ADOPTION OF THE PROVISIONAL AGDA The Committee adopted the provisional agenda as set out in doc. CM 4695/10. Following the invitation by the Chair, the associated countries remained present for the entire agenda. 2. APPROVAL OF THE DRAFT SUMMARY CONCLUSIONS OF THE 1ST MEETING The Committee approved the summary conclusions of the first meeting held in Santiago de Compostela, on 9 and 10 June 2010, set out in doc. 3. STANDING INFORMATION POINTS 3.1. Information from the Presidency The Presidency presented the outcome of the informal Competitiveness Council of 15 July 2010 and presented the agenda for the research part of the Competitiveness Council on 12 October 2010. The Presidency in particular explained the timetable for the adoption of Council conclusions based on the Communication on the Europe 2020 flagship initiative "Innovation Union", adopted by the Commission on 6 October, with a view to providing an input to the European Council meeting on 10 December 2010 which will be dedicated to the research and innovation issues. 3.2. Information from the Commission The Commission explained that for administrative reasons it had not been in a position to nominate representatives and alternates to ERAC but announced it would do so shortly. As regards the implementation of FP7, the Commission informed the Committee that calls for proposals had been launched on 20 July 2010. In relation to the interim evaluation, the Commission provided an update of the work in the panel which is to finalise its report by end October. The Commission's response to this report is expected by the end of 2010. With regard to the work in the European Parliament, the Commission informed that the report of Ms. Maria de Graça Carvalho on the simplification of the implementation of FP had been approved by the ITRE Committee with large majority and that is final adoption by the plenary is scheduled for November. The discussion on the draft EU budget continued in the Budget Committee, and according to the Commission it seems that conciliation would be needed to find an agreement with the Council, including on the research budget. ADOPTION OF ERAC RULES OF PROCEDURE In accordance with Point 17 of the Mandate of ERAC (see Annex to the Annex to Council Resolution on Developments in the governance of the European Research Area (ERA) 1, as adopted by the Competitiveness Council at its meeting on 26 May 2010), the Committee adopted its rules of procedure, as set out in document 1206/10. Following the adoption, the Chair expressed his regrets for having proposed changes regarding the power of the Commission to convene an ERAC meeting, which subsequently led to a change in Article 6(2), on a basis of misunderstanding. 5. ELECTION OF VICE-CHAIR AND OF MEMBERS OF THE STEERING BOARD 5.1. Election of Vice-Chair According to Point 10 of the Mandate of ERAC and Article 3 of its Rules of Procedure, the single candidate, Mr. Bjarne Kirsebom (SE) was elected as the Vice-Chair of the Committee for a period of two years. 5.2. Election of Members of the Steering Board According to Point 12 of the Mandate of ERAC and Article 4 of its Rules of Procedure, the single candidate, Ms. Jane Peters (UK), was elected as the elected member of the ERAC's Steering Board (SB). The term of 18 months will start counting on 1 January 2011. 1 10255/10 ERAC 1207/10 MF/nj 3

The Spanish delegation, which takes part in the SB as the former Presidency of the EU Council, expressed its willingness to continue participating in the work of the SB after 31 December 2010; therefore it announced the intention to put forward a candidate for the second elected SB member at one of the future ERAC meetings. The Chair welcomed this intention; a possibility to launch a second round of election of members to the SB will be explored. 6. FUTURE ORITATIONS OF UNION SUPPORT TO THE RESEARCH AND INNOVATION POLICY The Committee provided an initial input to the Commission as regards the preparation of a Communication on the basis of which a broad consultation of stakeholders will be organised at the beginning of 2011 with a view to preparing proposals for the next Framework Programmes by end 2011. Focusing on the type of questions the Communication should address as regards the headline objectives of the FP, its scope and focus as well as its structure and the type of instruments to be used, the Committee underlined in particular the following: How to attract more private sector investment into financing of projects? How to increase the participation of SMEs? How to ensure a better link between research and innovation in facing grand challenges? Should there be a separate programme for innovation? What should be the balance between the science-based research and research to face the grand societal challenges? How would it be possible to integrate joint programming (JP) in FP (and to ensure equal access to JP to all MS)? How to ensure mutual reinforcement and/or provide better coordination of national and EU programmes? How to better link FP and Structural funds? What structure of FP would cater for better integration of the ERA? Should there be other programmes to advance the ERA? ERAC 1207/10 MF/nj 4

How to reduce the complexity of the system? Possibility to streamline the rules for participation for all instruments? How to strengthen international cooperation (with other research areas)? Should FP better foster R&D in developing countries? How to improve the participation of new Member States (by taking into account also future EU enlargement) or countries that have been hit by the financial crisis? How to attract and ensure better involvement of young researchers (not only from the EU)? How to ensure better involvement of universities? How to combine traditional and e-science approach? How forward looking a FP we should have? What role and support should be given to services? Balance between curiosity and result driven approach? What amount/kind of risk could/should be taken)? How could FP contribute to technological competition (within the EU and in relation to other world competitors)? Should smart specialisation be fostered with FP? The Chair thanked the delegations for their input and proposed that ERAC comes back to this issue if delegations have additional input, subject to the decision on the agenda by the SB. The Chair also stressed the importance of ERAC delegations in launching consultations with stakeholders at national level. ERAC 1207/10 MF/nj 5

7. ERAC ad-hoc working groups on Synergies between policies and programmes and Review of ERA-related instruments The Chair of the Working Group on ERA Synergies, Arie van der Zwan (NL), presented the recommendation and possible options to achieve more synergies between the Knowledge triangle and Cohesion policies at various governance levels, based on the replies to questionnaires of 12 Member States. He also informed the Committee about further work of the group, i.e. an input document for the WG on ERA- related instruments concerning the overview of national schemes by type of arrangement, for which delegations were requested to provide an input by 21 October. The Chair of the WG on the review of ERA-related instruments, Mr. Dan Andree (SE), presented the final work plan of the group, set out in doc. 1208/2010, with a view to the adoption of an ERAC report on ERA- related instruments, provisionally in March 2011. The Committee took note of the work plan. Delegations were requested to send possible comments by 21 October. On the basis of the work plan the group will produce a questionnaire the responses to which will serve as the basis for drafting the report. The attention was drawn upon the WG to prepare a more detailed questionnaire. In addition, more emphasis was requested on the topic of streamlining and synchronisation of different instruments. Contributions from the associated countries will also be welcome. 8. ERA initiatives: Information and follow-up The Committee adopted the report of the Knowledge Transfer Working Group entitled "2010 Report on the implementation of the Council Resolution and Commission Recommendation on the management of intellectual property in knowledge transfer activities and code of practice for universities and other public research organisations by Member States and Associated Countries, set out in doc. 1209/10, as presented by the Chair of the Group, Mr. Klaus Uckel (DE). The Committee also took note of the work under way in GPC and SFIC. In relation to the review of the ERA-related groups that shall be initiated before the end of 2010 the Committee invited the Steering Board to consider how to structure a debate on this in view of the next ERAC meeting on 9-10 December 2010. 9. Towards Innovation Union: Common session with the Innovation sub-group of the Enterprise Policy Group (EPG) 9.1. Communication on Innovation Union The Commission presented the main features of its Communication "Europe 2020 Flagship Initiative - Innovation Union", set out in doc. 14035/10. Given the fact that the Communication was adopted only a day before the ERAC meeting, the Committee held only a preliminary exchange of views. Delegations in general welcomed the Communication, in particular its broad based and holistic approach, though they also expressed the need for a rigorous impact assessment before the Commission comes forward with legislative proposals. Without prejudice to the future involvement of ERAC in the implementation of the Innovation Union, the discussion on the Communication will continue in the Competitiveness Council with a view to the European Council on 16 December 2010 dedicated to research and innovation matters. 9.2. National Reform Programmes in the context of the Strategy Europe 2020 The Commission presented the guidance for drafting, implementing and monitoring of National Reform Programmes (NRPs) under the Europe 2020 Strategy, containing the overall context and roadmap for preparing and assessing the NRPs to be adopted by April 2011. The aim was to address the expected content and structure of the R&I component of NRPs and the role of ERAC notably through the organisation of a mutual learning exercise and policy mix peer reviews. The Committee took note of the draft guidance. Some reservations were expressed with regard to the proposed joint ERAC-EPG group for the monitoring. The Committee invited the Steering Board to examine how to bring this topic to future attention of the Committee. 9.3. Innovation Headline indicator(s) The Commission presented the report of the High Level Panel on the Measurement of Innovation, established by the Commissioner Geoghegan-Quinn, and the state of play of the definition and use of headline indicator(s) for innovation complementing the 3% R&D intensity target. The discussion aimed at gathering preliminary feedback in view of the next steps and in particular discussions in the Competitiveness Council on 26 November and the European Council on 10 December. In line with the Communication on the Europe 2020 Flagship "Innovation Union", the Commission explained it would propose to launch the necessary work for the development of a new innovation indicator in the next two years, following a decision of the European Council on the headline innovation indicator, as well as to start already now to monitor overall progress on innovation performance using the Innovation Union scoreboard. 9.4. Purpose and implementation of European Innovation Partnerships (EIPs) The Commission presented the concept and the approach to the implementation of the European Innovation Partnerships, as set out in the Communication on the Europe 2020 Flagship "Innovation Union". The Committee held an exchange of views. According to their preliminary comments, the following issues should be further explained or defined: the governance of EIPs, which should be as simple and light as possible; the role of Steering Board; their relation with other existing instruments with a view to prevent unnecessary overlaps, notably the EIT and its KICs, and JPIs; ERAC 1207/10 MF/nj 8

the role of Member States in defining the areas (and roles) of EIPs; the financing of and access to EIPs; the need for a legal instrument for creating EIPs; The discussion on the EIPs will continue at the Competitiveness Council and the European Council. 10. Any Other Business 10.1. Involvement of the Faeroe Islands as observer to ERAC The Chair informed the Committee of his intention to invite the Faeroe Islands as observers to ERAC, following the agreement on the association to the FP of 3 June 2010 with retroactive effect as of 1 January 2010. A question was raised concerning the participation of different regions of Member States as observers in relation to the efficient work of ERAC. Further national consultations will be undertaken with a view to a decision at the next ERAC meeting on 9-10 December 2010. 10.2. Information about the Helsinki group on women and science The Commission presented the state of play of the Helsinki group on women and science as well as its main activities and achievements. Some delegations drew the attention of the Committee with a view to looking at possibilities how this Group could be further integrated in the work of ERAC. The Vice-Chair will propose this topic to the Steering Board. 10.3. 3 rd ERAC meeting in Eupen on 9-10 December 2010 The Belgian Presidency presented the programme in relation to the ERAC meeting on 9-10 December.
