4 PROCEDURE MANUAL FOR USE OF METRO VANCOUVER TRUCKED LIQUID WASTE (TLW) FACILITIES OVERVIEW OF THE TRUCKED LIQUID WASTE PROGRAM Metro Vancouver currently operates Domestic trucked liquid waste (TLW) facilities at the Northwest Langley, Annacis Island and Iona Island Wastewater Treatment Plants (WWTP). These Domestic TLW facilities were established in order to provide a domestic waste disposal service to homeowners living within Metro Vancouver, but whose residences are not connected to a municipal sanitary sewer. These residences discharge domestic wastewater to on-site treatment systems (holding or septic tanks), that must be pumped out periodically to ensure the maximum storage capacity of the tank is not exceeded. Waste disposal companies, known as Carriers, pump out the tank and the material collected is taken to a TLW facility for disposal and treatment. Metro Vancouver also operates a Non-Domestic TLW facility at the Iona Island WWTP. This service provides a disposal and treatment option for commercial, industrial and institutional operations that generate an organic waste from on-site wastewater collection and treatment systems. These treatment systems are usually connected to municipal sanitary sewer systems and are used to pretreat wastewater which (if left untreated) could, by itself or in combination with another substance, obstruct flow or interfere with the operation of a sewer or sewage facility. These collection and treatment systems need to be cleaned out periodically before maximum storage capacity is exceeded. The organic material, which must be authorized by Metro Vancouver, Regulation & Enforcement staff prior to disposal, is collected by a Carrier and taken to the Non-Domestic TLW facility for disposal and treatment Overview of Wastes Accepted at Metro Vancouver TLW Facilities Only wastes generated within the boundaries of Metro Vancouver will normally be accepted for disposal. Possible exceptions may be considered on a case by case basis. If you are seeking to dispose of a waste from outside Metro Vancouver boundaries, please call Metro Vancouver, Environmental Regulation & Enforcement at (604) Northwest Langley WWTP Due to the small size of the Northwest Langley plant and its limited capacity to process high strength wastes, TLW disposals are limited to Domestic Waste collected from holding tanks within the Township of Langley. Holding tank wastes from other communities may be accepted if pre-approved for disposal by Northwest Langley WWTP staff. Annacis Island WWTP The Annacis Island plant can accept all types of Domestic Waste from all areas of Metro Vancouver. Non-Domestic Waste will not normally be accepted at the Annacis facility except by prior approval by both wastewater treatment plant Environmental Regulation & Enforcement staff. 5 Iona Island WWTP The Iona Island plant can accept all types of Domestic Waste from all areas of Metro Vancouver. In addition, properly authorized Non-Domestic Wastes will be accepted for disposal. To obtain an authorization number for Non-Domestic TLW, please call Metro Vancouver, Environmental Regulation & Enforcement at (604) Authorizations Non-Domestic Waste must be pre-approved and authorized prior to disposal at the Iona Island TLW facility. To obtain an Authorization the waste generator must complete TLW Form A, Application to Discharge Non-Domestic Waste at the Iona Island Wastewater Treatment Plant Trucked Liquid Waste Facility and submit the application to Metro Vancouver, Environmental Regulation & Enforcement Division. An Authorization is issued subject to confirmation that the waste meets the terms and conditions for use of the TLW facility. If approved, an Authorization Number is assigned to the identified waste stream. The Authorization will also include any special conditions under which the waste must be collected and disposed. The Authorization Number must be quoted on each occasion that the waste is taken for disposal. Please note that a separate Authorization is needed for each waste at a given facility. Generators should allow up to 5 working days for processing of applications, and longer if wastewater contaminant profile data is requested. Authorizations are issued for both ongoing discharges and specified-term discharges. Authorizations may be cancelled if inactive for a period of 12 months. Specified-Term Authorizations expire on the date identified in the Authorization. In either case, a new Authorization will be required for subsequent disposal of the waste. If a waste is determined to be unacceptable for discharge at the WWTP, the generator will be notified of the denial of the Authorization and the application will be kept on file for future reference. Credit Accounts Only Carriers that have a valid credit account with Metro Vancouver are allowed access to Metro Vancouver TLW facilities. To establish a credit account, a Carrier must complete TLW Form B, Carrier Credit Application for Use of Trucked Liquid Waste Facilities Operated by Metro Vancouver. As noted in the application, three credit references are required. Please submit the application to Metro Vancouver, Corporate Services, Environmental Regulation & Enforcement Division, 4330 Kingsway, Burnaby, B.C. V5H 4G8. Allow at least 10 working days for processing of the credit application. Gate Passcards Access to the Iona Island and Annacis Island WWTPs is controlled by electronically activated gates. Carriers will be issued gate passcards for each of their trucks once their credit account has been established. Disposal Fees and Invoice TLW disposal fees apply to both Domestic and Non-Domestic Wastes. The TLW program is a userpay system, meaning that the costs of operating the TLW facility and treating the waste are recovered. The disposal charge for each load is based on the appropriate disposal fee and is prorated to the actual volume of the discharge. The disposal fee is reviewed and re-calculated on an annual basis. 6 During the first week of each month, the Carrier will be invoiced for all waste loads disposed of in the previous month. Payment in full must be made within 30 days of the invoice date. Overdue amounts will be subject to an interest penalty of 1.25 % per month. Credit privileges may be suspended for nonpayment. Payment by cash or credit card at the time of disposal cannot be accepted at the TLW facility. Manifest The Carrier must identify all wastes taken for disposal to TLW facilities by completing TLW Form C, Manifest of Liquid Waste Collected for Disposal at Metro Vancouver Trucked Liquid Waste Facilities. The manifest must identify the origin of all generator wastes which make up the load and include an accurate description of each waste. For Non-Domestic Wastes, an Authorization Number must also be noted. At the Iona Island and Northwest Langley TLW facilities, the completed manifest must be reviewed by the Attendant prior to disposal of the load. At the Annacis Island TLW facility, the completed manifest must be placed in the metal drop box provided once disposal of the load has been completed. Please ensure that load manifests are complete and accurate. Incomplete manifests may cause delays unloading the waste or result in rejection of the load. Rejected Loads At the Iona Island and Northwest Langley facilities, the Attendant will review the manifest and may assess the load by sampling or observation to confirm that the waste is acceptable for disposal. If the Attendant determines that the load is in violation of the terms and conditions of this Procedure Manual, or in the case of Non-Domestic Waste, the waste Authorization, the load will be rejected. Upon notification by the Attendant that the load has been rejected: the Carrier will cease discharging, the Carrier will remove any waste discharged to the facility, as directed by the Attendant and, the Carrier will make alternate plans for disposal Generators of rejected loads will be contacted by an Environmental Regulation and Enforcement Officer, and may be sent a violation notice. In addition, the Ministry of Environment will be notified of the rejected load. If the Carrier load is comprised of waste from more than one generator, a notice of violation may be sent to each generator. Non-Domestic Waste generators may also have their waste Authorization cancelled. Trucked Liquid Waste Procedure Manual Page 3

7 Off-Hour Disposal Off-hour disposal is not permitted unless pre-approved by the WWTP Operations Supervisor. Carriers providing a waste collection service during off-hours should make arrangements to store the waste until the next TLW business day. Requests for pre-approval of off-hour disposal must be made between the hours of 9:00 AM and 3:00 PM, Monday to Friday. Approval of such requests is at the discretion of the WWTP Operations Supervisor. To request off-hour disposal, call the Operations Supervisor at the WWTP where you want to dispose of the waste: Northwest Langley: (604) Iona Island: (604) Annacis Island (604) Emergency Disposal Waste may be accepted in emergency situations. Emergency situations are defined as when human health, property or the environment is endangered, and storage until the next TLW business day is not a viable option. In an emergency, contact the Environmental Regulation and Enforcement Division 24- hour number at (604) Falsified Information The Generator, the Carrier, and their employees must not falsify information provided to Metro Vancouver, either verbally or in written format. Falsifying information may result in the loss of use of all TLW facilities operated by Metro Vancouver. In addition, Metro Vancouver may take legal action as per the provisions of the Greater Vancouver Sewerage and Drainage District Sewer Use Bylaw No. 299, Where to get Forms and Further Information A copy of each TLW form is included in the Appendix to this Procedure Manual. The Attendant verifies that the Carrier has a valid credit account, reviews the Carrier Manifest and assesses the waste by sampling or observation to confirm that the waste is acceptable for disposal. Following disposal, the Attendant will provide a copy of a disposal record which identifies the generator, the type of waste, the volume discharged and the applicable disposal charge. Carriers are invoiced monthly. Carriers are responsible for housekeeping at the disposal area and must clean up waste leaks or spills. 12 Radioactive Waste: any Waste that is defined as a Nuclear Substance under the federal Nuclear Safety and Control Act. Hazardous Waste: as defined by the Hazardous Waste Regulation under the provincial Environmental Management Act. PROCEDURE FOR USING THE IONA ISLAND TLW FACILITY Disposal companies are prohibited from combining Domestic and Non-Domestic Waste in the same load (with the exception of waste from Bowen Island). Domestic and Non-Domestic Wastes are discharged at separate areas within the WWTP. Disposal companies are prohibited from discharging waste without first reporting to the Attendant located at the TLW operations office. Access to the WWTP is gained through use of a gate passcard. Carriers are issued one gate passcard for each truck in their fleet. The Attendant verifies that the Carrier has a valid credit account and that any Non-Domestic Waste has a valid Authorization for disposal. The Attendant reviews the Carrier Manifest and assesses the load, by sampling or observation, to confirm that the waste is acceptable for disposal. If accepted, the Attendant will direct the Carrier to one of two disposal stations, Domestic or Non-Domestic, where the waste load is discharged. Following disposal, the Attendant will provide a copy of a disposal record that identifies the name of the generator, the type of waste disposed, the volume disposed and the applicable disposal charge. Carriers are invoiced on a monthly basis. Carriers are responsible for housekeeping at the disposal facility and must clean up waste leaks or spills. Special arrangements must be made prior to discharge at either the headworks or the Pilot Co-Digestion Facility. Wastes from recreational vehicles PROCEDURE FOR USING THE ANNACIS TLW FACILITY Carriers will be issued a gate passcard for each of their trucks when they receive approval to use Metro Vancouver trucked liquid waste facilities. Gate passcards are normally obtained from the plant reception area during the first visit to the TLW facility. There is no full-time Attendant to oversee operation of the Annacis TLW facility. The Septage Receiving Unit is an automated system and the Carrier must use a password and a truck identification number in order to operate the equipment. 15 The Carrier must enter some of the manifest information in the electronic data management system. As at other facilities, the Carrier is also required to submit a waste manifest (paper form) which identifies all generator waste that made-up the Carrier load. The waste manifest must be deposited in the metal drop box provided. Data entry consists of the following information: the type of domestic waste, i.e. septic, holding tank, portable toilet, etc. the municipality in which the waste was collected, and the estimated disposal volume. The Septage Receiving Unit allows two Carriers to discharge at the same time. Discharge volumes will be measured at both inlets to the TLW facility. Paper receipts will not be issued. Carriers must close out of the system after discharging their load to ensure subsequent loads are not charged to their account. Carriers are responsible for housekeeping at the disposal facility and must clean up waste leaks or spills. For large leaks or spills, Carriers must contact plant reception. For discharge of Non-Domestic Waste at the Annacis Island WWTP, prior approval from Environmental Regulation & Enforcement staff must be granted. Following disposal, the Attendant will provide a copy of a disposal record that identifies the name of the generator, the type of waste disposed, the volume disposed and the applicable disposal charge to the Plant receptionist. Carriers are invoiced on a monthly basis. Carriers are responsible for housekeeping at the disposal facility and must clean up waste leaks or spills. 16 Detailed Instructions for Use of the Annacis Island TLW Facility In order to use the domestic trucked liquid waste screening system you will need a gate pass-card, a Metro Vancouver access number and a Personal Identification Number (PIN). Gate Pass-Card: Disposal companies will be issued a gate pass-card for each truck in their fleet. Pass-cards are used to open the front gate at the plant. The cards must be used to enter and exit the plant, and will only be active during the operating hours of the TLW facility: Monday to Saturday 6:00 AM to 5:00 PM. If you have questions regarding pass-cards, please call the Regulation and Enforcement Division at (604) Metro Vancouver Access Number: Each truck will have its own unique three-digit Access Number (example: 123). The number is provided by Metro Vancouver and is linked to the vehicle license plate number. The disposal company should only give out the access number to staff who are required to use it. You must advise the Regulation and Enforcement Division at (604) when a vehicle license plate is retired or changed. Personal Identification Number: Each three-digit Access Number will have its own unique fourdigit identification number (example: 1234). The number is chosen by the disposal company and should only be given to staff who are required to know it. The identification number can be changed at any time by contacting the Regulation and Enforcement Division at (604) Hooking up and activating the TLW system. The TLW system can accommodate two trucks at a time. Step 1: Hook up the discharge hose to one of the two disposal stations. Step 2: Using the monitor screen and keypad, enter the Access Number and PIN for your vehicle. Step 3: What type of domestic waste are you discharging? Look at the table next to the screen, find the waste type and enter the corresponding number. For example, if the waste was collected from a septic tank, enter number 1. Step 4: What municipality does the waste come from? Look at the table next to the screen, find the name of the municipality and enter the corresponding number. For example, if the waste is from White Rock, enter number 20. Step 5: What is the estimated volume of the load in cubic meters? Look at the gallons to cubic meter conversion table next to the screen if you need to convert. For example, if the volume is 3,000 gallons, enter cubic meters. Step 6: Answer Yes or No to the question Any other generators in the load? If you select No, the screening system will begin processing the load. If you select Yes, you must repeat Steps 3 to 6, entering the required information about subsequent loads. The discharge flow to the TLW system is measured with a magnetic flow meter and when the discharge is complete, the monitor screen will post the volume for the load. This is the volume that you will be invoiced for - if you disagree with the volume recorded on the screen, contact the Regulation and Enforcement Division at (604) Please note that you must also fill out a paper manifest form for each load and deposit it in the metal box provided. 28 b) must make payment by cheque (or by certified cheque, bank draft or money order if required by GVS&DD in writing) in favour of GVS&DD delivered to the Finance and Administration Department, 4330 Kingsway, Burnaby, B.C., V5H 4G8; c) must pay interest at the rate of 1.25% per month (equivalent to 15% per year) calculated daily and compounded monthly on all amounts overdue, including all overdue interest, from and including the date of invoice to and including the date of final payment in full, which interest is payable on demand by separate invoice; and d) indemnifies GVS&DD for all costs, charges and fees of whatsoever nature incurred by GVS&DD in connection with the collection of any overdue amounts, including all legal fees on a solicitor and client basis. If the Applicant delivers a cheque to GVS&DD and the cheque is dishonoured for non sufficient funds, the Applicant must pay GVS&DD an additional charge of $25.00 (the NSF Charge ), which will be added to amount owing by the Applicant to GVS&DD. The NSF Charge is in addition to any NSF fee charged by the Applicant s financial institution. 2. SUSPENSION OF PRIVILEGES If the Applicant s account is overdue, GVS&DD may, in its sole and absolute discretion and without notice to the Applicant, suspend the Applicant s available credit under this Agreement and the Applicant will not be permitted to deposit Waste at the Facilities unless it pays the applicable fees. Once the Applicant s account has been paid in full, the Applicant may resume discharging Trucked Liquid Waste at the Facilities on credit in accordance with this Agreement. 3. TERMINATION GVS&DD may terminate this Agreement at any time by delivering a notice of such termination to the Applicant at the address listed above, to the fax number listed above or to the Applicant s billing address listed above, whether or not the Applicant has defaulted in any of its obligations contained herein. The Applicant's obligation to pay all amounts payable hereunder, whether invoiced or not at the date this Agreement is terminated, survives the termination of this Agreement and continues in full force and effect and all rights and remedies of GVS&DD under this Agreement, both at law and in equity, will continue without prejudice. 4. COLLECTION AND USE OF PERSONAL INFORMATION In cases where the Applicant is an individual, the Applicant authorizes GVS&DD to collect credit and other information about the Applicant ( Personal Information ) in accordance with the Freedom of Information and Protection of Privacy Act (British Columbia) from credit bureaus, reporting agencies and from the references provided to GVS&DD. GVS&DD may: a) disclose the Personal Information to credit bureaus and reporting agencies; b) use the Personal Information to determine the financial position of the Applicant (or the Principal, if applicable); c) use the Personal Information to provide credit to the Applicant in accordance with the terms of this Agreement; and d) disclose the Personal Information to GVS&DD s staff, but only as needed in connection with services provided by GVS&DD to the Applicant in accordance with the terms of this Agreement. GENERAL If this Agreement is terminated in accordance with Section 3, the Applicant may not discharge any further Trucked Liquid Waste at any of the Facilities unless it pays the discharge fees payable in respect of such Trucked Liquid Waste in full. GVS&DD may unilaterally change the terms upon which credit is granted to the Applicant under this Agreement, such change to be effective 5 days after GVS&DD has given notice to the Applicant at the address set out above. No term, condition, covenant or other provision of this Agreement will be considered to have been waived by GVS&DD unless such waiver is expressed in writing by GVS&DD and the waiver by GVS&DD of any such term, condition, covenant or other provision will not be construed as or constitute a waiver of any further or other breach of that or any other term, condition, covenant or other provision of this Agreement. 30 GUARANTEE Company Name: (Applicant) In consideration of GVS&DD establishing a credit account in favour of the Applicant, the Guarantor, and where there is more than one Guarantor, the Guarantor(s), jointly and severally, hereby guarantee to GVS&DD and its successors and assigns, full and complete payment and performance of all the covenants, agreements and obligations on the part of the Applicant to be observed, performed or fulfilled in accordance with this Agreement. The Guarantor(s) acknowledge that the Agreement may be amended from time to time by the parties thereto without the prior consent or notice of the Guarantor(s), and it is further agreed that no such amendment will release the Guarantor(s) from liability under this Guarantee either in whole or in part. If the Applicant fails to perform any of its obligations under the Agreement, or breaches any provision thereof, then the Guarantor(s) hereby undertake(s) to perform the obligations of the Applicant under the Agreement and will indemnify GVS&DD against all losses, damages, costs and expenses which may be incurred by GVS&DD by reason of any default on the part of the Applicant in performing or observing the agreements and provisions on its part contained in the Agreement. GVS&DD is not required to exhaust its recourse against the Applicant or other parties, nor realize on any security granted to GVS&DD by the Applicant or any party, nor value any such security, nor notify the Guarantor(s) of any act of default on the part of the Applicant before enforcing the provisions of this Guarantee. This Guarantee is of a continuing nature and secures the guaranteed obligations that may be due from time to time and at any time from the Applicant to GVS&DD, notwithstanding that the amount of the guaranteed obligations may change from time to time or may at any time be reduced to zero. All debts and liabilities, present and future, of the Applicant to the Guarantor(s) are hereby assigned to GVS&DD and postponed to the liabilities of the Applicant to GVS&DD, and all monies received by the Guarantor(s) or any of the representatives or assigns of the Guarantor(s) from the Applicant must be received in trust for GVS&DD and must be paid over to GVS&DD. 31 CARRIER MANIFEST OF LIQUID WASTE COLLECTED FOR DISPOSAL AT THE TRUCKED LIQUID WASTE FACILITY Only Carriers that have a valid credit account with Metro Vancouver will be allowed access to Metro Vancouver trucked liquid waste facilities. Carriers must complete the following manifest identifying each waste that makes up the load. Prior to disposal, the completed form must be given to the Attendant at the WWTP (Northwest Langley and Iona Island) or placed in the metal drop box provided (Annacis Island). Carriers are reminded that combining Domestic and Non-Domestic Wastes in the same load is prohibited (with the exception of waste loads from Bowen Island). In carrying out their tasks, Carriers are asked to report any problems noted with treatment works to business owners or residents. Carriers and their employees are advised that falsifying information given on a manifest form or to an employee of Metro Vancouver may result in the loss of use of all Metro Vancouver owned trucked liquid waste facilities.
