6 Original Page 6 PRELIMINARY STATEMENT This Price List contains all effective rates and rules together with information relating to and applicable to Global Crossing Telecommunications, Inc. ("Global"). Global provides specialized intrastate telecommunications services within the State of California for calls originating from Los Angeles, San Francisco/Oakland, Sacramento and San Diego, California.

8 Original Page 8 APPLICATION OF PRICE LIST This Price List contains the regulations and rates applying to interexchange common carrier communications service provided by Global Crossing Telecommunications, Inc., (hereinafter "Global") between and among the points listed herein for service within the state of California.

9 Original Page DEFINITIONS For the purpose of this Price List, the following definitions shall apply: 1. Access Line A dedicated arrangement which connects a customer location to a Global NSC (see below for definition). 2. Administrative Change The modification of an existing circuit, dedicated access line or port, at the request of the customer, that involves changes in authorization codes, speed numbers, route guide, consolidation of billing, verification of testing performed by parties other that Global, or any other administrative change not covered by a Billing Record Change. (See below for definition) 3. Application for Service A standard Global order form which includes all pertinent billing, technical and other descriptive information which will enable Global to provide the communication service as required. The order form may be completed by an Global employee using information obtained by telephone. 4. Authorization Code A multi-digit code, one or more of which are available to Metered Use Service customers to enable them to identify individual users or groups of users, and thereby allocate the costs of their long distance service; except where Equal Access Dialing is used by the customer and costs are allocated on the basis of the telephone number from which the customer uses the service. 5. Billing Record Change A change in customer billing address, telephone number or a change from one billing package to another using the same access method.

10 Original Page DEFINITIONS (Cont d) 6. Cancellation of Order A customer initiated request to discontinue processing a service order, either in part or in its entirety, prior to its completion. Cancellation charges will be assessed for each dedicated access line canceled from an order prior to its completion by Global under the following circumstances: (1) if the local Telco has already confirmed in writing to Global that the dedicated access line will be installed; or (2) if Global has already submitted facilities orders to an interconnecting telephone company (this differs from a Disconnection, see definition below). 7. Circuit Termination The point at which Global s circuit originates, terminates, or drops for the insertion or removal of a customer s signal. 8. Customer The person, firm, corporation or other entity which orders service, including the ordering or use of Equal Access Dialing --either for its own use, as an Other Common Carrier, or as a non-profit manager of a sharing group--and which is thereby responsible for the payment of charges and for compliance with Global Price List regulations billing purposes, a customer is considered to be an account. If a customer orders or uses Equal Access Dialing, in more than one Global originating city, or requests the assignment of more than one Authorization Code in a particular city, each such account is a separate customer for billing purposes. 9. Customer-provided Terminal Equipment Terminal equipment, as defined herein, provided by a customer. 10. Disconnection The disconnection of a dedicated access line or port connection being used for existing service. (This differs from a Cancellation; see definition above.)

Equal Access Dialing The use of service through Telco Equal Access facilities allowing the customer to access Global s NSC through either a "1+" or dialing sequence. Customers using Equal Access Dialing may be billed to the telephone number from which the Equal Access Dialing originates. 12. Global Global Crossing Telecommunications, Inc. 13. Global Tariff FCC No.5 or No. 8 That tariff filed by Global with the Federal Communication Commission and known as Global Crossing Telecommunications, Inc. Tariff FCC No. 5 or No. 8, as amended from time to time. (Global s Federal Tariffs) 14. Installation The connection of a dedicated access line or port for new or additional service. 15. Joint User A person, firm, or corporation designated by the customer as a user of communication facilities furnished to the customer by Global, and to whom a portion of the charges for such facilities are billed under a joint user arrangement. 16. National Holidays Global recognized National Holidays are New Year s Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day. 17. Network Switching Center (NSC) Any location where Global has a network switch installed.

12 Original Page DEFINITIONS (Cont d) 18. Network Trunks Access lines, interswitch trunks, and circuits connecting services and facilities of Global or other carriers to Global NSC s. 19. Nonspecific Account Code These codes do not have specific numbers designated by the customer. All numbers from are preprogramed into the switch for these customers. Therefore, any three digit number entered by the customer will allow the call to be completed. 20. Off-Network Access Line A local exchange, foreign exchange, or WATS line connecting both incoming and outgoing traffic from a Global switched service network to the public switched network. 21. Other Common Carrier (or Interexchange Carrier) A person, firm, corporation, or entity regulated by the FCC or by any state public utility commission which sells communication services and facilities to the public for profit, including resellers. 22. Permitted User A person, firm, corporation or other entity permitted by the Customer to receive or send communications. Such permission includes, without limitation, (1) the use of the customer s Authorization Code where the Authorization Code has been made known to the user by the customer, its employees or agents, and (2) the use of customer s telephone number when Equal Access Dialing is used. 23. Physical Change The modification of any existing dedicated access line or port, at the request of the customer, requiring some physical change or retermination.

13 Original Page DEFINITIONS (Cont d) 24. Premises The space designated by a customer as its place or places of business for termination of Global service. 25. Service Group One or more A.D.S. dedicated access lines terminated in the same multiline terminating device at the same customer premises. 26. Special Promotional Offering Special discounts or modifications of its regular service offerings which Global may, from time to time, offer to its customers for a particular service. Such offerings may be limited to certain dates, times and locations. 27. Specific Accounting Codes These codes are those numbers which are designated by the customer and entered against a unique trunk type for that customer. If any accounting code other than those designated by the customer are used, the call will not be completed. 28. Speed Number A signaling arrangement by which a customer may elect to dial a pre-programmed number in place of a designated ten-digit area code and local telephone number. 29. Terminal Equipment Devices, apparatus and their associated wiring, such as teleprinters, telephone handsets, data sets or dialers.

14 Original Page Description of Service RULES AND REGULATIONS Global is an interexchange common carrier furnishing communications services between specified locations under the terms of this Price List. Global, when acting at the customer s request, and as his authorized agent, will make reasonable efforts to arrange for service requirements which may include terminal equipment and circuit conditioning or Equal Access Dialing. 2.2 Limitations Service is offered subject to the availability of facilities and the provisions of this Price List. Global reserves the right to discontinue furnishing service upon written notice, when necessitated by conditions beyond its control or when the customer is using the service in violation of the provisions of this Price List or in violation of law. 2.3 Terms and Conditions Service is provided and billed on the basis of a minimum period of at least one month, beginning on the date that billing becomes effective, and continues to be provided until canceled by the Customer in writing, with not less than thirty (30) days notice. In the event a Customer orders a Global option that does not require a monthly subscription fee, Global reserves the right to treat a period of non-use of not less than 90 days as a cancellation and to discontinue furnishing service without notice, after such 90 day period Service is offered on a monthly basis For the purpose of computing charges in this Price List, a month is considered to have 30 days The name(s) of the Customer(s), including members of a sharing group, desiring to use the service must be stipulated in the application for service A Customer may cancel without termination fees or penalties any new tariffed service or any new contract for service within 30 days after the new service is initiated. This Rule does not relieve the Customer from payment for per use and normal recurring charges applicable to the service incurred before canceling, or for the reasonable cost of work done on the Customer s premises (such as wiring or equipment installation) before the Customer canceled.

15 Original Page Liability RULES AND REGULATIONS (Cont d) The liability of Global, for whatever reason, shall not exceed an amount equivalent to the proportionate charge otherwise payable for the period of time during which any mistake omission, interruption, delay, error or defect, or any other event giving rise to a claim, occurs. In no event shall Global be liable for special, consequential or incidental damages Global shall be indemnified and held harmless by the customer against: A. claims for libel, slander, or infringement of copyright arising out of the material, data, information, or other content transmitted over Global s channels; B. patent infringement claims arising from combining or connecting Global s furnished channels with apparatus and systems of the Customer; and C. all other claims arising out of any act or omission of the customer in connection with any service provided by Global Global is not liable for any act or omission of any other company or companies furnishing a portion of the service Global does not guarantee or make any warranty with respect to any equipment provided by it where such equipment is used in locations containing an atmosphere which is explosive, prone to fire, dangerous or otherwise unsuitable for such equipment. The customer indemnifies and holds Global harmless from any and all loss, claims, demands, suits or other action, or any liability whatsoever, whether suffered, made, instituted or asserted by the Customer or by any other party or persons, for any personal injury to or death of any person or persons, and for any loss, damage or destruction of any property, whether owned by the cu Customer or others, caused or claimed to have been caused directly or indirectly by the installation, operation, failure to operate, maintenance, removal, presence, condition, location or use of such equipment so used The Customer indemnifies and holds Global harmless from any and all loss, claims, demands, suits, or other action, or any liability whatsoever whether suffered, made, instituted or asserted by the Customer or by any other party or persons for any personal injury to or death of any person or persons, and for any loss, damage, or destruction of any property whether owned by the Customer or others, caused or claimed to have been caused directly or indirectly by the installation, operation, failure to operate, maintenance, removal, presence, condition, location or use of such equipment where such installation, operation, failure to operate, maintenance, condition, location or use is not the direct result of Global s negligence.

16 Original Page Liability (Cont d) RULES AND REGULATIONS (Cont d) Global is not liable for any defacement of or damage to the premises of a customer resulting from the furnishing of channel facilities or the attachment of instruments, apparatus and associated wiring furnished by Global on such Customer s premises or by the installation or removal thereof when such defacement or damage is not the result of Global negligence. No agents or employees of other participating carriers shall be deemed to be agents or employees of Global The Customer is responsible for taking all necessary legal steps for interconnecting his customer - provided terminal equipment or communications systems with Global facilities. The Customer shall secure all licenses, permits, rights-of-way and other arrangements necessary for such interconnection The Customer shall ensure that his equipment and/or system is properly interfaced with Global facilities, that the signal emitted into Global s network are of the proper mode, bandwidth, power, data speed and signal level for the intended use of the Customer and that the signals do not damage Global equipment, injure personnel or degrade service to other customers. If the Federal Communications Commission or some other appropriate certifying body certifies terminal equipment as being technically acceptable for direct electrical connection with interstate communications service, Global will permit such equipment to be connected with its channels without the use of protective interface devices. If the Customer fails to maintain and operate his equipment and/or system properly, with resulting imminent harm to Global equipment, personnel, or the quality of service to other customers, Global may upon written notice require the use of protective equipment at the Customer s expense. If this fails to produce satisfactory quality and safety, Global may upon written notice terminate the Customer s service.

17 Original Page Cancellation of Service by a Customer RULES AND REGULATIONS (Cont d) If a Customer cancels his order for service before the service begins, before completion of the minimum period or before completion of some other period mutually agreed upon by the Customer and Global, a charge will be levied upon the Customer for the nonrecoverable portions of expenditures or liabilities incurred expressly on behalf of the Customer by Global and not fully reimbursed by installation and monthly charges. If, based on an order by a Customer, any construction has either begun or been completed, but no service provided, the nonrecoverable cost of such construction shall be charged to the Customer. 2.6 Use of Service The Customer may cancel without termination fees or penalties any new tariffed service or any new contract for service within 30 days after the new service is initiated. However, this does not relieve the Customer from payment for per use and normal recurring charges applicable to the service incurred before canceling, or for the reasonable cost of work done on the Customer s premises (such as wiring or equipment installation) before the Customer canceled The services offered herein may be used for, one or more of the following: A. for the transmission of communications to or by the Customer; and/or B. for the transmission of communications to or by an authorized user or joint user.

18 Original Page Use of Service (Cont d) RULES AND REGULATIONS (Cont d) Service may be arranged for joint use or authorized use. The joint user or authorized user shall be permitted to use such service in the same manner as the Customer, but subject to the following: A. one Joint User or Authorized User must be designated as the Customer. The designated Customer does not necessarily have to have communications requirements of his own. The Customer must specifically name all joint users or authorized users in the Application for Service. Orders which involve the start, rearrangement, or discontinuance of joint use or authorized use service will be accepted by Global only from that designated Customer and will be subject to all regulations in this Price List. B. all charges for the service will be computed as if the service were to be billed to one Customer and any discount arrangements will be based on the actual number of circuits installed at the beginning of the billing period. The Customer shall be responsible for allocating charges to each Joint User or Authorized User Service may be arranged for use by other common carriers for the purposes of resale subject to the following: A. other Common Carriers will be responsible for charges, costs, etc. incurred by Global with respect to services as referenced in Section 2.6.4; B. other Common Carriers are responsible for all interaction and interface with their own subscribers or customers Service shall not be used: A. for any unlawful purpose; B. for any purpose for which payment or other compensation is received by the Customer, except when the Customer is a duly authorized and regulated common carrier. This provision does not prohibit an arrangement between the Customer, Authorized User or Joint User to share the cost of the service so long as this arrangement generates no profit for anyone participating in a joint use or authorized use arrangement.

19 Original Page Payment Arrangements RULES AND REGULATIONS (Cont d) The Customer is responsible for payment of all charges for services furnished to the Customer or any Authorized User through Customer s Authorization Code or Equal Access Dialing telephone number. Charges for installation, physical or administrative changes, or for cancellation of orders are payable upon completion. Recurring charges including estimated usage where applicable are billed in advance. Estimated usage charges are determined by Global based on the Customer s projected use of service or at Global s option, on the highest previous monthly usage charges incurred by the Customer. Global shall prorate charges for basic service for partial months. A 30-day month may be used for prorating in lieu of calendar days Bills will be payable upon receipt. Interest at the rate of 1½% per month (unless prescribed by law, in which event at the highest rate allowed by law) will accrue upon any unpaid amount commencing 22 days after rendition of billing An Applicant or Customer whose financial condition is not acceptable to Global may be required at any time to make a deposit up to an amount up to two months estimated charges for the service to be provided. In the case of a cash deposit, deposits shall earn on the monthly, unused balance not less than simple annual interest based on the three-month financial commercial paper rate published by the Federal Reserve Board, on November 30th, of the prior year. Global shall refund deposit amounts associated with basic service, with interest, after one continuous year of timely payments for basic service, and not later than 30 days after basic service is discontinued The charges set forth in this Price List for circuit terminations contemplate installations made in normal locations and under normal working conditions. Any installations to be made under other circumstances are subject to additional charges which will be tariffed as appropriate.

20 Original Page Payment Arrangements (Cont d) RULES AND REGULATIONS (Cont d) If notice of a dispute as to charges is not received in writing by Global within three months after an invoice is rendered, such invoice shall be deemed to be correct and binding upon the Customer. In the case of a billing dispute between the Customer and Global, Global shall investigate the charge(s) the Customer has informed Global are in question, and shall reach a determination and communicate it to the Customer within 30 days. During the time the investigation is pending, no late charges or penalties may be collected, the charge may not be sent to collection, and no adverse credit report may be made based on non-payment of the charge. If the Customer prevails, then no late charge or penalty may be imposed on the amount in dispute. Global may not disconnect service to the Customer before seven calendar days after the date the carrier notifies the Customer in writing of the results of its investigation. In no event shall the Company disconnect service prior to the due date shown on the bill In the event that legal action is instituted by Global to recover any sums then due and Global prevails, Global shall be entitled to recover its costs of collection, legal costs, court costs and reasonable attorney fees, in addition to whatever other relief the court may award. Any sums then due shall earn interest at the rate of one and one-half (1½%) percent simple interest per month (unless prescribed by law, in which event at the highest rate allowed by law), from the date these sums were accrued until the entire debt is paid in full. 2.8 Change in Service Agreement When a change in service arrangement involves the continued use by the customer of circuits furnished by Global, installation charges do not apply to the circuits continued in use. The minimum service period for the circuits contained in use is determined from the date of the initial installation thereof. 2.9 Restoration of Service The use and restoration of service in emergencies shall be in accordance with Part 64, subpart D of the Federal Communications Commission s Rules and Regulations, which specifies the priority system for such activities.

21 Original Page Inspection RULES AND REGULATIONS (Cont d) Global may, upon reasonable notice, make such tests and inspections as may be necessary to determine that the requirements of this Price List are being complied with in the installation, operation or maintenance of the Customer or Global equipment. Global may interrupt the service at any time, without penalty to Global, because of departure from any of these requirements Cancellation for Cause by Global Upon nonpayment of any sum owed to Global, or upon a violation of any of the provisions governing the furnishing of service under this tariff, Global may upon written notification to the Customer without incurring any liability, immediately discontinue the furnishing of such service. Global shall provide notice in writing to the Customer whose payments are overdue not less than 7 calendar days prior to terminating service for nonpayment Global will not disconnect service to a Customer for nonpayment of a disputed amount if the Customer has: (a) submitted a claim to CAB for informal review; and (b) deposited the disputed amount with the Commission. No late charge or penalty may be imposed on the amount in dispute deposited with the Commission. During the time any CAB review is pending, no late charges or penalties may be collected, the charge may not be sent to collection, and no adverse credit report may be made based on non-payment of the charge.

22 Original Page Testing and Adjusting RULES AND REGULATIONS (Cont d) Upon reasonable notice, the circuits provided by Global shall be made available to Global for such tests and adjustments as may be necessary to maintain them in satisfactory condition. No interruption allowance will be granted for the time during which such tests and adjustments are made Local Charges In certain instances the Customer may be subject to local telephone charges or message unit charges in using Global s service. Global is not responsible for any such local charges imposed directly on the Customer by the local telephone company for gaining access to Global s intercity network Taxes and Surcharges Customer will be billed for and is liable for payment of all applicable federal, state and local taxes, surcharges or other assessments including such amounts as Global may be authorized to pass through to the customer. Pursuant to Resolution T-16901, all telecommunications carriers are required to apply CPUC mandated Public Program Surcharge rates and the CPUC Reimbursement Fee rate to intrastate services. For a list of the Public program surcharges and Reimbursement Fee, and the amounts, please refer to the AT&T Communications of California, Inc. tariffs. Exclusions to the CPUC mandated Public Program Surcharge rates are as follows: 1. Universal Lifeline Telephone Service (ULTS) billings 2. Charges to other certificated carriers for services that are to be resold 3. Coin Sent paid telephone calls (coin in box) and debit card calls 4. Customer-specific contracts effective before September 15, Usage Charges for coin-operated pay telephones 6. Directory advertising 7. One-way radio paging Exclusions to the CPUC Reimbursement Fee rate are as follows: 1. Directory advertising and sales 2. Terminal equipment sales 3. Inter-utility sales

23 Original Page General Description of Global s Services 3.0 SERVICE DESCRIPTION AND RATES Global s services are offered to subscribers on a monthly basis All service shall remain in effect for a minimum of thirty (30)days Global offers its services subject to the availability of the necessary facilities and/or equipment. Global reserves the right to refuse to provide service to or from any location where the necessary facilities and/or equipment are not available. 3.2 Metered Use Service Metered Use Service offers the use of intercity communication facilities shared among multiple users. The Customer s basic monthly charges for its use of these intercity communication facilities are based upon the total time the Customer utilizes such facilities from each originating location and can vary, depending upon the option chosen, with the distance of each call Unless otherwise specified, calls will be measured from the time that the called party answers to the time that either the calling or called party disconnects from the call, as indicated by answer supervision. No charge is made for calls not completed. It is never the Company s policy to charge for incomplete calls. A Customer may dispute any charges by contacting the Company s Customer Service Department and proper credits will be issued if upon investigation the disputed charges are found to be incorrect. For billing purposes, the duration of each call will be rounded as specified in the description of each service option in the following sections. The rates per minute charged for service are set forth in this Section.

24 Original Page Some Metered Use Service involves a recurring monthly minimum usage charge for intercity facility usage. A monthly listing of each individual call and its duration is available as a standard feature on the bill Global In order to utilize Global s facilities intrastate, a Customer must be a Customer under Global s Tariffs FCC No. 5 and 8. Appropriate rates and charges found therein apply for all options and services other than intrastate calling. Customers may experience busy signals in less than one percent (1%) of all calls. Global is a one-way dial up multi-point service whereby the Customer originates a call by dialing 1+ the area code and desired telephone number or dialing 10XXX plus 1+ the area code and telephone number. Calls may terminate to any location within the state of California. A Customer may complete calls via Option A Travel Service, or via Global Access at the rates set forth below. A.
