2 Mandate COP V/26 Decisions COP V/26: Work Programme of the Technical Working Group (Dec. 1999) Adopts the Programme of Work of the Technical Working as contained in the annex to the present decision; Annex (II. Technical guidelines: 4. Consideration of the further preparation of technical guidelines on the environmentally sound management of Persistent Organic Pollutants )
3 Mandate COP VI/23 Decisions COP VI/23: Preparation of Technical Guidelines on the ESM of POPs as wastes (Dec. 2002) Requests the Open-ended Working Group to finalize the technical guidelines and submit them for consideration and eventual adoption by the Conference of the Parties at its seventh meeting; Further requests the Open-ended Working Group to continue and reinforce its cooperation with the appropriate subsidiary bodies of the Stockholm Convention on Persistent Organic Pollutants to ensure consistency in implementation and mutual support between the Basel and Stockholm Conventions.
4 Mandate OEWG I/4 A) Decisions OEWG I/4: Preparation of Technical Guidelines on the ESM of POPs as wastes Agrees that the following separate technical guidelines ( ) should be developed: (a) A general technical guideline; (b) Specific technical guidelines on ( ): PCBs (including PCTs and PBBs) dioxins and furans; DDT; HCB and the eight pesticides aldrin, chlordane, dieldrin, endrin, HCB, heptachlor, mirex and toxaphene;
5 Mandate OEWG I/4 (2) B) Decisions OEWG I/4: Preparation of Technical Guidelines on the ESM of POPs as wastes Agrees to aim to include in the draft technical guidelines referred to in subparagraph 1 (b) above to be considered by the Conference of the Parties at its seventh meeting: (a) (b) Provisional definitions for low persistent organic pollutant content (with reference to subparagraph 2 (c) of article 6 of the Stockholm Convention) for each persistent organic pollutant; Levels of destruction and irreversible transformation;
6 Mandate OEWG II/10 A) Decisions OEWG II/10: Preparation of Technical Guidelines on the ESM of POPs as wastes 1. Invites Parties and others to submit comments ( ) on the following: (a) (b) Further proposals on provisional definitions for low POP content ( ) Methods that constitute environmentally sound disposal, including pretreatment, with the following addressed separately: (i) (ii) Destruction or irreversible transformation methods; Other disposal methods when the POP content is low; (iii) Other disposal methods when destruction or irreversible transformation does not represent the environmentally preferable option; (c) Levels of destruction and irreversible transformation;
7 B) Decisions OEWG II/10: Preparation of Technical Guidelines on the ESM of POPs as wastes Agrees that: Mandate OEWG II/10 (a) (d) (e) The technical guidelines should have a similar structure ( )as far as possible, taking into account comments made at and after the second session of the Openended Working Group; The guidelines should make clear that mixing of wastes ( ) for the purpose of generating a mixture with a POP content below the defined low POP content is not environmentally sound ( ) ( ) only technologies which are currently commercially available and are environmentally sound should be recommended ( ); technologies that are currently operating on a pilot or test basis should also be mentioned ( );
8 Mandate by the Stockholm Convention (Art.6) The COP (of the Stockholm Convention) shall cooperate closely with the appropriate bodies of the Basel Convention ( ) to: Establish levels of destruction and irreversible transformation necessary to ensure that the characteristics of POPs as specified in paragraph 1 of Annex D are not exhibited (Destruction efficiency of disposal technologies) Determine what they consider to be the methods that constitute environmentally sound disposal referred to above (Methods for environmentally sound disposal); and Work to establish, as appropriate the concentration levels of the chemicals listed in Annexes A, B, C in order to define the low POP content referred to in paragraph 1 d ii (Low POP Content)

10 Status of negotiations (OEWG3/CRP.28) On low POP content: The OEWG agrees, that the following provisional definitions for low POP content should be further considered by the small inter-sessional working group: a. PCB: [50 mg/kg] b. PCDD/PCDF: [0.1] [1] [10] [50]µ g TEQ/kg c. Other POPs: [5] [50] mg/kg
11 Status of negotiations (OEWG3/CRP.28) On levels of destruction or irreversible transformation a. The technologies applied should be capable to achieve a destruction efficiency of 99,9999% when they are operating with waste consisting of or containing POPs with a POP content above 1%; however, this does not apply for technologies disposing of waste arising from remediation of contaminated sites; b. The technologies should meet the following: i. the following concentrations in solid wastes: - for PCBs: [1-10 mg/kg] - for HCB and the eight pesticides: [5] mg/kg ii. regarding emissions to air and water pertinent national and international legislation, and c. The technologies should be operated in accordance with BAT/BEP
