1 July 6, 2017 REQUEST FOR PROPOSAL: CREEKSIDE UNDERPASS MURAL PROJECT PROPOSALS ARE DUE: Thursday, August 17, 2017; 4:30PM. The proposal can be ed (in pdf format) to or one copy delivered to: Resort Municipality of Whistler, Municipal Hall 4325 Blackcomb Way, Whistler, BC, V0N 1B4 Attention: Annie Oja THE OPPORTUNITY The Resort Municipality of Whistler (RMOW) seeks to create a large scale mural at the Highway 99 bridge underpass in Whistler Creekside, by London Lane. The mural would encompass the walls on both the north and south sides of Whistler Creek. As a separate optional item, the RMOW is also interested in including the side abutment walls on the north side of the bridge, adjacent to the underpass. Artists (or artist teams) may propose to work on certain walls, but the RMOW is most interested in addressing both of the underpass walls. The bridge and abutments are managed by the provincial Ministry of Transportation and Infrastructure (MOTI). The Creekside Underpass Mural Project requires Ministry approval and adherence to Ministry requirements (appended). The municipality does not own or control the underpass but will serve as client for the mural project in order to improve this public place at the entry to the Creekside neighbourhood. THE SITE The south wall is approximately 28 metres long by 2.5 metres high (70 square metres) and is located above rip rap boulders (all measurements are approximate). The Valley Trail runs adjacent to this wall, at the base of the rip rap. The trail is approximately 3.0 metres wide and at least one half that width must remain open to the public during the mural painting. The north wall is 36 metres long by 2.5 metres high (90 square metres). This site is challenged by limited access and limited work space at the base of the wall. 1
2 The bridge abutment walls are most prominent of the north side of the creek. All of these walls have been extensively tagged. The wall surface needs to be clean and free of loose material. The wall should be dry scrubbed with a drop sheet spread out collecting any loose paint and debris followed by a final pressure wash cleaning. 3 BUDGET The budget for completion of both underpass walls is $25,000. The budget is for artist fees and all expenses related to painting the mural, securing the site, as well as insurance. The proposal should include a fee breakdown for the work as well as an optional line item for the tagged portion of north abutment walls. SCHEDULE The work should commence following the Labour Day long weekend in September 2017, in order to avoid the peak period of trail use. The work should be completed by mid October or earlier. THE PROPOSAL 1. The proposal should include sketch drawings sufficient to convey your ideas. The sketch doesn t have to be fully resolved, but should relate to the scale of the site. Drawings should be limited to 11 x There should be some brief statement of your theme or design intent. 3. Describe your plan to implement the mural (i.e. will there be an artist team; what materials will be used; will scaffolding be used; how you plan to access the site and secure the site, etc.). If a team approach is proposed, a team leader or lead artist should be designated and other key members should be named. Some indication should be given of how much the key team members will be involved in the work. 4. Artist teams should have some background with outdoor mural projects. Proposals should include a summary of relevant experience and should include up to six relevant images of completed projects. The images should be pdf files (if submitted digitally) or printed pages. 5. Propose a start date and the time required to complete the project. 6. Propose a cost estimate of artist fees, as well as material, equipment, insurance and other project expenses. 7. The cost estimate must include provision for liability insurance, with $2,000,000 coverage and with RMOW and MOTI named as co-insured. If applicable, the project should be compliant with Work Safe BC. 8. Sales tax may be charged in addition to project budget (receipts will be required). 3
4 SITE SAFETY The mural sites are challenging, on both sides of the creek. On the north, there is a narrow ledge at the base of the wall. Access is via an uneven path from the northwest parking lot. On the south side, there is more room, but there is proximity to Valley Trail users. In this case, the ledge atop boulders is wider and there is opportunity to add scaffolding or work from one lane of the valley trail. If a portion of the Valley Trail is used, safety cones and signage must be installed each day. The cones and signs can be provided by the RMOW. In consultation with RMOW Parks, an adjacent storage site can be designated. The work and / or storage sites must be kept in an orderly condition, with materials / equipment secured or removed at the end of the day. The sites are near residences, so work hours should be limited to 8:00am to 8:00pm. There is no opportunity to bolt into, or otherwise damage, the underpass walls or ceiling. Care must be given to avoid spilling materials into the adjacent creek. Proponents should make an effort to understand the challenges of the work site. OTHER REQUIREMENTS The MOTI has requirements that must be followed to allow mural work at the underpass. The terms of their permit are attached. This includes dates, requirements for insurance, site safety, no drilling into walls and no painting of the ceiling, signage, lighting or electrical services. The mural should not have text, other than a title, which will be subject to MOTI approval. Prior to the start of painting, MOTI requires evidence that the primer and paint are compatible for painting concrete surfaces and (are) environmentally approved. MOTI may cancel the project if the terms of the permit are not respected. OTHER NOTES 1. A limited competition was staged for this competition in That competition was terminated as it was felt the competition should be open to all. The artists that submitted proposals in 2016 will be invited to resubmit in There is no particular advantage due to prior involvement. 4
5 2. Proposals will be reviewed by jurors that have a background or interest in art. The jurors will have had no involvement in the 2016 process. The jury will make a proposal selection recommendation to RMOW staff. If approved, the recommended proposal will be submitted for MOTI review. 3. RMOW will print the digital submissions and will prepare all submissions so the concept proposal and description are the first materials reviewed by the jury. Artist names / identification will be hidden for the concept review. That is, the quality of the concept will be the juror s first impression. If the jury is impressed, they will open a second envelope containing the rest of the proposal. 4. The RMOW is not compelled to select any proposal and there will be no compensation for proposal preparation. The RMOW will not keep proposals that are not selected. These materials will be destroyed. 5

The Minister has the authority to grant permits for the auxiliary use of highway right of way, which authority is pursuant to both the Transportation Act and the Industrial Roads Act and the Motor Vehicle Act B. The Permittee has requested the Minister to issue a permit pursuant to this authority for the following purpose: The installation and maintenance of a Community Arts Mural to be painted on the abutments of the Highway 99, Whistler Creek / London Lane bridge structure, Creekside, Whistler. C. The Minister is prepared to issue a permit on certain terms and conditions; ACCORDINGLY, the Minister hereby grants to the Permittee a permit for the Use (as hereinafter defined) of highway right of way on the following terms and conditions: 1. That the construction and maintenance of the said works is carried out to the satisfaction of the Regional Director, Transportation. 2. That any person appointed by the Regional Director, Transportation, for the purpose shall have free access to all parts of the works for the purpose of inspecting the same. 3. That the construction of the said works shall be commenced on or before the 5 th of September, 2017 (amended) and shall be prosecuted with due diligence and to the satisfaction of the Regional Director, Transportation, and shall be completed on or before the 30 th of October, 2017 (amended). 4. The highway traffic must not be impacted at any time during the process. All associated with the mural project must not park vehicles or equipment on the highway right-of-way at any time. Page 1 of 3

That where the work for which permission is hereby granted comes in contact with any bridge, signs, culvert, ditch, or other existing work, such existing work must be properly maintained and supported in such manner as not to interfere with its proper function during the construction of the new work, and on the completion of the new work the bridge, signs, culvert, ditch, or other existing work interfered with shall be completely restored to its original good condition see condition no That the person or persons for whom these works are being constructed, or by whom these works are maintained, shall at all times accept full responsibility for any accident that may occur or damage that may be done to any person or property whatsoever caused directly or indirectly by these works, and shall save harmless and keep indemnified the Crown from all claims and demands whatsoever in respect of the works. 7. At all times the Permittee must safeguard all those associated including the artists, traveling public, pedestrians, cyclists, etc.. This includes all users of the valley trail. It is also necessary that access to the permitted painting surfaces areas are restricted from the public access and adequately signed accordingly. Adequate safeguards to protect the artist must also be in place at all times, i.e. safety railings, etc.. All safeguards must be checked and maintained regularly though out the process. 8. That the permission herein granted to use and maintain the works is only granted for such times as the land or public work in, upon, or over which the said works are constructed is under the jurisdiction of the Minister of Transportation and Infrastructure. This permission is not to be construed as being granted for all time, and shall not be deemed to vest in the Permittee any right, title or interest whatsoever in or to the lands upon which the works are constructed. Should the lands affected at any time be included within that of an incorporated municipality or city, this permission shall become void, unless the works are on a highway duly classified as an arterial highway pursuant to Section 45 of the Transportation Act. 9. That after receiving notice in writing of the intention on the part of the Provincial Government to construct, extend, alter, or improve any public work, the person or persons responsible for the maintenance of the works for which permission is hereby granted shall within six weeks move or alter such work at his or their own expense to such new positions or in such manner as may be necessitated by the construction, extension, alteration, or improvement proposed to be carried out by the Provincial Government. 10. That while reasonable care will be taken on the part of the Provincial Government and their contractor to prevent or do as little damage as possible to any private work in the carrying-out of the construction, extension, alterations, improvement, repair, or maintenance of any public work adjacent thereto, the Provincial Government and their contractor can accept no responsibility for any kind of such damage. 11. That the permission hereby granted to construct, use, and maintain work is granted without prejudice to the provisions of the Transportation Act, or other Acts governing Crown lands and public works or their use by the public. 12. That this permission shall be in force only during such time as the said works are operated and maintained by the applicants, to the entire satisfaction of the Regional Director, Transportation. 13. This permit is valid only for the specific works stated herein. Any alterations or additions must be covered by a separate permit. 14. This permit may be canceled, at the discretion of the Minister, without recourse, should the Permittee fail to comply with all the terms of the permit. Thirty days' notice will be given before cancellation. 15. When the requirements of the Ministry necessitate use of the said lands for Provincial purposes, at the discretion of the Minister, this permit may be canceled. 16. That these works shall be identified with this permit number in a manner satisfactory to the District Official of the Ministry of Transportation and Infrastructure. 17. As a condition of this permit, the Permittee unconditionally agrees with the Ministry of Transportation and Infrastructure that the Permittee is the prime contractor or will appoint a qualified prime contractor, as described in Section 118 of the Workers Compensation Act, for the purposes of the work described by this permit, at the work location described in this permit, and that the Permittee or designated prime contractor will observe and perform all of the duties and obligations which fall to be discharged by the prime contractor pursuant to the Workers Compensation Act and the Occupational Health and Safety Regulation. 18. The Permittee is advised and acknowledges that the following hazards may be present at the work location and need to be considered in coordinating site safety: overhead hazards, particularly electrical or telecommunications lines; buried utilities, particularly electrical, telecommunication, and gas lines; traffic, danger trees, falling rocks, and sharp or infectious litter. 19. The Permittee is responsible for notifying all utility companies whose works may be close to or affected by the works described in this permit. 20. The Permittee shall, at his cost, supply, erect, and maintain standard traffic control devices in accordance with the Ministry of Transportation and Infrastructure Traffic Control Manual for Works on Roadways and Occupational Health and Safety Regulation. Safe passage of cyclists, pedestrians, etc., must also be accommodated at all times. Page 2 of 3
9 Permit/File Number: Office: Squamish Area Office 21. The permitted mural area is restricted to the vertical abutment face, including wing walls only and must not be visible from Highway 99. No painting of the ceiling surface of the structure. The rip-rap rock creek bank protection may also be painted however all possible environmental concerns must be address and approved in advance. 22. The Permittee is responsible for all related environmental issues including fishery concerns, for items such as siltation control, paint leaching, etc., related to these works. Any such issues must be identified in advance and resolved to the satisfaction of the appropriate governing agency, in advance. All products used for the preparation and mural paintings must be environmentally safe and friendly. 23. Structure Cleaning The maintenance contractor s structure cleaning process and frequency may not satisfy the Permittee. The Permittee may consider sharing some of the responsibilities for this activity in order to protect the murals. It must be noted that the Ministry or their maintenance contractor will assume no responsibilities for any possible damage or deterioration of the murals associated with this activity. The Permittee should contact the maintenance contractor, Miller Capilano Highway Maintenance, to discuss this subject. 24. All maintenance, such as refreshing, touch up, graffiti removal, etc. associated with the murals will be the responsibility of the Permittee. 25. The Permittee will manage and control any existing vegetation overgrowth that may obstruct the murals. This permit does not include any new plantings or landscaping. 26. Structure No drilling into concrete surfaces or attaching anything to the structure. Signs - All existing signs, MOTI s and/or RMOW s will be completely visible and not impacted by the permitted works and must be in good condition and maintained at all times. 27. The mural should be neutral and not include any text, wording, messages, labels or symbols of any kind. 28. Electrical and Illumination - No painting on the existing lighting lens or housing and the electrical service must not be disturbed. No additional lighting will be permitted. 29. Any proposed changes to the murals will require Ministry approval. 30. Clean Up - All unsuitable material and inorganic debris shall be removed from the project area. On site storage of material will not be permitted. The rights granted to the Permittee in this permit are to be exercised only for the purpose as defined in Recital B on page 1.
