Purpose The purpose of this policy is to inform staff of their responsibilities as employees of the Region One Education Service Center. B. Persons Affected This policy applies to all Region One Education Service Center staff. C. Policy CKD (LEGAL) Safety Program/risk Management - Security CL (LOCAL) Buildings, Grounds and Equipment Management DC (EXHIBIT) Employment Practices DH (LEGAL): Employee Standards of Conduct DH (LOCAL): Employee Standards of Conduct DH (EXHIBIT) Employee Standards of Conduct DI (LEGAL) Employee Welfare Each employee shall comply with the standards of conduct set out in this policy and with any other policies, regulations, and guidelines that impose duties, requirements, or standards attendant to his or her status as an ESC employee. Violation of any policies, regulations, or guidelines may result in disciplinary action, including termination of employment D. Definitions Capri Pants end above the ankle and traditionally come to about mid-calf Cargo Pants have several large pockets, most often with button, snap or Velcro closable flaps. Crop Pants are a bit longer in length and end at just about the ankle, grazing it rather than ending on the calf E. Responsibilities Each employee shall comply with the standards of conduct. 1

2 F. Procedures The ESC Dress for Excellence Code - Professional Appearance and Grooming Appearance and grooming of ESC employees represents the ESC and shall exhibit professionalism. Apparel shall be clean, neatly pressed, fit properly and appropriate for the day s assignment. Clothing should not appear too tight, short in length, distressed or in need of repair. This dress code is for Monday - Thursday during the regular school year. (Friday/Summer dress code is listed below). Appropriate Professional attire for ESC staff shall be: Women business coordinates, dress/casual slacks, blouse, sweater, pant/skirt/dress suits, or business dresses** Skirt/Dress length must be no shorter than the top of the kneecap while standing. Side and back slits can extend no more than two inches above the knee. A suit or dress coat, dress/casual slacks, shirt and tie is required for school district visits, workshop presentations, conference participation, and other outside meetings.** Jackets are not required for in office days. Neatly-trimmed mustaches/beards and sideburns and hair length no longer than the top of the collar footwear should be safe and appropriate for professional business attire. Appropriate attire for Friday and Summer Schedule ONLY shall be: Dress/Casual style slacks, Crop or Dress Capri Pants, Polo/Golf Type Blouses, and ESC staff shirts. Blouses and/or skirts made of denim are permitted. ** Dress/Casual style slacks, Polo/golf type, ESC staff, guayaberas, button down or denim shirts. With the exception of guayaberas, all shirts must be tucked in. Ties are not required. The ESC Dress for Excellence Code does not allow for: Extreme apparel or hair styles or color Revealing apparel Jeans or colored denim pants Shorts, Skorts and Cargo pants Tank tops, or inappropriate sleeveless shirts/dresses/blouses Leggings Bare or Stocking feet, Flip-flop style or Tennis/athletic footwear Exposed Body Piercings nose, lip, brow, etc. Exposed Tattoos 2

3 Rattails/Ponytails on Male Employees Earrings on Male employees Operations and Technology Support Staff Staff members are provided uniforms once a year and are responsible for maintaining uniform cleanliness and appearance. Staff members will wear uniforms at all times during normal working hours with the exception of Friday staff shirt day. Upon separation of employment, the staff member must return all uniforms to the ESC. ECI Case Managers ECI Case Managers will dress in a manner appropriate for their community based setting. (i.e., Scrubs or loose khakis with shirts/blouses and tennis shoes are acceptable) Staff Compliance All Staff are responsible for following The ESC Dress for Excellence Code. Failure of staff to adhere to these standards will result in appropriate disciplinary action. Specific questionable deviations from the dress code should be referred to the Deputy Director(s) for review. The ESC Dress for Excellence Code has been established for Region One Staff and may be changed at any time by the Executive Director. When staff members are found to be in non-compliance with dress code, their immediate supervisor will give them a verbal warning/reminder of the dress code. If there is a second offense, the supervisor will issue a written notification to the employee and they will be sent home to change. Third offense will be a formal HR write up and placed in the employee s file. Supervisor will contact HR to inform them of the issue prior to employee write up. Dress Code Exceptions Any exceptions to this dress code due to medical issue or an assigned duty (i.e., Conference Set-Up Day, Warehouse or Office Clean Out Day, etc.) must be approved by supervisor prior to day of assignment. ** ** (If ESC staff member is to present at a workshop or train at a district, then Professional Attire should be worn). Summer Schedule applies during June, July and August as announced by the Executive Director s Office. 3

5 Immunity from Liability An employee or volunteer of an ESC is immune from liability to the same extent as an employee or volunteer of a school district. (Education Code 8.006) Public Servants All ESC employees are public servants and subject to Title VII of the Penal code, regarding offenses against public administration, including bribery and corrupt influence to perjury and or to falsification, obstructing governmental operation and abuse of office. All ESC employees shall perform their duties in conformity with ESC policy, ethical standards for professional educators, and state and federal law. Weapon Free Workplace Employees shall not carry or in any manner possess, whether or not concealed, a firearm, handgun, club, explosive weapon, knife, knuckles, hoax bomb, chemical dispensing device, or dangerous weapon as defined in the Penal Code, on the premises of the ESC or at any event sponsored by the ESC. Any person who brings a weapon onto the premises will be in violation of this policy and will be removed. If such person is an employee, he or she may face disciplinary action. Any person refusing to leave may be charged with criminal trespassing. Arrests, Indictments, Convictions, and Other Adjudications An employee shall notify the Director for Human Resources within three calendar days of any arrest, indictment, conviction, no contest or guilty plea, or other adjudication of the employee for any felony, any offense involving moral turpitude, and any of the other offenses as indicated below: Crimes involving ESC property or funds; Crimes involving attempt by fraudulent or unauthorized means to obtain or alter any certificate or permit that would entitle any person to hold or obtain a position as an educator; Crimes that occur wholly or in part on ESC property or at an ESC-sponsored event or activity; or Crimes involving moral turpitude, which include: Dishonesty, fraud, deceit, theft, misrepresentation; Deliberate violence; Base, vile, or depraved acts that are intended to arouse or gratify the sexual desire of the actor; Drug or alcohol related offenses Acts constituting abuse under the Texas Family Code 5

6 Pest Control Treatment Notice The Director of Operations and Facilities and Operations notifies persons who work in the building that it will receive an indoor pest control treatment. Auto Insurance Coverage In the conduct of ESC business, the Region One ESC employee s personal auto coverage applies as primary coverage. If additional liability coverage in excess of what is provided by the employee s coverage is needed, the ESC s auto liability coverage may apply to liability claims presented subject to the limits of liability coverage. The ESC does not provide physical damage coverage for damage to an employee s vehicle used in the conduct of ESC business. Employees who use their personal vehicle in the conduct of ESC business are required to maintain liability coverage on their personal auto in compliance with the Texas Motor Vehicle Safety Responsibility Act and to maintain a valid driver s license. 6
