1 Carpinteria Valley Water District Memo To: Directors From: Charles Hamilton, General Manager Date: September 10, 2014 Re: Water Truck operations in the Carpinteria Valley Recommendation: Consider directing the General Manager to prepare and provide information to customers about water trucking in the Carpinteria Valley and its potential effects on their drinking water supplies (for possible Board action on September 24, 2014). Discussion: As you know there has been a great deal of publicity about water trucks in the Carpinteria Valley delivering water to buyers in Montecito. The District has received numerous inquiries. n general there is concern and criticism that certain well owners are exporting water from the Carpinteria Groundwater Basin for personal profit and in doing so depleting the local groundwater resource to the disadvantage of all other groundwater users in the Valley including the Carpinteria Valley Water District. am personally aware of three customers in the District who have been selling and trucking their well water. As of the date of this memo, two of the three have since notified me that they have discontinued the sale and trucking of their well water. District Rules and Regulations (No. 23 Resale of Water) prohibit the re-sale of potable or drinking water delivered by the District to any other customer or person, or on other premises than specified in their applications for service.. without the prior written consent of the District. The District, however, has no authority over a customer's use or disposition of their private well water. However, the trucking of water offsite by a party located in the unincorporated area of the County is not permitted by the County in zone districts in the Coastal Zone such as AG-1 or AG-. Most of the Carpinteria Valley Ag land is zoned AG-, and so most of the well owners in the Carpinteria Valley are not permitted to engage in water trucking. (See attached Page 1
2 Carpinteria Valley Planning Map). For land designated as RR, R-1/E1, R-2, EX-1, DR, PRD, SR- M, SR-H, and MHP a Minor Conditional Use Permit is required for this activity by the County. (See attached excerpt of Santa Barbara County Code). To report a zoning code violation a person can fill out the attached form (copy attached) found on the County Planning & Development s website or in the south county call (805) Relative to State law concerning such activity involving the sale of groundwater from a private well, it is possible that an adjoining property owner with a well could file a claim in court (not against the District) if said party is able to show that he/she is being damaged by a loss in water on his property caused by the adjacent groundwater pumper s use and export of groundwater from his property. Most water trucks carry no more than 5,000 gallons of water. t would take over 65 truckloads of this quantity to reach an acre foot of water. n the short term the loss of this amount of water, or even as much as 5 acre feet, does not pose a serious immediate threat to the Carpinteria Groundwater Basin as a whole. The Basin currently sustains up to about 4,000 AF of groundwater extraction/year. Further, depending on the aquifer (A, B, C or D) from which this water may be pumped by a private well owner from the Carpinteria Groundwater Basin, and/or if the water is perched water just below the ground level, and of poor quality not suitable for most agricultural and/or drinking water uses, its pumping and extraction may not have an appreciable impact on the District s groundwater supply. But over time, if the practice continues or even increases, it possibly could. Page 2
