5 Annex 1 to the application for inspection and testing of PROFINET products 1. Processing of inspection and testing requests PNO-laboratory in general conducts inspection and testing neutrally in the order in which requests are received. Throughout the entire process of inspection and testing - from the receipt of the EUT to the delivery of the test report or the return of the EUT respectively - PNO-laboratory ensures, that unauthorized persons do not have access to the EUT. Customer and the representative of PNO's advisory board appointed by PNO's management board shall be entitled to attend the inspection and testing. The person responsible for the performance of inspection and testing at the PNO-laboratory shall ensure compliance with the principle of confidentiality towards other customers of PNO-laboratory and shall ensure that security measures are not jeopardized. The EUT shall be operated in accordance with the specifications supplied with it. If, however, a EUT should become defective during its inspection and testing, e.g. because of a defective description, PNO-laboratory shall notify customer without undue delay in order to allow customer a prompt repair or replacement of the EUT. Place of performance shall be Fuerth. 2. Obligation to co-operate Customer shall provide PNO-laboratory with an expert who is able to engineer the EUT. The exemplary engineering project shall be specified by PNO-laboratory. Customer shall provide its support to PNO-laboratory up to two days, including provision of the engineering system, during the performance of inspection and testing. Moreover, customer shall provide PNO-laboratory with the following documentation: - General description of construction of the EUT, - Descriptions and explanations required to understand how the EUT works, - Precise type designation, version of hardware, firmware and software. 3. Handover of the EUT, cancelation of inspection and testing agreement Customer shall provide PNO-laboratory with the EUT, including its technical documentation, for the purpose of inspection and testing. If the inspection and testing shall be regarded as type testing, the EUT must comply with series-produced devices. After handover the EUT shall be taken to the premises of the PNO-laboratory. In general this is done without removing it from its packaging. The PNO-laboratory shall verify and document the completeness of delivery. During the receiving inspection the scope of the EUT and its suitability for testing shall be determined and documented. In case PNO-laboratory determines that customer's requirements in terms of the scope of inspection and testing and/or the measuring accuracy exceed the testing capabilities of PNO-laboratory or the EUT does not meet the technical requirements for inspection and testing in accordance with the underlying testing methods and procedures, PNO-laboratory is entitled to cancel the inspection and testing agreement by giving a statement of reasons to customer. The same shall apply in case an objective result of inspection and testing is jeopardized and/or such results are likely to be uninformative. Storage of the EUT during inspection and testing If the performance of inspection and testing it is not possible immediately after the receiving inspection according to section 3, the EUT shall be stored in an appropriate manner and shall not be made accessible to unauthorized third parties. 5. Inspection and testing of the EUT Inspection and testing shall be performed in accordance with the PNO guidelines for the operation of PNOlaboratories and with the internal directives of PNO-laboratory. The inspection and testing shall be conducted by staff with appropriate skills commissioned expressly for such work by the head of the PNO-laboratory. The performance of inspection and testing shall be based upon inspection and testing methods used by the PNO-laboratory which are approved by PNO, including inspection and testing instructions and specifications. The inspection and testing procedure and the results obtained shall be monitored by the head of the PNO laboratory or his/her representative. Customer shall be informed within a reasonable period of time in case of any discrepancies arising during inspection and testing. Only customer shall be entitled to modify the EUT. After completion of inspection and testing the results of the inspection and testing shall be compiled in a test report by the PNO-laboratory and handed over to customer. The test report shall list all test scenarios completed successfully, all test scenarios not completed successfully and all test scenarios yet to be decided. The test report shall include an express statement to the effect that the inspection and testing carried out are equivalent to a single performance of the test scenarios listed with a single sample of customer implementation. It is neither possible to make a general claim to proven conformity with the standards for the implementation tested on the basis of the test report, nor does the latter imply a statement on the stability of the quality thereof. Those inspection and testing records produced by the testing system during the test shall all be made available to customer upon request. The hardware and firmware versions shall be archived at PNO-laboratory. 6. Documentation of inspection and testing results The documentation of the results of inspection and testing compiled in the test report shall ensure that the inspection and testing can be reproduced at any time under the same conditions. All inspection and testing results shall be treated as confidential and stored appropriately. The storage period shall be three years from the date of the test report. Results shall be archived in the document safe at PNOlaboratory and in the department of I IA CE SE(documentation and project department). After expiration of such period the documents shall be destroyed or the data media shall be cleared. Any amendments or additions made after the inspection and testing report has been issued shall be marked as supplements to the inspection and testing report. Supplements shall be given a serial number and are linked clearly with the inspection and testing report by means of the reference of that report. The format of the supplements shall correspond to the specifications for inspection and testing reports. The inspection and testing reports do not include any advice or recommendations arising from the inspection and testing results. 7. Objection Customer shall be entitled to object to inspection and testing results compiled in the test report of PNOlaboratory in writing within a period of two weeks following the handover of such test report to customer. In case customer and PNO-laboratory have not reached an agreement within four weeks following the receipt of such objection, customer shall be entitled to consult the advisory board of the PROFIBUS User Organization (PNO) for arbitration purposes, to which the PNO itself has assigned the role of arbitration and conciliation body in accordance with its framework conditions for testing and certification (FA1/PNO- PRZ/ ). For purposes of arbitration, the PNO Advisory Board should be convened for a conciliation meeting first. Should these efforts be unsuccessful, an expert accepted by both parties may be consulted by the customer. Application for inspection and testing of PROFINET field devices V 3.8 Page 6 of 11

Disposition of the EUT, Return of the EUT In accordance with the PNO "DP testing guideline the test station at PNO-laboratory is continually extended with a wide range of PN/DP/PA products of various manufacturers or product types in order to ensure the interoperability of the maximum possible number of DP/PA products - as far as the limits of technical feasibility permit. In the absence of an agreement to the contrary between customer and PNO-laboratory the EUT and all corresponding data media and documents shall remain at PNO-laboratory and shall not be returned to customer even after completion of the inspection and testing. Customer agrees to transfer title to the EUT to PNO-laboratory without payment of any separate remuneration. Customer's liability in respect of any defects in the EUT shall be excluded, unless liability is mandatory by law and in cases of intent and gross negligence. If PNO-laboratory and customer have agreed upon the return of the EUT after completion of inspection and testing the procedure described in either section 8 a) or section 8 b) shall apply as required by customer: a) Dispatch of the EUT by PNO-laboratory The PNO-laboratory shall ensure that the EUT, data media and documents are properly packaged and dispatched appropriately within an appropriate period of time after completion of inspection and testing. The method of dispatch shall be agreed upon in advance with customer. Customer and PNO-laboratory shall receive copies of the consignment documentation. A flat rate of EUR shall be charged for the costs of packaging and shipment. b) Collection of EUT by customer PNO-laboratory shall provide customer (or its representative) with reasonable opportunity to pack, load and transport the EUT, the data media and the documentation, and shall provide reasonable assistance with same. Customer or its representative shall confirm collection of the EUT. Customer shall bear the costs of packaging. 9. Confidential treatment of customer-specific information and of the EUT The employees of PNO-laboratory shall observe confidentiality in the treatment of customer-specific information and of the EUT. Inspection and testing requests may be processed simultaneously where the capacity of the PNO-laboratory allows. In order to ensure confidentiality in respect of various customers, it is agreed that only one customer (or its representative) may be present at PNO-laboratory at any given time and that confidentiality in respect of other customers is assured. An agreement may be concluded whereby a number of customers (or their representatives) are present at the same time; this shall require the consent of all customers affected. 10. Exception for interruption of inspection and testing requests In the event of an interruption of inspection and testing requests, the EUT, data media and documents belonging to customer shall remain at PNO-laboratory, unless customer takes the EUT back. If an interruption in an inspection and testing request continues longer than expected and PNO-laboratory therefore wishes to use the laboratory facilities to execute another inspection and testing request, the latter may be commenced only after the EUT, any data media and documents have either been returned to customer or stored elsewhere, by agreement with customer for that inspection and testing request which has been interrupted. All specific information relating to customer (held on paper and on data media) in respect of the interrupted inspection and testing order shall in this case be removed from the premises of PNOlaboratory and stored in its archives. 11. Non-adherence to the agreed inspection and testing date In order to ensure that the schedule for inspection and testing remains uninterrupted, it is required that customer keeps the agreed appointment for inspection and testing, which according to PNO-laboratory s confirmation of the request might deviate from the preferred date of customer. 8 during development of a field device, that the appointment for inspection and testing confirmed by PNOlaboratory cannot be kept by customer, customer shall notify PNO-laboratory thereof in writing (fax: ++49 (0) or comdec@siemens.com) at least seven days prior to the agreed appointment for inspection and testing. In the event of non-compliance to such time limit, PNO-laboratory is entitled to charge customer an amount of the equivalent to 10% of the remuneration according to the inspection and testing agreement. Furthermore, a new appointment for inspection and testing shall be agreed upon between customer and PNO-laboratory. 12. Warranty, Liability a) PNO-laboratory warrants only that the inspection and testing shall be duly conducted in accordance with the latest version of the PNO guidelines valid at the date the request was placed by customer, and with those inspection and testing specifications agreed upon with customer in the respective instance, that the data in those documents produced on this inspection and testing are consistent with the results of the inspection and testing, and that the assessments of the EUT tested are issued with the ordinary care which the PNO-laboratory exercises in its own affairs. Warranty claims shall become statute-barred 12 months following the handover of the test report by PNO-laboratory to customer. Any defects must be reported in writing by customer to PNO-laboratory without undue delay after the defect was detected, including a detailed description of the defect. If customer notifies PNO-laboratory of the defect in due time PNO-laboratory shall once again perform the testing and inspection of EUT in accordance to the conditions of this Annex. If in the course of the repeated testing and inspection it becomes clear that the defect claimed by customer did not exist, customer shall bear the costs of the repeated test. b) PNO-laboratory shall not be liable for the correctness, accuracy and completeness of the PNO guidelines. 13. Miscellaneous In the absence of any provision to the contrary to the stipulations of this Annex the following conditions shall apply: For customers with registered office in Germany: The General Conditions for the Supply of Products and Services of the Electrical and Electronics Industry for Commercial Transactions between Businesses (as of June 2005). For customers with registered office outside of Germany: The General Conditions for Supplies of Siemens, Automation and Drives for Customers with a Seat or registered Offices outside of Germany (as of January 2002). 9 Annex 2 to the application for inspection and testing of PROFINET products Conditions for prompt processing of the certification test Additional information is required in order to be able to test a slave without a great deal of effort in terms of commissioning and clarification. This is not always available from the manuals, descriptions or in the component master data file. In order to minimize both delays in commissioning and effort in clarification, and so as to optimize the procedure, please note the following points and provide us with the appropriate information and materials required. Input and output data: It must be possible for the input data for the test item to be amended while the test is in progress. If such input data is not available in physical form, e.g. with a simple I/O module, a description of how this can be amended should be given. The same also applies to special output data on the test item. In the event of user data transfer, e.g. by means of an internal transfer memory or virtual address range, the input data should be mirrored in the output data. User applications: If you have specified a particular dedicated data transfer profile in order to control your device, all PROFINET messages required for the control sequence should be disclosed. The provision of function modules for the PLC alone is not sufficient. Wiring of input and output channels: If special connectors are used here as well, these or the prefabricated cables should be enclosed. PROFIdrive profile The current profile document and the currently valid Errata list must always be used. In addition to error corrections in the profile document, the Errata list contains several points which are important to implementation and certification (and are not indicated in the profile explicitly). All work group members receive the Errata list automatically with the work group meeting protocol. Non-work group members receive the list on request from the testing laboratory. PROFIdrive Profile The current Profile document and the Error List that is currently valid have to be used. In addition to the error corrections for the Profile document, the error list includes a few items that are important to implementation and certification (and are not explicitly included in the Profile). All WG members always receive the error list automatically along with the WG meeting protocol. Those who are not WG members can obtain the list from the Test Lab upon request. To determine the test effort, the Test Lab needs a form filled out by the manufacturer ("PROFIdrive related information ). The Test Lab sends the form to the applicant, together with a confirmation of the fixed date. PROFIsafe According to the TÜV guidelines, it has to be ensured that a PROFIsafe test can be reproduced for a period of 10 years. This time span starts with the test report date of the respective PROFIsafe device. If the specimen does not remain in the Test Lab, the Test Lab needs a confirmation signed by the manufacturer that the test specimen remains unmodified on his premises for 10 years. The Test Lab sends the confirmation to the applicant, together with the confirmation of the fixed date. Application for inspection and testing of PROFINET field devices V 3.8 Page 9 of 11

10 Annex 3 to the application for inspection and testing of PROFINET products Price list Scale of fees valid until September 30, 2018 The fees for conduct of inspection and testing shall be charged according to the service used.
