3 INTRODUCTION The term pesticide includes herbicides, insecticides, fungicides, rodenticides, and other pest control products. Individuals who apply or consult on the use of pesticides may be required to be licensed with the Oregon Department of Agriculture (ODA), depending on the type of work to be performed and the classification of the pesticide involved. This booklet has been prepared to assist individuals interested in becoming licensed as pesticide applicators, trainees, or consultants in Oregon. It is not intended to be a substitute for the OREGON PESTICIDE CONTROL LAW (Oregon Revised Statutes - Chapter 634) or the OREGON PESTICIDE REGULATIONS (Oregon Administrative Rules, Chapter 603, Division 57). SITUATIONS WHERE LICENSING IS NOT REQUIRED There are a limited number of instances where individuals who apply pesticides are NOT required by Oregon law to hold a pesticide-related license; they are as follows: 1. Application of a general-use pesticide on an individual s own (or leased) property, or that of his/her employer while acting as an employee. ( General-use pesticides are those which do not bear a Restricted-Use Pesticide statement on the front panel of the label). 2. Consulting on the use of general-use pesticides. 3. Performing structural pest inspections for the benefit of individuals purchasing or selling homes or other real property. (FHA, VA and other lending institutions may require pest and dry rot inspectors to hold commercial pesticide applicator/pesticide operator licensing. In addition, the Construction Contractors Board requires registration of pest and dry rot inspectors with their agency). 4. Employees of the State of Oregon or its agencies, counties, cities, municipalities, irrigation districts, drainage districts, public utilities, and telecommunication utilities who do not use restricted-use pesticides or apply pesticides with machine-powered equipment in the course of their application work. 5. Persons who do not advertise or publicly hold themselves out as being in the business of applying pesticides but whose main or principal work or business is the maintenance of small or home lawns, shrubs, or gardens [ORS (6)]. Some landscape companies may fall under this exemption if: 1) no restricted-use pesticides or machine-powered equipment are used, 2) the income generated from pesticide application is minor compared to the total business (10% or less), and 3) the use of pesticides is not specified in advertisements, contracts or invoices. PESTICIDE CERTIFICATION VS. PESTICIDE LICENSING There are two terms which should be understood before an individual begins the licensing process: certification and licensing. Certification is the process of demonstrating a minimum level of competence in specific categories of application for the purpose of obtaining the corresponding license. A passing score of 70% or higher on the appropriate examination(s) is required to become certified and eligible for licensing. An individual s certification period begins on the date that the required examination(s) are successfully completed and continues until the end of the fifth calendar year (December 31st). Note: Exam scores expire after two years (see Pesticide Examination section). Licensing is the process of obtaining the documentation (a license), which shows that an individual has satisfied the certification requirements, paid the fee, and is therefore qualified to 3

4 perform certain services. Once certified, an individual completes the licensing process by submitting the application form and the proper fee to ODA. Just passing the required examinations alone does NOT mean an individual is licensed! Those qualifying for licensing during the last 45 days of the year (November 17 through December 31) will be considered certified as of the date they qualified through the end of the FIFTH full calendar year following that date. Individuals qualifying for licensing PRIOR to the last 45 days of the year (before November 17) would be considered certified as of the date they qualified through the end of the FOURTH full calendar year following that date. Question: When is a person considered licensed? Answer: An individual is considered licensed when the license has been issued by ODA. Those who need to be licensed by a certain time must allow sufficient time for processing in order to assure the licensing process is completed before you begin conducting pesticide applications. This processing time may be two to three weeks after your application and fees are received. Your name and licensing information will appear in a license search from the ODA Pesticides Division Web Page after your license application has been approved. You will be considered licensed at that time. A license certificate will also be mailed to you within a few days of approval, and will serve as your proof of licensing. PESTICIDE LICENSE TYPES 1. The private pesticide applicator license is required of those who use or supervise the use of restricted-use pesticides on land in agricultural production that they or their employer own, lease, or rent. This includes farm land, ranch land, forest land, nurseries, and orchards. No license is needed if only general use (non-restricted) pesticides are used. To qualify for this license, an individual must receive a passing score on the Private Pesticide Applicator Examination. Once the applicant passes, he/she becomes certified (eligible to obtain a license) and may submit a license application and fees to ODA to obtain a private pesticide applicator license. Both the license and the certification period expire on December 31 st of the fifth year of certification. 2. The commercial pesticide applicator license is required of individuals who apply or supervise the application of pesticides on the land or property of others while employed by a commercial pesticide operator. This license is also required of those who apply restricted-use pesticides to non-agricultural land or property that belongs to them or their employer, even if they are not employed by a commercial pesticide operator. This licensing is based on categories, and the licensee must qualify by passing the Laws & Safety Examination plus examinations that relate to the type of pesticide application work to be performed. Descriptions of the various categories of licensing are provided later in this booklet. Commercial pesticide applicators may also consult on the use of restricted-use pesticides in the categories in which they are licensed. This license expires on December 31 st of each year and is renewable annually during the licensee s certification period. 3. The commercial pesticide operator license is required of any business which applies pesticides to the land or property of others. For a corporation to obtain this license, at least one employee must be licensed as a commercial pesticide applicator in the proposed categories of operation to qualify as the responsible applicator for the firm. In the case of a pesticide business which is classified as a sole ownership or a partnership, the owner or at least one partner must be licensed as a commercial pesticide applicator. Employees performing pesticide applications for a commercial pesticide operator must be licensed as commercial pesticide applicators in the proposed categories of operation. Proof of financial responsibility (insurance) for pesticide applications must accompany the operator license application and fee. Form 4018 is available from the Pesticides Division for this purpose, and must be 4

5 submitted before an operator license can be issued. The commercial pesticide operator license expires on December 31 st of each year and is renewable annually. 4. The public pesticide applicator license is required of employees of the State of Oregon or its agencies, counties, cities, municipalities, irrigation districts, drainage districts, public utilities, and telecommunication utilities who use or supervise the use of restricted-use pesticide products or who use machine-powered equipment to apply pesticides in the course of their work. Public pesticide applicators may consult in those categories in which they are licensed and must prepare and maintain records of pesticide applications for which restricted-use pesticides or machine-powered equipment were used. The applicant must qualify for licensing by passing the Laws & Safety Examination plus examinations that relate to the type of pesticide application work to be performed. Descriptions of the various categories of licensing are provided later in this booklet. The public pesticide applicator license expires on December 31 st of each year and is renewable annually during the licensee s certification period. 5. A directly supervised commercial pesticide trainee license is required of individuals who work under the direct supervision of a properly licensed commercial applicator. This trainee license is limited to the categories held by the supervising applicator. On-site supervision is not required, but the supervising applicator must have the trained person under supervision and be reasonably available for assistance (in person or by radio or telephone). To qualify for this license, the applicant must obtain a passing score on the Directly Supervised Pesticide Trainee Examination. This license is valid for the remainder of the calendar year in which it is issued and is limited to a one-time renewal for the following calendar year only. 6. An immediately supervised commercial pesticide trainee license is required of individuals who work under the immediate supervision of a properly licensed commercial pesticide applicator. This trainee license is limited to the categories held by the supervising applicator s license. This supervisor must be on-site at all times and be no further than five minutes from the trainee while he/she is applying pesticides. There is no examination required for this license; it expires December 31 st of each year and may be renewed annually without limitation. 7. A directly supervised public pesticide trainee license is similar to the directly supervised commercial pesticide trainee license except that it is issued only to individuals employed by a governmental agency, public utility, or school district who apply restricted-use pesticides or any pesticide with machine-power equipment. To qualify for this license, the applicant must obtain a passing score on the Directly Supervised Pesticide Trainee Examination. This license is valid for the calendar year in which it is issued and is limited to one renewal for the following calendar year only. 8. An immediately supervised public pesticide trainee license is similar to an immediately supervised commercial pesticide trainee license except that it is issued only to individuals employed by a governmental agency, public utility, or school district that apply restricted-use pesticide or any pesticide with machine-powered equipment. There is no examination required for this license; it expires December 31 st of each year and may be renewed annually without limitation. 9. A pesticide consultant license is required of individuals who provide technical advice in any license category to users of restricted-use pesticides. To qualify for this license, an individual must receive a passing score on the Pesticide Consultant Examination. The pesticide consultant license expires on December 31st of each year and is renewable annually during the licensee s certification period. The applicant may select the Demonstration and Research category on the application form if he/she wishes to be licensed to apply pesticides for demonstration and research purposes only. A pesticide 5

6 consultant is eligible to obtain a private pesticide applicator license (without further examination) by submitting the additional licensing fee and a private applicator license application form at any time during the consultant certification period. In this case, the private applicator certification period will run concurrently with that of the pesticide consultant license. 10. A pesticide dealer license is required of pesticide sales outlets which sell, offer for sale, handle, display, or distribute restricted-use pesticides to pesticide users. There is no examination required to obtain this license; it expires on December 31st of each year, and it is renewable annually. Pesticide dealers must prepare and maintain specific records of all restricted-use pesticide sales for a period of three years. These records must include: 1. Name, address, and valid pesticide license number of the purchaser; 2. Date of sale; 3. Identity of pesticide product(s) sold (EPA Reg. No. or specific product name and manufacturer); and 4. Quantity of product sold (gallons, pounds, etc.). LICENSING FEES The following fees are due with the initial license application and upon annual renewal thereafter, except private pesticide applicator: Assessed by testing center. An individual working under the direct supervision of a properly licensed commercial applicator (on-site supervision not required). Right-of-Way The use of pesticides in right-of-way areas, including road shoulders, utility lines and irrigation ditch banks. Industrial, Institutional, The use of pesticides, other than fumigants, in or around structures, Health and Structural institutions and establishments, for the protection of stored, processed (I.I.H.S.): General Pest or manufactured products, or for the protection of human health. The use of insecticides and fungicides in the establishment and maintenance of ornamental plants and turf (does not include Christmas tree plantations, commercial nurseries, or forests). The use of pesticides on seed. The use of pesticides for the control of plants designated as noxious weeds. 8

9 PESTICIDE APPLICATION RECORDS Pesticide Operators shall prepare and maintain records containing specific information (ORS ) Public Pesticide Applicators shall prepare and maintain the records required of pesticide operators. (OAR ) Commercial Pesticide Applicators not employed by an operator (groundskeeper, etc.) shall prepare and maintain the records required of pesticide operators. (OAR ) Record Information Required Explanation 1. The firm or individual for whom the pesticide application was made 2. The location of the land or property where application was made. 3. The date and approximate time of application. 4. The supplier of pesticide product(s) applied. 5. The trade name and the strength of such pesticides applied. 6. The amount or concentration (pounds or gallons per acre of active ingredient or concentration per approximately 100 gallons). 7. The specific property, crop or crops to which the pesticide was applied 8. The summary information of equipment, device or apparatus used and, if applied by aircraft, the F.A.A. number. 9. Name of applicator(s) or trainee(s) who made application. 10. Records kept for three years. The full name, address and phone number of the business, firm or individual who owns or controls the crop or property sprayed. Do not use initials, nicknames, or partial names. The address of the site, or a geographic description of the application site (such as circle number, map number or township/section/range), and the size of the area treated (acres, square feet, linear feet, etc.) The month/day/year of application, and the beginning and ending time of application. The full name of the individual or business that supplied the pesticide to you. Do not use initials, nicknames, or partial names. The EPA registration number of each pesticide product applied or the manufacturer, product name, and formulation type of each product applied. A. The amount of each pesticide product applied per unit of measure (ounces, pounds, pints, quarts, etc). B. The type and amount of carrier applied per unit of measure (acre, square feet, etc.) or, where a specific unit of measure is not applicable, the total amount applied to site. C. The amount and type of other material applied (such as spreader/sticker, wetting agent or drift retardant). For each pesticide product applied, the specific crop or site of application: Agricultural applications - the specific crop PCO General and PCO Structural applications - the specific area (exterior wall voids, kitchen cabinets, interior foundation, living room baseboards, etc.) Ornamental applications - the general area (front yard, hedge, fruit tree, etc.) Other applications - descriptions similar to the examples above. Identification of the application equipment used (aerosol can, speed sprayer, backpack sprayer, fogger, etc.) and, if applied aerially, the N number of the aircraft. The full name of the applicator(s) or trainee(s) who applied the pesticides. Records shall be maintained for at least three years from the date of application 9

10 PEST AND DRY ROT INSPECTIONS Home inspectors who provide pest and dry rot (P&D) reports to lending institutions (i.e., banks) and agencies who guarantee loans (i.e., Farmer s Home Administration, Veterans Administration) for the purchase of real estate may be required to provide a license This is a requirement of the lending industry not the State of Oregon. number on the inspection report form. For this reason, inspectors may need to obtain commercial pesticide applicator licensing issued by the Oregon Department of Agriculture. The commercial applicator license only authorizes the license holder to perform pesticide APPLICATIONS*; it confers no special authorization to conduct P&D inspections. Pesticide licenses are not a requirement of ODA or the State of Oregon to conduct P&D inspections, however lenders and guaranteeing agencies may not accept inspection reports that are prepared by individuals or businesses who do not have this license. For inspectors who wish to qualify as commercial pesticide applicators, passing scores must be obtained on the Laws and Safety examination and the IIHS Structural Pest Control examination. An individual is eligible for licensing after passing these two examinations. *Inspectors who also plan to perform pesticide application activities must obtain both the Commercial Pesticide Applicator License and Commercial Pesticide Operator License (or be employed by a licensed Commercial Pesticide Operator). The Construction Contractors Board (CCB) requires registration of businesses making structural inspections, modifications, or repairs to real property; or businesses that do inspections involved in the transfer of real estate. Most pest control applicators/operators who perform pest and dry rot inspections or pesticide applications are required to fulfill the requirements of this agency. Contact the CCB at ext for more information. RECIPROCAL PESTICIDE LICENSING Oregon commercial and public pesticide applicator licensing and consultant licensing is not available to licensees of other states on a reciprocal basis. Individuals requiring these licenses must qualify for certification by passing the required Oregon pesticide examinations. PESTICIDE EXAMINATIONS Certification examinations are administered on a regular basis at testing centers throughout Oregon. Preregistration is required. Prior to the examination session, applicants must tell the testing center precisely which examinations are needed, (i.e., Agriculture Herbicide or Ornamental & Turf Herbicide; not Herbicide ) as well as the type of license required (commercial pesticide applicator, public pesticide applicator, commercial pesticide trainee, etc. Proctors are responsible only for administering the examinations and are not responsible for advising applicants on licensing or category requirements. Testing fees are assessed at all centers; inquire about cost and forms of payment accepted when making arrangements for testing. 10

11 Applicants will be required to show photo identification (e.g., a driver s license) and pay a testing fee before they may participate in examination sessions. They must also have their Social Security Number for reference when filling out application forms and answer sheets. All examination sessions conducted on behalf of ODA are closed book; no books, notes or other materials are allowed to be used during the sessions. Do not bring these items to examination sessions. All materials needed to take examinations will be provided: answer sheets, scratch paper, number 2 pencils, and test booklets. Cell phones, beepers and other similar devices are prohibited in the testing area. Please leave these items in your vehicle or with the testing proctor. Small, silent calculators may be used, however applicants must bring their own; sharing calculators is not allowed. All materials provided must be returned at the end of the session, including scratch paper. Talking with other examinees during a session is prohibited; cheating will not be tolerated and is grounds for immediate disqualification of an individual s examination results. Pesticide exams may consist of multiple choice, matching, and true/false questions. The examinee must select one answer out of several possible answers provided for each question. Answer sheets arriving at ODA without the Social Security Number field filled in will not be graded. An electronic scanner is used to grade all answer sheets; for this reason, it is very important that ALL sections of EVERY answer sheet be completed neatly and accurately. Incomplete or poorly completed answer sheets may result in scores not being returned or available. The usual time allotted for examination sessions is two to three hours; it is suggested that no more than three examinations be attempted during any one session, since the average time needed to complete an examination is approximately one hour. Applicants are strongly encouraged to prepare in advance for examinations. Recommended study materials are described later in this booklet. County extension agents, local community colleges, and agri-chemical dealers may also sponsor pesticide pre-license classes. Contact these sources directly for more information. The passing score on all pesticide examinations is 70%. Scores will be returned by mail. TEST SCORES ARE NOT GIVEN OUT OVER THE PHONE! For those with Internet access, test scores will be available online as soon as grading is completed (see website information below). Sample answer sheets on the next pages show how your answer sheet should be filled out. The department assesses a five-dollar retake fee each time an examination is retaken. Those who pass their examinations and qualify may submit their application form and the specified licensing fee to the Department of Agriculture. Testing fees will be collected at testing sessions; licensing and retake fees are due when the license application is submitted to ODA for processing. If all paperwork is in order, the license will be issued within three weeks of receipt of the application and required fees. The Commercial Pesticide Applicator and Public Pesticide Applicator licenses require the successful completion of Laws and Safety and at least one category exam. Please note that exam scores are valid for two years. The applicant has two years from the date the first exam is passed to take and pass the remaining exam required for certification. Once certification has been obtained, the applicant can add additional categories at any time during the certification period. 17 RECERTIFICATION REQUIREMENTS Recertification is the process of renewing pesticide certification. This may be accomplished by either of two methods: 1. Accumulating the required number of credit hours during the current certification period by attending training programs accredited by the Oregon Department of Agriculture (ODA) or 2. Retaking and passing all required examinations. The credit hour requirements for recertification vary, depending on the type of license held. The current requirements are given below: Private applicators must accumulate a total of sixteen (16) credit hours during their certification period: four (4) of these hours must be Core training and twelve (12) can be other ODA-accredited training. No more than eight (8) credit hours (including Core ) may be accumulated in any one calendar year (January 1 - December 31). Credit hour accumulation may begin the day after the licensee is certified. Pesticide consultants, public pesticide applicators, and commercial pesticide applicators must accumulate a total of forty (40) credit hours during their certification period. Training may include Core programs, however no more than fifteen (15) credit hours may be accumulated in any one calendar year (January 1 -December 31). Credit hour accumulation may begin the day after the licensee is certified. RECERTIFICATION TRAINING Recertification training is offered by a variety of sources, including the Oregon State University Extension Service, local community colleges, agri-chemical dealers, and industry associations. These sources may be contacted for information regarding pesticide recertification training occurring in your area. The Pesticide Applicator Training Coordinator at Oregon State University in Corvallis may also be contacted for information regarding upcoming sessions at Each issue of the ODA Pesticides Quarterly newsletter (sent to all licensed pesticide applicators and consultants) contains a listing of upcoming accredited courses. 19 Appendix A: Frequently Asked Questions about Public Applicator Licensing and House Bill 2604 (HB2604) Q: What is HB 2604? A: This bill was introduced in an effort to clarify the licensing requirements of public pesticide applicators when pesticide applications are made for noxious weed or other pest control purposes. Q: What requirements were changed by HB 2604? A: There are three conditions that must now be met to allow public applicators of one public agency to apply pesticides upon the property of another public agency outside their jurisdiction but within the parameters of a public applicator license. These three conditions are: The land is in a jurisdiction adjacent to property under their ownership, possession, control or jurisdiction AND The application is done in conjunction with, or as an extension of, an application of pesticides to property under their ownership, possession control or jurisdiction AND The pesticide application is done on a cost recovery, cooperative trade of services or no cost basis, and not as a source of profit Q: What pesticide license does an applicator need to apply pesticides upon property under the ownership, possession, control or jurisdiction of their public employer? A: Public applicator licenses are appropriate for applicators of pesticides upon public property as described above. A Commercial pesticide operator license or commercial pesticide applicator license are NOT appropriate and may not be utilized for pesticide applications conducted for public agencies by public employees. Use of a commercial applicator license by a public employee for work-related pesticide applications may be considered a violation of state law. Q: Can a public agency advertise for pesticide application business? A: No advertising or solicitation for pesticide application business may be conducted by public agencies outside of their jurisdiction. Q: For a public applicator who makes pesticide applications for general or noxious weed control on roadsides within his/her own public agency jurisdiction, what pesticide license is needed? A: Public applicator license with Right of Way category for general weed control and/or Regulatory Weed category for noxious weed control. Q: Can a licensed public pesticide applicator make applications for noxious weed control on private property? A: Yes, as long as the applications are made: Only in accordance with the noxious weed control law ORS 570. On property within the public agency jurisdiction By a licensed public pesticide applicator with the regulatory weed category After the public applicator has informed the private landowner of other resources that could perform the pesticide applications. Q: What about pesticide applications made on a contract basis between two public agencies? A: If the land to be treated is within the jurisdiction of the public agency conducting the pesticide applications, such as a Weed Control District, a public pesticide applicator license is required for the public applicator. If the land to be treated is not within the jurisdiction of the public agency conducting the pesticide applications, then the conditions listed above apply (i.e. adjacent property, application done in 19

20 conjunction with, or an extension of, not for profit, no advertising, information provided of other resources, etc.). Q: If a federal agency has an Interagency Agreement with a state, county or other public agency for pesticide application services, does the federal agreement supercede the state requirements of pesticide licensing revised by HB 2604? A: NO. State law can be, and is in this case, more restrictive than federal law. The conditions stipulated in the recent revisions of ORS 634 by HB 2604 for public pesticide applicators must be complied with by all parties. 20
