Article 1. Scope of regulation Chapter I GENERAL PROVISIONS This Circular provides the order and procedmes for plant quarantine and grant of plant quarantine ce1ii:ficates for impo1i, expo1i and transit of aiiicles subject to plant quarantine; and post-impo1i plant quai antine. In case plant quai antine treaties which the Socialist Republic of Vietnam has signed or acceded to contain different provisions, such treaties prevail. Article 2. Subjects of application This Circulai applies to Vietnamese and foreign organizations and individuals engaged in the impo1i, expoli and transit of, or post-impo1i activities involving, aiiicles subject to plant quarantine (below refe1ted to as aiticles) in Vietnam. Article 3. Interpretation of te1ms In this Circulai, the te1ms below shall be constrned as follows: 1. Impo1i covers impo1i, tempora1y impo1i and re-impo1i of lots of aiiicles, border-gate transfer and consignment to bonded wai ehouses. 2. 40 OFFICIAL GAZETTE Issue nos 11-12/October 2014 3. Lot of articles means a certain volume of aiticles with the same conditions and elements with regai d to the possibility of contagion. 4. Plant quarantine agencies include regional plant quarantine sub-departments and border-gate plant quatantine stations. Article 4. General requirements for plant quai antine 1. To conduct inspection in a prompt manner and detect Vietnam's plant quarantine objects and control objects and exotic ha1mful organisms on a1ticles upon impo1t, expo1t and transit or after impo1t. 2. To promptly apply appropriate measmes for handling articles infested with Vietnam's plant quarantine objects or control objects or exotic haimful organisms. Article 5. Charges and fees Alticle owners shall pay chai ges and fees for plant quarantine in accordance with the law on chai ges and fees. Chapter II ORDER AND PROCEDURES FOR PLANT QUARANTINE UPON IMPORT Article 6. Dossier of registration for plant quarantine upon impo1t 1. A written registration for plant quai antine (made according to the fo1m provided in Appendix I to this Circulai-). 2. The plant quarantine ce1tificate issued by a competent plant quarantine agency of the expo1ting countiy or a copy of such ceitificate. In case an aiticle owner submits a copy of the plant quarantine ce1tificate, he/she must submit the original before being granted a plant quai antine ce1tificate for impo1t, transit or domestic transpo1tation of the lot of aiticles. 3. The pe1mit for plant quarantine upon impo1t or a ce1tified copy of such pe1mit (in case a pe1mit is required). Article 7. Order and procedmes for plant quarantine upon impo1t 1. Registi ation for plant quarantine An aiticle owner shall submit a dossier of registration for plant quai antine upon impoit at a plant quarantine agency. 2. Receipt and examination of dossiers The plant quarantine agency shall receive the dossier and examine its validity according to regulations. If the dossier is invalid, the plant quarantine agency shall request the aiticle owner to supplement the dossier. 3. Inspection of aiticles Based on dossier examination results, the plant quai antine agency shall decide on the place of quarantine and assign an officer to inspect the lot of aiticles in the following order: a/ Preliminaiy inspection Vietnam Law and Legal Fornm

lssut> nos 11-12/October 2014 OFFICIAL GAZETTE 41 To inspect the outside of the lot of aiticles, its packaging and caitier; slits, interstices and places where haimful organisms may hide; to collect insects that fly ai ound, creep on or cling onto the lot of aiticles; b/ Detailed inspection To inspect the inside of the lot of articles and take samples according to National Technical Regulation QCVN O 1-141:2013/BNNPTNT on phytosanitaiy sampling methods; to collect articles showing haimful signs or organisms; to analyze and assess collected samples of a1ticles or haimful organisms. 4. Grant of plant quai antine ce1tificates a/ Within 24 hours since the quarantine sta1ts, the plant quai antine agency shall grant a plant quai antine ce1tificate for impoit, transit or domestic transpo1tation, made according to the f01m provided in Appendix II to this Circular, if the lot of aiticles is not infested with Vietnam's plant quarantine objects or control objects or exotic haimful organisms. In case the time limit for grant of a ceitificate must be extended to more than 24 hours due to technical professional requirements or in case of refusal to grant a plant quarantine ce1iificate, the plant quai antine agency shall issue a written notice or reply to the aiiicle owner clearly stating the reason. b/ If detecting that the lot of aiiicles is infested with Vietnam's plant quai antine objects or control objects or exotic haimful organisms, the plant quarantine agency shall apply appropriate plant quarantine measures according to regulations; c/ In case the lot of aiticles is transpo1ied by a seagoing vessel with a cai go hold of a height of 3 meters or higher and must be divided into several layers for inspection, after inspecting each layer, the plant quarantine agency shall, based on inspection results, grant a tempora1y ce1iificate of plant quarantine results for the volume of inspected aiiicles (made according to the f01m provided in Appendix III to this Circular); After being granted the temporaiy celiificate of plant quarantine results, the lot of aliicles may be transported to a warehouse and may be used for production or trading only after it is granted a plant quarantine certificate for import, transit or domestic transportation. Based on the results of inspection of the whole lot of aiiicles, the plant quarantine agency shall grant a plant quai antine celiificate for import, transit or domestic transportation for the lot of aiiicles. Article 8. Notification of plant quarantine 1. Notification to expoliing countries The Plant Protection Depaiiment shall notify competent plant quarantine agencies of expo1iing countries in the following cases: a/ Impo1ied a1ticles are infested with Vietnam's plant quarantine objects or control objects or exotic haimful organisms and plant quarantine measures have been applied for handling; b/ Impo1ied aiiicles are not yet pe1mitted to be impo1ied into Vietnam; c/ Imported aiiicles do not have plant quarantine certificates issued by competent agencies of expo1iing countries;

Notification to article owners and related agencies Plant quarantine agencies shall notify aiticle owners and other related agencies in the following cases: a/ The case provided at Point a, Clause 1 of this Alticle; bl The lots of aiticles ai e plant varieties or useful organisms. Chapter III ORDER AND PROCEDURES FOR PLANT QUARANTINE UPON EXPORT Article 9. Dossier of registration for plant quarantine upon export 1. A written registration for plant quai antine upon expo1t or re-expo1t (made according to the fo1m provided in Appendix IV to this Circular). 2. The plant quarantine ce1ti:ficate issued by the expo1ting country (in case of re-expo1t). Article 10. Order and procedures for plant quarantine upon expo1t 1. Registr ation for plant quai antine An aiticle owner shall submit a dossier of registr ation to the neai est plant quarantine agency. 2. Receipt and examination of dossiers The plant quarantine agency shall receive the dossier and examine its validity according to Clause 2, Alticle 7 of this Circular. 3. Inspection of aiticles Based on dossier examination results, the plant quai antine agency shall decide on the place of quai antine which may be the production establishment, place of depa1ture, inland storage or border-gate of expo1tation and assign its officers to inspect the lot of aiticles. The inspection of the lot of a1ticles shall comply with Clause 3, Alticle 7 of this Circular. 4. Grant of plant quarantine ce1ti:ficates a/ Within 24 hours since the quarantine staits, the plant quarantine agency shall grant a plant quai antine ce1ti:ficate (made according to the fo1m provided in Appendix V to this Circular) or a plant quai antine ce1tificate for re-expo1t (made according to the fo1m provided in Appendix VI to this Circulai-), if the lot of aiticles satisfies the impo1ting country's plant quai antine requirements. In case the time limit for granting a ce1tificate must be extended to more than 24 hours due to technical professional requirements, the plant quai antine agency shall issue a written notice or reply to the aiticle owner, clearly stating the reason. b/ In case the lot of articles fails to satisfy the impo1ting c01mtiy's plant quarantine requirements, the plant quai antine agency shall refuse to grant a plant quarantine ce1tificate and notify such to the aiticle owner. A written registration for plant quarantine (made according to the fo1m provided in Appendix I to this Circular). 2. The plant quarantine ce1tificate issued by the expo1ting countiy or a copy of such ce1tificate. In case the aiticle owner submits a copy of the plant quarantine ce1tificate, he/she must submit the original before the lot of aiticles is granted a plant quarantine ce1tificate for impo1t, ti ansit or domestic transpo1tation. 3. The original pe1mit for plant quarantine upon impo1t or a copy of such pe1mit. Article 12. Order and procedures for plant quarantine upon transit 1. Registi ation for plant quarantine An article owner shall submit a dossier of registi ation for plant quai antine upon impo1t at a plant quarantine agency. 2. Receipt and examination of dossiers The plant quai antine agency shall receive the dossier and examine its validity according to Clause 2, Atticle 7 of this Circulai. 3. Inspection of a1ticles Based on dossier examination results, the plant quarantine agency shall decide on the place of quarantine and assign an officer to inspect the lot of aiiicles in the following order: a/ Prelimina1y inspection To inspect the outside of the lot of aiticles, its packaging and caitier; slits, interstices and places where haimful organisms may hide; to collect insects that fly ai ound, creep on or cling onto the lot of aiticle. b/ Detailed inspection To inspect the packaging and intactness of the lot of aiiicles; to analyze and assess collected samples of aiticles or hannful organisms. In case the packaging of the lot of a1ticles is unsecure, the a1iicle owner shall re-package it. 4. Grant of plant quai antine ce1tificates a/ Within 24 hours since the quai antine starts, the plant quarantine agency shall grant a plant quarantine ce1tificate for impo1t, ti ansit or domestic transp01tation, if the lot of articles satisfies plant quarantine requirements upon transit; b/ If detecting that the lot of aiticles is infested with Viet:nain's plant quai antine objects or conti ol objects or exotic ha1mful organisms, the plant quarantine agency shall apply plant quarantine handling measures according to regulations.

Cuttings, seedlings, bulbs, slips and grafts which are subject to post-impo1t plant quarantine according to pest risk analysis results. 2. Useful organisms. Article 14. Quantity of a1ticles required for post-impo1t plant quarantine I. Cuttings, scions, trees or bulbs: 30-50 individuals. 2. Slips or grafts: 10-20 branches. 3. Useful organisms: The quantity shall be specified in pest risk analysis repo1ts. Article 15. Contents of post-impo1t plant quarantine I. For plant varieties: To inspect implicit ha1mful organisms dete1mined in pest risk analysis repo1ts. 2. For useful organisms: To examine tameness and host-parasite specificity in isolated rearing areas. For useful insects and spiders, the criterion of grade-2 parasites shall be further examined. Article 16. Process of post-impo1t inspection in isolated rearing areas I. Initial inspection To preliminarily inspect the status of the lot of aiticles; to record related info1mation. 2. Inspection of the lot of a1ticles a/ For plant varieties The whole lot of aiticles shall be sown and grown in an isolated plant quai antine ai ea. Conditions on isolated plant quarantine areas shall comply with relevant national technical regulations issued by the Ministiy of Agriculture and Rural Development; To apply cai e measures suitable to each type of vai-iety so as to ensure that ti ees will develop well and create the most favorable conditions for appearance of signs of haimful organisms; To conduct periodical or unexpected inspection of all trees; To collect the samples of trees showing abno1mal signs, haimful organisms or haimful signs so as to dete1mine disease-causing agents in laboratories. b/ For useful organisms To inspect all individuals to assess their tameness; To inspect and dete1mine the host-parasite specificity of the lot of aiticles; For useful insects and spiders, to inspect and supervise the status of the lot of aiticles eve1y day and collect deceased individuals for inspection of grade-2 parasites. 3. Post-impo1t plant quai antine results Upon the expiration of the required monitoring period, agencies conducting postimpo1t plant quarantine shall repo1t inspection results to the Plant Protection Depaitment for consideration and decision. lssut> nos 11-12/0ctober 2014 OFFICIAL GAZETTE 45 Article 17. fuspection and monitoring period The period of post-import inspection, monitoring and plant quarantine of each type of plant variety and useful organisms is as follows: 1. Scions, cuttings, slips and grafts: from 1 to 2 years. 2. Trees: from 6 to 12 months. 3. Bulbs: 1 growth cycle. 4. Useful organisms: At least 1 generation. Chapter VI ORGANIZATION OF IMPLEMENTATION AND IMPLEMENTATION PROVISIONS Article 18. Responsibilities of the Plant Protection Department 1. To direct, guide and examine plant quarantine agencies in implementing this Circular. 2. To notify expo1iing countries of the cases provided in Clause 1, Aliicle 8 of this Circular. 3. To organize public communication and dissemination of this Circular to related organizations and individuals. Article 19. Responsibilities of plant quarantine agencies 1. To receive and examine dossiers, inspect lots of articles, grant plant quarantine ce1ii:ficates and perfo1m other plant quarantine operations under this Circular. 2. To prese1ve, send, transpo1i and destroy samples of aiiicles or haimful organisms; to make and preserve plant quarantine dossiers according to cmtent regulations. Article 20. Effect This Circular takes effect on Janua1y 1, 2015, and replaces the Minister of Agriculture and Rmal Development's Circular No. 65/2012/TT-BNNPTNT of December 26, 2012, providing the order and procedmes for grant of plant quarantine ce1ii:ficates. To annul Fo1ms 3, 7, 8, 9, 10 and 11 provided in Appendix I to the Ministiy of Agriculture and Rmal Development's Circulai No. 14/2012/TT-BNNPTNT of March 27, 2012, guiding plant quarantine operation dossiers. Article 21. Organization of implementation The Director of the Plant Protection Department, heads of agencies and related organizations and individuals shall implement this Circular. Any problems arising in the comse of implementation should be repo1ied to the Ministiy of Agricultme and Rmal Development (the Plant Protection Depaiiment) for consideration and settlement.- For the Minister of Agriculture and Rural Development Deputy Minister LE QUOC DOANH *All appendices to this Circular are not translated.
