(1 ) ARCHITECTURAL REVIEW COMMITTEE TRAILS WEST HOMEOWNERS ASSOCIATION THIS BOOKLET has been compiled as a guide for both the members of the Architectural Review Committee (ARC) and the Trails West homeowners. It is hoped that this information will increase the awareness of ways in which the integrity, ambiance and property values of Trails West are preserved. COVENANTS AND RESTRICTIONS: Article III of the Covenants and Restrictions (C & R's) defines the Architectural Control Committee (now referred to as the Architectural Review Committee or ARC) and its duties. Every Trails West home owner should have received a copy of the Declaration of the Covenants and Restrictions at time of purchase. Also the Trails West Welcome Committee makes every effort to see that a Welcome Packet containing the C & rrs and other important information is delivered to each new home owner. Since these covenants are recorded in the county public records to run with the land, they are binding on all home owners and should be fully understood. WHAT MUST HAVE ARC APPROVAL? Any change to the exterior appearance of one's property must be approved. Again;, the specifics are outlined in Article III of the C & rrs covering new buildings and structures as well as alterations and even changes in color. (The term "structure" is defined in Article I of the C & R's.)
ARC RESPONSIBILITY: The ARC approves or denies approval based on aesthetic factors only and does not assure authority or responsibility for the acceptability or soundness of construction or installation of any item based on construction practices or codes. The owner is solely responsible for obtaining all permits and observing all building codes. APPLICATION PROCESS: 1. The home owner must contact the Association Manager (738-9470) to obtain the appropriate application forms which are submitted with the supporting documents and information to the ARC. 2. The ARC has scheduled meetings for the first and third Thursdays of every month. The completed application must be submitted to management no later than 4:00 p.m. on the Monday for the Thursday meeting. If there is nothing on the agenda by Monday at 4:00 p.m.. the Thursday meeting will be cancelled. 3. The ARC meets and either approves or denies the request. (The home owner is welcome to attend the meetlng.) If pertinent information is lacking. the ARC may either deny the request until such information is received or may give conditional approval subject to specified instructions. (2)
4. The ARC will return one copy of the application with its approval or denial indicated thereon within 30 days of receipt of the application and all required supporting information. 5. Any appeal should be directed to the Homeowners Association. The following guidelines have been established by the Board of Directors of The Trails West Homeowner's Association to assist the property owners of Trails West in planning and deciding the nature and extent of buildings and structures to be constructed on Trails West properties. These guidelines are recommendations only and the ultimate decision concerning the building of any structure in Trails West rests with the Architectural Review Committee and Board of Directors of Trails West Homeowner's Association as set forth in the Covenants and Restrictions and By-laws of Trails West Homeowner's Association, Inc. 1. Each homeowner should carefully review the Covenants and Restrictions of Trails West Homeowner's Association, Inc. as such Covenants and Restrictions are the ultimate authority concerning buildings and structures built in the Trails West subdivision. 2. Each homeowner should consider the following concerning any proposed building or structure: - set-back restrictions (3 )
- location and impact on neighbors - scale/size in relation to adjacent structures - color and materials to be used - Iandscaping 3. The following guidelines should be considered by the property owner in formulating plans before submitting the item to the ARC for approval: a. Air Conditjoning Units. Water Softeners and Other EQuipment: - Must be screened or otherwise located out of sight. Landscape screening is acceptable but must cover equipment at time of planting. or b. DogHouses: - Must be same material and color of home - Must be located within dog pen behind home c. Dog Pens: - Must be constructed of wooden fencing or dark vinylcoated chainlink fence with appropriate landscaping - Can be no larger than twelve feet by eighteen feet (l2'x18') - Must be located in rear of home not seen from street (4 )

Driveways, parking areas and Walkways: - Should be concrete or asphalt - Mulch driveway must have concrete apron at the street abutting asphalt - Accessory areas may be mulched - painting is not allowed e, Fences: - Must be constructed of wooden fencing with finished side facing the street and neighbor's property or _dark vinyl-coated chainlink fence with appropriate landscaping to hide the fencing, (Neighbors should be consulted before constructing chain link fencing) - painted or stained to blend with residence and landscape - Must be located behind the front elevation of the house (front of house must be completely visible) - Height should not be higher than necessary for intended use, Height should conform with other fencing but no higher than six feet (6') - Split rail fencing is allowed - Gates should match fence. - Extended lengths of fencing should be broken up in design with appropriate landscaping
f. Grills. Barbecue Pits and Accessories: - Should not be a dominant feature of the landscape - Must be located in rear of the yard Must be consistent with neighborhood and landscape Should. use supplemental planting to screen items g. Houses: - Must consist of wood. brick. stone or approved stucco finishes or Vinyl siding. - May be one or two story only. - Paint or stain colors should complement surrounding structures and landscape - Roofs should be shingles. wood shake or tile. Gravel roofs are not permitted. - Windows should complement trim. There should be sufficient windows or landscaping in the home to break up single plane walls. Garage doors should complement the trim or house color and be paneled if facing the street. Screens are not approved. - Gutters and downspouts should match trim. ( 6)
h. Lawn ornaments, statues, benches and tables - Should not be a dominant feature of landscaping - Design, color. and materials should be consistent with surrounding structures and landscape - Generally, one table and four chairs or two benches are permitted. i. Mailboxes - Must meet state and federal laws Must be consistent with surrounding homes and landscapes, j. Patios and Decks - Generally located in back yards - Must be made of brick, stone, concrete or wood. Material and color should be consistent with house. k. Pools and Spas: - Allowed only in est ate section - May not be offensive to adjoining homes - Located in such a manner that they do not cause a disturbance - Pool areas should have some type of screening and appropriate fencing (7)

Satellite Dishes and antennas - Only satellite dishes no larger than 20 inches in diameter are permitted if positioned on the homeowner's property in such a location as it cannot be seen from the street - Antennas are not permitted on the exterior of any home m. Screened Enclosures: - Screened enclosures should match or complement trim color - Screen is to be a dark material n. Shutters - Consistent with home Must be proportional to windows -Must be consistent with neighborhood and landscape o. Signs and flags -Generally signs are not permitted. - Approved "For Sale" signs are available at a minimal cost. See management. - National, State, or decorative flags should be of, such size and displayed in such a manner as to be consistent with (8)

ADDENDUM #1 The following guidelines apply to the VILLAS OF LAKE MAMIE and are in addition to the over-all Trails West Guidelines: 1) The exterior materials and colors of the walls, trim, and roofs of each unit a building shall be identical. 2) Swimming pools, basketball goals and skateboard ramps are not permitted in the Villas of Lake Mamie. 3) External changes must be approved by the Lake Mamie Board of Directors as well as the Trails West ARC. ADDENDUM #2 The following guidelines apply to the Oakwood and Oakwood Cove units and are in addition to the over-all Trails West Guidelines: 1) Mulch driveways and/or parking aprons are not permitted. 2) Chain link and / or split rail fences are not permitted. 3) Aluminum roofs are not permitted. 4) permanently installed basketball hoops are not permitted. 5) The following items, if approved by the Oakwood Board of Directors and the Trails West ARC, must not be visible from any street: a) Out-door barbecue equipment b) Dog runs and dog houses 6) External changes must be approved by the Oakwood Board of Directors as well as the Trails West ARC. ADDENDUM #3 The following gutdelines apply. to Pine Bluff and are in addition to the over-all Trails West Guidelines: 1) Roof material: Only shingles are permitted; no wood shake, tile or tar and gravel. Exception: Building codes do not permit shingles on the flat patio roofs. Rolled roofing must be used (no gravel). The color must match existing roof. 2) Metal awnings may be allowed in Pine Bluff if individually approved by the Pine Bluff Board of Directors. 3) All units within a mulr-unlr buildings are to be painted the same color, including windows, doors, garage doors and porches. 11 is preferred that all units within a multi-unit building be painted at the same time. 4) A paint color chart, showing colors approved by the Pine Bluff Board of Directors is available. 5) No external changes are to be permitted to any unit without express approval of the Pine Bluff HOA Board of Directors and the Trails West ARC.
