4 HERNE BAY AREA MEMBER PANEL 12 th January 2016 Subject: Director/Head of Service: Decision Issues: Herne Bay Public Realm Improvements Assistant Director Planning and Regeneration Policy and Resources Committee Classification: CCC Ward(s): Summary: To Consider: Next stage in process This report is open to the public Heron This report provides an update on consultation results and proposed design amendments to the town centre improvements that will be implemented in accordance with the Sainsburys (Altira) planning condition The Panel are asked to note the summary of consultation responses and to note and comment on the proposed design amendments. It is anticipated that the improvement works will carried out in phases and completed by summer 2016 SUPPORTING INFORMATION 1.0 Introduction Planning approval was granted on 21 st October 2014 for a Sainsbury s superstore at the Altira Business Park. The permission was granted subject to a number of conditions, including the formulation of a legally binding agreement detailing a package of mitigation measures designed to off-set the impact to the town centre. The agreed mitigation measures were summarised in the planning committee report as follows: Access improvements: a subsidised parking scheme for the William Street car park to offset the free parking that would be provided at the new food store. Public realm improvements: a package of measures that would provide qualitative improvements to the streetscape of Herne Bay town centre and promote visual linkage from the car park to the retail core. A range of business support and promotion measures, primarily focused at the town centre

5 2.0 Detail Following the granting of the planning consent, a Section 106 legal agreement was entered into between the developers of the food store, Kent County Council and Canterbury City Council which set out exactly how the financial contributions would be spent in accordance with the planning conditions. It is important to note that these measures were carefully selected to ensure full compliance with the relevant planning regulations. Any works that deviate from these measures will breach the regulations and could result in an appropriate payback of the contribution. This report provides an update on the consultation results and proposed design amendments to the public realm improvements. 2.1 Public realm improvements consultation results summary Plans showing the proposed changes have been published on the council s web-site and hard copies placed on deposit at the divisional office. A letter drop has been carried out informing residents and businesses of the proposed changes. A period of 4 weeks was allowed for responses to be made. 6 2.2 Public realm improvements proposed design amendments Based on the responses to the consultation process, the following design changes are proposed: William Street Car Park No change to original proposal Beach Street No change to original proposal New public square / Wimereux Gardens Retention of vast majority of mature trees Retention of green space where possible Additional new trees where possible Additional planting where possible Surfacing solution will be SUDS (Sustainable Urban Drainage System) compliant Lower William Street Inclusion of loading bay Upper William Street/Mortimer Street No change to original proposal Wider Improvements No change to original proposal 3. 7 6. Reasons for supporting option recommended, with risk assessment The design proposals have been revised based on feedback received from the consultation process. 7. Implications (a) Financial Implications The works are being funded through the contributions secured through a Section 106 agreement Other implications (f) Planning/Building Regulations/Highway The works are being undertaken in accordance with the Section 106 planning agreement. Works on the highway will be carried out under a Section 278 agreement (h) Equalities The Development Advisory Panel has been contacted and comments sought on the scheme design. An Equalities Impact Assessment will be carried out prior to works commencing. 8. Conclusions This report provides an update to the panel on the proposed mitigation works in respect of public realm improvements. The report summarises the consultation responses and details the proposed design amendments as shown in Appendix One. The proposed works will be carried out in accordance with the Section 106 legal agreement.
