The Food Waste Programme

Food Waste Treatment Hubs North East Hub Conwy, Denbighshire, Flintshire Central Wales Ceredigion and Powys Heads of the Valleys Caerphilly, Blaenau Gwent and Torfaen South West Bridgend, Carmarthenshire, Neath Port Talbot, Pembrokeshire, Swansea [Vale of Glamorgan] Prosiect GwyriAD Gwynedd Tomorrow s Valley RCT and Merthyr Tydfil Newport

Programme Timetable Hubs in Central pre-qualification process OJEU - August 2009 Pre-qualification end - October 2009 Hubs commence procurement - November 2009 onwards 12 months (estimate) to appointment of preferred bidder November 2010 Planning

Planning Taskforce Reason for establishing Ministerial Programme Board request for Planning Risk Assessment January 2009 Planning Risk Paper Ministerial Programme Board March 2009 Objectives Risks identified in the Planning Risk Paper Mitigate risks Support local solution development Terms of Reference

Planning Taskforce Members Hazel Nickless, Dawn Brace, Andrew Garcia, Gemma George, Tal Maynard from WPPO WAG Adrian Jones - WAG Waste Strategy Branch Chloe Chadderton Institute of Society, Health and Ethics Aled Davies - DE&T Daryl Hill - PUK, Julie James - Clarkslegal Rachel Jowitt - WLGA Karen Maddock Jones - Countryside Council for Wales Ceri Morris - Coordinator Regional Waste Plan Tim Patterson - Centre of Excellence for AD Joanne Smith - WAG Planning Phil Williams - Chair of POSW Anthony Wilkes, Cathy O Brien, Huw Davies and Caroline Drayton - EA Wales Beth Winkley - WRAP.

Commercial issues Competition Sites held by Authority Focus on solutions rather than sites Site selection Risk in relation to planning and permitting Standard form drafting assumes planning sought after contract close Position if externally funded Judicial Review

Authority Choices Assuming site available: do nothing, leave everything to the contractor; apply for full planning consent; apply for outline planning consent; Undertake core non-detailed solution specific tasks required for any planning application.

Do Nothing Timing issue, planning programme will only commence once preferred bidder is identified No cost outlay for Authority If alternative site is preferred solution, no wasted costs. Some bidders would prefer this way forward, giving site owners competitive advantage Uncertainty as to planning outcome/deliverability

Full Planning Consent Possible complete wasted costs. Bidders may be reluctant to accept design risk in facility. Will require changes to planning consent after contractor appointed. Assists with timing issues, construction potentially can commence as soon as contract signed. Gives bidders/funders comfort as to deliverability of the project. Authority needs to manage/resource the application.

Outline Planning Consent Would assist in future full planning application by contractor Is it possible to secure outline planning consent for a waste facility? Is there any real value in having an Outline Planning Application? Is the position different in the case of an AD Is the position different in the case of an AD facility/efw or other major waste disposal facility?

Preparatory Work What can the Authority properly carry out that will contribute to the planning application? Traffic Impact Assessment? Other elements of the EIA? Public consultation? Site surveys Ground conditions Contamination Task Force initiatives

Conclusion Planning is a significant risk in waste projects: timing risk even if permission granted project fails if planning permission not granted potential for increased project costs if onerous conditions applied funding is dependent on planning reality Authorities need sites which must be suitable in planning terms All involved in planning matters need to work together
