3 BID ANNOUNCEMENT TRENCH DRAIN MODIFICATIONS Department of Public Works The City of Des Peres is soliciting bids from qualified contractors for modifications to three trench drains crossing three nearby public streets in the City of Des Peres. Bids will be accepted until 2:00 pm on Tuesday, March 8, 2011 at which time they will be publicly opened and read aloud. For more information regarding the request for proposal please contact Denis Knock, Director Public Works, , Bids should be submitted to: Office of the City Clerk City of Des Peres Manchester Road Des Peres, Missouri It is the sole responsibility of the vendor to see that his/her bid is received in proper time. No late bids will be considered. Bids should be submitted in duplicate in a sealed envelope clearly marked Trench Drain Modifications, with the name of the bidder and with the date and time of the bid opening. 4 II. PROJECT DESCRIPTION A. INTENT It is the intention of the City to modify three trench drains crossing public streets in the City of Des Peres at the following locations: Beaver Dam Road, Westledge Lane, & 612 Westledge Court. B. SCOPE OF WORK Furnish all labor, equipment, materials, traffic control, etc. necessary to remove and replace three trench drains on Beaver Dam Road and Westledge Lane and Court in accordance with the specifications listed below: General Work Description The project involves modifications to three existing 24 to 36 deep concrete trench drains, either 26 or 32 ft. wide. In all cases the continuous trench will be converted to single 5 x 30 or 6 x 24 grates at both curb lines with side hood intakes and a new 12 or 16 PVC pipe will be installed in the old trench and covered with concrete. The existing grates and hoods may be reused, however new steel angles and steel reinforcing must be installed. 1. UNIT COSTS: While it is the City s intent to purchase all of the items provided in these specifications, the unit cost provided on the bid document shall be utilized in the event it becomes necessary to reduce the quantity purchased. 2. PAYMENT: The City intends to make a single payment to the successful contractor on receipt of the services as outlined in the specifications. 3. RESERVATION OF RIGHTS: The City reserves the right to reject any or all bids, to waive any technicalities in the bid process, to award any bid or portion of a bid which is deemed to be the most advantageous to the City of Des Peres and to make such investigations as are deemed necessary to determine the ability of the vendor to perform the services requested. III. GENERAL TERMS AND PROVISIONS OF BID 1. PRICES: All prices shall be F.O.B. at the appropriate job site. No other costs will be permitted the vendor beyond those stated in his bid. 2. WITHDRAWAL OF BIDS: Products and prices included in the bid may not be withdrawn for a period of thirty (30) days from the date of bid opening without consent of the City. 4

5 3. INSURANCE: A copy of the Contractor s Certificate of Insurance shall be attached. At least $2,000,000 worth of general aggregate insurance shall be provided and $1,000,000 worth of automobile liability insurance shall be provided. 4. BOND: A Performance Bond of one hundred percent (100%) shall be required of the successful bidder. A 10% bid bond shall be submitted with each bid. 5. WARRANTIES/GUARANTEE: All work shall be guaranteed for one year from the final payment date. 6. INTERPRETATION OF CONTRACT DOCUMENTS PRIOR TO BIDDING: If any person contemplating submission of a bid for items contained in this bid is in doubt regarding the true meaning of any part of the contract documents, he/she may submit to Denis Knock, , dknock@desperesmo.org., a request for an interpretation or correction thereof not later than 2:00 pm, Tuesday, March 1, The person submitting the request will be responsible for its prompt delivery to the designer. Any interpretation or correction of the contract documents will be made by addendum and will be mailed or delivered to each bidder of record. 7. QUESTIONS REGARDING TECHNICAL SPECIFICATIONS: Any and all questions regarding the technical specifications shall be directed to Denis Knock, , dknock@desperesmo.org. Any material changes as a result of such questions shall be approved in writing and mailed or delivered to each bidder of record. 8. ERRORS AND OMISSIONS BY CITY: No vendor shall be permitted to use to his/her advantage any error or omission in this solicitation or specifications. If vendor shall have any questions or desires a clarification or interpretation regarding any of the items specified, the vendor shall request such clarification in writing and any such clarifications shall be made available to all vendors. 9. SUBMISSION OF BIDS: Bids must be submitted prior to 2:00 pm, Tuesday, March 8, 2011, at which time they will be publicly opened and read aloud. Bids should be returned to the attention of: Office of the City Clerk City of Des Peres Manchester Road Des Peres, Missouri Bids must be in duplicate, in a sealed envelope clearly marked Trench Drain Modifications and shall include the name of the bidder and the date and time of the bid opening. 5

6 IV. SPECIFIC CONDITIONS AND REQUIREMENTS A. Specific Tasks (for each trench drain) Locate utilities. Mobilize men and equipment. Install warning signs and barricades for traffic control. Remove ½ of grates in street on uphill side of drain. Clean all debris from the trench. Sawcut trench drain wall 12 down for a length of approximately 5 to 6 on both sides. Break and remove this sawed concrete and half the existing pavement per plans. Install new 12 or 16 diameter schedule 40 PVC pipe in old trench. Install steel reinforcing for new walls and slab. Form new vertical walls, street pavement edges & set center keyway with dowels. Set anchors, frame (painted) and new hood. Pour concrete (wall, over pipe, & street slab) and pour new curbs to meet hoods. Install grate bolts and bolt down one grate (reuse). Backfill curbs with clean earth & seed & straw. Repeat for other side of street after seven day cure. B. Quality All work shall be that of skilled craftsmen familiar with this type of sewer and concrete work. Care must be taken in application not to damage existing structures or to damage other concrete slabs. All grates and frames shall be firmly secured at a uniform even grade and shall not rattle when vehicles pass over them. C. Time All work shall be scheduled to be completed within 30 consecutive days between April 15, 2011 and June 15, Additional time may be allowed for bad weather. Time is of extreme importance. Delays beyond this period will be subject to $100 per day penalty. D. Standards/Permits All work shall comply with the drawings and specifications shown. No formal building permits will be required. The existing trench drains are owned and maintained by the City of Des Peres. E. Clean-Up The Contractor shall be responsible for all cleanups and shall leave each site in a clean condition at the end of each day. New slabs shall be backfilled with topsoil and seeded. Debris may not be left in piles on the premises F. Site Protection The sites are along three streets that must be kept open to the public. Barricades must be provided by the Contractor and warning signs indicating one lane ahead must be installed prior to beginning work. G. Changes Minor modifications may be allowed to aid in the installation if approved by the City Engineer. Any alterations that result in added costs must be mutually agreed upon by Owner and Contractor in writing prior to initiation of the work. All prices are to include all handling, delivery and installation. 6

7 H. Wages All workmen must be paid at a wage rate in accordance with that established by the Missouri Department of Labor and Industrial Relations. An Affidavit must be submitted prior to final payment. I. Insurance Contractor must submit a Certificate of Insurance to the City prior to beginning work. The insurance must provide for workers compensation insurance per state standards and liability insurance in a least $1, J. Payment Only one final payment will be allowed. It shall be paid within 15 days of the Contractor completing the work to the satisfaction of the City Engineer. K. Safety/Liability The Contractor is assumed to have control over his workers, subcontractors, suppliers, etc., and the manner and method by which they work. As such, he shall take appropriate steps to insure safety on this job. He shall agree to indemnify, defend, and hold harmless the City in all actions arising out of work performed on this job. L. Default Should the Contractor fail to perform the above work in the specified time or fail to comply with the specifications or perform said work in a poor quality or manner, the City reserves the right to cancel the contract upon 5 days written notice and to take new bids, using the Performance Bond to pay others to satisfactorily complete said work. M. Guarantee All work shall be guaranteed for at least one year from final payment date. Any discrepancies found during that time period shall be promptly corrected by the Contractor. A written guarantee shall be provided with the final bill. N. Bond A 100% performance Bond shall be provided by the Contractor prior to beginning this work. A 10% Bid Bond shall be provided with the bid. O. References References may be requested to insure the City of the Contractor s ability to perform this work. 7

12 CONTRACT FOR THREE TRENCH DRAIN MODIFICATIONS THIS AGREEMENT, made this day of, 2011, by and between Hereinafter called the Contractor, and the City of Des Peres, Missouri, hereinafter called the Owner, WITNESSETH that: WHEREAS, the Contractor has submitted a Bid Proposal dated drain modifications on Beaver Dam Rd. and Westledge Lane and Court. for the trench WHEREAS, the Owner accepts said proposal and has awarded the work to the Contractor, NOW THEREFORE, the Contractor and the Owner for mutual considerations stated herein agree as follows: ARTICLE 1. SCOPE OF WORK The Contractor shall commence work when notified in writing to proceed and shall complete the work within 30 working days as provided for or pay liquidated damages of $100 per day. It is understood that the rate of progress and time of completion area essential of this contract. ARTICLE 3. ACCEPTANCE AND PAYMENT When the work specified under this contract has been fully completed in accordance with the terms hereof, the City Engineer shall make a final inspection and any defects found shall be remedied by Contractor. After final acceptance of the work by the City Engineer and receipt of the lien waivers, the Contractor shall receive final payment as determined in his bid, by the actual units installed as measured by the City Engineer, less any monies which are due and payable to the Owner as liquidated damages. 12

13 ARTICLE 4. GUARANTEE The Contractor hereby expressly guarantees the aforesaid work as to workmanship and quality of materials used in connection therewith for a term of one year, commencing on the date of the final acceptance of the work or improvements, and binds himself, his successors, or assigns, to make all replacements which may become necessary within that time due to non-conformity with the specifications. Whenever notified by Owner that said replacements area required, the Contractor shall at once make the same as directed, and at his own expense. If Contractor does not proceed with such replacements within ten (10) days of receipt of written notice, then Owner shall have the power to cause the same to be made and to charge the cost thereof to Contractor. Nothing in this Section is intended as maintenance guarantee. ARTICLE 5. PERFORMANCE BOND The Contractor furnishes the attached Performance Bond and Payment of Labor and Materials Bond, acceptable to Owner, in the amount of 100% of the total contract price as indicated in the bid. ARTICLE 6. CONTRACT DOCUMENTS The Contract includes this instrument, Notice to Bidders, Bid, Specifications, and any addenda or change orders which may be used. WITNESS WHEREOF, the parties hereto have caused this instrument to be executed in two original counterparts as of the day and year first above written.
