3 Performance Assessment Measures for Air Pollution Prevention and Control Action Plan (For Trial Implementation) Article 1 For purposes of strictly implementing responsibilities on the prevention and control of air pollution, intensifying supervision and management, and therefore accelerating improvement of air quality, these measures are formulated in accordance with the following notices: Notice of the State Council on Issuing Air Pollution Prevention and Control Action Plan (No. 37[2013] of the State Council) and the Notice of the State Council on Issuing the Plan on the Division of Work among Key Department Engaged in Air Pollution Action Plan Prevention and Control (No. 118[2013] of General Office of the State Council). Article 2 These measures shall be applicable to the annual assessment and final assessment of the people s governments of all provinces (autonomous regions and municipalities) pertaining to their implementation of Air Pollution Prevention and Control Action Plan (hereafter referred to as the Ten Measures on Air). Article 3 Assessment indicators include two aspects, namely achievement of targets set for improving air quality and achievement of key tasks on the prevention and control of air pollution. Annual concentration reduction rate of fine particles (PM 2.5 ) and inhalable particles (PM 10 ) in regions shall be regarded as indicators of assessment towards achievement of air quality improvement targets. Annual concentration reduction rates of PM 2.5 shall be taken as assessment indicators in the following cities: Beijing-Tianjin-Hebei and surrounding areas (Beijing, Tianjin, Hebei province, Shanxi Province, Inner Mongolia Autonomous Region, Shandong province), Yangtze River Delta Region (Shanghai, Jiangsu province and Zhejiang province), Pearl River Delta Region (9 cities in Guangdong province, namely Guangzhou, Shenzhen, Zhuhai, Foshan, Jiangmen, Zhaoqing, Huizhou, Dongguan and Zhongshan) and Chongqing. With respect to other areas, annual concentration reduction rate of PM 10 shall be regarded as assessment indicators. Achievement of key tasks on the prevention and control of air pollution shall be assessed based on the following 10 indicators: adjustment and optimization of industrial structure, clean production, coal management and oil supply, rectification of coal-fired boilers in small size, industrial air pollution control, urban dust pollution, vehicle emission prevention and control, energy efficiency in buildings and heat metering, capital investment in the prevention and control of air pollution, as well as management of atmospheric environment. Definition of indicators, assessment requirements and scoring system will be released by Ministry of Environmental Protection separately after discussions with relevant departments Article 4 The scoring method shall be applied in the annual assessment. 100 points is the full mark for assessing achievement of air quality improvement targets and key tasks on the prevention and control of 1 China Clean Air Updates 2014 CAAC
4 air pollution. Comprehensive assessment results are divided into four grades, namely excellent, good, pass, and fail. Final assessment and annual assessment of regions in China except Beijing-Tianjin-Hebei and surrounding areas, Yangtze River Delta Region and Pearl River Delta Region shall only take into consideration achievement of air quality improvement targets. Article 5 Local governments shall be the responsible bodies to implement the Ten Measures on Air. The people s governments of all provinces (all peer level autonomous regions and municipalities under central government) shall, in accordance with prescribed targets of air quality improvement, formulate detailed implementation rules and annual work plans on the Ten Measures on Air. Targets and tasks shall be broken down to the people s governments at city (prefecture) and county level. Key tasks shall be implemented into relevant departments and enterprises. Moreover, annual targets of air quality improvement shall be identified and efforts shall be made to carry out reasonable arrangement of key tasks and implementation schedules of projects. It shall identify funding sources, supporting policies, departments in charge, and safeguard measures. As significant a basis for assessment, detailed implementation rules, and annual work plans shall be disclosed to the public and submitted to the Ministry of Environmental Protection. Article 6 The people s governments of all provinces (autonomous regions and municipalities) shall, in accordance with assessment requirements, develop work accounts and carry out self-inspection on the implementation of the Ten Measures on Air. Self-inspection reports of the previous year shall be submitted to the Ministry of Environmental Protection by the end of every February and copies shall be forwarded to National Development and Reform Commission, Ministry of Industry and Information Technology, Ministry of Finance, Ministry of Housing and Urban-Rural Development and National Energy Administration. Self-inspection reports shall include information on air quality improvement, key tasks, progresses of control projects, and investment status. Article 7 Ministry of Environmental Protection will, together with National Development and Reform Commission, Ministry of Industry and Information Technology, Ministry of Finance, Ministry of Housing and Urban-Rural Development and National Energy Administration, take responsibilities for conducting assessments and reporting assessment results to the State Council by the end of May each year. Article 8 Assessment results shall be disclosed to the public after approval of the State Council and transferred to cadre competent authorities that shall, in accordance with Opinions on Establishing Assessment and Evaluation Mechanism for Promoting Scientific Development of Party and Government Leading Group and Leading Cadres, Measures on Comprehensive Assessment and Evaluation of Local Party and Government Leading Group and Leading Cadres (for Trial Implementation), Notice on Improving Achievement Assessment of Local Party and Government Leading Groups and Leading Cadres, Opinions on Carrying out Pilot Work of Government Achievement Management, take these assessment results as 2 China Clean Air Updates 2014 CAAC
5 significant basis for comprehensive assessment and evaluation of leading group and leading cadres in regions. Assessment results are significant for receiving special funds allocated by central finance to prevent and control air pollution. More supports from central finance shall be given to the ones excellent in assessment results. Those unqualified shall be given appropriate deduction. Article 9 With respect to regions failing to pass the annual assessment, Ministry of Environmental Protection will, together with organization departments and supervisory organs, arrange talks with persons in charge from the people s government of provinces (autonomous regions and municipalities) and relevant departments, put forward opinions on rectification, supervise and urge for improvement. With respect to new construction projects causing air pollutants in relevant responsible cities of these regions, it shall suspend approval of environmental impact assessment and cancel the provision of Environmental Protection honors previously awarded by national government. With respect to regions failing to pass the final assessment, approval of environmental impact assessments of all new construction projects causing air pollutants in these regions shall be suspended (with exception of people s livelihood projects and energy-saving projects). It shall increase efforts on accountability. Leaders of the State Council will arrange talks with principal persons in charge from the people s governments of provinces (autonomous regions and municipalities) when necessary. Article 10 Where monitoring data have been tampered with and forged, assessment results shall be identified to be disqualified. Supervisory organs will, in accordance with relevant stipulations in the Ten Measures on Air, severely investigate responsibility of relevant units and staffs in accordance with rules. Article 11 The people s governments of all provinces (autonomous regions and municipalities) may, in accordance with these measures, carry out assessment of local implementation of the Ten Measures on Air in consideration of their local contexts. Article 12 Ministry of Environmental Protection shall be responsible for the interpretation of these measures. 8 Clean Air Alliance of China (CAAC), initiated by 10 key Chinese academic and technical institutions in clean air field, aims at providing an integrated clean air collaboration platform in China for academic and technical institutions, provinces and cities, non-profit organizations and enterprises. The overarching goal is to improve air quality in China and mitigate the negative impacts on public health due to air pollution.
