3 1 Purpose These packaging guidelines describe the basic requirements, with reference to the Appendi included herein, to all suppliers of Siemens and their packers, hereinafter referred to as contractor (C), of Siemens Turbomachinery GmbH, hereinafter referred to as principal (P), for the packaging and supply of goods. They serve as binding design specifications for packages which ensure optimum goods protection in consideration of logistic, economic and ecological aspects. These guidelines are based on legal regulations, norms and standards relating to packaging, and subject to compliance with the respective applicable HPE packaging guidelines being the minimum standard. 2 Supplement to scope The handling of baseframes, baseplates, aggregate oil supply systems, spiral housings, generators and other large parts (weight > 5 tons) are not covered by these guidelines. They need to be prepared separately and agreed upon, if necessary. Any deviations from these guidelines must be agreed in writing. 3 Roles and responsibilities C shall be provided with this document by P and responsible for the implementation of the specified measures as well as for compliance with the specified requirements. The competent contact persons of the participating locations are also available on the abovementioned website. P agrees with the proposal of C or otherwise stipulates packaging specifications binding for C. P must not unreasonably withhold its consent. Alternatively, P shall be entitled to stipulate packaging specifications in form of a "rough specification/packaging proposal" for individual A and selected B components. These specifications are subject to agreement between the parties, after which C will prepare its quotation in accordance with the mutually agreed rough specification. On the basis of the agreed rough specification, C shall be provided with a "detailed packaging specification" by P, which forms an integral part of the order. P reserves the right to deliver the packaging to C free of charge. Page 3 of 12

4 4 Packaging specifications In general, Euro pallets and grid boes are to be used for packaging/as load carrier. If this is not possible or reasonable in the individual case, other returnable packaging may be agreed with P. Whether these are provided by C or P shall be subject to mutual agreement between the parties. If the use of returnable packaging is not possible for economic, ecological or quality reasons, disposable packaging may be agreed with P. Construction and design of packaging shall ensure safe transport, proper handling and storage, considering economic efficiency. 4.1 General requirements Environmental protection In order to not unnecessarily increase environmental pollution, the following aspects must be observed: Use of recyclable, environmentally friendly packaging, i.e..no foam chips and flips. Plastic bags, stretch and shrink films must be made of polyethylene only. P reserves the right to dispose any packaging containing CFC and/or PVC or similar contents, including such packaging which does not comply with our specifications, on the account of C. Mied and composite packaging is not permitted, ecept in case of returnable packaging. No use of adhesive filling material. Use of hygroscopic filler and padding materials (e.g. wood wool, hay, straw, paper) to fill in gaps and/or for padding purposes is not permitted Customs clearance on behalf of P C shall basically not be authorised to perform any kind of customs clearance on behalf of P. If customs clearances on behalf of P become necessary, then C shall obtain a customs power of attorney from P's competent department (Siemens Turbomachinery Equipment GmbH, Siemens AG). When performing packaging in its own name or involving eternal packers, C shall ensure to observe the specifications provided by the authorised economic operator (AEO) and the requirements according to the European National Air Security Programme Packaging and carriage of dangerous goods Packaging of dangerous goods must be in compliance with the applicable Law on the carriage of dangerous goods, as well as the applicable specifications and standards as amended relating to the corresponding transport means. National requirements, if applicable, must be observed. Subject to type of carriage, only UN-approved packaging for dangerous goods must be used. Compliance with relevant specifications and standards shall be C's eclusive responsibility. C shall be liable for any damage caused by non-compliance, and indemnify P for any and all damages and costs incurred by P in connection with such non-compliance, including internal administration and processing fees. 5 4.2 Technical requirements Functional requirement Each order item must be packed individually and identified as such; always use the Siemens material number. The item must not protrude packaging; for goods are delivered on palettes use pallet frames, if reasonable. Non-palletised cardboard boes and packaging drums must not eceed the maimum weight of 30kg; Ensure maimum utilisation of space/packing density; All goods must allow for easy individual removal without the use of special tools and time-consuming unpacking. In specific cases and subject to agreement, particularly heavy and large materials may be also delivered in the proper assembly position; Packaging must protect goods against damage, contamination and humidity as well as UV radiation (ultra-violet); Materials with sensitive surfaces or sealing surfaces must be provided with particular protection, allowing goods to be protected also during and after assembly; Packaging must ensure safe transport and secure storage using any kind of the common transport and storage means; Packaging must allow for handling from four directions using all common industrial trucks; Goods must allow for handling without the use of special lifting means. If packaging/goods are to be dispatched, which require special lifting equipment, then such equipment shall be delivered by C; Packaging, such as boes, crates or racks, must be stackable at least 3 times for transport, handling and storage purposes. Eceptions are subject to mutual agreement; The same packaging must be used for all delivery lots; Packaging must be re-sealable; Packaging must be designed so as to eliminate the need of re-packing when receiving, storing and assembling the goods at the premises of P; If goods delivered by C must be unloaded using a crane, then only Siemens approved lifting tackle must be used and/or attached (e.g. RUD eyebolts) Packaging of goods with treated / sensitive surfaces must ensure that any damage to these surfaces during transport and/or manipulation (e.g. unloading the load carrier) is prevented Containers / seaworthy packaging The actual purpose of containers is to be a "handling aid, and thus suitable for packing only to a limited etent. Delivery of goods in containers at the Frankenthal location is not permitted. Manufacture and design of seaworthy packaging is subject to the applicable "HPE Packaging Directive". Treatment of the wood used and for identification of packaging is subject to the applicable "Import regulations for packaging containers made of solid wood - IPPC standard". In contrast to the IPPC standards, the use of methyl bromide (MB) is not permitted, unless P epressly agreed to its use. The preferred method applied by C is the heat treatment (HT). Page 5 of 12

6 4.2.3 Preservation and corrosion protection Unless requirements relating to preservation and protection against corrosion are stipulated in the relevant standards, C shall observe the following: Materials, which are prone to corrosion due to their design and properties, must be sealed in foil. The minimum film thickness is 0.2 mm. When choosing the suitable film (polyethylene or aluminium laminated films), attention must be paid to its vapour tightness and durability over the entire transport and storage period. Eception: untreated parts, e.g. cast blanks Add sufficient amount of desiccant for the transport and storage period so as to ensure that the relative humidity within the barrier film is maintained for minimum 12 months over the entire period of transport and storage (calculation according to DIN 55474). Packaging of goods must be ensured by use of clearly non-corrosive packing means only. This applies both to their chemical composition, and their ability to absorb water. If materials are dispatched unpacked, then C shall ensure that these materials are protected against corrosion in accordance with the relevant technical specifications and with respect to the intended type of delivery. In case of doubt, contact the technical department of P. The protection against corrosion must be removable and disposable in an economic and environmentally friendly manner. Any blind holes, bushings, open pipe and hose lines and connections must be properly covered using lids or plugs. Lids and plugs must be tight so as to prevent them from becoming loose during transport, manipulation and storage. 4.3 Logistic optimisation Returnable packaging Returnable packaging includes both Euro pallets and grid boes handled in echange systems, and any agreed special load carriers, such as crates, steel and plastic pallets and transport racks, which must be returned to C. Returnable packaging must be designed foldable to as to allow for economic transport. Returnable packaging must be used basically in a clean and perfect condition. Returnable packaging owned by P shall be made available to C in the required quantity. C shall use such returnable packaging for the transport of materials according to its delivery obligation toward P only. Any emerging shortfall must be notified to P without undue delay. If the returnable packaging provided by P has defects, which could jeopardise the safe transport and handling of the goods, then P shall be immediately notified in this respect. Such returnable packaging must not be -reused, unless P has approved its reuse. P shall be responsible for the repair and/or replacement of a defective load carrier. Returnable packaging owned by C shall be retained by C in the required quantity so as to ensure transport, storage, in-house transport and return without bottlenecks. The responsibility for the return of empty returnable packaging and the related costs shall be subject to the Incoterm agreed for this delivery transaction. If FCA is agreed, the responsibility lies with P; in case of DDU, C shall be responsible. If DDU is agreed, P shall ensure that returnable packaging is made ready for collection after having removed materials. Page 6 of 12

7 The place of collection may differ from the place of delivery. Specific arrangements must be made for returnable packaging from third countries Identification of returnable packaging Returnable packaging owned by C shall be clearly identified by the words "Loan Packaging", the "company name" and the full "return address" of the owner. Each returnable packaging must be provided with indications in terms of net weight, load capacity, etra load, and any other safety and handling instructions. Any data specified in this chapter is basically added to the returnable packaging by applying an identification method agreed with P (e.g. barcode). Any identification, such as barcode labels or transponders (radio communication device) must not be removed or rendered unidentifiable. This applies both to C and P. Any returnable packaging with incomplete identification is treated as disposable packaging! Logistic modules (Log Mod) / component groups A Log Mod is the combination of different materials to one material group which is processed through a combined SAP order of P. This may be single parts or pre-assembled components. The Log Mod content is defined by P and must be verifiable using a packing list indicating all material numbers including part quantities. Log Mods must be delivered always complete. Container and/or assembly materials, if part of the Log Mod, must be provided in the required quantity. The individual materials must be ergonomically accessible, according to P's specifications, and removable from the packaging/load carrier in the order of their assembly. Each Log Mod must be delivered in a separate packaging. Distribution over several packages is permitted if the Log Mod does not fit into one packaging. These packages must be identified so as to allow for easy recognition that they belong to one group. Packaging containing different Log Mods or materials are not permitted (non-mied delivery). 8 5 Documents and identification 5.1 Delivery documents Delivery documents must be attached so as to ensure that they are easily accessible from outside, clearly visible, weather-resistant and permanent. 10 6 Supplier's non-performance Any deliveries in breach of C's obligations resulting under these terms and conditions may be rejected at C's epense. Any breach of these terms and conditions must be notified either by P or by its carrier service providers in its name and on its behalf. P declares, until further notice, to have authorised its carrier service providers to do so. The same applies for the assertion of rights of P resulting from such notified breaches. Page 10 of 12
