1 1.1 Corperate Health and Safety Policy Nivek Oilfield Hauling Ltd. ( Nivek ) is committed to employee safety and the protection of our environment. Our priority is the prevention of accidents and/or injury to all of our employees and those that work closely with Nivek.. Safety is the responsibility of each and every employee of Nivek, as well as any person present at our facility and worksite. Nivek employees, contractors, sub-contractors and visitors will comply with all applicable municipal, provincial and federal regulations and legislation. Environmental protection will also be the responsibility of each and every employee, contractor, sub-contractor and visitor to Nivek Management has the responsibility of providing its employees, contractors, sub-contractors, visitors and clients with a safe and healthy work environment. All personnel holding management positions will promote a safety attitude and will, at all times, lead by a positive example. Management will enforce compliance of all policies, rules and procedures by way of continued education of the safety program, inspection processes and the use of the disciplinary policy presently in place. All employees must make safety and the protection of the environment the most important part of each and every task. Active participation and adherence to company safety and environmental policies is continually encouraged and is a condition of employment. Constant safety awareness will enable Nivek to maintain a safe and healthy workplace, protect our environment and offer high quality, professional services to our customers. 2 1.2 Petroleum Industry Guiding Principles For Worker Safety We, the members of the petroleum industry, have a responsibility to protect all workers engaged in its activities from personal injury and health hazards. To meet our responsibility we will operate under the following guiding principles: RESPONSIBILITY The operating company, when acting as prime contractor, is responsible for coordination and general supervision of all activities at the work site, including activities carried out by contractors, sub-contractors, service companies and suppliers. While all parties have a responsibility to promote worker safety, the operating company recognizes its leadership role in promoting worker health and safety on the basis that it has the greatest power to influence work site situations. It is the responsibility of workers and employers to refuse to perform unsafe work practices. PRIORITY Activities will be conducted on the basis that safety of all personnel is of vital importance, whether 'those personnel are employed by an operating company, a contractor, a sub-contractor, a service company or a supplier. RECOGNITION The process of selecting contractors, sub-contractors, service companies and suppliers, and the administration of contracts, will include recognition and support of good safety performance. Support and recognition based on good safety performance will also be provided by all employers to their employees. IMPROVEMENT The operating company, in cooperation with service companies within the Industry, will promote methods and practices that have potential for improving safety performance. 3 1.3 Safety Responsibilities Managers Provide a signed Corporate Safety Policy statement that outlines the direction, goals and responsibility relating to the Nivek safety program. The statement provides a commitment and philosophy that sets levels of expectations for safety performance throughout the corporation Ensure the Health, Safety and Environment Program remains current by annually reviewing all documents. Arrange to have necessary revisions completed as needed and ensure the safety program is audited, in its entirety, against the Basic Safety Program Audit Protocol set out by the Petroleum Industry. Maintain overall control of the safety and loss prevention program and implement as necessary. Ensure all established safety policies are administered and enforced in all areas. Ensure that all personnel are aware of and effectively practice the policies and procedures set out in this Health, Safety and Environment (HSE) Program. When required, accompany government O.H.& S. inspector(s) during project inspections. Develop and implement a mentoring program for all new employees for field and facility duties. Correct physical conditions, hazardous situations, defective equipment, which are liable to cause or have caused accidents. Enforce all established safety policies and safe work procedures. Take disciplinary action as necessary to ensure compliance with the rules. Investigate all incidents to determine the route cause(s) and assist personnel in the development of necessary action items. Ensure the maintenance of the highest standards of performance, with respect to the safety program, is reached at any site where work with heavy equipment is required eg. client s job locations, privately owned property and construction sites. Have a clear understanding of his/her responsibilities towards the Health, Safety and Environment (HSE) and develop a clear understanding of safety responsibilities and specific duties of each employee. The manager must be knowledgeable and responsible for complying with all policies, procedures and regulations. Management must lead by example. Make daily observations of safety activities on projects and/or in the facility and provide safe working conditions for all employees under his/her supervision. Maintain good housekeeping standards and assign definite responsibilities to individuals for housekeeping.

4 1.3.2 Health, Safety & Environment Coordinator Responsible for daily administration of safety program. Post all safety bulletins, safety posters, safety rules and regulations. Ensure that pertinent safety reports are submitted as required. Maintain current documentation and necessary safety literature and information on all Government regulations. Establish a schedule for facility, vehicle and equipment inspection. Lead investigation of all incidents to determine the route cause(s) and assist personnel in the development of necessary action items. Review safety and accident reports as they occur. Provide health education material or instruction to all on-site employees as required. Enforce all established safety policies and safe work procedures. Ensure all new employees receive detailed safety instructions through the use of the New Employee Orientation Plan as set out in Section 4 of this Health, Safety and Environment (H.S.E.) Program. Document all safety meetings to include time, date, all topics covered during the meeting, list of all personnel attending, and any action items that may have been created. Copies of the meeting minutes should be posted in the office. Have a clear understanding of his/her responsibilities towards the Health, Safety and Environment (HSE) Program and develop a clear understanding of safety responsibilities and specific duties of each employee. The H.S.E. Coordinator must be knowledgeable and responsible for complying with all policies, procedures and regulations. The H.S.E. Coordinator must lead by example. Review safety conditions, general safety policies and review any incidents that may have occurred each month. Allow contractors/subcontractors to attend Nivek safety meetings when ever possible. Document and file all information gathered for that particular month. Make daily observations of safety activities when working with or around equipment and when on any job site. Inform clients of any safety deficiencies immediately. It is the responsibility of the HSE Coordinator to ensure that all environmental concerns such as spills and/or releases have been documented and cleaned up as necessary. It is also the responsibility of the HSE Coordinator to ensure all environmental rules, regulations, procedures and compliance issues are followed as required.

5 1.3.3 Workers / Personnel Review and retain knowledge of all safety policies, work procedures and their responsibilities towards the Health, Safety and Environment (HSE) Program implemented by Nivek. Comply with all company safety and environmental policies and work standards as set out in this Health, Safety and Environment (HSE) Program and report any unsafe issues immediately to management. Wear all necessary Personal Protective Equipment i.e.) safety glasses, footwear, head protection, fire retardant coveralls, gloves etc. as required for the task at hand. To be in attendance at required meetings for the purpose of acquiring safety education. Assist manager in the implementation and maintenance of the established safety policies, procedures and necessary reporting on all aspects of the Health, Safety and Environment (HSE) Program. It is the reponsibility of all workers to ensure that all environmental regulations, policies and procedures are complied with as required by federal, provincial and municipal governments Contractors/Subcontractors To understand and comply with Nivek Health, Safety and Environment (HSE) Program Immediately report any unsafe conditions or acts to the manager of Nivek that may exist where equipment is being stored or on the job site. To report all accidents/incidents, in writing, immediately to Nivek and to participate in the investigation and assist in developing action items to correct any problem areas. Carry out regular inspections of their work site to ensure a safe and healthy environment for all employees. To supply the HSE Coordinator of Nivek with necessary proof of current WCB coverage and Liability Insurance Coverage. It is the responsibility of the contractor / sub-contractor to ensure any environmental issues are reported immediately to management. It is the reponsibility of all contractor / sub-contractor to ensure that all environmental regulations, policies and procedures are complied with as required by federal, provincial and municipal governments.

6 1.3.5 All Personnel As outlined in the company safety policy, it is the responsibility of all employees to strive for a continued high level of safety and environmental awareness in the day to day operations of the company. The specific responsibilities of all employees will vary from time to time depending on a particular situation and the position they hold within the company. Nivek has the opportunity to work for many different contractors that have safety programs in place. Nivek will comply with the terms and conditions of the primary Client s or Contractor's safety program and the wishes of the on-site primary Client s or Contractor's representative. If it is determined by mutual consent that the " Safe Operating Procedures " developed by Nivek exceed the established standards and are better able to protect the workers, property, material and the environment, Nivek will utilize their policy or procedure with mutual consent of both parties. In order that the most effective and efficient procedures are utilized, the management will use all of the factors at their disposal to the best advantage. This will include: Pre-planning events Personnel scheduling Selection and training of workers Materials, safe handling and controls of environmental issues. Supervising operations Inspecting processes and equipment Establishing a preventative maintenance program Development of a Near Miss Identification Program Orientation and interpretation of company policies to all workers. It is the responsibility of the employer and employee's to understand and comply with the Alberta Occupational Health and Safety Act and Regulations. It is the reponsibility of all contractors / sub-contractors to ensure that all environmental regulations, policies and procedures are complied with as required by federal, provincial and municipal governments.

7 1.3.6 Visitors All visitors are required to report to the front office on their arrival at the facility and/or prior to them visiting any work site that Nivek may be working. Visitors will receive a brief review of company policies as necessary. Such items as the visitor sign in policy, evacuation and fire alarm procdeures and proper use of personal protective equipment will be discussed. All visitors will be required to follow all necessary company policies and procedures as set out in the Nivek. Proper PPE must be worn at all times. Any hazards, accidents/incidents must be brought to the attention of management immediately and details of the incident or hazard must be reported in detail on the proper company form(s). All visitors must report to the main office on arrival at the facility to sign in at the front reception desk and review the safety rules the visitor is required to adhere to. Prior to leaving the facility the visitor is asked to return to the front reception area to sign out on the attendance sheet. 1.4 Management Communication Nivek uses different means of safety communication to promote workplace safety and to open the lines of communication between employees and management. It is essential to have good communication between management and employees. This adds necessary value to the Health, Safety and Environment Program. The safety communication system at Nivek consists of: New Employee Safety Orientation Use of Incident/accident Reports Safety Meetings as required Internal office memos Posted reports Safety training as required by Government Regulations and guide lines set out by the Petroleum Industries. Environmental Awareness. All employees are expected to participate in all aspects of the Health, Safety and Environment Program and become familiar with the contents of the safety program and abide by all rules and policies set out in this program.
