2 I. LEGAL BASES AND GENERAL CONDITIONS 1. This European Technical Approval is issued by UBAtc in accordance with: Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of Member States relating to construction products 1, modified by Council Directive 93/68/EEC 2 and Regulation (EC) N 1882/2003 of the European Parliament and of the Council 3, Belgian law of 25 March 1996 concerning the adaptation of legislative and administrative provisions of Member States to the Construction Products Directive (89/106/EEC) for construction products 4 and Belgian Royal Decree of 18 August 1998 concerning construction products 5 Common Procedural Rules for Requesting, Preparing and the Granting of European Technical Approvals set out in the Annex to Commission Decision 94/23/EC 6 Guideline for European Technical Approval of Prefabricated Building Units, ETA-Guideline Nr The UBAtc is authorized to check whether the provisions of this European Technical Approval are met. Checking may take place in the manufacturing plant(s). Nevertheless, the responsibility for the conformity of the products to the European Technical Approval and for their fitness for the intended use remains with the holder of the European Technical Approval. 3. This European Technical Approval is not to be transferred to manufacturers or agents of manufacturers other than those indicated on page 1, or manufacturing plants other than those laid down in the context of this European Technical Approval. 4. This European Technical Approval may be withdrawn by UBAtc, in particular pursuant to information by the Commission according to Article 5(1) of Council Directive 89/106/EEC. 5. Reproduction of this European Technical Approval including transmission by electronic means shall be in full. However, partial reproduction can be made with the written consent of UBAtc. In this case partial reproduction has to be designated as such. Texts and drawings of advertising brochures shall not contradict or misuse the European Technical Approval. 6. Subject to the application introduced, this European Technical Approval is issued by the approval body in its official languages. These versions correspond fully to the version circulated in EOTA. Translations into other languages have to be designated as such. 7. The ETA holder confirms to guarantee that the product(-s) to which this approval relates, is/are produced and marketed in accordance with and comply with all applicable legal and regulatory provisions, including, without limitation, national and European legislation on the safety of products and services. The ETA-holder shall notify the UBAtc immediately in writing of any circumstance affecting the aforementioned guarantee. SPECIFIC CONDITIONS OF THE EUROPEAN TECHNICAL APPROVAL 1 Definition of product and intended use 1.1 Definition of the construction product The product of the present approval is the tridimensional module made of reinforced concrete by the company Modulart. This module is a parallelepiped structure that is composed of 6 plates which are all reinforced. The 4 vertical walls, which are the supporting walls, are joined and compressed together, and attached to the floor and ceiling with specially adapted galvanized bolts every 450 mm. The full specification and drawings for the materials and components covered by this ETA are given in the manufacturer s technical dossier, a copy of which has been deposited with UBAtc. The design and calculation shall be in accordance with EN , EN and, if applicable further codes. This section only gives general details of the system and Annex 1 the typical construction details. Calculation and design is required in each single case. The external walls have a total thickness of 180mm and consist of two concrete layers between which a layer of 110mm of foamed polystyrene thermal insulation can be found. The layer of reinforced concrete situated at the inside of the module consists of a peripheral frame which has a thickness of 100mm and a sheet of 50 mm, they form the structural part. The external, nonstructural layer is a decorative concrete sheet of 20mm reinforced with anti-alkali glass fibre. The whole, stuck into a concrete casting, is mechanically joined by means of stainless steel (or polyethylene) pins, 6 pins per m². The walls that are not exposed to bad weather conditions (for example between two modules) have a total thickness of 100mm. They also have a reinforced concrete sheet of 50mm on the inside, with a peripheral frame of 100mm. A 50mm insulating layer of polystyrene guarantees the continuous thickness of the wall and serves as a lost formwork. The floor has a total thickness of 180mm. It consists of a 40mm reinforced concrete slab with ribs every 450mm. The ceiling is assembled in the same way as the floor. If the floor is used for the ground floor, EPS is applied everywhere underneath the module with a thickness of 60mm as to avoid thermal bridges. The walls are attached to the floors and the ceilings by means of continuous reinforcement tie rods in these floors and ceilings holding together the walls through traction (by means of M12 [8.8] bolts). These walls are also held together in the same way. These tie rods are covered by concrete and the number of fasteners comes to 132 for one module. The roof consists of a derbigum or an epdm membrane. The roof is equipped with a pitch of roof (5cm on the width of the module) is foreseen before laying the water-proof membrane. A lateral drain for the water drainage and the watertightness of the module is also provided in the top part of the wall. 1.2 Intended use The Modulart system is a prefabricated building system used for residential buildings of maximum 2 storeys. The units, once piledup and/or juxtaposed, constitute the basic layout of the building, which consists of an array of independent units. The type of units covered is described in Annex 2, Table 1. Buildings based on Modulart units may start on ETA 13/0874-2/17

3 Foundations: in general, the foundations laid on concrete pads, slabs and/or other means specified by the research bureau. Structure that is foreign to the system, as for example a cellar. Vertical communication between contiguous units through their floor is not envisaged and the buildings have not been assessed for use in all seismic zones. This European technical approval refers to a concrete prefabricated building unit. Complementary parts like substructure, surface coverings, stairs, windows and doors, internal fittings, external facing, technical installations for water, heating, ventilation and electricity as well as other components necessary to form completed works are not covered by this approval although they are delivered by the company Modulart. 1.3 Assumed working life The provisions made in this European Technical Approval are based on an assumed intended working life for the building of 50 years for the load-bearing structure and for non-accessible components and materials, and 25 years for repairable or replaceable components and materials like claddings, roofings materials, internal finishes, and integrated components like windows and doors. The indication given on the working life cannot be interpreted as a guarantee given by the producer, but are to be used as a means for selecting the appropriate product in relation to the expected economically reasonable working life for the works. 2 Characteristics of product and methods of verification 2.1 Characteristics of constituent materials of Modulart units Modulart unit is made of the following basic materials: Structural concrete C30/37 (fck 30 N/mm²) conforming to EN206 Decorative concrete reinforced with anti-alkali glass fibre ASGLATEX. Welded steel wire mesh B500A Ø5mm Welded steel reinforcement bars B500A Ø 8,10,12,16 Steel tension rods BE500 threaded M12 at both side Hexagon head screws M12x50 conforming to ISO 4017 Stainless steel (or polyethylene) pins. Expanded polystyrene ECO EPS 20 SE with λd = 0,032 W/mK for walls in accordance with EN Expanded polystyrene EPS 100 PS SE with λd = 0,036 W/mK for floor and ceiling in accordance with EN Caracteristics of Modulart units The characteristic performance of the buildings was determined using a combination of full-scale testing, calculation, computer modelling and judgement based upon experience of the buildings. The building system was assessed for each of the relevant Essential Requirements. The results are tabulated in Annex 3. 3 Evaluation of conformity and CE marking 3.1 Attestation of conformity The system of attestation of conformity, specified by the European Commission in decision 99/455/EC is system 1, according to Council Directive 89/106/EEC Annex III.2(i), and provides for: Certification of the conformity of the product by a notified certification body on the basis of: a. Tasks for the manufacturer: Factory production control; Further testing of samples taken at the factory by the manufacturer in accordance with a prescribed test plan; a. Tasks for the notified body: Initial type-testing of the product; Initial inspection of factory and of factory production control; Continuous surveillance, assessment and approval of factory production control; 3.2 Responsibilities Tasks of the manufacturer Factory Production Control The ETA-holder shall exercise permanent internal control of the production. All the elements, requirements and provisions adopted by the ETA-holder are being documented in a systematic manner in the form of written policies and procedures. This factory production control system ensures that the products are in conformity with this European Technical Approval. The ETA-holder shall only use such materials and components as covered in this European Technical Approval. The factory production control shall be in accordance with a written quality manual ( Test Plan ). The personnel involved in the production process have been identified, sufficiently qualified and trained to operate and maintain the production equipment. Machinery equipment is being regularly maintained and this is being documented. All processes and procedures of production are being recorded at regular intervals. The ETA-holder proceeds to controls during the production according to specific policies. Those controls include: Control of the incoming raw material Examination of type, quality and dimensions of all materials and components incorporated in the unit Archiving of the incoming goods in self-monitoring Control in production Quality control on concrete The clamping force at studs for the assembling of panels Comparison with plans Outgoing inspection with the loading Control for completeness Comparison with plans Damages control Testing of samples taken at the factory Testing is needed only with regard to the resistance and durability of concrete. The test methods shall correspond to the methods given in the standard EN 206 and the details of them shall be given in the test control plan Declaration of conformity When all the criteria of the Conformity Attestation are satisfied the manufacturer shall make a Declaration of Conformity, stating that the construction product is in conformity with the provisions of this European Technical Approval. 4 3.2.2 Tasks of approved bodies Initial assessment of the product Initial assessment of the product has been carried out by the approval body in accordance with section 6 of the ETA Guideline, as part of the ETA issuing procedure Initial inspection of factory and of factory production control The notified body has conducted initial inspection of the factory in order to ensure that the ETA-holder has acceptable premises, technical equipment, qualified personnel and a factory production control system that is in accordance with the provisions in the ETA Guideline and this ETA Continuous surveillance, assessment and approval of the factory production control The notified body shall normally visit the factory twice a year for routine inspections, and primarily check that the production is in conformity with the factory production control plan. The notified body shall particular check that the manufacturer only uses materials and components which are specified in the product description of the units under the ETA, and that all the specified case by case structural designs have been made and filed for each kit that is produced and delivered. During the factory visits the notified body shall also inspect prefabricated elements, components and material made ready for shipment to the building site, and that the kits and assembly instructions are in conformity with the construction details in Annex Certification When all the criteria of the Conformity Attestation are satisfied the notified body shall issue an EC Certificate of Conformity with this European Technical Approval. In cases where the provisions of the European Technical Approval and the prescribed test plan are no longer fulfilled the Certification of Conformity shall be withdrawn. 3.3 CE marking General The letters "CE" shall correspond to the Council Directive 93/68/EC The CE marking shall be affixed on the commercial documents accompanying the product. The CE marking shall be accompanied by the following information: Name or identifying mark of the producer and plant, Number of the approved body involved, Identity of the product (commercial name), ETA number, Relevant product characteristics/performances and levels/classes thereof (all products under the same designation, regardless of the manufacturing plant, must meet the relevant product characteristics and performance values), Year of manufacture and, if necessary, time of manufacture and production number Example of CE marking See Annex IV of the ETA. 4 Assumptions under which the fitness of the product for the intended use was favourably assessed 4.1 Manufacturing All production including internal and external cladding is performed in the industrial hall of Tubize (Belgium). The detailed description and conditions of the manufacturing process of Modulart units are specified in the manufacturer s technical dossier deposited with UBAtc. The ETA is issued for the product on the basis of agreed data/information, deposited with the UBAtc, which identifies the product that has been assessed and judged. Changes to the kit or production process, which could result in this deposited data/information being incorrect, should be notified to the UBAtc before the changes are introduced. The UBAtc will decide whether or not such changes affect the ETA and consequently the validity of the CE marking on the basis of the ETA and if so, whether further assessment or alterations to the ETA shall be necessary. 4.2 Design and building regulations Normally, a specification of relevant requirements concerning fire resistance and reaction to fire, sound insulation performance, thermal insulation performance and ventilation provisions should be elaborated for each delivery as a basis for the production of the units. The design process (including the approval of detailed plans, applications for planning permissions, building permits, etc.) shall comply with the procedures foreseen in the Member State in which the building is to be built. An ETA for a prefabricated building unit does not amend this process in any way. Verification of the design, foundation design and the whole final works must be carried out by appropriately qualified personnel in accordance with the procedures specified by the relevant Member State and the regulations pertaining in that state. Consideration must be given to the location, the geotechnical condition of the soil and the intended use of the final works. To enable these tasks to be undertaken, the ETA holder may have to supply all relevant data and details about the buildings. When necessary, declared thermal conductivity values can be corrected due to moisture content, ageing and temperature of the different materials resulting from conditions in the works, in accordance with the method described in NBN EN ISO 10456: 2008 (chapter 6). 4.3 Requirements set for the substructure This European Technical Approval does not comprise the substructure of the building. A plan drawing with the dimensions and schematic details of the substructure are delivered by the ETA-holder. The substructure shall be individually designed according to the local building regulations to correspond to the building site. The setting out and level foundations are checked by the ETA holder before the modules are delivered to site. The synthetic membranes are placed between the modules and the foundations to guarantee a continuous course, an acoustic, thermal insulation, or a water-seal. 4.4 Installation To enable transport of the module, transport cradles are bolted to the module in the vertical walls. They are then secured on a semi-trailer to be transported on-site. When required the open sides of the modules are weatherproofed during transit. ETA 13/0874-4/17

5 The building is installed and handled by the ETA holder in accordance with its instructions. The modules are placed by crane on prepared foundations using purpose-designed lifting points fixed to the structure. They are placed by means of gravity on next to the other or one on top of the other (maximum ground floor +1). Recommendations on use, maintenance, repair There are no specific use or maintenance conditions of the Modulart units different to those applicable to a conventional reinforced concrete structure with metal connection elements. Therefore, regular inspections will be focused, amongst other aspects, on the state of conservation of reinforced structural parts (inspection of covers, concrete, etc.), and on the state of metal connection elements (and the state of their corrosion protection layers, if any). The module can also be cut to an interior length, if necessary, during the elaboration of the plans. 8 This is the main opening suggested in one of the standard modules of Modulart. If one asks for a bigger opening, an extra research will have to be carried out by a recognized research bureau in order to be able to possibly modify the structure. 9 The maximum number of openings depends on the type of openings chosen. These openings can be doors, windows or sliding glass doors. If it s a small side, only one opening will be allowed. 10 Density of 9410 without opening.
