2 Report of Review Committee Township of Mahwah Requests for Qualifications December 28, 2012 Contract Period Commencing January 1, 2013 The Township of Mahwah has solicited Requests for Qualifications (RFQ s) for Professional Services Contracts for the period commencing January 1, 2013 through December 31, RFQ s for professionals were prepared to meet the Fair and Open Pay to Play legislation requirements of N.J.S.A. 19:44A-20.5 et seq. The Professional Service Contracts will be awarded in accordance with the Public Contracts Law requirements of N.J.S.A. 40A:11-5 et seq. The Review Committee generally followed the recommendations of the Best Practices for Awarding Service Contracts from the Office of the State Comptroller and the Guide to the New Jersey Local Unit Pay to Play Law from the Department of Community Affairs. Issuance of the Requests for Qualifications was accomplished by advertisement on the Township s web site on November 9, RFQ s were received and publicly opened in the Administration conference room on December 11, 2012 except for Utilities Engineer RFQ#12-9A, which was extended to December 28, A Review Committee of three persons was appointed by Township Council resolution. The members of the committee met on December 26, 2012, December 27, 2012, and December 28, 2012 to evaluate the RFQ s. As announced in the RFQ Packages, the criteria for evaluation were: 1. Experience and reputation in the field; 2. Knowledge of the Township and the subject matter addressed under the contract; 3. Availability to accommodate the required meetings of the Township; 4. Compensation proposal. Numerical score sheets were completed for each submission. The Committee s award recommendations for each professional service are set forth in the attached recommendations. The recommendation for Township Auditor is made to the Township Council which appoints the Township Auditor. The other Professional Services recommendations are made to the Mayor who makes the appointments with the advice and consent of the Council RFQ s Page 2

3 1. RFQ#12-1A Recommendation December 28, Township Attorney Four responses were received for the Township Attorney position. Archer & Greiner, P.C. Nasta Attorney at Law 32 Old Stone Church Road Upper Saddle River, NJ Randall & Randall, LLP 287 Kinderkamack Road Westwood, NJ The proposals met all technical qualifications. However, Archer & Greiner, P.C., appeared to be most knowledgeable about the Township of Mahwah and its requirements. Thus, the Committee recommends award of the Professional Services agreement for Township Attorney to: Archer & Greiner, P.C. Attorneys at Law Court Plaza South, West Wing 21 Main Street, Suite 353 Hackensack, NJ RFQ#12-2A Recommendation December 28, Township Auditor There were two responses received for Township Auditor. Louis C. Mai CPA & Associates P.O. Box 624 Pompton Plains, NJ McEnerney, Brady & Company LLC 293 Eisenhower Pkwy., Ste. 270 Livingston, NJ Both firms satisfied the technical requirements of the RFQ. Both firms have substantial experience in the field. Both submittals were scored equally for compensation purposes for preparation of the audit. Louis Mai has demonstrated an exceptional knowledge of the workings of the Township and its departments and has a demonstrated history of availability to 2012 RFQ s Page 3

4 accommodate the needs of the Township. Therefore, the recommendation is to award the Auditor Professional Service contract to: Louis C. Mai CPA & Associates P.O. Box 624 Pompton Plains, NJ RFQ#12-3A Recommendation December 28, 2012 Township Bond Counsel All three submittals satisfied the technical requirements of the RFQ. McManimon & Scotland L.L.C Raymond Blvd. Suite 400 Newark, NJ Parker McCay, P.A Midlantic Dr. Suite 300 Mt. Laurel Wilentz,Goldman & Spitzer, P.A. 90 Woodbridge Center Dr. Woodbridge, NJ The compensation proposals were comparable. McManimon & Scotland have demonstrated the most impressive experience in this field. McManimon & Scotland has demonstrated knowledge of the needs of the Township of Mahwah. McManimon & Scotland has also demonstrated experience with applications to the New Jersey Local Finance Board. Therefore, the Township recommends award of the Professional Service contract for Township Bond Counsel to: McManimon & Scotland, L.L.C. Attorneys at Law 1037 Raymond Blvd. Suite 400 Newark, NJ RFQ#12-4A Recommendation December 28, 2012 Township Co-Public Defender There were four responses to the RFQ for the two Co-Public Defenders. Prelich-Passaro, Esq. 155 Polifly Road Hackensack, NJ RFQ#12-5A Recommendation December 28, Township Engineer There were four responses to the RFQ for Township Engineer. Boswell McClave Engineering 330 Phillips Avenue South Hackensack, NJ CME Associates 3141 Bordentown Ave. Parlin, NJ08859 Matarazzo Engineering 575 Route 46 West Fairfield, NJ Suburban Consulting Engineers, Inc. 100 Valley Rd. Ste. 202 Mount Arlington, NJ All four respondents were technically qualified. The compensation proposals were within a comparable range. The Committee looked for a combination of experience as a day to day advisor on municipal issues and as project engineer for municipal construction projects and grant funded projects. Most of the respondents were satisfactory in these areas. However, Boswell McClave appeared to be most knowledgeable about the Township of Mahwah and its requirements and also appeared to be most available on a daily basis. Thus, the Committee recommends award of the Professional Services agreement for Municipal Engineer to: Boswell McClave Engineering 330 Phillips Avenue South Hackensack, NJ Boswell Engineering is also qualified to perform Utility Engineering if selected RFQ s Page 5

The Committee looked for a combination of experience as a day to day advisor on municipal issues. Most of the respondents were satisfactory in these areas. However, PIA McCarthy Forde appeared to be most knowledgeable about the Township of Mahwah and its requirements. Thus, the Committee recommends award of the Professional Services agreement for Township Insurance Agent/Risk Manager to: PIA McCarthy Forde 429 Hackensack Street P.O. Box 818 Carlstadt, NJ RFQ#12-7A Recommendation December 28, Township Planner There were four responses to the RFQ for Township Planner. 7 experience as a day to day advisor on municipal issues and as project planner for municipal land use, affordable housing and development projects. Most of the respondents were satisfactory in these areas. However, Maser Consultants appeared to be most knowledgeable about the Township of Mahwah and its requirements and also appeared to be most available on a daily basis. Thus, the Committee recommends award of the Professional Services agreement for Municipal Planner to: Maser Consulting PA 53 Frontage Rd., Ste.120 Perryville III Corp. Park Clinton, NJ RFQ#12-8A Recommendation December 28, Township Prosecutor One response was received for the Township Prosecutor position. The proposal met all technical qualifications. The response was from the current Prosecutor. The Committee recommends award of the contract for Township Prosecutor to: Dennis G. Harraka, Esq. 6 Valley View Drive Ramsey, NJ RFQ#12-9A Recommendation December 28, Township Utilities Engineer There were four responses for the position for Township Utilities Engineer. Hackensack, NJ Malcolm Pirnie The Water Division of Arcadis Route 208 North Fair Lawn, NJ CMEAssociates 3141 Bordentown Ave. Parlin, NJ T & M Associates 11 Tindall Road Middletown, NJ The proposals met all technical qualifications RFQ s Page 7

8 The Township operates a water utility which produces and distributes potable water. The sewer department operates and maintains a waste water collection system which sends effluent to a regional treatment center in Waldwick, New Jersey. Engineering expertise in the potable water area is the more significant of the two operations. All respondents demonstrated knowledge and expertise, in this area. Malcolm Pirnie The Water Division of Arcadis and Boswell Engineering have the experience and knowledge of the location and the operation of the Mahwah water and sewer systems. Since all applicants are qualified and were rated with similar scores the committee does not make an individual recommendation to the Mayor. The Township may consider having the Municipal Engineer perform most of the utility work with outsourcing special projects by RFP s on an as needed basis. 10. RFQ#12-10A Recommendation December 28, 2012 Township Real Estate Tax Appeal Appraisal Consultant There was one response for the position of Township Real Estate Tax Appeal Appraisal Consultant. The proposal met all technical qualifications. The response was from the current Real Estate Tax Appeal Appraisal Consultant. The Committee recommends award of the contract for Township Real Estate Tax Appeal Appraisal Consultant to: McNerney & Associates, Inc. 266 Harristown Road P.O. Box 67 Glen Rock, NJ RFQ#12-11A Recommendation December 28, 2012 Township Tax Appeal Attorney There were eight responses for the position of Township Tax Appeal Attorney. Eric M.
