9 DEQ FY18 Budget The House Appropriations Subcommittee meeting this week on HB 4231 (DEQ s Budget). The Senate Appropriations Subcommittee also meeting this week on SB 140 (DEQ s Budget). This will be followed by the May revenue estimating conference and the conference committee which will work through any differences between the House and Senate versions.

16 Michigan s 404 Program Potential Changes In December 2016 the EPA published in the Federal Register the findings of their review of Michigan s 2013 amendments to the state wetlands and inland lakes and streams statutes. The findings identify the amendments that are consistent and inconsistent with the Clean Water Act. Michigan is committed to maintaining our authority to administer the 404 Program and the WRD will be working with stakeholder groups to develop corrective actions in response to EPA s review.

23 Legislation Update House Bill 4100 proposes to create a new public act that will allow local units of government to establish and collect storm water utility fees as part of a storm water management utility. House Bill 5923 proposes to establish a fee for discharges of untreated or partially treated sewage from a sewer system into waters of the state and establish additional criteria for a sewage overflow cleanup fund to which the collected fees will be deposited. Senate Bill 154 proposes to amend Part 31, Water Resources Protection, of the NREPA to create the Water Resources Commission within the DEQ to exercise supervisory authority for the issuance, denial, revocation, suspension, or modification of permits; the promulgation of rules; and the development of DEQ policies. Senate Bill 363 would amend Part 325, Great Lakes Submerged Lands, of the NREPA to revise bottomland lease amounts.
