Permit Requirements for Eurasian Watermilfoil Management in the Adirondack Park Eurasian Watermilfoil Management Summit August 16, 2012
APA Jurisdiction NYS Freshwater Wetlands Act Non-jurisdictional activities Mechanical control in depths greater than 2 meters (6.6 feet) Hand Harvesting of Nuisance Aquatic Plants in Water Depths Less than 2 Meters 200 ft² native plants remain Does not involve more than 1000 ft² of native plants Not part of lake-wide effort No rare, threatened,or endangered species
APA Jurisdiction Permit Required for following: Hand harvesting* Benthic mats* Drawdowns Suction harvesting Biological control Herbicides *General Permit 2008G-1A
Aquatic Herbicide Permit Process Two Part Permit Application: Part I- General Information Request (GIR) Part II- Application for Use of Pesticides to Control Aquatic Plants-Supplemental Information Request (SIR)
Aquatic Herbicide Permit Process APA SIR Requires: Tier III plant survey Evaluation of alternatives Reduce impact to: Wetlands Non-targets native plants NYS Protected Plants Long-Term Aquatic Plant Management Plan (non-chemical control) Public benefit Sequestration curtains
Aquatic Herbicide Use Treatment Strategy/Objectives -Part of a lake-wide management effort to control EWM Requires implementation of nonchemical options as part of achieving long-term objective -Treatment area consists of dense beds of milfoil -Use chemical formulation that can be functionally selective and of low toxicity -Treat early when EWM is active and natives are dormant -Sequestration of treatment area to control herbicide dispersal and limit non-target impacts -Objective is to use herbicide to reduce EWM to manageable level Natives will repopulate later in the season
* NYS protected plant Renovate Non-Target Impacts: Native Dicots Susceptible to Triclopyr: Myriophyllum sibiricum- northern watermilfoil *Myriophyllum alterniflorum- alternate watermilfoil Myriophyllum verticillatum- whorl-leaf milfoil *Myriophyllum farwellii- farwell s watermilfoil * Bidens beckii (Megalondonta)- watermarigold Pontedaria cordata- pickerelweed Brasenia schreberi- watershield Nuphar spp yellow water lily Nymphaea spp-white water lily * Ludwigia spp- water primrose Susceptible Monocots: Heteranthera dubia- water stargrass Sagittaria spp- arrowhead Elodea canadensis- common waterweed (low susceptibility?)
Why Sequestration Curtains? 1. Eliminate/reduce impact/impairment to freshwater wetlands 2. Increase efficacy ( the efficacy may be improved by restricting the flow of water SEIS 2007) 3. Lower concentration (i.e. Lk Luzerne 0.5 ppm) 4. Reduce herbicide dispersal (drift) 5. Limit non-target impact 6. Eliminate/limit protected plant species impact 7. Limit herbicide outflow to other waterbodies (i.e. Hudson River) 8. Smaller waterbodies-partial lake treatments can be contained 9. Lower potential for less desirable plant growth (i.e. Southern naiad) 10. Slow turn around time on triclopyr residual analysis (>48 hrs) 11. Data gaps with Renovate OTF treatments (dispersal rates, dilution, non-target impacts, etc. ) 12. Public opposition
Treatment Without Sequestration Curtains? Data needs: Minimum concentration required Herbicide residual testing Dispersal rate and distances Degradation and dilution rate Non-target evaluations Dicot susceptibility studies within 1500 feet of treatment area Lake hydraulic retention time Study lake: Uniform water depth (<15 feet) in treatment area Protected bay Dense milfoil beds No protected plant species No outlet or limited outflow No Forest Preserve land
Agency Approval Process Public Notification Requirements Public Notice to adjacent landowners Public Notice published in Environmental Notice Bulletin Agency Board Review- within 60 days of completing application project will be presented to Agency Board of Commissioners: Approve Permit with conditions Require Public Hearing Denial of Permit (Hearing required)
