3 JANUARY 2018 Sun Mon Tues Wed Thur Fri Sat New Year s Day Martin Luther King Jr. Day Hazardous Waste Training January is a great time to host annual training. Other than non-accumulating CESQGs, all generators are required to provide annual training to their employees with regard to those employees hazardous waste management duties. New employees must have training within six months of taking a position that requires handling or managing hazardous waste. Employers must document that training, including who was trained, when and a description of the training provided. Training can be done at one time for all employees or be spread out into smaller segments throughout the year. Training must be documented and records retained for three years. Use a log such as the one below to document training. It is good to get training from various sources. Classroom training is good, but do not forget to supplement it with on-site training. 5 FEBRUARY 2018 Sun Mon Tues Wed Thur Fri Sat Valentine s Day Groundhog Day Documenting Hazardous Waste Determinations Most generators can use their knowledge of process and SDS, rather than testing when making a hazardous waste determination. These must be documented and the documentation should be maintained on-site for a minimum of three years from date you last shipped that particular waste off-site. A sample waste determination form can be found at the back of this calendar. Make copies of it, or use the new Kansas Waste Determination app available in the Play stores for Apple and Android, to document your waste determinations. Conference register at kdheks.gov/waste/p_workshops.html Saint Patrick s Day Generator Categories In Kansas, hazardous waste generators fall into one of four different generator categories, based on the amount of hazardous waste generated at the facility in a calendar month. Generators cannot average the generation over a few months or year, but instead should maintain accurate generation records. The four generator category names and quantities follow. Conditionally Exempt Small Quantity Generator generates less than 55 pounds of hazardous waste in a calendar month and accumulates less than 2,200 pounds on-site. Kansas Small Quantity Generator generates 55 pounds or more, but no more than 220 pounds of hazardous waste in a calendar month and accumulates no more than 2,200 pounds on-site. Small Quantity Generator generates more than 220 pounds, but less than 2,200 pounds of hazardous waste in a calendar month, stores waste for no longer than 180 days, and never exceeds accumulations of 13,200 pounds on-site at any one time. Large Quantity Generator generates 2,200 pounds or more hazardous waste in a calendar month and stores waste on-site for no longer than 90 days. Please note the quantities listed above do not include limits for acutely hazardous waste. If a facility s generator category changes, it has 60 days to update the status and waste codes using the Notification of Regulated Waste Activity form. The definition for a closed container may be different for liquids and solids, as detailed at kdheks.gov/waste/techguide/hw-2005-g1.pdf. A satellite container must be located at the point of generation and under the control of the operator. Satellite containers do not have to be inspected. A storage container must have an accumulation start date and be inspected regularly, as dictated by the generator category Although container inspections do not need to be completed on a specific day, weekly inspections should be completed at least once every seven days and monthly inspections must be completed at some point during the calendar month. 11 MAY 2018 Sun Mon Tues Wed Thur Fri Sat Pollution Prevention Awards due in early June; call for more information Mother s Day Shipping Hazardous Waste Most generators use a disposal contractor to transport and dispose of their hazardous waste. The hazardous waste transporter must be registered with KDHE. These hazardous waste transporters typically complete the necessary paperwork or manifests required for shipping hazardous waste. However, it is important the facility representative signing the manifests is familiar with the requirements before signing the manifest. Per generator category requirements, copies of these shipping documents must be maintained. Find a list of registered hazardous waste transporters on the Bureau of Waste Management website at kdheks.gov/waste/hw/hwt_list.pdf. Missing a manifest? Contact your hauler right way to get a copy so your on-site records are complete. 12 If your facility generates solvent-contaminated wipes, it is critical employees be trained on the definition and management of these wipes. 13 JUNE 2018 Sun Mon Tues Wed Thur Fri Sat Pollution Prevention Awards due in early June; call for more information Solvent-Contaminated Wipes As of Jan. 31, 2014, a federal rule allows most solvent-contaminated wipes to be managed as excluded solvent-contaminated wipes. The following wipes are not eligible for conditional exclusions under this rule: wipes that contain a listed hazardous waste other than solvents; wipes that exhibit the characteristic of toxicity, corrosivity or reactivity due to non-listed solvents, or contaminants other than solvents; and disposable wipes that are hazardous waste due to the presence of trichloroethylene. To meet conditions of the exclusion, eligible wipes must be disposed of at a municipal solid-waste landfill (MSWLF). Several areas of Kansas use arid landfills that do not meet MSWLF standards and cannot accept these wipes. There are handling and storage requirements for both reusable and disposable, excluded solvent-contaminated wipes. 15 JULY 2018 Sun Mon Tues Wed Thur Fri Sat Independence Day Mud-Trap Waste Mud-trap waste from truck wash facilities, industrial facilities and repair shops may contain high concentrations of petroleum products or heavy metals. As a result, these facilities must test their mud-trap waste and make a hazardous waste determination. KDHE has recently updated its guidance at kdheks.gov/waste/techguide/sw-1994-g3.pdf. 17 AUGUST 2018 Sun Mon Tues Wed Thur Fri Sat Kansas Environmental Conference check kdheks.gov/sbcs/index.html Aerosol Cans RCRA empty aerosol cans can be disposed of or recycled, as long as they meet the definition of empty. Most aerosol cans are considered RCRA empty when the product has been expelled from the can and only residue remains; and the pressure in the can is at or very near atmospheric pressure at normal room temperature. The only exception is if the can contained a P-listed chemical, then even the empty container must be managed as hazardous waste. If your facility generates partially full aerosol cans on a regular basis, find out why. Are the nozzles clogged? Is it a manufacturer s problem or an employee-use problem? Loss of usable product, time to manage the containers and cost of disposal take money, as well as increase your waste-generation rate. If your facility utilizes an aerosol puncturing system, make sure employees operating the system are properly trained, based on the manufacturer s operating specifications. As with other waste streams, generators need to determine if the spent filters are hazardous waste. Most do this by reviewing various paint SDSs. If the paint contains a regulated metal, then depending on type of paint, metal concentration and paint-booth use, the filters may be hazardous waste. In these instances, generators typically send a filter sample to a certified lab for a TCLP test. Paint filters that do not have regulated metals and pass the paint filter test are typically not hazardous waste and can be disposed of with a special waste authorization. Most facilities generating paint-booth filters that are not hazardous waste dispose of such filters with a special waste-disposal authorization. Learn more at kdheks.gov/waste/. 20 Used oil managed properly can be recycled and reused as a fuel, conserving a valuable resource and saving companies money. Note: Used oil may not be used as a dust suppressant, pesticide carrier, sealant or coating, or for any similar purpose. 21 OCTOBER 2018 Sun Mon Tues Wed Thur Fri Sat Columbus Day Kansas Health and Safety Conference, Wichita Oct Used Oil Used oil means any oil that has been refined from crude oil or any synthetic oil, and has been used and as a result of such use, is contaminated by physical or chemical impurities as defined in 40 CFR Petroleum-based antifreeze and solvents, and vegetable-based oils are not considered used oil under this regulation. Used oil sent for recycling or for use as a fuel is not a hazardous waste. However, oil disposed of or mixed with hazardous waste should be evaluated to determine if it is a hazardous waste, often a costly mistake. Although drained filters can go to the trash, generators are encouraged to recycle them. 23 NOVEMBER 2018 Sun Mon Tues Wed Thur Fri Sat Veterans Day Veterans Day observed Universal Waste Certain widely generated hazardous wastes have been designated as universal waste. This designation allows universal waste handlers to manage universal waste under the streamlined requirements of 40 CFR 273, instead of the more stringent RCRA Subtitle C requirements for hazardous waste. Universal waste includes hazardous waste batteries (Ni-Cd, lithium and lead-acid), hazardous waste lamps (fluorescent and metal halide), mercury-containing equipment (thermostats and medical equipment) and certain hazardous waste pesticides. Universal wastes do not count against your generation rate and have less-stringent container management standards. Universal waste containers must remain closed and should be labeled with the accumulation start date, then sent to a universal waste handler at least annually. As with other waste records, maintain universal waste management records for at least three years. 25 DECEMBER 2018 Sun Mon Tues Wed Thur Fri Sat Hanukkah begins Hazardous Waste Emergency Response All KSQGs and SQGs are required to post emergency information next to a telephone that is immediately available in an emergency. This information includes name and telephone number of the emergency coordinator; location of fire extinguishers, spill-control material (if present) and the fire alarm; and telephone number of the fire department. KDHE has developed a form that can be used to post this information. Use the KDHE sample form, or complete the information in another format, and make copies to post next to telephones throughout the facility wherever hazardous waste is stored.
