177 Cross Ave. B2-065 2 1.0 INTRODUCTION This document is a Noise and Vibration Impact Study regarding the proposed mixed use development at 177 Cross Avenue, Oakville. It is associated with rezoning application for the site. The proposed development consists of residential and commercial components. The proposed site plan is shown as Figure 1. The objective of this study is to determine if the residential component on this site can meet the requirements of the Town of Oakville, using criteria developed by the Ontario Ministry of the Environment (MOE). The noise control measures are summarized in Section 5.0. 2.0 SITE The proposed site is located on the west side of Cross Avenue, south of Argus Road. An aerial photo of the area is provided in Figure 2. The railway corridor is approximately 200 m east of the site. The area between the site and the railway tracks is currently a parking lot for the train station. QEW is approximately 200 m west of the site. There are existing commercial developments north and south of the site. The proposed development consists of three buildings which are linked together through the commercial space on the first and second levels. The residential portion of the development starts from the third level of all three buildings. The designated outdoor amenity area is the Podium on Level 3, located on the east side of the site between Tower B and Tower C. 3.0 NOISE IMPACT 3.1 NOISE SOURCES The identified transportation noise sources are train pass-by on the railway corridor and road traffic on Cross Avenue, Argus Road and QEW. There are no significant stationary noise sources. 3.2 CRITICAL NOISE RECEPTORS Critical Noise Receptors are those receptors likely to be most affected by the identified noise sources. OLA Outdoor amenity area in the Podium on Level 3. 3.3 NOISE SOURCES, NOISE LEVELS Traffic data for Cross Avenue and Argus Road were obtained from the Town of Oakville. Traffic data for QEW were obtained from Ontario Ministry of Transportation. The traffic data are attached in Appendix A. The AADT for Cross Avenue is 15641. Truck percentages were taken to be 2.2% medium trucks and 1.8% heavy trucks. The day/night split is 94%/6%. The posted speed limit on Cross Avenue is 50 km/h. An annual increase of 5% for 10 years in traffic volume has been applied. The AADT for Argus Road is 4932. Truck percentages were taken to be 0.55% medium trucks and 0.45% heavy trucks. The day/night split is 94%/6%. The posted speed limit on Argus Road is 50 km/h. An annual increase of 5% for 10 years in traffic volume has been applied. The ultimate AADT for QEW is 218000. Truck percentages were taken to be 2.25% for medium trucks and 6.75% for heavy trucks. The day/night split is 86%/14%. The posted speed limit on QEW is 100 km/h. 177 Cross Ave. B2-065 5 Outdoor Sound Level (Day-time Leq) Need for Noise Reduction Measures 56 to 60 dba Physical reduction measures may be implemented. If no physical reduction measures are planned, a warning clause must be included in the unit title or lease agreement. Above 60 dba Control measures (barriers) required to reduce the Leq to below 60 dba and as close to 55 dba as technically, economically and administratively feasible. A warning clause is required if resultant Leq exceeds 55 dba. The day-time outdoor sound level at the outdoor amenity area is above 60 dba, so physical reduction measures are required. Indoor Sound Level Limits The predicted total sound levels at the noise receptors are dominated by road traffic. Therefore only the road traffic noise criteria are required. 177 Cross Ave. B2-065 7 ASSESSMENT LOCATION RAIL Leq Less than or equal to 55 dba Greater than 55 dba BUILDING COMPONENT REQUIREMENTS Building compliant with the Ontario Building Code Building components must be designed to achieve indoor sound level criteria The daytime sound levels are greater than 65 dba due to road traffic and greater than 60 dba due to train pass-by. The night-time sound levels are greater than 60 dba due to road traffic and greater than 55 dba due to train pass-by. Therefore building components must be designed to achieve indoor sound level criteria. 3.5 NOISE CONTROL MEASURES 3.5.1 Outdoor Amenity Area Two 2.8 m high noise barriers are recommended along the east perimeter and west perimeter of the Podium on Level 3 respectively. The locations of the noise barriers are shown in Figure 3. The noise barriers should have a minimum surface density of 20 kg/sq. m. There should be no holes or gaps on the barriers. The noise barriers can be constructed of a variety of material, such as masonry, glass and wood, as long as it meets the above surface density requirement. The mitigated daytime sound levels will be 59.6 dba at OLA. As the sound level is above 55 dba, a warning clause is required (see Section 3.5.2.3) 3.5.2 Indoor Living Areas 3.5.2.1 Ventilation Central air-conditioning in all units is required for noise control, which allows the windows and exterior doors to remain closed. 3.5.2.2 Building Components As the building design is at a relatively early stage, the floor plan of condo suites and the construction of the exterior wall and glazing are not available. The transmission losses, in terms of Sound Transmission Class (STC), are as follows: Component Assumed Component Area Percentage Versus Floor Area of Room STC Required Exterior wall 63% STC-54 Fixed glazing 20% STC-35 Operable glazing 10% STC-32 Typical minimum constructions for exterior wall and glazing were determined to provide a basis for the final design. Exterior Wall The following proposed construction from the foundation to the roof will meet STC-54: 12.7 mm Type X gypsum board vapour barrier 89 mm studs 89 mm (or thicker) mineral wool or glass fibre batts in inter-stud cavities sheathing 25 mm air space 100 mm brick veneer Fixed Glazing Fixed glazing sealed to the frame and consists of two 6 mm panes separated by an airspace of 13 mm. Alternatively, two 4 mm panes sealed to the frame and separated by an airspace of 16 mm. Operable Glazing Operable glazing should consist of two 6 mm panes separated by an airspace of 13 mm. 177 Cross Ave. B2-065 9 equivalent or greater STC values will be acceptable. Changes in window sizes and unit layouts will change these requirements. Specifically, reduced window sizes will reduce the window requirements. 3.5.2.3 Warning Clauses Since central air-conditioning is required in the proposed development, the following warning clauses should be inserted in all development agreements of each dwelling: This dwelling unit has been supplied with a central air conditioning system which will allow windows and exterior doors to remain closed, thereby ensuring that the indoor sound levels are within the Municipality s and the Ministry of the Environment s noise criteria. Since the mitigated day-time sound level at the outdoor amenity area exceeds 55 dba, the following warning clause should be inserted in all development agreements for the residential units at 177 Cross Avenue: Purchaser/tenants are advised that despite the inclusion of noise control features in the development and within the building units, sound levels due to increasing subway and road traffic may on occasions interfere with some activities of the dwelling occupants as the sound levels exceed the Municipality s and the Ministry of the Environment s noise criteria. Since part of the development is within 300 m of the CN railway right-of-way, the following warning clause should be inserted in all development agreements for the residential units at 177 Cross Avenue: Canadian National Railway Company or its assigns or successors in interest has or have a rights-of-way within 300 metres from the land the subject hereof. There may be alterations to or expansions of the railway facilities on such rights-of-way in the future including the possibility that the railway or its assigns or successors as aforesaid may expand its operations, which expansion may affect the living environment of the residents in the vicinity, notwithstanding the inclusion of any noise and vibration attenuating measures in the design of the development and individual dwelling(s). CNR will not be responsible for any complaints or claims arising from use of such facilities and/or operations on, over or under the aforesaid rights-of-way. Swallow Acoustic Consultants Ltd. 177 Cross Ave. B2-065 10 4.0 VIBRATION IMPACT 4.1 VIBRATION CRITERIA 4.1.1 CN Rail The CN Rail criterion for train vibration on proposed new residential development is an overall vertical vibration level of 0.14 mm/sec (RMS) between 4 Hz and 200 Hz. The monitoring system should be capable of measuring frequencies between 4Hz and 200 Hz, ±3 db with an RMS averaging time constant of 1 second. 4.1.2 MOE The MOE criterion for an acceptable impact of ground-borne railway vibration is yet to be formally standardised. However, based on the currently available information including existing standards, scientific literature and past MOE s recommendations, the criterion should limit the vibration velocity to below about 0.1 mm/s, RMS, in the frequency range of about 10 to 100 Hz. 4.2 Vibration Measurement Instrumentation Vibration levels were detected by an Endevco Type 7703-1000 High Sensitivity Accelerometer. Signals from the accelerometer were passed to a B&K Type 2635 Charge Amplifier set to convert the acceleration signal to a velocity signal. Signals were then passed to a Ziegler Two Channel FFT Analyser, installed in a Dolch Type EPAC486-66C-C Portable Computer. The accelerometer was checked for calibration prior to the vibration measurements using a B&K 4291 Vibration Calibrator. 4.3 Vibration Measurement Results Train vibration measurements were performed in the afternoon of July 5, 2012 at two locations on the site: approximately 9 m from the east property line of the site and approximately 18 m from the east property line. The measurement locations correspond to the setback of the entrance to Tower B and the setback of condominium suites from Cross Avenue. The measurement results are shown in Appendix C. The maximum measured vibration level reaches 0.02 mm/s. It is below both CN Rail and MOE vibration limits. Swallow Acoustic Consultants Ltd. July, 2012

Not included in the above data are GO Transit commuter trains running east and west on the Oakville Subdivision. Except where anti-whistling bylaws are in effect, engine-warning whistles and bells are normally sounded at all at-grade crossings. There is one at-grade crossing in the immediate vicinity of the study area; Kerr Street (Mi. 22.10). Anti-whistling bylaws are in effect at this crossing. Please note that engine warning whistles may be sounded in cases of emergency, as a safety and or warning precaution at station locations and pedestrian crossings and occasionally for operating requirements. With respect to equipment restrictions, the gross weight of the heaviest permissible car is 286,000 lbs. The two mainline tracks of the Oakville Subdivision are constructed of continuously welded rail throughout the study area. The presence of the switch located at Mile 21.64 and the various switches between Mile 21.97 and Mile 22.23 may exacerbate the noise and vibration caused by train movements. The Canadian National Railway continues to be strongly opposed to locating developments near railway facilities and rights-of-way due to potential safety and environmental conflicts. Development adjacent to the Railway Right-of-Way is not appropriate without sound impact mitigation measures to reduce the incompatibility.
