1 ORDINANCE NO AN ORDINANCE OF THE CITY OF ISLAND PARK, IDAHO ADOPTING THE 2012 EDITIONS OF THE INTERNATIONAL RESIDENTIAL CODE FOR ONE-AND TWO- FAMILY DWELLINGS; THE INTERNATIONAL BUILDING CODE; THE INTERNATIONAL ENERGY CONSERVATION CODE; INTERNATIONAL WILDLAND URBAN INTERFACE CODE; 1997 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS; PROVIDING FOR SEVERABILITY; REPEALING ORDINANCE NO IN ITS ENTIRETY; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, pursuant to the provisions of Idaho Code local governments may adopt building codes; WHEREAS, Idaho Code require local governments to adopt any amendments or revisions made by the Idaho building code board through the negotiated rulemaking process as set provided for in Title 39, Chapter 41 of the Idaho Code; WHEREAS, the City of Island Park Mayor and City Council have adopted to 2009 editions of the International Building Code; the International Residential Code for One- and Two-Family Dwellings; the International Energy Conservation Code; and the International Mechanical Code; and WHEREAS, the City Council desire to adopt the 2012 editions of the International Building Code; the International Residential Code for One- and Two-Family Dwellings; the International Energy Conservation Code; and the International Wildland Urban Interface Code; and the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF ISLAND PARK, IDAHO: Section 1. ADOPTION OF CODES: The following Codes, except as herein amended, are hereby adopted and incorporated by reference as set forth herein, and shall apply in all of the incorporated limits of the City of Island Park, Idaho. The following Codes and portions thereof are on file with the City Clerk in accordance with the provisions of Idaho Code : A. International Residential Code for One-and Two-Family Dwellings, 2012 edition (hereinafter referred to as the "International Residential Code"). Published by the International Code Council, Inc., parts I, II, III, IV, V, and IX; and in addition the following appendices: Appendix F, Radon Control Methods; Appendix G, Swimming

2 Pools, Spas, and Hot Tubs; and Appendix H, Patio Covers. B. International Building Code, 2012 edition. Published by the International Code Council, Inc., and in addition the following appendices: Appendix E, Supplementary Accessible Requirements: Appendix I, Patio Covers; and Appendix J, Grading. C. International Energy Conservation Code, 2012 edition. Published by the International Code Council, Inc. D. International Wildland-Urban Interface Code, 2012 edition. Published by the International Code Council, Inc., and in addition the following appendices Appendix A, General Requirements; Appendix B, Vegetative Management Plan; and Appendix C, Fire Hazard Severity Form. E. Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition. Published by the International Conference of Building Officials. Whenever in this Ordinance reference is made to any other code or ordinance of the City of Island Park, such cross reference is for the coordination of this Ordinance with such other codes or ordinances, but to any extent such other ordinance has not yet been adopted, such reference shall be ignored. Section 2: CITY OF ISLAND PARK AMENDMENTS TO THE 2012 INTERNATIONAL RESIDENTIAL CODE: A. Chapter 1 "Scope and Administration" is amended as 1. R101.1 Title. Replace bracketed "[]" text with the following: "City of Island Park." 2. R101.2 Scope. Exception 2. Add a new exception 2 as Transient rental houses and lodges with three (3) or fewer bedrooms shall be permitted to be constructed in accordance with the 2012 edition of the International Residential Code. Such occupancies shall be required to install smoke alarms and carbon monoxide alarms in accordance with the provisions of sections R314 and R315, respectively, of the 2012 International Residential Code. 3. Section R103, Department of Building Safety, R103.1 Creation of enforcement agency. Delete in its entirety and replace as The Planning and Building Department is hereby created and the official in charge thereof shall be known as the Planning and Building Administrator.

3 4. R103.3 Deputies. Delete last sentence. 5. Section R105, Permits, Work exempt from permit. Building: 2. Delete in its entirety and replace as Fences not over six (6) feet (1,829 mm) high may be exempted from the requirement of a building permit in the absence of any other applicable land use regulation (City adopted Development Code) governing the installation, height, type, location, or any other aspect. Building: 7. Delete in its entirety and replace as Prefabricated swimming pools that are not greater than four (4) feet (1,219 mm) deep. Electrical: Delete electrical paragraphs. Gas: Delete gas paragraphs Mechanical: Delete mechanical paragraphs Add a new subsection as Section R Work involving the exterior surfaces of existing dwellings, including but not limited to, replacement of roofing or siding, or the addition or replacement of windows or doors, or the addition of a porch or deck not exceeding thirty inches (30") in height, are exempt from the requirements of this Ordinance. 6. Section Time Limitation of application. Delete section in its entirety and replace as Applications for which no permit is issued within one-hundred eighty (180) days following the date of eligibility for permit issuance shall expire, by limitation, and plans and other data submitted for review shall thereafter by returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period of time not to exceed one-hundred eighty (180) calendar days on written request by the applicant showing justifiable cause for the time extension request. No application shall be extended more than once. In order to renew action on an application that has expired, a new application is required, including new fees. 7. Section Expiration. Add a second sentence as

4 If work has not been completed, the final inspection preformed, and the project approved for occupancy or use with two (2) years from the date of issuance, such permit shall expire and become null and void. Prior to work recommencing after the permit has expired, a new permit shall be obtained. The cost of the new permit shall be one-half (1/2) of the cost of a new permit for the work required to complete the building or use. 8. Section R108.2, Schedule of permit fees. Delete in its entirety and replace as On buildings, structures, or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule of fees as established, by Resolution, by the City Council. 9. Section R108.3, Building permit valuation. Delete in its entirety and replace as Building permit valuation shall include the total value of the work for which a permit is being issued, including materials and labor. 10. Section R108.5 Refunds. Delete in its entirety and replace as The City Council, by Resolution, is authorized to establish a refund policy. 11. Section "Reinspection". Add a new section R as To obtain a reinspection, the applicant shall pay the reinspection fee in accordance with the fee schedule as established, by Resolution, of the City Council. 12. Section R113, Violations, Section R113.4 Violation Penalties. Delete section in its entirety and replace as Any person who violates a provision of this Ordinance or fails to comply with any of the requirements thereof, or who erects, constructs, alters, or repairs a building or structure in violation of approved plans or construction documents, or a directive of the building official, or of a permit or certificate of occupancy issued under the provisions of this Ordinance, shall be guilty of a misdemeanor, punishable by a fine in any amount not exceeding one thousand dollars ($1,000.00), or by imprisonment for a period of not longer than one hundred eighty (180) calendar days, or by both fine and imprisonment. Each day in which a violation continues shall be considered a separate offense. Deemed violators shall be responsible for any cost incurred by the City of Island Park to enforce this Ordinance including staff costs, City Attorney s fees and costs, and court cost. B. Chapter 2, Definitions, is amended as 1. Section R202 Definitions

5 Building Official. Delete in its entirety and replace as The Planning and Building Administrator shall be the Building Official for the purposes of this Ordinance and is charged with the administration and enforcement of this Code as is adopted by reference in this Ordinance. Dwelling. Add the following language to the end of this definition: Except as provided for herein a dwelling is not Transient or a Transient Rental house or unit, or any other similar term. C. Chapter 3, Building Planning, is amended as 1. Table R301.2(1) Climatic and Geographic Design Criteria. Table Exterior Walls. Section R Townhouses Delete Exception in its entirety and replace as

6 Exception: A common one-hour or two-hour fire resistance rated wall assembly tested in accordance with ASTM E 119 or UL 263 is permitted for townhouses if such walls do not contain plumbing or mechanical equipment, ducts or vents in the cavity of the common wall. The wall shall be rated for fire exposure from both sides and shall extend to and be tight against the exterior walls and the underside of the roof sheathing. Penetrations of electrical outlet boxes shall be in accordance with section R Section R303.4, Mechanical ventilation. Delete Section in its entirety. 5. Section R313.1, Townhouse automatic fire sprinkler systems Delete Exception in its entity and replace as Exception: Automatic residential fire sprinkler systems shall not be required in townhouses where a two-hour fire-resistance rated wall is installed between dwelling units or when additions or alterations are made to existing townhouses that do not have an automatic residential fire sprinkler system installed. 6. Section R313.2 One- and two-family dwelling automatic fire systems. Delete Section in its entirety. D. Chapter 4, Foundations is amended as 1. Section Add to the end of the section the following: Bottom reinforcement shall be mechanically hung (wired) or otherwise physically located a minimum of 3 inches (76 mm) clear from the bottom of the footing. E.. Chapter 5, Floors, is amended as 1. Section R501.3 Fire protection of floors, and its Exceptions. Delete Section and Exceptions in their entirety. F. Chapter 6, Wall Construction, is amended as 1. Section R Wall Bracing. Delete Section in its entirety and replace as Wall bracing. Buildings shall be braced in accordance with this section or, when applicable section R602.12, or the most current edition of APA (American Plywood Association) System Report SR-102 as an alternate method. Where a building, or portion thereof, does not comply with one (1) or more of the bracing requirements in this section, those portions shall be designated and constructed in accordance with section R G. Chapter 11 Energy Efficiency. The following sections and tables of chapter 11 shall be amended in accordance with the requirements below: 1. Table R (Table N ) Insulation and fenestration requirements by component.

Delete section in its entirety and replace as The components of the building thermal envelope as listed in Table R shall be installed in accordance with the manufacturer s instructions and the criteria listed in Table R , as applicable to the method of construction. 5. Table R (Table N ), Air barrier and insulation installation. Delete the criteria requirement for the Fireplace component of Table, and replace with the following: An air barrier shall be installed on fireplace walls. 6. Section (N ) Testing. Delete section in its entirety and replace as Building envelope tightness and insulation installation shall be considered acceptable when tested air leakage is less than seven (7) air changes per hour (ACH) when tested with a blower door at a pressure of 33.5 psf (50 Pa). Testing shall occur after rough in and after installation of penetrations of the building

9 envelope, including penetrations for utilities, plumbing, electrical, ventilation and combustion appliances. During testing: i. Exterior windows and doors, fireplace and stove doors shall be closed, but not sealed; ii. Dampers shall be closed, but not sealed, including exhaust, intake, makeup air, backdraft and flue dampers; iii. Interior doors shall be open; iv. Exterior openings for continuous ventilation systems and heat recovery ventilators shall be closed and sealed; v. Heating and cooling system(s) shall be turned off; vi. HVAC ducts shall not be sealed; and vii. Supply and return registers shall not be sealed. 7. Section R (N ): Testing. Add a new section as Visual inspection option. Building envelope tightness and insulation installation shall be considered acceptable when the items listed in Table , applicable to the method of construction, are field verified. Where required by code official an approved party independent from the installer of the insulation shall inspect the air barrier and insulation. 8. Section R (N ) Fireplaces. Delete section in its entirety and replace as Fireplaces. New wood-burning fireplaces shall have tight-fitting flue dampers and outdoor combustion air. 9. Section R402.6 (N1102.6) Residential Log Home Thermal Envelope. Add a new section as Residential log home construction shall comply with sections 401 (General), (Air Leakage), (Maximum Fenestration U-Factor and SHGC), (Controls), (Sealing), (Building Cavities), sections through (referred to as the mandatory provisions), Section 404 (Electrical Power and Lighting Systems), and either Subparagraph i., ii., or iii. as i. Sections through 402.3, , and Table 402.6; ii. Section 405 Simulated Performance Alternative (Performance); or iii. REScheck (U.S. Department of Energy Building Codes Program). 10. Table R402.6 (Table N1102.6) Log Home Prescriptive Thermal Envelope Requirements By Component (to be used only in accordance with Subparagraph i. above). Add a new Table as

Section R404.1 (N1104.1) Delete section in its entirety and replace as Lighting equipment (Mandatory). A minimum of fifty percent (50%) of the lamps in permanently installed lighting fixtures shall be high-efficacy lamps or a

11 minimum of fifty percent (50%) of the permanently installed lighting fixtures shall contain only high efficacy lamps. H. Chapters 25 through 34. Delete Chapters in their entirety. Section 3. CITY OF ISLAND PARK AMENDMENT TO THE 2012 INTERNATIONAL BUILDING CODE, INCLUDING APPENDIX I, PATIO COVERS AND APPENDIX J GRADING: A. Chapter 1, Part 2, " Scope and Administration" is amended as 1. Section Title. Replace bracketed "[]" text with the following: "City of Island Park." 2. Section Gas. Delete section in its entirety. 3. Section Plumbing. Delete section in its entirety. 4. Section Property Maintenance. Delete section in its entirety. 5. Section Fire Protection. Delete section in its entirety. 6. Section Existing Structures. Delete in its entirety and replace with the following; The legal occupancy of any structure existing on the date of the adoption of this code shall be permitted to continue without change, except as is specifically covered by this code or as deemed necessary by the building official for the general safety and welfare of the occupants and the public. B. Chapter 1, Part 2, Administration and Enforcement 1. Section 103, Creation of enforcement agency. Delete in its entirety and replace as The Planning and Building Department is hereby created and the official in charge thereof shall be known as the Planning and Building Administrator. 2. Section Appointment. Delete section in its entirety and replace as The Planning and Building Administrator shall be appointed by the Mayor of the City of Island Park and confirmed by majority vote of the City Council. 3. Section Deputies. Delete last sentence. 4. Section Required. Delete section in its entirety and replace as

12 Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any gas or mechanical system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. 5. Section Annual Permit. Delete section in its entirety. 6. Section Work Exempt from permit. Amend the "Building" section as 1. One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area is not greater than 200 square feet (18.58 m 2 ). 11. Swings and other playground equipment accessory to detached one and two family dwellings. 14. Buildings or structures used to facilitate construction projects. Said building or structure shall be removed from the property prior to issuance of any Certificate of Occupancy. 15. Painted and manufactured wall signs not exceeding thirty two (32) square feet installed in accordance with the manufactures or design professionals instructions. This does not preclude or supersede the requirements for signs found in the City of Island Park adopted version of the Development Code. 7. Deleted "Electrical" and "Plumbing" sections. 8. Section Time limitation of application. Delete section in its entirely and replace as Applications for which no permit is issued within one-hundred eighty (180) days following the date of eligibility for permit issuance shall expire, by limitation, and plans and other data submitted for review shall thereafter by returned to the applicant or destroyed by the building official. 13 permit is required and shall be obtained before work shall recommence. The cost of a new permit shall be one-half (1/2) of the cost of the original permit. 10. Section General. Amend section as The building official is authorized to issue a permit for temporary structures and temporary uses. Such permit shall be limited as to time of service, but shall not be authorized for more than 180 days. Service for less than thirty (30) days shall not require a permit. Permits for temporary structures for more than thirty (30) days shall require a permit and shall bear the same fees as permanent structures. The building official is authorized to grant extensions for demonstrated cause. 11. Section Schedule of permit fees. Delete section in its entirety and replace with the following: On buildings, structures, temporary structures, or alterations requiring a permit, a fee for each permit shall be paid in accordance with the fee schedule as established, by Resolution, of the City Council. 12. Section "Reinspection" Add a new Section Reinspection as To obtain a reinspection, the applicant shall pay the reinspection fee in accordance with the fee schedule as established, by Resolution, of the City Council. 13. Section Building permit valuation. Delete section in its entirety and replace as The applicant for a permit shall provide an estimated permit value at the time of application. Permit valuations shall include total value of work, including materials and labor, for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment and permanent systems. The building permit value upon which the building permit fee is based shall be the project valuation as stated in the City of Island Park building permit application or the calculated value using the building permit fee schedule adopted, by Resolution, of the City Council, whichever is greater. Final building permit valuation shall be set by the building official. 14. Section Work commencing before permit issuance. Delete section in its entirety and replace as Any person who commences any work on a building, structure, or temporary structure, before obtaining a necessary permits shall be subject to a fee established by the City Council, by Resolution, that shall be in addition to the required permit fees. 15. Section Refunds. Delete section in its entirety and replace as The City Council, by Resolution, is authorized to establish a refund policy.

14 16.Section 114 Violations Prosecution of violations. Replace building official with Mayor Violation penalties. Delete section in its entirety and replace as Any person who violates a provision of this Ordinance or fails to comply with any of the requirements thereof, or who erects, constructs, alters, or repairs a building or structure in violation of approved plans or construction documents, or a directive of the building official, or of a permit or certificate of occupancy issued under the provisions of this Ordinance, shall be guilty of a misdemeanor, punishable by a fine in any amount not exceeding one thousand dollars ($1,000.00), or by imprisonment for a period of not longer than one hundred eighty (180) calendar days, or by both fine and imprisonment. Each day in which a violation continues shall be considered a separate offense. Deemed violators may be responsible for any cost incurred by the City of Island Park to enforce this Ordinance including City Attorney s fees and court cost Unlawful continuance. Delete paragraph and replace with the following: Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed by the building official to perform to remove a violation or unsafe condition, shall be subject to the penalties as set forth in this ordinance. Chapters 27, 28, and 29. Delete Chapters in their entirety. Section 4: CITY OF ISLAND PARK AMENDMENTS TO THE 2012 INTERNATIONAL WILDLAND URBAN INTERFACE CODE: A. Part 1 - "General Provisions", Section 101, "Scope and General Requirements" is amended as Title. Replace bracketed "[]" text with the following: "City of Island Park." 2. R Appendices. Delete Section and replace as Adopt Appendix A, General Requirements; Appendix B, Vegetative Management Plan; and Appendix C, Fire Hazard Severity Form. B. Part 2 - "Administrative Provisions", Section 102, "Applicability", is amended as 1. Section Existing Conditions. Delete reference to the International Property Maintenance Code and the International Fire Code.

15 2. Section 103 "Enforcement Agency", Section Replace bracketed "[]" text with the following: "Planning and Building Department". 3. Section Appointment. The Planning and Building Administrator shall be the code official for the purposes of administering and enforcing this code. 4. Section 105 "Compliance Alternatives", Section Delete first sentence in its entirety and replace as The code official, in concurrence with a recommendation of the building official and the fire chief, is authorized to approve alternative materials or methods, provided that the code official finds that the proposed design, us or operation satisfactorily complies with the intent of this code and that the alternative is, for the purpose intended, at least equivalent to the level of quality, strength, effectiveness, fire resistance, durability and safety prescribed by this code. 5. Section 107 "Permits", Section delete reference to the International Fire Code. 6. Section In the third paragraph delete the following phrase: "When required by the code official,". 7. Section Work exempt from a permit. Delete entire section and replace as Unless otherwise provided in the requirements of the City of Island Park adopted versions of the international residential code or the international building code, a permit shall not be required for the following: 1. One-story detached accessory buildings used as a tool and/or storage shed, playhouses or similar uses, provided the floor area does not exceed two hundred (200) square feet (18.58 m 2 ). 2. Fences not over six (6) feet (1,829 mm) high. 8. Section Time limitation of application. Delete section in its entirely and replace as Applications for which no permit is issued within one-hundred eighty (180) days following the date of eligibility for permit issuance shall expire, by limitation, and plans and other data submitted for review shall thereafter by returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period of time not to exceed one-hundred eighty (180) calendar days on written request by the applicant showing justifiable cause for the time extension request. No application shall be extended more than once. In order to renew action on an application that has expired, a new application is required, including new fees.

16 9. Section Expiration. Add a third paragraph as If work has not been completed, the final inspection preformed, and the project approved for occupancy or use with two (2) years from the date of issuance, such permit shall expire and become null and void. Prior to work recommencing after the permit has expired, a new permit shall be obtained. The cost of the new permit shall be one-half (1/2) of the cost of a new permit for the work required to complete the building or use. 10. Section 108 "Plans and Specifications", Section 108 General. Delete entire section (keeping the Exception) and replace as Plans, engineering calculations, diagrams and other data shall be submitted in at least two (2) complete sets with each application for a permit. All construction documents shall be prepared by an Idaho register, licensed design professional. When special conditions exist, the code official is authorized to require additional documents to be prepared and submitted by an Idaho register, licensed design professional. 11. Section 109 "Inspection and Enforcement", Section General. Add to the end of this section the following: Said survey shall be conducted by a Idaho licensed land surveyor in compliance with the rules and regulations of the State of Idaho for land surveys. 12. Section "Reinspection". Delete third paragraph in its entirety and replace with the following: To obtain a reinspection, the applicant shall pay the reinspection fee in accordance with the fee schedule as established, by Resolution, of the City Council. 13. Section "Prosecution of violations". Replace building official with Mayor. Replace legal counsel with City Attorney. 14. Section "Violation penalties". Delete section in its entirety and replace with the following: Any person who violates a provision of this Ordinance or fails to comply with any of the requirements thereof, or who erects, constructs, alters, or repairs a building or structure in violation of approved plans or construction documents, or a directive of the building official, or of a permit or certificate of occupancy issued under the provisions of this Ordinance, shall be guilty of a misdemeanor, punishable by a fine in any amount not exceeding one thousand dollars ($1,000.00), or by imprisonment for a period of not longer than one hundred eighty (180) calendar days, or by both fine and imprisonment. Each day in which a violation continues shall be considered a separate offense. Deemed violators shall be responsible for any cost incurred by the City of Island Park to enforce this Ordinance including staff costs and City Attorney s fees and court cost.
