The Federal Motor Carrier Safety Administration s (FMCSA) final ELD rule is made up of more than 500 pages of legal jargon that can be intimidating and diff icult to comprehend, but don t let that stop you from being compliant. 3 WHAT IS THE ELD MANDATE? Let s start at the beginning. The most common question regarding the mandate is, What is it and what does it mean? Although the final rule was published in December 2015, parts of the industry still struggle to understand how it will affect them and what ELD compliance will look like. The ELD mandate was established by Congress requiring paper logbooks be replaced with an electronic logging device to record a driver s Record of Duty Status (RODS). The device must have the capability to be connected to the vehicle s electronic control module (ECM) to track its movements, while allowing drivers to edit and carrier s agent to make suggested edits. Other details within the rule include the ELD performance and design standards, supporting documents; drivers and carriers are required to keep, and driver protection from ELD harassment. Key data points the ELDs will automatically extract and record: Date Time CMV location Engine hours Vehicle miles Identification information of driver or authenticated user Vehicle identification data Motor carrier identification data WHO IS EXEMPT? The ELD rule applies to the majority of carriers and drivers who are currently required to keep paper logs but there are exemptions according to the FMCSA. Drivers who use paper RODS for not more than 8 days out of every 30-day period. Drivers who conduct drive-away-tow-away operations, where the vehicle being driven is the commodity being delivered, or the vehicle being transported is a motor home or a recreation vehicle trailer with one or more sets of wheels on the surface of the roadway. 4 ELD VS. AOBRD The major difference between both solutions are the technical specifications outlined in each Code of Federal Regulation (CFR). Many companies have opted to maintain their AOBRD, which is based on regulations adopted in 1988, consisting of only a few pages rather than going to ELDs, before they have to. HOS Driver Advisory Messages Not addressed. HOS limits notification NOT required. Unassigned driving time/miles warning provided upon login. Device Default Duty Status Not addressed. On-duty not driving, when CMV has not been in motion for 5 consecutive minutes, and driver has not responded to an ELD prompt within 1 minute. No other nondriver-initiated status change is allowed. Clock-time Drift Not addressed. ELD time must be synchronized to UTC, and absolute deviation must not exceed 10 minutes at any point in time. Communications Methods Not addressed - focused on interface between AOBRD support systems and printers. 1. Telematics: At minimum, ELD must transfer data via both wireless Web services AND wireless Local Transfer: At minimum, the ELD must transfer data via both USB 2.0 AND Bluetooth. Both types of ELDs must be capable of displaying a standardized ELD data set to authorized safety officials via display or printout. Resistance to Tampering AOBRD and support systems must be, to the maximum extent practical, tamperproof. ELD must not permit alteration or erasure of the original information collected concerning the driver s ELD records or alteration of the source data streams used to provide that information. ELD must support data integrity check functions. Identification of Sensor Failures and Edited Data Must identify sensor failures and edited data. ELD must have the capability to monitor its compliance (engine connectivity, timing, positioning, etc.) for detectable malfunctions and data inconsistencies. ELD must record these occurrences. 4

It becomes even more difficult when the marketplace is overcrowded with inexperienced vendors with subpar products. Make the smart purchasing decision by asking the proper questions. It s your responsibility to be compliant, and not the providers. Vendor Does the vendor have a customer retention rate of 99% or greater? Has the vendor been in business for more than 15 years? Is the vendor recognized as an industry leader? Technology Can the ELDs be connected with the vehicle s electronic control module (ECM) to provide data? Is the hardware and software created by the same vendor? Can the system by updated over the air? Is the device able to transmit data to enforcements for review and to a fleet management system? Compliance Does the ELD reduce location accuracy of one-mile radius during personal conveyance and not during on-duty driving periods? Does it automatically record all driving time and at intervals of 60 minutes? Does it record date, time, location, vehicle miles, engine hours, and driver identification? Does it require certification of driver records at the end of each 24-hour period? Features Does it provide volume control or mute options for any audio feature? Does the vendor provide user manuals, instructions for handling malfunctions and record-keeping during malfunctions, and instructions for transferring ELD HOS to safety officials?
