However, the ambition is clear, i.e. to also enable delivery points from DSO networks and to enable Transfer of Energy. Transfer of Energy is a feature that will not be limited to one product, also R3 and other products will evolve including ToE 28

30 Transfer of Energy: an introduction to the concept Energy Market Balance Responsible Party (BRPsource) Without a ToE-mechansism, the supplier would make a loss as he bought (and pays to the market) the energy, but can only invoice a smaller amount to the end consumer who reduced its load as requested by the BSP Also the BRP(source) needs to be corrected, otherwise he suffers an imbalance for the activated volume beyond its control. 34 Transfer of Energy brought to reality a) Phase 1: as from 1/7/2017 As the legal framework was not adapted in time to allow a Go-Live of the BidLadder project including Transfer of Energy However, the product Non-Reserved Tertiary Control for Non-CIPU units goes live on 1/7/2017, accepting situations where all ToE aspected are arranged between those parties involved for a delivery point. Creating Transfer of Energy Rules Amending the ARP-contract Arranging the imbalance adjustment ( perimeter correction ) Amending the Balancing Rules Amending the General Framework Agreement All changes follow the normal proces, incl. public consultation, WG Balancing, etc. Setting up Elia-Supplier contracts with respect to the information exchange The contractual and regulatory framework should be adapted to take into account the necessary ToE-related aspects. Estimated lead time 7-8 months as from when the legal framework is in place. 36

38 Key messages With the new product Non-reserved tertiary control power for non-cipu units, a great milestone in market opening for flexibility will be taken (even in absence of ToE) The new product Non-reserved tertiary control power for non-cipu units is a low-barrier product with rather mild technical requirements. Arranging the Transfer of Energy enables flexibility to find its way to the market via different parties without negatively impacting the other involved parties. Market parties can continue to collaborate and are not obliged to follow the generic Transfer of Energy scheme. Enabling Transfer of Energy requires the legal, regulatory and contractual framework to be amended. The ambition is to further develop the product and Transfer of Energy towards delivery points in DSO networks. Transfer of Energy will now be applied on one product, but other products are likely to follow. 38
