parks of India Chennai, No: 05, Rajiv Gandhi Salai, Taramani, Chennai- 600 113 and will not be received personally. c) Alternatively, the tenderer, who prefers to submit the tender through post can dispatch them through registered post so as to reach the above address on or before the due date and time specified in the Tender Notice. Tenders received after the due date and time will not be considered and STPI will not be liable or responsible for any postal delays. 3. DUE DATE AND TIME: The sealed tenders should reach Software Technology Parks of India Chennai, No:05, Rajiv Gandhi Salai, Taramani, Chennai- 600 113 and dropped in Tender Box not later than 02.30 PM on 13.01.2009. The tenders will be opened on 13.01.2009 at 3.00 p.m. The tenders received after due date and time or unsealed or incomplete or received by facsimile (Fax) or by electronic mail will be summarily rejected. 4. Documents Establishing Tenderer s Qualification The documentary evidence of Tenderer s qualification to perform the Contract if its tender is accepted, shall establish to the STPI - Chennai, satisfaction: (a) The tenderer s firm should not be a blacklisted firm. 6
(b) All tenders submitted shall also include the following information: (i) Copies of original documents defining the constitution or legal status, place of registration, principal place of business, Income tax and Trade tax registration numbers of the tenderer. (ii) The tenderer should furnish a brief write-up, backed with adequate data, explaining his available capacity and experience (both technical and commercial) for the supply of the required systems and equipment within the specified time of completion after meeting all their current commitments. (iii) Reports on financial standing of the tenderer such as profit and loss statement, balance sheets and auditor s report for the past 3 years, bankers certificate etceteras. (iv) Details of experience and past performance of the tenderer on equipment offered and on those of similar nature within the past three years 5. DETAILS TO BE FURNISHED AND MODE OF PRESENTATION: a) The rate should be indicated clearly both in words and figures. The tenderer with full signature should attest any scoring or overwriting. The rate quoted should be firm and should not be subjected to any variation clauses. b) Company Profile in the form of leaflets and brochure should necessarily accompany the offer. c) Prices shall be quoted in Indian rupees only 6. OPENING OF TENDER AND EVALUATION THERE OF: The tenders received up to 02.30 p.m on 13.01.2009 will be opened on 13.01.2009 at 3.00 p.m by the DIRECTOR, STPI or any other officer authorized by him/ her on her behalf at STPI, No:05, Rajiv Gandhi Salai, Taramani, Chennai- 600 113 in the presence of such of those Tenderers or their representatives who may be present at the time of opening. Representatives who are attending the opening of the tenders should bring a letter of authority from the tendering firms, which they represent to identify their bonafides. 7. TENDER EVALUATION CRITERIA: All evaluation will be carried out by STPI - Chennai as detailed below. STPI - Chennai will prepare a list of firms based on the compliance and all the terms and conditions of the tender. The tenders, which do not conform to the tender conditions and tenders from firms without adequate capabilities for the preparation of report as per tender requirements shall be straight away rejected, specifying the reason. All eligible tenders will be considered for further evaluation. The decision of STPI Chennai shall be final in this regard. 9. ACCEPTANCE OF TENDER AND WITHDRAWALS: 7
i) The right of final acceptance of the tender is entirely vested with the DIRECTOR - STPI who reserves the right to accept or reject, any of the tenders in full or in parts without assigning any reason whatsoever. After acceptance of the tender by STPI, the tenderer shall have no right to withdraw his tender, or claim higher price. The tender acceptance authority may also reject all the tenders for reasons such as change in scope of work, new technologies, and lack of anticipated financial resources, court orders, accidents or calamities and other unforeseen circumstances. ii) Tenders with incomplete information are liable for rejection. 10. Amendment of Tender Documents At any time prior to the last date for submission of tenders, STPI Chennai may, for any reason, modify the tender document. Such modification will be published through our web-site. 11. Language of Tender The tender prepared by the tenderer, as well as all correspondence and documents relating to the tender exchanged between tenderer and STPI Chennai, shall be written in English Language. Only English number shall be used in the tender. 12. PRICE SCHEDULE: Sl. Particulars No. 1. PAYMENT TERMS: The payment will be made on quarterly basis on submission of the services report. Advance payments will be made only against Bank Guarantee 14. AGREEMENT / LIQUIDATED DAMAGES FOR NON-FULFILLMENT OF CONTRACT OBLIGATION: The Successful tenderer will have to enter into an agreement, for the specific work. Penalty will be levied at the rate of 2% per calendar week on the total value of contract subject to a maximum of 5%, for delay in services. 15. GENERAL: 8
The tenderers while sending their tender should enclose original Tender Documents in the respective envelopes with the conditions stipulated duly certified and attested by them as a token of accepting the tender conditions that they understood and accepted them fully. The tenders received without the original Tender Documents shall be rejected summarily. 16. OTHER TERMS AND CONDITIONS: The final decision would be based on the technical capacity and pricing. STPI do not bind itself in selecting the firm offering lowest prices. The Bids should be submitted neatly and all corrections, over-typing should be attested with seal. The offer submitted by the tenderers shall be valid for a minimum period of 90 days from the date of submission of Tender. The offer shall be submitted by registered post with acknowledge due or shall be dropped in tender box. 17. SERVICE NORMS: On call Response: For 24*7 support MONDAY-SUNDAY-2 Hours for Metros and 4 hours + Travel time to the site from the nearest vendors office (non-metros) Resolution: The resolution will be on best effort basis for those EOSL products. For the Cisco 3662 the resolution shall be Next Business Day (Metros) and shipment travel Time between the Nearest office of the vendors Necessary Standby shall be provided incase of emergency. Telephonic assistance: Vendor shall provide unlimited telephonic e-mail and web-based support through the 24/7 Global Support Centre. The Support Center shall simulate problems and provide online assistance to STPI. On call support: Well trained and certified engineer shall visit the specified office of SOFTWARE TECHNOLOGY PARKS OF INDIA to resolve the problem reported. The typical activities covered under onsite maintenance shall be problem diagnosis, resolution by restore/repair/replacement, user assistance, installation of updates, patches provided by the vendor on the system apart from the knowledge base for technical information relevant to the STPI products. Part repair and replacement: If a part is identified as the cause for the malfunction, the same when repairable shall be attempted by the vendors. If a part is to be replaced immediately, it shall be attempted by the vendors. If a part is to be replaced immediately, it shall be done with a functionally equivalent part of the vendors. However in the long run vendors shall provide the same make and configuration free of cost by the vendors. 9
18. ARBITRATION: All disputes regarding the order shall be referred to Director General, STPI or his nominee for arbitration who shall have all the powers conferred by the Indian Arbitration and conciliation Act1996 or any statutory modification thereof in force. 19. JURISDICTION This order shall be governed by the Laws of Indian Union in force. Only the competent courts in Chennai shall have the jurisdiction as provided under the Indian Arbitration and conciliation bill 1996 or any statutory modifications thereof in force or any matter arising out of any arbitration proceedings under contract. 20.
