You have an industrial facility if you engage in any of the following activities: You make a product for wholesale according to an organized plan and with a division of labor; Change materials by processing* them; or Substantially support** either of those activities. If you are involved in any of these industrial activities, all wastes that your facility produces are industrial waste even office trash 6

11 Combined Waste Considerations Mixture Rule a mixture of a characteristic hazardous waste and a non-hazardous waste is non-hazardous if it no longer exhibits any hazardous waste characteristics a mixture of a listed hazardous waste and a non-hazardous waste remains the listed waste, o unless the listed waste is designated only because it exhibited ignitable, corrosive or reactive characteristics Derived-from Rule Any material derived from treatment of a listed hazardous waste is also a listed hazardous waste. 11

21 One-Time Shipments One-Time Shipment (OTS) Waste Codes For industrial generators who are not and should not be registered with the TCEQ. o E.g., CESQG who generates <220 lbs/month of Class 1 non-hazardous waste Receive: o temporary Texas registration number, o temporary Texas waste code, (for one time use only), and o if necessary, a temporary EPA ID number. Complete the One-Time Shipment Request for Texas Waste Code for Shipment of Class 1, 2, 3, and EPA Hazardous Waste Form (TCEQ-0757). 21
