4 Recycling as an Alternative to Waste Retail model: Use hazardous waste programs for many unsold, expired and/or damaged products Requirements and costs of hazardous waste programs - and a desire to be greener are driving retailers to look for product end-of-life alternatives Shipping materials from one facility to another, only to dispose of them after shipment, has often been interpreted to be waste shipment and disposal (Possible partial future solutions - USEPA) 4

5 Regulatory Tools for Recycling Conditionally Exempt Generator Continued Use Universal Waste Use as an Ingredient or Substitute Reclamation of Commercial Chemical Products 5

6 Conditionally Exempt Small Quantity Generator (CESQG) No hazardous waste manifest for shipping (usually) Usually time/waste pickup advantages Materials can go to a beneficial use facility Technical approach to waste management What to watch out for: Generator status assumptions Any state CESQG requirements/differences Still have DOT/shipping rules Work with your environmental folks! 6

11 Reclaimed Commercial Chemical Products Reclamation (via chemical, heat, etc.) of usable materials for the same intended use Contaminated or off-specification gasoline with water, where the gasoline is reclaimed for fuel What to watch out for: Must start with and extractable/usable material Some states don t allow or may restrict this option Must have a legitimate reuse recovered material has a market Documentation 11
