1 -.. ORDINANCE NO. An ordinance authorizing the execution of the development agreement by and between the City of Los Angeles and City Centre Development, a California Limited Partnership (*Developer ), relating to that real property in the Central City Plan area laying between Eighth Street on the north, Ninth Street on the south, the Harbor Freeway on the west and Francisco Street on the east, except the State-owned property adjacent to the Harbor Freeway (the Project Site ). WHEREAS, The Project Site is located within the boundaries of the Redevelopment Plan for the Central Business District Redevelopment Project; and WHEREAS, the City and the Community Redevelopment Agency of the City ("CRA") are desirous of redeveloping the Project site in a unified and coordinated manner; and WHEREAS, the Developer has now obtained all major governmental approvals for the Project including (i) a final Environmental Impact Report certified by the CRA in, (ii) a TFAR Plan and owner Participation Agreement approved by the CRA on February, 0 and by City Council on August, 0, (iii) a tentative tract map approved by the Advisory Agency on March,, and (iv) a Resolution to Vacate certain public streets within the Project site approved by City Council on June, ; and - - /

2 WHEREAS, City and the Developer are now desirous of assuring development of the Project Site in accordance with the owner Participation Agreement; and WHEREAS, The City Planning commission on July,, approved and recommended that the City Council approve the development agreement which is attached to Council File No. qd-!";(,q by and between the City of Los Angeles and City Centre Development ("Development Agreement ), which agreement is hereby incorporated by reference into the provisions of this ordinance: and WHEREAS, pursuant to California Government Code Sections et seqa the City Planning Commission has transmitted its findings and recommendations; and WHEREAS, after due notice the City Planning Commisslon and the City council did conduct public hearings on this matter; and WHEREAS, the City Council has determined the Development Agreement is in the public interest and is consistent with the City's General Plan including the Central City Community Plan and with the zoning code for the City of Los Angeles: and WHEREAS, The City Council has reviewed and considered the Development Agreement and the findings and recommendation of the City Planning Commission: - -

The City Council finds and determines, that the subject Development Agreement is exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant to Article III, Section.i of the City's CEQA Guidelines and hereby adopts the Notice of Exemption issued on December,. Sec.. The City Council finds, with respect to the Development Agreement which is attached to Council File No. 'b-nl, that: (a) It is consistent with the City's General Plan and with the objectives, policies and programs specified in the Central City Community Plan, a portion of the City's General Plan, and is consistent with the Redevelopment Plan for the Central Business District Redevelopment Project: (b) The intensities, building heights and uses set forth in the Development Agreement are permitted or are consistent with the regional center commercial designation in the Central city community Plan; - -

(c) It will not be detrimental to the public health, safety and general welfare since it encourages the construction of a project which is desirable and beneficial to the public. Furthermore, the Development Agreement specifically permits application to the project of rules and regulations under the City Municipal Code Sections.0 to.00 relating to public health and safety: (d) It complies with all applicable City and State regulations governing development agreements; and (e) It is necessary to strengthen the public planning process and to reduce the public and private costs of development uncertainty. Sec.. The City Council hereby approves the Development Agreement by and between the City of Los Angeles and City Centre Development, in the form attached to Council File No. 0 D(.,{,i,, and authorizes and directs the Mayor to enter into said Agreement in the name of the City of Los Angeles, and further directs the City Clerk to record said Agreement and this Ordinance with the County Recorder within ten () days of its effective date of adoption. - - pvt\altrcmt\orumcc
