2 1. INTRODUCTION Within the framework of the objective on strengthening governance, the Government of Mongolia joined the Open Government Partnership (OGP), which is a multilateral initiative that aims to secure concrete s from governments to promote transparency, empower citizens, and fight against corruption and harness new technologies to strengthen governance in As a member country of the OGP, the Government of Mongolia has set and is actively working on the second OGP National Action Plan s (NAP) specific s on promoting public services towards more open, transparent, pro-innovation, and creating more safe society. Mongolia will implement goals reflected in the Sustainable Development Concept until 2030 by ensuring sustainable governance. With the goals to foster transparency, empower citizens, fight against corruption, and strengthen the governance for open government, working through the partnerships of public, private sector, civil society organizations, media and international organizations by maintaining the principle of introducing new technology in driving innovation is highly important to create the conditions for government to become more open, transparent, accountable and corruption-free. The II OGP NAP Mongolia was elaborated based on the lessons learned from the I OGP NAP ( ), and considering the objectives defined by the Sustainable Development Concept until 2030, with the leadership of the Cabinet Secretariat of Government of Mongolia, under the guidance of the OGP Mongolia National Council, and with the technical and financial support of The Asian Foundation and the World Bank. 2. MONGOLIA S OPEN GOVERNMENT EFFORTS It is important to note that the timing for the development of the Mongolian National Action Plan (NAP) for coincides with the concept of the Sustainable Development Policies and Priorities for Mongolia until Mongolia sets a goal to become a leading upper middle-income country with stable multisector economy, dominating middle and upper middle classes, preserved ecological balance, and with sustainable democracy by To ensure sustainable economic development, Mongolia is prioritising the four key objectives. The first one is to intensify agriculture, to create and export Mongolian organic brands, to promote value-added final productions, to improve a competitiveness of mining sphere, to attract more tourists through advertising untouched beauty of Mongolian landscape, to cover the domestic energy consumption, and to export energy by building more sources. The second key matter is to improve a quality of and access to healthcare, the public education on health, to form a national system of lifetime education, to eradicate all forms of poverty, to reduce unemployment rate, to enlarge a portion of the middle class. Next one is to protect water reserves and prevent its shortage, to enhance an access to hygiene facilities, to build national capacity of climate change adaptation, to reduce carbon dioxide emission, to strengthen a system of preventing natural calamities, to make sophisticate the green urban planning, and to improve waste management. The fourth goal is to determine the sustainable

3 development policies in local levels, to establish accountably monitoring system over the policy implementation, to enhance administrative leadership within the public services, and to consolidate good and transparent governance that ensures close public-private partnership. Working within the framework of reforms to strengthen governance and reporting mechanisms, Mongolia has joined the United Nations Convention against Corruption in 2005 and developed several pieces of draft legislations on fighting against corruption. This is in addition to the creation of the Independent Agency against Corruption in 2007 which serves as an independent mechanism in promoting good governance. Mongolia has made significant efforts towards good governance through approving numerous laws such as the Law on Information Transparency and Right to Information (2011), the Law of Preventing Conflict of Interest in Public Service (2012), the Budget Law (2011), the Law on Glass Account (2014), the Law on amendment to the Law on Petroleum (2014), the General Law on Administration (2015), the Law on Public Hearing (2015), and the Law on Debt Management (2015), and has also joined the International Budget Partnership (2005), the Extractive Industries Transparency Initiative (2006), the Open Government Partnership (2013), as well as established a branch of the Global Organisation of Parliamentarians against Corruption (2012) in Mongolia. The OGP will be the important leverage for continuously implementing these efforts more effectively, transparently, civic engaged and accountably and will be the international platform to share Mongolian best practices globally. In its second NAP, Mongolia has identified 13 s within the framework of four challenges out of five that OGP has identified. Of which two s are "Mobile Application for Government 11:11 center to receive citizens feedbacks and requests" and "Improving Glass Account System" which are ongoing s from previous NAP-I that will Mongolia plans to build upon continuously. The OGP also outlines a to "Online registration of VAT and the dissemination of relevant information to the general public as well as entities", which fully meets OGP s core principles and requirements, and we assume this initiative as a best practice at the international level. The previous NAP for the OGP for included 35 s in frame of three challenges. The Plan stipulated an implementation phase where the creation of a "Mid- Term Self Assessment Report" by the Cabinet Secretariat of the Government of Mongolia and the IRM report by Independent researchers were required. These documents were created in 2015 and adhered to international OGP Principles and requirements. Of the 35 s outlined in the NAP for the OGP for , two s received "STAR" rating and were shared as best practice at the international level. The IRM report also concluded that the daily operations of the National Council of Mongolia for OGP and the partnership between government and civil society organisations proved to be insufficient in the implementation phase of the OGP NAP-I Mongolia. 3. NATIONAL ACTION PLAN DEVELOPING PROCESS After discussing the Self-Assessment Report, the IRM Report for the NAP , as well as ideas and recommendations from participants for the next NAP draft development during the Public Consultation in last February, the Working Group was established with the task to draft the NAP of OGP Mongolia. All phases of the development process for the NAP draft have fully ensured the engagement of multiple stakeholders.

4 Based on the recommendations and feedback identified in the second Public Consultation all the ideas of the challenges, priorities, and s for the NAP were discussed and the most important priorities identified. The Consultation involved over 80 representatives from government, civil society, private sector, media and citizens Availability of timeline. The details of the Public consultation and its timeline with its draft of the ideas were available prior to the consultation as published on the Mongolian government website / newspapers such as "Daily Newspaper" and "National Post", Mongolian OGP webpage / "OGP Mongolia" Facebook group, and also distributed via s to CSOs, as well as broadcasted through MNB television. Moreover, several websites also published as news such as and Adequate notice: The Public Consultation to discuss NAP-II draft and get public feedbacks was announced through the multiple channels mentioned above the date of the Consultation sharing the written draft eight days before the official start of the consultation held to allow stakeholders to organize themselves. A soft copy of the draft NAP was uploaded and disseminated to the news portal websites mentioned above with the announcement. The Cabinet Secretariat of Government of Mongolia also sent out an official letter to the governor of every aimag with the NAP draft requesting to consult the draft at their local level and send us the feedback or recommendations Awareness raising. We have been briefing about Mongolian OGP as much as possible to enhance public participation along with the announcement of the Public Consultation and interested persons were able to access more information by joining "OGP Mongolia" a public Facebook group and by following the Twitter account "@OGP_Mongolia." There were also constant and continuous reminders to the public informing them that they can access more information on the following websites: // Multiple channels. Besides of providing opportunity for the public to be engaged in the consultation in person, to ensure the accessibility of opportunity also people were allowed to be introduced with the NAP draft in soft version and send their feedbacks via and other channels, even aimags were involved sending their feedbacks via letters The breadth of consultation. In order to reflect the feedback and recommendations that various stakeholders in the NAP draft, the Consultation aimed to include over 100 participants from government, civil society, international organisations and media sector. And it engaged over 80 representatives which ensured equal participation from each sector Documentation and feedback. A total of five sub-consultation sessions were held within that Public Consultation divided in accordance with the five challenges

5 identified by the OGP. Depending on their field, members of the Working Group facilitated different consultation sessions and then consolidated recommendations and feedback from the meetings. After the development of the initial draft, the document was sent to the Working Group members through . The Members are composed of representatives from both government and civil society organisations. In addition to being distributed to the Members, the draft was also uploaded onto the public "OGP Mongolia" Facebook group. Documentation in the form of memos was also kept at each meeting, discussions and consultation session Consultation during implementation. The Working Group for developing II OGP NAP draft of Mongolia was established by order #65 of the Chief of the Cabinet Secretariat of Government of Mongolia on April 20, And the Cabinet Secretariat plans to establish new working group with broader component and organize it as a forum where regular meetings to facilitate multi-stakeholder consultations and to monitor and ensure its progressive implementation of the II NAP. 4. PUBLIC CONSULTATION The Public Consultation on II OGP NAP draft took place on May 19, 2016, over 80 representatives from government, the private sector, civil society organisations, international organisations, and media sector participated. Mr. G.Ganbold, Deputy chief of the Cabinet Secretariat of Government of Mongolia and Deputy chief of the OGP Mongolia National Council opened the Consultation and presented an introduction session on "OGP and Mongolia". B.Lkhagvajav, President of the Mongolian National Chamber of Commerce and Industry, B.Galaarid, President of the General Association of Mongolian Journalists, Z.Batbold, Independent researcher for I NAP, G. Undral, representative of civil society organisations, D.Ganbayar, a member of the Financial Regulatory Commission and head of the National Council for Corporate Governance were important representatives from the private and public sector, who attended the forum and presented on behalf of their sectors and provided valuable feedback and recommendations. The consultation involved five sector-specific meetings where participants were required to take part in one meeting. In the meeting, participants were engaged in group activities for the purpose of generating feedback and recommendations on the s of the NAP for the OGP for Total of 30 proposals consolidated within the frame of five OGP challenges as some of the ideas were recommended from the Med-Term Self Assessment Report and the IRM Report of the previous NAP , some of them were from all Ministries and local aimags, some made by representatives of Civil Society Organisations during the February 2016 National Council Meeting and broadened consultation, as well as there were some proposals from the World Bank. As a result of the Public Consultation total of 25 s were consolidated. 5. NATIONAL COUNCIL FOR THE OPEN GOVERNMENT PARTNERSHIP

6 The National Council for Mongolian OGP was established by directive #61 of Prime Minister of Mongolia on May 16, 2014 for the purpose of implementing the policies and plans of the OGP while supervising and coordinating the works of the Secretariat of OGP Mongolia. And changes made to the composition of the National Council by directive #207 of the Prime Minister of Mongolia on October Currently, the Head of the National Council is chief of the Cabinet Secretariat of Government of Mongolia, the Deputy is the Deputy Chief of the Cabinet Secretariat of Government of Mongolia as their positions. Members of the National Council are State Secretaries of the Ministry of Finance, Ministry of Justice, Ministry of Foreign Affairs and President of the Mongolian National Chamber of Commerce and Industry, President of General Association of Mongolian Journalists, Executive Director of Research Centre for Economic Policy and Competitiveness, the Executive Director of Open Society Forum and the secretary of the NC is head of Monitoring, inspection, evaluation and internal auditing department of the Cabinet Secretariat. By its first meeting, the NC has approved the I NAP and submitted to the OGP. And the second meeting with new structure was held on February 2016 as a broadened consultation including CSO representatives to consult and evaluate the I NAP Self- Assessment report and its IRM report, as well as discussed about II NAP draft. And it is remarkable that Mrs. Shreya Basu, Civil Society Coordinator for the Asia and Pacific region of the OGP and Mr. Jack Mahoney, Government Programme Officer participated in the meeting and co-facilitated consultations and discussions. Based on the proposal from the meeting, a Working Group dedicated to the development of II NAP draft was established. After the second Public Consultation on May 19, the working group concluded the NAP draft and submitted to the National Council on May 30 for review before it was discussed by Cabinet meeting, and the final draft was presented at the Cabinet meeting on May 31, Mr. S.Bayartsog, head of OGP National Council, a State Minister and chief of Cabinet Secretariat of Government of Mongolia presented the II NAP OGP Mongolia at the Cabinet meeting. By the Cabinet meeting, the NAP draft was principally encouraged and some feedbacks from Cabinet members were reflected in the draft. Reflecting the feedbacks from the Cabinet members, total of 12 s consolidated in the NAP draft. Afterwards, that draft was discussed by National Council meeting and approved with total of 13 s by resolution #2 of the OGP National Council of Mongolia on June 7, The Cabinet Secretariat plans to establish new working group with broader component and organize it as a forum where regular meetings to facilitate multi-stakeholder consultations and to monitor and ensure its progressive implementation of the II NAP of OGP Mongolia. 6. COMMITMENT AND TARGET ACTIVITIES OF OGP OF MONGOLIA

7 The following 13 s in the II NAP OGP Mongolia were submitted within the framework of 4 challenges out of 5 challenges 1 of OGP. Each of the s was detailed in templates with their implementation milestones, responsible persons, and main objectives as attached as follow. The 11:11 Call Centre responds to complaints and feedback from citizens, but currently it is unable to take action on these complaints and improve government service. Therefore, there is a need to establish a reporting system for citizens to rate provision, quality and transparency of services provided by the 11:11 Call Centre and make reports by the service providers by using modern technological innovations. Main Objective The introduction of the mobile application for the Call Centre and Service Centre of the government, the government service will become more transparent and efficient, and the quality of the service will improve. Social accountability, which is displayed through a productive and effective partnership between the service provider and beneficiary, is one of the possible solutions to meet this need. As a result, an efficient and productive feedback mechanism, which fosters mutual respect and understanding will be established. These steps are necessary for not only improving service and service provision of the health and education sector but also to improve the system within the sector. These pieces of legislation are the Law on Development Policies and Planning, the Law on Public Hearing, the General Law on Governance and the Law on Legislations. Thus, for these documents to be effective, there is a necessity to increase and mobilise public engagement in the implementation of these legislations. Ensure public engagement and transparency in the decision-making processes of government organisations, which in turn has a positive impact on the public interest. Promote and advocate the rights of public engagement reflected in these legislations to the general public and foster justice by enabling the public to implement their rights and obligations and actively engage and participate in the decisions concerning them. According to survey data and study reports, political parties have the highest risk of exposure to corruption. There are still cases of violations related to election funding; This shows that the system is not comprehensive enough to handle these issues. Various international studies reveal that corruption in political parties is the base of defects in the political system, and has a negative effect on the development of parties and creates a foundation for future corruption. Therefore, there is an immediate need to address the issues of funding to political parties and make these channels more open, transparent, monitored and accountable. 18 Status quo or problem addressed by the The amendment of Law on VAT by the Parliament of July 09, 2015, established a legal environment for correctly collecting VAT. It created an opportunity for the customers to register their receipts onto the online receipt registration system and get back a certain portion of their tax payment in a form of incentives and lottery prize. GTA has started to implement the EBARIMT system, which meets international standards, from January 01, 2016 and as of now, the amount of VAT income increased 2.2 times a year on year for the first two months of implementation. Since January 01, 2016 a total of 29,880 entities and 37,045 cash registers are connected to the system. Since 1995, only 12,000 POS machines were connected to a system to register non-cash transactions in Mongolia. Connecting 37,045 Cash Register POS machines into the system in less than three months period is an impressive achievement. With the conversion from paper receipts to online receipts, it became easier for entities to report to the tax system and created an opportunity to reduce stress related to tax reporting. It also stopped the allocation of about 300 million MNT for paper receipts in the government budget.
