1 Agenda Report TO: FROM: CCCSWA BOARD OF DIRECTORS BART CARR, SENIOR PROGRAM MANAGER DATE: OCTOBER 26, 2017 SUBJECT: ANNUAL DIVERSION REPORT FOR 2016 CALENDAR YEAR SUMMARY This report documents RecycleSmart s waste disposal and diversion during calendar year It includes diversion and disposal information provided to CalRecycle as part of the mandatory annual reporting. Reporting as a Regional Agency 1, per capita disposal in 2016 was 3.7 pounds, which is no change from the per capita disposal in The 3.7 pounds per capita figure is below the 4.7 pound Disposal Target established for the RecycleSmart Regional Agency by CalRecycle. This means that RecycleSmart member agencies have met and exceeded the AB % diversion requirement for Using a methodology provided by CalRecycle, staff calculates that the 3.7 per capita disposal equates to a 61% diversion rate for 2016, no change from 61% reported for For comparison, the statewide 2016 per capita disposal weight reported by CalRecycle is 6.0 pounds, an increase from 4.7 pounds statewide reported for (See Attachment B for a description of statewide diversion in 2016). RecycleSmart s 3.7 pounds per capita disposal places this Agency well ahead of the State in progress toward achieving their higher diversion goals. In addition to meeting the requirements of AB 939, this report also documents 2016 service area disposal, diversion tons, and the performance of diversion programs supporting RecycleSmart member agencies. RECOMMENDED ACTION 1. This report is for information only. No Board action is required. 1 In 2009, the CCCSWA became a Regional Agency. Regional agency formation allows cities and counties who share the same waste reduction and recycling plans and services to form regional agencies in order to reduce the cost of reporting disposal and diversion programs and increase the diversion of solid waste from disposal facilities. 2 DISCUSSION RecycleSmart per capita disposal was 3.7 pounds which is below the 4.7 pound Disposal Target and establishes that RecycleSmart has met the 50% (AB 939) diversion requirement for SB 1016, legislated in 2008, replaced use of diversion percentage. SB 1016 requires use of a jurisdiction-specific disposal target that is the equivalent of 50% diversion, expressed on a per capita weight basis. If a jurisdiction disposes less than its 50% per capita target weight and has implemented all its designated recycling programs, it has met the AB 939 diversion requirement. RecycleSmart met the diversion requirement in 2016 because the per capita disposal weight of 3.7 pounds is less than the generation target weight of 4.7 pounds. Table 1 provides the target statistics that were reported to CalRecycle and Table 2 compares the 2016 per capita disposal weight with the prior year. RecycleSmart reports as a Regional Agency and CalRecycle does not provide per capita disposal weight for each member agency. Since this data is not provided, RecycleSmart staff must calculate per capita figures using the annual total disposal for each member agency provided by CalRecycle, and the most current population data from the CA Department of Finance. The staff generated figures can be compared to the 3.7 pounds figure for the RecycleSmart region. Higher per capita weight for Walnut Creek, Lafayette, and Danville is due to larger commercial sectors in each of these jurisdictions. Page 2 of 10

The equivalent percentage diversion rate to the per capita 3.7 pounds for the region is 61% as shown in Table 4, and also includes the 2015 diversion rate for comparison. Both 2015 and 2016 diversion rates were calculated using an approved methodology provided by CalRecycle. The disposal tonnage figure comes from CalRecycle Disposal Reporting System (DRS). Note that AB 939, 50% diversion target compliance is based on changes in disposal only. Diversion weight data is reported to CalRecycle for purposes of understanding implemented program performance but diversion weight is not used to determine diversion target compliance. Diversion weights are recorded by RecycleSmart staff through analysis of tonnage reported by various collection programs operated by this Agency, as well as programs and facilities outside the RecycleSmart service area. The diversion tonnage is reported to CalRecycle by program type within the program summary section of the CalRecycle Annual Report. A copy of the 2016 Annual Report is attached to this staff report as Attachment A. Page 3 of 10

The chart does not include unreported self-haul and commercial backhaul of recyclables which may account for the difference between the 58% diversion percent represented here and the 61% shown in Table 4. This represents an overall increase of 6,654 tons of household recyclable materials. The increase reaffirms that residents continue to use weekly curbside collection of their dry recyclables (food and beverage containers and mixed paper) in their efforts to recycle. Page 4 of 10

As in past years, when organic collected tons are combined with the container/mixed paper tons, residential recycling tonnage is significantly higher than all other programs and continues to be the backbone of RecycleSmart diversion efforts. 6 Commercial Recycling Commercial recycling tonnage consists of mixed containers, mixed paper (includes cardboard), organic materials, and food waste. The combined weight for these materials, in 2016, was 16,739 tons. This is an increase of 5,059 tons over 2015 tonnage. The tonnage does not include construction & demolition materials which will be described separately. 7 Multi-Unit Recycling Collection In 2016, multi-unit collection tonnage was 3,945 tons. Outreach and assistance continues to be provided to property management and tenants to encourage participation. A primary focus for assistance is maintenance of sufficient recycling collection capacity, checking for current wallmounted signage, and encouraging the addition of organic material collection. Collection containers with insufficient capacity or too few collections per week (or a combination of both) directly impact businesses and multi-family tenant s ability to recycle. Through expansion of capacity, our programs can support greater participation and diversion. RecycleSmart staff have been working with Republic and contractors to increase collection capacity throughout the service area in Tables 11 and 12 below illustrate increase in cubic yards during Page 7 of 10

Diablo Recycling (MDR) collected 956 tons of reuse materials in MDR operates reuse collection according to the requirements and guidelines established in their contract, and avoids collection of materials that are not reusable. Projecting current year collection weight (March - August 2017) suggests an increase in collected tonnage to 984 tons in the current rate year. Page 8 of 10
9 Construction & Demolition (C&D) Table Curbside Reuse Collection Tonnage Member Agency Danville Lafayette Moraga Orinda Walnut Creek County TOTAL 1, C&D waste diversion is measured through quarterly reporting submitted to RecycleSmart by permitted transporters and disposal tonnage data using Green Halo electronic reporting. Combined C&D tonnage for 2016 was 49,256, an increase from 46,074 tons. The Green Halo system continues to play an important role in recording and monitoring C&D waste diversion because it includes all forms of disposal, including self-haul. Self-haul is the primary way that contractors dispose of their waste, either for reuse, recycling or landfill disposal. 10 2016 CalRecycle Annual Report Submission Attached is a copy of the 2016 Annual Report submitted to CalRecycle. The majority of the report contains the Source Reduction and Recycling Element (SRRE) Program Summary providing brief descriptions (updates) of operating programs and reported tonnage (where tonnage data is reported and available). CalRecycle uses this report along with annual staff visits to make the formal determination of annual compliance with the requirements of AB 939. Conclusion RecycleSmart compliance with the State 50% diversion target requirement was unchanged in 2016, as was the per capita disposal weight of 3.7 pounds. While State diversion significantly decreased in 2016, RecycleSmart held its per capita disposal to 3.7 pounds which equates to the 61% diversion rate. Review of collected tonnages does indicate improvement in each Member Agency s residential sector which continues to be the primary support for our sustained 61% rate. Commercial and multifamily tonnages also improved incrementally. RecycleSmart s construction and demolition waste diversion activities were the second largest contributor to overall diversion efforts at 18 percent. This reinforces the need to maintain focus on construction waste diversion as a major waste fraction that must continue to be managed. Although commercial and multi-family exhibited improvement from 2015 collection, these sectors must do more to support increased regional diversion. RecycleSmart collection services currently have the capacity to support increased diversion in commercial and multi-family sectors, but more outreach and greater participation by businesses and multi-family complexes will be the focus of staff and Republic Services. RecycleSmart must also remain in compliance with mandatory commercial recycling (MCR) regulation and the new commercial organics requirements put into place by AB In the immediate future, RecycleSmart will plan to respond to the new SB 1383 organics diversion requirements, which include 50% reduction in 2020 and 75% in 2025 from 2014 levels.
