RESOLUTION OLIY MAJLIS OF UZBEKISTAN ON APPROVAL OF THE STATE COMMITTEE OF UZBEKISTAN FOR NATURE PROTECTION (Bulletin of the Oliy Majlis of the Republic of Uzbekistan, 1996, 5-6, art. 70, 2000, 5-6, Art. 153; 7-8, Art. 217; 2002, 1, p. 22; 9, p. 165; 2003, 9-10, Art. 149) Oliy Majlis of the Republic of Uzbekistan decides: 1. To approve the Regulations on the State Committee of the Republic of Uzbekistan for Nature Protection (attached). 2. To recognize the decision of the Presidium of the Supreme Soviet of the Republic of Uzbekistan dated December 10, 1990 "On approval of the State Committee of the Republic of Uzbekistan for Nature Protection" (Bulletin of the Supreme Council of the Republic of Uzbekistan, 1991, 1-2, art. 21). Chairman of the Oliy Majlis E.Khalilov Tashkent, April 26, 1996, 232- I APPROVED Resolution of the Oliy Majlis of Uzbekistan on April 26, 1996 POSITION the State Committee of the Republic of Uzbekistan for Nature Protection 1. The State Committee of the Republic of Uzbekistan for Nature Protection (hereinafter - the State Committee for the Republic of Uzbekistan) is a specially authorized supradepartmental and coordinating body exercising state control and intersectoral management in the field of nature protection, use and reproduction of natural resources. 2. The State Committee for the Republic of Uzbekistan subordinate and accountable to the Oliy Majlis of the Republic of Uzbekistan. State Committee for the Republic of Uzbekistan is guided by the Constitution, the laws of the Republic of Uzbekistan, decisions of the Oliy Majlis, decrees and orders of the President of the Republic of Uzbekistan, decrees and orders of the Cabinet of Ministers, as well as the present Regulations. 3. The State Committee for the Republic of Uzbekistan, the State Committee of the Republic of Karakalpakstan, regional and Tashkent City Committee for Nature Protection, interregional, regional and city committees (inspections) on nature protection, as well as their subordinate enterprises, institutions and organizations constitute a single system. 4. Decisions of the State Committee of the Republic of Uzbekistan adopted within its competence, are binding for all ministries, state committees, departments, other legal entities and individuals. Where necessary, the decision of the State Committee of the Republic of Uzbekistan taken together or in coordination with other ministries, state committees and departments of the Republic of Uzbekistan. 5. The state control and intersectoral management in the field of nature protection and use of natural resources SCNP Republic of Uzbekistan shall in conjunction with the bodies of state power and administration. 6. In addressing international and regional issues related to the conservation and use of natural resources, the State Committee of the Republic of Uzbekistan, within its competence interacts with the relevant environmental authorities and organizations in other states. 7. The State Committee for the Republic of Uzbekistan is not a substitute ministries, state committees, agencies, public authorities and local self-government bodies, enterprises, institutions and organizations in their efforts to protect nature and natural resources. 8. State Committee for the Republic of Uzbekistan coordinates the activities of the Ministry of Health of the Republic of Uzbekistan, the Ministry of Internal Affairs, Agency for Supervision of Safety in industry and mining in terms of control over the protection of the environment and natural resources, as well
as other ministries, state committees and agencies in the field of conservation and use of natural resources. (Paragraph 8 of Law of the Republic of Uzbekistan dated August 31, 2000 125- II - Bulletin of Oliy Majlis, 2000, 7-8, art. 217) 9. State Committee for the Republic of Uzbekistan cooperates with public associations and the public, providing them with methodological assistance and environmental activities. 10. Decisions of the State Committee of the Republic of Uzbekistan are published in their own publications and, if necessary, they are reported to the public through the media. 11. The main tasks of the State Committee of the Republic of Uzbekistan are: State control over the protection of the environment, use and reproduction of natural resources; implementation of cross-sectoral integrated environmental management; Development and implementation of a unified environmental and resource policy; ensure a favorable state of the environment, improving the environmental situation. 12. The State Committee for the Republic of Uzbekistan in accordance with its tasks: provides comprehensive environmental management in the widespread use of predominantly economic methods of environmental protection and use of natural resources, promoting the widespread use of resource saving, low-waste and non-waste technology, involving in economic circulation of waste, the introduction of scientific and technological progress in the field of nature conservation and use of natural resources ; (Second paragraph of paragraph 12 of the Law of the Republic of Uzbekistan dated August 30, 2003 535- II - Bulletin of Oliy Majlis, 2003, 9-10, Art. 149) organizes the development and approves national, sectoral accords environmental regulations, rules and standards for the conservation and use of natural resources, create and maintain their fund; is working on metrological support of environmental activities, providing methodological guidance to control pollution of the natural environment; analyzes the impact of human activities on the natural environment in order to regulate the extent of involvement in the commercialization of all kinds of natural resources; is the Oliy Majlis, the Cabinet of Ministers and the public authorities in the field proposals for the implementation of natural resources necessary environmental measures to be included in long-term projects and annual forecasts of the environment, and set records for the analysis of the implementation of economic reforms in the environmental sector; coordinates ministries, state committees, agencies and other users of natural resources conservation programs and conducting research work on conservation and use of natural resources, the provisions on specially protected natural territories; approves standards of maximum permissible emissions and discharges of pollutants into the environment and waste disposal limits, charge compensation for environmental pollution and use them in the prescribed manner; (Eighth paragraph of paragraph 12 of Law of the Republic of Uzbekistan dated August 30, 2003 535- II - Bulletin of Oliy Majlis, 2003, 9-10, Art. 149) organizes work on standardizing the quality of the environment, implemented jointly with the State Committee on Statistics of Uzbekistan, other ministries, state committees, departments, enterprises and organizations records of pollution sources and their harmful effects (other than physical) on the environment; (Ninth paragraph of paragraph 12 of Law of the Republic of Uzbekistan dated August 30, 2003 535- II - Bulletin of Oliy Majlis, 2003, 9-10, Art. 149) conducting state environmental review of projects, programs, concepts, main directions and the arrangement and development of the productive forces, and project documentation, instructional methodology and normative and technical documentation, the environmental situation of certain regions, places, and existing facilities, as well as new techniques, technologies, materials and substances that have an impact on the environment;
developing the structure, content and procedure for monitoring the environment, create and maintain partnership with ministries, state committees and other bodies concerned a single Republican environmental information database on the state of pollution and other harmful effects on the environment and natural resources; directs the reserved matter in the country, is in conjunction with the Academy of Sciences of the Republic of Uzbekistan State cadastre of specially protected natural territories makes proposals for the creation of new protected areas; participates in the work of the State Commission for acceptance and commissioning of the new (reconstructed) facilities as well as facilities and environmental protection facilities, materials coordinates site selection and land acquisition for all types of economic activity; Approves the Statutes of the Red Book of the Republic of Uzbekistan, the personal composition of the Interdepartmental Commission on its jurisdiction, the Statutes of the Commission (together with the Academy of Sciences of the Republic of Uzbekistan), as well as the structure and position of other interdepartmental committees on matters within the competence of the State Committee of the Republic of Uzbekistan; approves regulations on regional and Tashkent City Committee for Nature Protection, inter-district, district and city committees (inspections) on nature protection; in the prescribed manner creates, reorganizes and abolishes subordinate enterprises, institutions, organizations and other structural units, according to their charters; organizes the work of educating the citizens of respect for nature and its resources, the promotion and dissemination of knowledge about nature, promotes environmental education, organizes competitions, exhibitions, conferences and other activities in this area; organizes the training of the employees of your system, provides methodological guidance of the work of ministries, state committees, departments, enterprises, institutions and organizations on training and retraining of specialists in the field of nature conservation and use of natural resources; gives the established procedure permits for emissions and discharges of pollutants into the environment, the consumption of air for industrial needs, waste disposal, special water, water well drilling, work on environmental norms, subsoil for disposal of hazardous substances, radioactive waste and waste production, the right of hunting and fishing activities, as well as on the use of animals (including fish) and flora, except the species listed in the Red Book, the collection (harvesting) of wild species of medicinal, edible and ornamental plants, industrial raw materials and other natural formations (including mummies), export them outside the country and to bring in it; (Nineteenth paragraph of paragraph 12 of Law of the Republic of Uzbekistan dated August 30, 2003 535- II - Bulletin of Oliy Majlis, 2003, 9-10, Art. 149) carries out the state control in the field of creating and maintaining hunting and fishing activities, protection, reproduction and rational use of animal (including fish) and flora (including forests) of the world, is developing regulations for the protection, management and use of the animal (including fish) or vegetable (including forests) world; making, if necessary, to the Cabinet of Ministers proposals for the consideration of the reports of the Council of Ministers of the Republic of Karakalpakstan, regional and Tashkent city on the protection of nature and natural resources; at the board meeting hears reports of heads of ministries, state committees, departments and other legal entities and individuals on environmental protection, natural resource management, puts the appropriate authorities the question of punishment for violations of heads; imposes on businesses and individuals claims for damages for the harm nature by pollution and unsustainable use of natural resources; credit the amounts recovered in environmental funds and special extra-budgetary accounts; submits recommendations on banking institutions cease funding for the design, construction, renovation or expansion of industrial and other purposes, carried out in violation of the legislation on the protection of nature and natural resources, as well as to the appropriate authorities to prosecute leaders of
enterprises, institutions and organizations, including the deprivation of premiums on the basis of economic activity in violation of the law, environmental regulations, rules and standards; imposes restrictions on the design and construction, reconstruction or expansion of industrial or other purposes, carried out in violation of the law, as well as suspend the operation of industrial and other enterprises, institutions and organizations that violate the rules and regulations of environmental protection, and imposes restrictions on output, the use of which leads to contamination or degradation of natural objects; considers within its competence materials on administrative violations in the field of environmental protection and natural resource use and imposes on perpetrators fines and other administrative sanctions, if necessary, submit the materials to the law enforcement authorities; request and free of charge in the prescribed form receives from businesses and individuals necessary information and explanations relating to the conservation and use of natural resources; forms of scientific and technical expertise and other interagency councils, groups and committees to determine the state of the environment and the development of measures to improve it, creates the State Committee for the Republic of Uzbekistan departmental self-supporting scientific-production associations, institutes, centers and other units to address the environmental challenges; draws in the prescribed manner research, development and design organizations, universities, centers of scientific and technical creativity and information, other organizations, and individual scientists and professionals to develop long-term programs of territorial complex schemes of nature protection, projects of legislative acts of the state ecological expertise and solutions of other issues related to the protection and use of natural resources; requires the heads of ministries, state committees and agencies, other entities to create subordinate objects points (stations), equipped with means for continuous monitoring of emissions (discharges) of pollutants into the environment, oversee the work of points (positions) of the said points (posts) State Committee for constant information Republic of Uzbekistan and its bodies in the field; in the prescribed manner, and used local and national environmental funds; open a special account of their subordinate departments and the State Committee for the Republic of Uzbekistan enterprises, institutions and organizations, the formation and use of which made her decision in consultation with the Ministry of Finance of the Republic of Uzbekistan; organizes a network of freelance inspectors and conservation experts whose activities are governed by the provisions approved by the board of the State Committee of the Republic of Uzbekistan; publishes magazines, newspapers, conference proceedings, newsletters for Nature Conservation. issues a certificate for transit of dangerous goods within its competence. (Paragraph 12 amended paragraph in accordance with the Law of the Republic of Uzbekistan dated August 30, 2002 405- II - Bulletin of Oliy Majlis, 2002, 9, p. 165) 13. The State Committee for the Republic of Uzbekistan carries out state control over: a) the state of ecosystems, natural gene pool, the biological balance of sources of air pollution, surface water and groundwater, soil, vegetation (including forests) and water biological objects, wildlife habitat; b) the implementation and enforcement of legal entities and individuals in terms of the legislation: established limits and maximum permissible emissions (discharges) of pollutants into the environment and coordinated measures to reduce these emissions (discharges) to established standards; environmental regulations, standards and requirements for the location, design, construction and commissioning of new and reconstructed enterprises and other objects; requirements to protect the environment from pollution and depletion, comprehensive utilization of natural resources in mining, blasting operations, placement and operation of tailings heaps, dumps and landfills; requirements for the protection of the environment during transport, storage and use of plant protection products, growth stimulators, mineral fertilizers and other chemical substances and preparations; norms and rules of development of deposits of common minerals; fishing regulations, protection of fish stocks and their reproduction and use, promotion of fish
farming; the rules of operation of water protection facilities, water systems, reservoirs and other hydraulic structures; the conditions of transit transport of dangerous goods in accordance with their competence. (paragraph "b" of paragraph 13 of the amended paragraph in accordance with the Law of the Republic of Uzbekistan from August 30, 2002 405- II - Bulletin of Oliy Majlis, 2002, number 9, Article 165). c) the implementation of programs and the protection of jobs environment, comprehensive utilization, conservation and restoration of natural resources; g) conducting the state cadastre of waters, flora and fauna; (paragraph "g" of paragraph 13 as amended by the Decree of the Oliy Majlis of the Republic of Uzbekistan dated December 7, 2001 322- II - Bulletin of Oliy Majlis, 2002, 1, Article 22). d) conducting natural resource of primary accounting of natural resources, emissions and discharges of pollutants, waste and other harmful influences (except natural) on the environment, as well as compliance, together with the State Committee on Statistics of Uzbekistan reliability of the state statistical reporting on conservation and use of natural resources; (paragraph "d" of paragraph 13 as amended by the Law of the Republic of Uzbekistan dated 30 August 2003 535- II - Bulletin of Oliy Majlis, 2003, number 9-10, item 149). e) the use of water resources, the observance of the established norms, rules and mode of use of water, protection of surface and groundwater from pollution and depletion, as well as the implementation of water conservation measures in the coastal bands (areas) water bodies; g) the use of land owners and users of land in accordance with the purposes for which they are provided, and conduct their activities on soil protection; h) bringing the land granted for temporary use, damaged during the construction, mining and other impacts, in a condition suitable for further use; i) ensuring the conservation of forest resources, valuable natural landscapes, as well as water protection, water regulation, shelterbelts and other protective functions of forest stands; a) the conduct of reserve management, ensuring the regime of specially protected natural territories; l) protection of state hunting fund, observance of rules of hunting and game management; m) decision of other issues in the field of environmental protection and use of natural resources, provided by the legislation. 14. Goskompriroda the Republic of Uzbekistan headed by the Chairman, shall be appointed and dismissed by the Oliy Majlis on the proposal of the President of the Republic of Uzbekistan. 15. The Chairman of the State Committee of the Republic of Uzbekistan: bears personal responsibility for performance of the tasks entrusted to Goskompriroda the Republic of Uzbekistan, as well as for the work of bodies subordinated to it, enterprises, institutions and organizations, approve the structure and staffing of the central apparatus of the State Committee of the Republic of Uzbekistan; produces the allocation of responsibilities between Vice-Presidents; agrees Jokargy Kenes of Karakalpakstan on the appointment and dismissal of the Chairman of the State Committee of the Republic of Karakalpakstan and his deputies; in coordination with the regional governor and the city of Tashkent, appoints and dismisses the heads of regional and Tashkent City Committee for Nature Protection and their deputies. 16. The First Deputy and Vice-Chairmen of the State Committee of the Republic of Uzbekistan shall be appointed and dismissed by the Kengash Oliy Majlis on the proposal of the Chairman of the State Committee of the Republic of Uzbekistan. 17. The Chairman of the State Committee of the Republic of Uzbekistan, the State Committee of the Republic of Karakalpakstan, regional and Tashkent city committees and their deputies in supervised areas are the main state inspectors for nature protection, respectively, the Republic of Uzbekistan, the Republic of
Karakalpakstan, regions and Tashkent city. One of the Vice-Presidents of the State Committee of the Republic of Uzbekistan is simultaneously the head of the State Ecological Expertise. 18. The State Committee for the Republic of Uzbekistan formed a bench of the Chairman of the Committee (chairman of the board), its Vice-Chairman of the State Committee of the Republic of Karakalpakstan, as well as the heads of individual departments of the central office, the State Committee for the Republic of Uzbekistan subordinate bodies, enterprises, institutions and organizations. Quantitative and personal composition of the college, in addition to those of its member ex officio, allegedly Kengash Oliy Majlis on the proposal of the Chairman of the State Committee of the Republic of Uzbekistan. In the State Committee for the Republic of Uzbekistan can be created coordination, scientific and technical, social, and other tips. Regulations of the Board and their personal composition of the board shall be approved by the State Committee of the Republic of Uzbekistan. 21. The officials of the system of the State Committee of the Republic of Uzbekistan shall be entitled to attend in accordance with the legislation enterprises, institutions and organizations, and other facilities located on the territory of the republic. Enterprises, institutions and organizations are obliged to ensure that officials of the State Committee of the Republic of Uzbekistan of the system in the execution of their duties premises, telecommunication, transport and, where appropriate, protective clothing for the period of inspection (inspection) of the object. Employees of the State Committee of the Republic of Uzbekistan of the system (except support staff) are provided with uniforms uniform sample and marks the difference, approved by the Chairman of the State Committee of the Republic of Uzbekistan. The State Committee for the Republic of Uzbekistan and its subordinate bodies are financed by the state budget of the Republic of Uzbekistan and other means provided by law. 24. The number of employees of the central apparatus of the State Committee of the Republic of Uzbekistan approved by the Oliy Majlis Kengash. 25. The State Committee for the Republic of Uzbekistan is a legal entity, has a seal with the State Emblem of the Republic of Uzbekistan and with its name.
