3 1. INTRODUCTION WMG Acoustics Pty Ltd has been requested to consider and comment on noise control aspects associated with the proposed residential development at 442 Cheltenham Road Keysborough. This document includes comment on the following matters: The requirements which apply to the subject site with respect to noise. Whether SEPP N-1 is applicable to the proposed residential development and the reasons why. Consideration of noise attenuation between the subject site and the adjoining future commercial use to the west of the site. The requirements to be considered in any domestic (2-3 storey residential) development which typically require noise attenuation measures. Outline of acoustic matters to be considered in detail as part of any future planning permit application with specific reference to potential noise attenuation measures which may need to be adopted to protect the amenity of adjoining residential properties to the south and east of the subject site. 2. REQUIREMENTS WHICH APPLY TO THE SUBJECT SITE WITH RESPECT TO NOISE As a purely residential development, the requirements which apply to the subject site with respect to noise are those which apply to residential premises. Under the Environment Protection Act 1970, noise from domestic air conditioners and the like installed as part of residential development of the site is to be inaudible inside a habitable room in any other residential premises (within this development or beyond it) with windows open or closed between the hours of 10pm and 7am, or 9am on weekends or public holidays. Apart from constraints regarding noise associated with the behaviour of residents, that is essentially the only requirement in terms of noise emission from the development to other nearby residential areas. In terms of noise impacting on the residential development, there are no regulatory requirements regarding limitation of traffic noise levels within a residential development. However, it is good practice to consider the traffic noise impact on the site and include in the development appropriate design features, ventilation provision and construction detailing to achieve indoor resultant noise levels as recommended in AS/NZS 2107:2000 Acoustics Recommended design sound levels and reverberation times for building interiors. Noise intrusion to the site from commerce, industry and trade is the responsibility of the noise maker, as discussed below ng.docx Page 3

SEPP N-1 - NOT APPLICABLE TO THE PROPOSED RESIDENTIAL DEVELOPMENT State Environment Protection Policy (Control of Noise from Commerce, Industry and Trade) No. N-1 (SEPP N-1) exists under the Environment Protection Act 1970 to control emission of noise from commerce, industry and trade to residential premises. It is therefore inherent within the title and intent of the Policy that it does not apply to emission of noise from residential premises and therefore does not apply to this development, which is purely residential. 4. NOISE ATTENUATION BETWEEN THE SUBJECT SITE AND THE ADJOINING FUTURE COMMERCIAL USE TO THE WEST OF THE SITE The potential need for noise attenuation between the subject site and the adjoining future commercial use to the west of the site has been limited by the application of appropriate Conditions in the Planning Permit for the commercial development, including no loading or unloading of any vehicles on the site during the period 10pm to 7am Monday to Friday and 10pm to 8am Saturday, Sunday and Public Holidays. This provides protection from noise events during the most noise sensitive night period, which also has the lowest noise limits under SEPP N-1. Other Conditions in the Permit require compliance with SEPP N-1 and limits the uses approved by the Permit and the compaction of refuse on the site to 7am to 9pm Monday to Friday, 7am to 7pm Saturday and 7am to 6pm Sunday, again avoiding activity and potential noise emission between 10pm and 7am. The onus of compliance with the SEPP N-1 noise limits lies with the noise emitter, not the residential noise recipient. SEPP N-1 noise limits apply outdoors, except under defined circumstances when an indoor assessment point is relevant. In principle, achievement of compliance with noise constraints can incorporate noise attenuation measures: at the source (such as selection of quiet machines, localised acoustic shielding and enclosures and the use of speed control to allow equipment to operate at less than full speed at night), between the source and recipient locations, most commonly in the form of a solid acoustic barrier at the boundary of dimensions and construction sufficient to achieve the required noise reduction and at the receiver in the form of appropriately designed single or double glazing systems, wall and roof constructions and solid doors with acoustic seals. However, it is important to note that the third option, noise control at the recipient location, is not normally relevant in the context of SEPP N-1 noise limit compliance because, as noted above, the onus of compliance lies with the noise maker. Under circumstances where a new residential use is introduced in the vicinity of an existing commercial, industrial or trade noise, municipalities have on occasions required the new residential development to self-protect from noise to an equivalent standard as the SEPP N-1 noise limits, as part of the approvals process in order to protect the viability of existing businesses ng.docx Page 4

REQUIREMENTS TO BE CONSIDERED IN ANY DOMESTIC (2-3 STOREY RESIDENTIAL) DEVELOPMENT WHICH TYPICALLY REQUIRE NOISE ATTENUATION MEASURES The main consideration regarding noise emission to other residential premises is normally air conditioning outdoor units. The principle requirement in this respect is to select units with noise emission characteristics appropriate to the ambient noise environment of the locality so as to achieve the intent of the requirements under the Act. Locating units to gain noise reduction due to solid purpose-built or incidental barriers between the unit and other residential premises is also an appropriate noise attenuation strategy. If multi-residential developments include underground car parking that requires a car park exhaust fan, then consideration of that source would also be required. Roller shutter doors may require consideration in particularly quiet locations, but this is unlikely at the subject site. Kitchen and bathroom exhaust fans must also comply with requirements under the Act, but are normally of sufficiently low noise emission characteristics that no specific consideration is required. Any potential acoustic protection measures will be subject to a detailed acoustic report at the time of the permit application 6. MATTERS TO BE CONSIDERED IN DETAIL AS ANY FUTURE PLANNING PERMIT APPLICATION AND CAPTURED IN A DETAILED FUTURE ACOUSTIC REPORT Monitoring of noise levels at the site is recommended in order to establish the ambient background level at adjoining residential properties to the south and east of the subject site in order to provide a basis for decisions regarding the selection and siting of air conditioning outdoor units. Monitoring of noise levels at the site should also separately be conducted in order to establish the exposure of future dwellings to noise from Cheltenham Rd traffic. This will form the basis for the development of appropriate design features, ventilation provision and construction detailing to achieve indoor resultant noise levels as recommended in AS/NZS The results of this noise monitoring and implications for the design of the development should be included in a detailed acoustic report for the project prepared on the detailed design of dwellings AND number of dwellings proposed.
