1 DECISION MEMO USDA Forest Service Inyan Kara Riders Motorcycle Enduro Event Rocky Mountain Region Thunder Basin National Grassland Medicine Bow-Routt National Forests Douglas Ranger District April 2011 Proposed Action: The proposed action is to authorize the Inyan Kara Riders out of Upton, Wyoming, to organize a motorcycle enduro on the third Sunday in June and to use the approximately 45 miles of singletrack trail in the Upton and Osage, or Inyan Kara Area of Thunder Basin National Grassland. In response to resource specialist concerns raised during internal scoping, the following restrictions will apply: Two golden eagle nest sites and 2 ferruginous hawk nest sites are within ½ mile of the proposed course. These nests have not been monitored in several years. If active, the TBNG LRMP requires the following timing restrictions: golden eagle, February 1 through July 31; ferruginous hawk, March 1 through July 31. The nests in proximity with the endure track will be checked each year, and if found to be active, the timing restrictions will be applied. This may require portions of the endure to be re-routed. Trail crossings of riparian areas will be done at right angles to the riparian zone. The trail will be monitored during and after the event for any erosion issues, with any problem areas that are identified, targeted for repair. Other design criteria are as follows: Five-pound fire extinguishers will be present at all fueling sites and areas of concentrated use. A county fire engine will be on standby in the event of a fire. All vehicles associated with the event will stay on open roads and trails as per the Thunder Basin National Grassland Motor Vehicle Use Map (MVUM).and/or in parking areas. Monitoring of reclaimed abandoned mine sites in the area of the event will occur before and after the event to ensure reclamation was not damaged as a result of off-road motor vehicle use associated with the event. To avoid adverse impacts to wildlife habitat, no race activities may be conducted inside the fenced habitat area of Kellogg Reservoir. Vehicles operating on NFS roads are to be restricted to speeds below 35 mph. Permit holder will sign all NFS roads being used for this event with approach signing that informs other public vehicle operators that a motorcycle event is occurring and to drive slowly, etc. Signs will comply with the Manual on Uniform Traffic Control Devices (MUTCD). All signs will be removed within one week after the event. 1
2 Permit holder will be responsible for maintaining NFS trails to standard prior to and following the event. Inspect trail and re-route trail segments which are parallel or follow drainages to at least 50 feet away from the drainage. Identify trail segments which are visibly contributing to sediment into drainages and install water bars or other drainage to minimize sediment. Annually monitor trail and take action to mitigate expansion of disturbed areas, such as from hill climb areas, etc. Purpose and Need The Inyan Kara Enduro is an annual event that is of economic importance to the small community of Upton, Wyoming. Upton has suffered setbacks to its economy in recent years. The Enduro event brings 300 riders, their families and friends to Upton, which in turn, is a boost to the local economy. However, without the assurance that the event can occur each year, local businesses cannot plan for, and make the investments that are necessary, to more fully capture the economic opportunities that the event represents and can bring to the community. Nor can the city government promote the enduro event to tourists. The Inyan Kara Enduro is a charity ride. All revenues outside of prizes and fees go to deserving individuals and organizations in the community as charitable donations. The assurance of being able to plan for this important charitable source provides stability to those organizations that rely on this money, especially in this economic downturn which has severely cut into charitable donations from other sources. The Forest Service also benefits from the stability of a five-year authorization for the Inyan Kara Enduro. The priority permit allows for less administrative work-load, as well as assuring the continued trail maintenance of the system in the Upton/Osage Area, which is a benefit of approximately $7000/year in saved crew and travel time for the Forest Service. Decision: I have reviewed the previous Inyan Kara Riders Motorcycle Enduro Event Decision Notice, signed June 21, 2004, and the comments received through the external scoping conducted December 20, 2010 for the re-issuance of the Inyan Kara Riders Motorcycle Enduro Event on Thunder Basin National Grassland. I have also reviewed the most recent data available regarding the rangeland, botany, wildlife, heritage and riparian area current conditions, the comparison between the current (existing) and desired conditions, and the Thunder Basin National Grassland Land and Resource management Plan (Grassland Plan) management prescriptions, management standards and guidelines (S&Gs), and goals and objectives for the analysis area. 2
3 I have determined that the resource conditions on the Thunder Basin National Grassland currently meet, or are moving toward, all applicable Grassland Plan and Forest Plan management area desired conditions, the management goals and objectives, and forest-wide and management prescription area standards and guidelines (S&Gs). Based upon my review and consideration of the project record I have decided to authorize the issuance of a five-year priority Recreation Special Use Permit for the Inyan Kara Riders Motorcycle Enduro. My conclusion is based on a review of the record that shows a thorough review of relevant scientific information, a consideration of responsible opposing views, and the acknowledgement of incomplete or unavailable information, scientific uncertainty, and risk. Rationale for the Decision The Inyan Kara Riders Motorcycle Enduro Event has proven to be a consistently well-run event in the 16 years it has been permitted on Thunder Basin National Grassland. The organizers have proven to be conscientious in their running of the event, as well as the yearly maintenance of the trail system. This event has also proven to be of economic benefit to the City of Upton, which is an underserved community. Continued authorization of this event will provide stability to the organizers and the business community of Upton in their advertising and preparations. Hydrological systems are not considered impacted by this event, as the trail system is not located near any wetlands mapped by the National Wetlands Inventory. The hydrologist recommended several design criteria (see above), which if followed, will meet the Grassland Plan Standards and Wyoming State Water Quality Standards. There are no threatened or endangered wildlife species on Thunder Basin National Grassland; however, there are two candidate species; mountain plover and greater sage grouse. Neither species has habitat in the proposed area, and therefore, will not be impacted by this event. No adverse impacts were expected for any sensitive species or management indicator species (see the biological Evaluation and Wildlife Specialist Report, April 13, 2011 in the file for the lists of these species). Two Species of Concern, Golden Eagle and Ferruginous Hawk, have nests near and within the trail system. No monitoring of these nests has been done for several years; therefore, design criteria have been developed to assure annual monitoring for occupation prior to the event, so re-routing of the trail away from the nest may occur. Reasons for Categorical Exclusion of the Proposed Action: According to Chapter 30 of the Environmental Policy and Procedures Handbook (4/17/2009), under 31.2, Categories of Action for Which a Project or Case File and Decision Memo Are Required (15), Issuance of a new special use authorization for a new term to replace an existing or expired special use authorization when the only changes are administrative, there are not changes to the authorized facilities or increases in the scope or intensity of authorized activities, and the applicant or holder is in full compliance with the terms and conditions of the special use authorization. 3
4 Issues in regards to bald eagle and ferruginous hawk nests were identified in the past and present internal scoping for this proposal; however, design criteria have been outlined and are listed above to alleviate these issues. These same issues and design criteria were in the previous Decision Notice and part of the authorization and operating plan for the event. Scoping and Public Involvement: Internal scoping was conducted in March, 2010 to review the previous NEPA conducted for this activity. Based on this internal scoping, no new significant issues were identified. Public scoping was conducted in December, 2010 with the Wyoming Game and Fish Department identifying concerns with any potential erosion on the trail. This has been identified with mitigation measures addressed above. No other issues were identified. Findings Required by Other Laws: Floodplains, wetlands, prime lands, threatened and endangered plant and animal species, global warming, minerals, cultural resources, consumers, civil rights, women, minority groups, and other environmental factors have been considered and will not be adversely affected. I have determined that this decision is consistent with the Grassland Plan approved by the Regional Forester on July 31, The decision complies and is consistent with: Executive Order Protection of Wetland 42 FR (signed May 25, 1977) and Executive Order Floodplain Management 42 FR 26951, (signed May 25, 1977). The Forest Service has evaluated the planned action in accordance with these Executive Orders and the decided action has been found to be in compliance with those orders. No wetlands or floodplains occur in the project area. National Historic Preservation Act of October 15, 1966, (80 Stat. 915) P.L , as amended, & Archeological Resources Protection Act of October 31, 1979, (93 Stat. 721) P.L 96-95, as amended. A Heritage resource inventory and report have been completed for the Federal lands in the project area. The Wyoming State Historic Preservation Officer has concurred with the Forest Service determination that the project will have no effects on cultural resources. Clean Water Act (Federal Water Pollution Control Act) of June 30, 1948, (62 Stat II 55) P.L , as amended by the Water Quality Act of 1987, (Act of February 4, 1987, P.L ) and other laws.
