2 Section 1. Introduction S.1 of the Danish Protection of the Marine Environment (Act no of 10 December 2015 Valid) provides that the Act shall contribute to the protection of nature and the environment, so that society develops on a sustainable basis with respect of the conditions of life of human beings and the preservation of flora and fauna. Section 2. Purpose The purpose of the present waste management plan is to describe the waste reception facilities provided by Copenhagen Malmö Port in the areas operated by it in the Port of Copenhagen. Copenhagen Malmö Port (from here on CMP) wishes to contribute to efforts to attain an environmentally positive effect on the marine environment by means of the safe handling of the operational- and cargo waste of ships in general, with ships calling at the port motivated to deliver all waste in the port, in the first-order to derive or dump it in the ocean. According to s. 15 of chapter 6 of BEK no. 415, the port operator must draw up a plan for the reception and management of ship-generated waste and arrange for subsequent updates of the waste management plan in case of material changes in the operation of the port. The updated plan must be sent to and approved by the Danish Environmental Protection Agency (EPA). According to s. 1(5) of Chapter 1 of BEK no. 415, the provisions contained in it shall apply to all operational waste and all cargo residues on board ships calling at the port. The waste management plan is available on CMP s website, under the tab Port info, Rules & Regulations. The Danish version is legally binding. The waste management plan takes effect on 1 January 2017 and is applicable until further notice. Section 3. Responsibility CMP is owned by CPH City & Port Development I /S, the City of Malmö and private investors. CMP is not covered by the Ports Act, as such, yet the rules about coastal protection. CMP is responsible for the operation of the commercial port, and the preparation and implementation of this waste management plan. The port has about 2,800 ship calls annually. Andersen, tel , or the Maritime Coordinator, Annette Berg Neergaard, tel The ship owner (the ship s owner, charterer, disponent owner or manager) is responsible for the accuracy of all information provided by the master of the ship about the waste (type, composition, amounts, and collection time) as well as for any damage caused by errors or omissions, including such as occur in connection with the manual operation. The ship owner is responsible for any damage caused by incorrect, misguiding or insufficient information provided by the master. This also applies to damage sustained by a third party. By signing a waste order form, the broker/agent of the ship guarantees the accuracy of the information passed on by him on behalf of the master of the ship. 2

Contact information Copenhagen Malmö Port AB Containervej 9 DK-2150 Nordhavn, Copenhagen, Denmark TLF (24 H) Reception facilities In accordance with applicable legislation and guidelines, CMP has established reception facilities in the areas operated by it in the Port of Copenhagen for: Small combustible waste, large combustible waste and recyclable waste Hazardous waste, hospital waste, oil and chemical waste Sewage (Black water) and Bath water (Grey water) Slop oil Oily tank washing water Clean ballast water CMP's reception facilities consist of containers, UN approved plastic drums, mobile reception facility and CMP s stationary reception facility at Oceankaj. Collection, transportation and disposal are handled by an approved transporter, registered in the Danish Environmental Protection Agency (EPA), see section 12. CMP can provide assistance in contacting to collect incinerator ash, emergency pyrotechnics and scrubber waste. The cost of disposing is borne by the ship and is determined in accordance with the List of charges Incinerator ash (dry) is collected in liftable sealed bigbags. Emergency pyrotechnics is collected in UN approved plastic drums, removable vermiculite head, max 5 kilo NEM (net explosive mass) per drum. Scrubber waste is collected in Y approved pallet tanks. Requests for the above collection has to be with at least 3 working days of notice. CMP can not help with delivery of empty drums or pallet tanks. CMP s current reception facilities do not include an arrangement for sewage sludge from biological treatment plants, and oily waste containing emulsifiers that prevent separation into an oil phase and a water phase. The use of incinerators (combustion plants) and activities causing the unnecessary development of smoke, dust, odours or noise, are not allowed in the port area. 3

4 According to s. 21 of the Executive Order on the standard rules for the observance of regulations in Danish commercial ports, unless otherwise agreed with the Port Authority it is not allowed to unload or place waste in the port area. Available waste containers must not be used for environmentally negative and hazardous products, substances and materials. Containers are intended exclusively for general operational waste generated by ships, see section 5. According to s. 23 of the Executive Order on the standard rules for the observance of regulations in Danish commercial ports, it is not allowed to burn, flush, pump out or deposit any kind of liquid or solid waste, including oil, chemicals, toilet waste, liquid waste from the scuppers and similar waste, or residues or water containing such substances, in the port area. Delivery obligation and notification (SafeSeaNet) According to s. 11 of Chapter 4 of BEK no. 415, the master of a ship calling at a port has a duty to ensure that all operational waste and all cargo residues are delivered to the port s reception facility, see however subs. 2 which provides that if the notification stated in s.12 documents that the involved amounts of waste are small and can be stored on board the ship in an environmentally safe manner, and if it is possible to deliver the waste, together with waste subsequently generated, at the next port of call, the master shall be exempt from the duty set out in par. 1. According to s. 12 (9) of Chapter 4 of BEK no. 415, must waste information as of June 1, 2015 be submitted electronically via SafeSeaNet. Collection requests The CMP waste order form 2017, Annex 1 shall be be submitted as to the Port Office / Port Security (24 H). portoffice@cmport.com Tel.: The waste order form must be received at least 24 hours in advance of the ship s arrival in the Port of Copenhagen, if the port of destination is known. Alternatively as soon as the port of destination is known, provided that this information is only available within the 24 hours preceding the arrival, or not later than upon the departure from the previous port visited, if the duration of the voyage is less than 24 hours. Only signed forms are accepted. Collection schedules Collection takes place within the normal working hours of the port (Monday to Thursday from 7am to 3pm, and Friday from 7am to 2.30pm). However, ships calling at the port outside normal working hours may arrange for waste collection with the Harbourmaster s office. 4

5 Delays Delays attributable to the ship, including in vain driving, unnecessary handling and container deliveries, and the delivery of sewage, bath water, slop oil or tank washing water at a pumping speed lower than that prescribed by the waste management plan, will be charged to the ship in accordance with the applicable schedule of fees, see section 13. Fees According to s.13 of Chapter 5 of BEK no. 415, payment for the reception and handling of shipgenerated waste must be included in the standard port dues. However, the port operator shall be entitled to claim separate payment in the following situations: The amount of operational waste stated in the delivery request is larger than the amount of operational waste generated by the ship since the previous port of call in case of regular service and in view of its size and type. If the request is for the delivery of operational waste outside the port s normal working hours (Monday to Thursday from 7am to 3pm and Friday from 7am to 2.30pm). If the ship does not pay the normal port dues. If notification is received less than 24 hours before arrival. If notification is not made in accordance with s. 12. If the ship cannot produce the required pump capacity. If the waste is cargo-associated sewage or cargo-associated waste covered by Annex V of Marpol 73/78. Operational waste S. 4 of Chapter 1 of BEK no. 415 defines operational waste as follows: any type of waste, including wastewater, and residues other than cargo residues, generated during the operation of a ship and falling under Annex I, IV and V of Marpol 73/78, as well as cargo-associated waste as defined in the guidelines for the implementation of Annex V of Marpol 73/78. Cargo waste S. 4 of Chapter 1 of BEK no. 415 defines cargo waste as follows: residues of cargo materials in holds or tanks after the completion of unloading and cleaning, including residual amounts of cargo and waste caused by loading/unloading. According to s. 14 of Chapter 5 of BEK no. 415, the fee for the reception and handling of cargo residues is determined on the basis of the amount and type of cargo residues delivered. Regarding the collection of such part of the waste as relates to the ship s cargo, reception facilities have been provided by CMP in accordance with Danish legislation. The cost of disposing of cargoassociated waste is borne by the ship and is determined in accordance with the applicable schedule of fees, see section 13. Further information is available in sections 5 to 11. State vessels and other vessels For state vessels and other vessels exempted from tonnage and cargo dues, settlement will be made in accordance with the applicable schedule of fees, see section 13. Vessels plying to and from port enterprises with own reception facilities must use these facilities as the primary facility 5

6 Receipts for waste deliveries Once waste has been delivered, etc., a waste receipt will be sent to the ship or its agent by , stating the amount and time of waste delivered. Right of property and registration When the ship has delivered its waste to the port, it becomes the property of CMP. Waste and type per. reception facility are registered in spreadsheets using the waste receipts from waste transporters. A copy of the waste receipt from small combustible waste, is sent to the Border veterinarian in Copenhagen. Waste management costs are available on CMP's website. Consultations and reporting of inadequate waste reception facilities The Port carries out consultations with representatives of users, subcontractors and other involved parties as and when required. If, in the assessment of a ship, the reception facilities available are inadequate to cover the ship s delivery requirement, contact should be taken to CMP s officers, see page 2. If, as a result, the ship s master or agent finds it necessary to draw the attention of the environmental authorities to the alleged inadequacy or deficiencies of the reception facilities, this may be done by means of Annex 2. The filled-in form is sent to the Harbourmaster, who will send a copy to the Danish Environmental Protection Agency. 8 Section 5. Small combustible waste, large combustible waste and recyclable waste According to s. 21 and 22 of Chapter 7 of the Protection of the Marine Environment Act, waste may not be discharged in the Danish sea territory, except for fish and parts thereof. In the area of the Baltic Sea and the North Sea, food waste may be discharged only if discharge takes place at least 12 nautical miles from the nearest land. Catering waste from ships and aircraft engaged in international voyages (Category 1 material), shall however, according to Guiding. no of 07/06/2010 Valid, without unnecessary delay, be transportet to a controlled incineration plant having signed an agreement with the City of Copenhagen. Reception facilities 22 m3 maxi container, 12 m3 midi container, 8 m3 front load container and 600 liter mini container. Containers for cruise ships are locked when deployed, but will be opened upon the arrival of the ship. They may be locked again on departure by the ship or its representative. The ship is responsible for the containers requested by it during its stay in the port. Permanent containers on the Copenhagen container terminal and Prøvestenen are accessible 24 hours a day and are emptied during the normal working hours of the port. For locations in the port, see page 11. Collection and transportation are handled by an approved transporter, see section 12. Waste trucks must have unimpeded access to and from the collection point without delays. Fees Such part of the waste as is associated with the operation of the ship is collected under no special fee, provided that the amounts are reasonable and were generated since the previous port of call in view of the ship s size and normal service. The facilities are available only for ships paying the tonnage and cargo dues applicable to the stay. If the waste amounts collected are disproportionately large, if notification is received less than 24 hours before arrival, in case of delays and attendance in vain, or if collection is requested outside the normal working hours of the port, the fees set out in the schedule of Fees in section 13 will apply. As regards the collection of such part of the waste as is associated with the ship s cargo, CMP provides reception facilities as required by Danish legislation. The costs of disposing of cargoassociated waste are borne by the ship. Special provisions Criteria for reception under no special fee : Combustible waste must be separated in small (maximum 100 x 50 x 50 cm) and large (maximum 300 x 125 x 20 cm) combustible waste. Small combustible waste MUST NOT be offloaded in big bags or in compacted bales, they may get stuck in the funnel at the incineration plant and cause a stoppage. 8

9 Heavy waste must be distributed evenly on the two sides of the container to prevent it from tiltning and only halfway loaded to where the doors start. The waste must not be so wet as to cause the seepage of liquids from the container. Other (kg/ m3) must be specified in the waste order form, see Annex 1. That combustible waste does not include: Hazardous waste, electronics, pallets, mattresses, incinerator ash, sewage sludge from bio-logical treatment plants, remains from the cleaning of exhaust gases from ships, emergency pyrotechnics, strong ropes, cables,, construction waste, white goods, PVC, fluorescent lamps, etc. or to large amounts of recyclable waste such as glass, plastic, cardboard and metal. According to s. 15 of City of Copenhagen s regulations for commercial waste, combustible waste is defined as waste within the definition of combustible waste in the Statutory Order on Waste s. 3 (25) of Chapter 2, where it says that combustible waste is waste not suitable for material recovery and that can be destroyed by incineration, without combustion of which gives rise to emissions of pollutants in unacceptable degree. Combustible waste is received as small combustible waste and large combustible waste in the below two sizes. Small combustible waste Small combustible waste is waste suitable for incineration, where components have a maximum length of 100 cm and no compact parts is bigger than 100 x 50 x 50 cm. CMP's small combustible waste goes directly to incineration at Amager Resource Center ( where it is registrated, weighed and destroyed by incineration and converted into district heating and electricity. Large combustible waste Large combustible waste is waste suitable for incineration, where components have a maximum length of 300 cm and no compact parts is bigger than 300 x 125 x 20 cm and a weight of maximum 80 kg. Large combustible waste goes to pretreatment at a waste facility at Large combustible waste is bigger than 100 x 50 x 50 cm and typically includes wood, cardboard, paper and plastics, furniture, equipment and pallets. The waste goes to presorting, where recyclable waste are separated and sent for recycling. The remaining waste is crushed to the size that is required for incineration, Recyclable waste CMP's recyclable waste such as pallets, plastic, cardboard, glass, crockery and metal are collected in specially marked containers (see page 10). Containers are put at the quay. The collected waste are transported for recycling by an approved registered collector. 9

10 Pallets Untreated wood is 100% pure, untreated wood for example disposable pallets, wood packaging and clean decomposition timber. Untreated wood may contain minor amounts of nails, screws and metal brackets, but not surface as varnish, color and glue. Untreated wood are transported to a facility where they are sorted before going to recycling. Mixed plastic Plastic covers wide and represents both soft and hard plastics. Discarded plastic is used for the production of, for example, a new plastic film, plastic bags, sacks and tubes. Clean plastic are collected and sorted and goes to pretreatment and granulation before final disposal for the plastics industry. Paper and cardboard, mixed Office paper, cardboard, mixed paper, newspapers and magazines are send for pretreatment and further sorting. Mixed glass and bottles Glass, bottles and packing (Beverages, glass packaging from food and surplus from production) must be empty. Larger amounts of glass and bottles are send to pretreatment, before going to recycling in the glass industry. Crockery Mugs, plates and similar ceramics are collected for landfill. Scrap iron/ metal Metal (Copper, aluminum, stainless steel, brass, etc.) are transported to a waste facility where it is checked and sorted into detailed category, before going to an environmentally approved facility in the recycling industry. Hazardous waste, hospital waste, oil and chemical waste CMP s reception facilities for hazardous waste, hospital waste, oil and chemical waste covers medical waste, paint, thinners, dry cleaning fluid, photographic fluids, fluorescent tubes, light sources, spray cans, cooking oils, batteries, electronics, sharp objects, packaged oil and chemical waste in the form of solid oil products, oil filters, oily rags and empty oil barrels for disposal. This group of waste falls under the segregation at the source regime, and the waste must be packaged and labeled in accordance with applicable IMO guidelines. Reception facilities According to the City of Copenhagen s regulations for commercial waste, hazardous waste shall be properly packaged so that the content can t accidentally escape. CMP s Hazardous waste, hospital waste, oil and chemical waste are collected in UN approved plastic drums. Collection and transportation are handled by an approved transporter, see section 12. Fees Collection of such part of the waste as is associated with the operation of the ship falls under no special fee, provided that the amounts are reasonable and were generated since the last port visited, both as regards the size and normal service of the ship. The regime applies exclusively to ships paying the tonnage and cargo dues payable for the visit. If the waste amounts collected are disproportionately large, if notification is received less than 24 hours before arrival, in case of delays and attendance in vain, or if collection is requested outside the normal working hours of the port, the fees set out in the schedule of fees in section 13 will apply. The cost of disposing of cargo-associated waste, or if the ship's drums is damaged or outdated by more than 5 years and must be repacked in new UN approved plastic drums, is borne by the ship and is determined in accordance with the applicable schedule of fees, see section 13. Special provisions Criteria for reception under no special fee : Other (kg/ m3) must be specified in the waste order form, see Annex 1. Hazardous waste is collected only in UN approved packaging. Recyclable waste Batteries, light sources, spray cans, oil filters and oil waste in packing are send for pretreatment, before going to further recycling. Electronics are controlled and sorted and metals, plastic and other non electronic equipment are sorted out. This is according to the WEEE Directive. Waste for incineration Hospital waste (care risk waste), medical waste, paint, thinners, dry cleaning fluid, photographic 12

13 fluids, solid products in the form of empty packaging which have contained oil, grease, and oil rags, oily floor sweepings, oily absorbent material, air filters and oil and fuel filters, solid organicchemical waste, inorganic acid waste in small packaging under 25 liters, inorganic alkaline waste in small packaking under 25 liters, are send for pretreatment before going to incineration and converted into district heating and electricity. 14 Section 7 & 8. Sewage (black water) and Bath water (grey water) According to s. 20 of Chapter 6 of the Protection of the Marine Environment Act, the discharge of sewage (drainage or other waste from toilets, hospital rooms and spaces containing living animals) is allowed in the Danish sea territory and in the Baltic Sea area only if: 1) The discharge involves the use of an approved sewage treatment plant and the wastewater produces no visible traces in the sea when discharged from the plant, 2) The wastewater (Grey water) has been finely divided and disinfected in an approved plant and is discharged at least 4 nautical miles from the nearest land, or 3) Discharge (Black water) takes place at least 12 nautical miles from the nearest land. Furthermore, if discharge is made from a tank for the collection and storage of sewage, the speed of the ship or the platform must be minimum 4 knots, and discharge must be done at a moderate drainage velocity. According to Annex IV of MARPOL 73/78, sewage is defined as: drainage or other waste from any type of toilet, as well as drainage from wash basins, wash tubs and drains in hospital rooms, and drainage from spaces containing living animals or other wastewater if mixed with one of the aforementioned types of drainage. According to Annex V of MARPOL 73/78, bath water is defined as drainage from dishwashing, showers, laundry, bath and wash basins. Reception facilities In the mobile reception facility established by CMP, the collected sewage and bath water is delivered to a municipal treatment plant through a pumping station and the sewers as well as CMP's stationary reception facility at Oceankaj. Before delivery of sewage or bath water to CMP s reception facilities, the declaration Annex 4, must be signed by the ship. For large amounts of waste it is possible to use three tanker lorries of 30 m3 each per hour, depending upon the ship s pumping capacity and the time available. Collection, transportation and disposal are handled by an approved transporter, see section 12. Fees Sewage collection falls under no special fee, provided that the amounts are reasonable and were generated since the previous port of call (130 liter per person per day), both in view of the size of the ship and its normal service. The regime applies exclusively to ships paying the tonnage and cargo dues payable for the visit. If the waste amounts collected are disproportionately large, if notification is received less than 24 hours before arrival, in case of delays and attendance in vain, or if collection is requested outside the normal working hours of the port, the fees set out in the schedule of fees in section 13 will apply. Payment for the reception of bath water is charged in accordance with the applicable schedule of fees, see section

15 Special provisions Criteria for reception of sewage under no special fee : The ship must deliver sewage at portside with a pumping capacity of minimum 50 m 3 per hour, Tanker lorries must have unimpeded access to and from the collection point without any time delay, The ship must be provided with a standard flange as shown in the chart below. If the sewage is not cargo-associated, see section 4. The flange with equivalent packing of oil-resistant material must be able to withstand a working pressure of 6 kg/ m 2 15

16 Section 9. Slop oil According to s. 11 of Chapter 2 of the Protection of the Marine Environment Act, the discharge of oil is not allowed in Danish sea territory. According to s. 9 of Chapter 2 of the Protection of the Marine Environment Act, oil is defined as any type of mineral oil and mixtures thereof, including crude oil, natural gas condensate, oil sludge and oil waste, as well as fuel oil and all other refined products except for petrochemicals classified according to s. 14. According to Annex I of MARPOL 73/78, oil waste and chemical waste are defined as all types of oil waste resulting from the transportation of oil, such as fuel, slop oil, tank washings and dirty ballast water. Reception facilities CMP has established a mobile reception facility in which the separated and cleaned oil is reused. Collection, transportation and disposal are handled by an approved transporter, see section 12. The port does not take reception of oily waste containing emulsifiers that prevent separation into an oil phase and a water phase. Fees Collection is made under no special fee, provided that the amounts are reasonable, both in view of the size of the ship and its normal service, and subject to the special provisions set out below. The regime applies exclusively to ships paying the tonnage and cargo dues payable for the visit. If the waste amounts collected are disproportionately large, if notification is received less than 24 hours before arrival, in case of delays and attendance in vain, or if collection is requested outside the normal working hours of the port, the fees set out in the schedule of fees in section 13 will apply. Special provisions Criteria for reception under no special fee : The ship must deliver slop oil at portside at a pumping capacity of minimum 7.5 m 3 per hour, Tank lorries must have unimpeded access to and from the collection point without any time delay, The ship must be provided with a standard flange as shown in the chart below. 16

If, by means of the calculation method set out above, a ship can prove that it generated more than the amount stated above, the generated amount will be accepted. 17

18 Bunker ships and other ships Bunker ships may deliver a reasonable amount of slop oil under no special fee, depending upon the duration of the voyage and provided that they can produce a receipt for waste delivery from the previous port of call. Provided that notification is made 24 hours before the requested time of slop collection, ships operating with Copenhagen as a fixed port of call may deliver reasonable amounts free of charge, depending upon an estimate made by the port and based upon the fuel consumption of the ship. 18

19 Section 10. Oily tank washing water According to s. 11 of Chapter 2 of the Protection of the Marine Environment Act, the discharge of oil is not allowed in Danish sea territory. According to s. 9 of Chapter 2 of the Protection of the Marine Environment Act, oil is defined as any type of mineral oil and mixtures thereof, including crude oil, natural gas condensate, oil sludge and oil waste, as well as fuel oil and all other refined products except for petrochemicals classified according to s. 14. According to Annex I of MARPOL 73/78, oil waste and chemical waste are defined as all types of oil waste resulting from the transportation of oil, such as fuel, slop oil, tank washings and dirty ballast water. Reception facilities CMP has established a mobile reception facility for oily tank washing water containing products classified as hazard class II and III. The separated and cleaned oil from tank washings is reused. The waste order form Annex 1 must be received at least 24 hours in advance of the ship s arrival in the Port of Copenhagen. See page 4. Collection, transportation and disposal are handled by an approved transporter, see section 12. Fees The ship will be charged a tonnage due for the visit. The amount charged for its use of the reception facilities is settled directly with the transporter. See section 13. Special provisions Oily tank washing water may not contain petrochemicals. The ship must fill in a declaration, Annex 3, to be handed over to the recipient. The ship must be provided with a standard flange as shown on the chart on page

20 Section 11. Clean ballast water According to s. 13 of Chapter 3 of the Protection of the Marine Environment Act, the discharge of liquid substances transported in bulk is not allowed in Danish sea territory. According to s. 19a of Chapter 5a of the Protection of the Marine Environment Act, ballast water is defined as water brought on board a ship to regulate its maneuverability, list, draft, stability or stresses. According to s. 19b of Chapter 5a of the Protection of the Marine Environment Act, the discharge of ballast water is allowed only as provided by the rules of said chapter as well as the rules provided pursuant to it. The treatment of ballast water must involve the use of an approved and sustainable plant that fulfils internationally determined treatment standards. The convention on ballast water is expected to take effect when the majority of nations have ratified the Convention, and it provides that all ships depending upon the time they were built and their ballast water capacity must either change ballast water or treat it on board the ship by means of approved equipment. According to an IMO decision, starting in 2016 all ships must effect treatment of their ballast water. Accordingly, there is a considerable need for the development of technology and the administrative requirements to be made to certification, control and handling of ballast water (Source: The Danish Maritime Authority). Until further notice, clean ballast water may be discharged in the Port of Copenhagen. Dirty ballast water from oil tanks must be delivered according to the provisions set out in section 10 on oily tank washing water. This page will be updated upon the entry into force of the convention. 20

22 Section 13. Schedule of fees applicable as of 1 January 2017 If the criteria for delivery under no special fee is not met, the actual cost will be charged based on the fees set out below. The fees below are stated less VAT and may be changed without notice.
