2 2 Summary MONITORING AND REPORTING REQUIREMENTS Inspection Period: From: To: Requirement Source: Agricultural Waste Control Regulation Activity:On Site Waste Type:Effluent Inspection Summary: On February 10, 2016, I attended the Purple Spring Nursery during an Agricultural Waste Control Regulation compliance promotion trip to the area. I met with Tim Walton of Purple Spring Nursery (the Nursery). Response: Notice The Nursery operates on approximately 250 acres of land and grows ornamental trees that are mainly sold to Alberta. Small diameter trees are planted in compost that is produced on site from tree grindings, dry manure from the Regher feedlot (across the road, same owner), and sudan grass. This compost material is not sold to the public. Compost is the main source of fertilizer used. There is an Integrated Pesticides Management (IPM) sprayer on staff and foliage fertilizer is sprayed as needed. I noted a small amount of hog fuel, or wood waste, being stored on site which originated from the North Enderby Timber mill. This material was not stored near a watercourse. I reviewed the Agriculture Waste Control Regulation (and Code of Practice for Waste Management) (the Regulation) with Mr. Walton and discussed specifically the definition of a watercourse and the required storage setbacks of 15 m and 30 m. I provided promotional handouts on composting, wood waste storage and manure storage. We discussed the drainage that enters the Nursery property under Hullcar Road that originates from the interception/sedimentation pond at the Regher feedlot. Mr. Walton indicated that this water is tested (and results were later provided on February 18, 2016 and March 7, 2016). This analysis indicates low levels (below detection limit of 1.0 ug/ml) of Nitrate, a parameter of concern in the area. This analysis does not capture any contributions from Nursery storage prior to where the flow dissipates to ground. Mr. Walton indicated that Joe Klassen, Nursery Manager, heads up the waste management program for both the Nursery and Regher feedlot. In a follow up discussion with Mr. Klassen on April 11, 2016, he informed me that the water sampling location is on the nursery side of the culvert and that the material stored near the watercourse was bark mulch (hog fuel) with no manure added. This storage of wood waste within 15 meters of a watercourse (photo 2) is noted as a potential issue. Section 7(1) of the Regulation requires a setback of 15 meters from a watercourse for the storage of agricultural waste (defined as manure, used mushroom medium and agricultural vegetation waste). Hog fuel is "wood waste" and when stored in preparation for composting product, does not legally require the same setbacks as agricultural waste. However, a best
3 management practise is encouraged to keep hog fuel and compost within the same set back requirements as agricultural waste. ACTIONS REQUIRED BY REGULATED PARTY: ADDITIONAL COMMENTS: Compliance History: This is the first inspection on file for this facility. Compliance Summary In Out N/A N/D Operations Inspection Details Section 4 Allowable storage Agricultural waste may be stored on a farm only if the waste is produced or used on that farm. All waste material (manure, hog fuel) is used on the Nursery once composted. Section 5 Storage methods When agricultural waste is stored, it must be stored (a) in a storage facility (structure, reservoir, lagoon, cistern, gutter, tank or bermed area for containing agricultural waste prior to its use or disposal, but does not include a vehicle or any mobile equipment used for transportation or disposal of agricultural waste; ), (b) as field storage (temporary stock of agricultural waste ready to be drawn upon for use as a crop fertilizer or soil conditioner), or (c) in the case of waste from fur bearing animals, under their outdoor pens. Field storage is the method used at this site. No manure was observed stored at the time of inspection, only wood waste. 3
4 Section 7 Location of storage facility (1) A storage facility must be located at least 15 m from any watercourse (a place that perennially or intermittently contains surface water, including a lake, river, creek, canal, spring, ravine, swamp, salt water marsh or bog, and including a drainage ditch leading into any of the foregoing) and 30 m from any source of water for domestic purposes. Agricultural waste was not observed within 15 m of a watercourse, only wood waste. Section 8 Field storage (2) Solid agricultural waste may be stored on a field for more than 2 weeks if the agricultural waste is (a) stored for no longer than 9 months, (b) located at least 30 m from any watercourse or any source of water used for domestic purposes, and (c) stored in a manner that prevents the escape of agricultural waste that causes pollution. No agricultural waste was observed stored at the time of inspection, only wood waste for composting. Section 11 Discharge to water Agricultural waste must not be directly discharged into a watercourse or groundwater. No agricultural waste was observed to be directly discharged into a watercourse or groundwater at the time of inspection. Section 12 Allowable application Agricultural waste must be applied to land only as a fertilizer or a soil conditioner. Agricultural waste is composted and used as fertilizer. Section 13 Prohibited application 4
5 Agricultural waste must not be applied to the land if, due to meteorological, topographical or soil conditions or the rate of application, runoff or the escape of agricultural waste causes pollution of a watercourse or groundwater. No application of agricultural waste to land was observed at the time of the inspection. No pollution of a watercourse or groundwater was observed at the time of inspection. However, pollution of a watercourse or groundwater could not be fully determined without additional sampling and analyses since the lagoon runoff analysis is only one contributing source from both the feedlot (and Nursery) operations. Compliance:Not Determined Section 14 Conditions unfavourable to application Agricultural wastes must not be applied (a) on frozen land, (b) in diverting winds, (c) on areas having standing water, (d) on saturated soils, or (e) at rates of application that exceed the amount required for crop growth, if runoff or escape of agricultural waste causes pollution of a watercourse or groundwater, or goes beyond the farm boundary. No application of agricultural waste was observed at the time of inspection. No evidence was observed of agricultural waste leaving the farm boundary. Section 15 Composting Agricultural waste may be composted on a farm if (a) the agricultural waste being composted consists only of agricultural waste (i) produced on that farm, or (ii) produced elsewhere but being composted for use on that farm only, The agricultural waste (defined in the code as manure, used mushroom medium and agricultural vegetation waste) composted at the Nursery is produced at the Regher feedlot (same property owner as the Nursery) and used only at the Nursery. Section 20 Allowable use Wood waste may only be used for (a) plant mulch, soil conditioner, ground cover, on-farm access ways, livestock bedding and areas where livestock, poultry or farmed game are confined or exercised, 5
6 (b) berms for cranberry production, or (c) fuel for wood fired boilers. Wood waste was observed to be used only in the composting process and applied as a soil conditioner. Section 21 Storage Wood waste stored and used on a farm must be handled so as to prevent any escape of (a) particulate or solid matter from the wood waste into the air, or (b) particulate or solid matter or leachate from the wood waste into any watercourse or groundwater hat causes pollution. Some of the hog fuel stored on site was observed to be within 30 m of a watercourse (see Photo 2). It could not be determined whether there was any leachate from the hog fuel (wood waste) that caused pollution of any watercourse or groundwater. While there are no specific setback requirements for storing hog fuel, a best management practise is encouraged to keep hog fuel and compost within the same set back requirements as agricultural waste.
