2 Changes in Legal Framework Exploitation of Natural Resources ENERGY REFORM Rational & sustainable under the principles of National Sovereignty, Economic Efficiency and Social Benefits Benefits for population in general: Energy Production at lower cost and cleaner, increase of oil revenues, increase in high level jobs & environment protection
3 Objectives Attract investment and modernization in the Energy Sector in order of: Half Million jobs in this Period (6 years) and 2.5 Million until 2025 in the whole country 4. Enforce State Ownership in oil & Gas, as well as Regulator of Oil Industry 1. Improve the Families Economy: Decrease in electric and gas bills 3. Enforce PEMEX & CFE 2. Increase Investment and Employment Flexibility in the decisionmaking process for better results and modernization
4 Benefits: Energy Reform Family Economy: decrease on electric, gas and food prices. Social Development: oil revenues will be invested in social budget, long-term saving & scholarship programs, as well as Universal Pension, productive projects and R & D. Environmental Protection: workers protection and wellness for population by promoting energy generation through renewable and clean energy resources.
5 Benefits: Energy Reform Transparency in Energy Sector: public reports of oil and natural gas income; Competitiveness: small and medium mexican companies will spend less in energy; PEMEX and CFE will invest their resources for modernization and cutting-edge technology; Increase in productive and industrial capacity: al with the increase of availability of energetic sources produced at lower cost within Mexico.
6 Measures for Environmental Protection Art. 19 Transitory, Mexican Constitution; Creation of the National Agency for Industrial Security and Environmental Protection of the Hydrocarbons Sector (ASEA). Attributions: regulation and supervision of industrial security, operability and environmental protection, facilities and activities of sector hydrocarbons, including activities of dismantlement and abandonment of facilities, as well as integral management of disposals.
7 Considers: Minimize the affectations al to environment; Grant the effective capacity of respond before any incident or accident The Reform emphasizes the responsible exploitation of natural resources. Collaborates with: Marine Corps and the Labor and Social Prevision Ministry Respond before any industrial incident that represents a risk for employees health and environment ASEA depends of SEMARNAT
8 National Agency for Industrial Security and Environmental Protection of the Hydrocarbons Sector (ASEA) Started operations in March 2nd as an specialized entity of the Federal Government which depends of SEMARNAT, with technical and self-management autonomy, in charge of regulation and supervision of industrial security and environmental risks in the value chain of hydrocarbons Sector in Mexico. Publish rules of operation, authorize and supervise management systems and operational and environmental prevention of risks; Design statutes or standard legal based on best practices and international standards to protect environment and peoples security.
9 Functions transferred to ASEA (scheme of collaboration) Energy Ministry (SENER) Regulation, supervision and industrial security Deliver and supervise permits and regulations for the activities of oil & LP gas exploration and production. Regulatory Energy Commission (CRE) National Hydrocarbon Commission(CNH) Regulation, supervision and authorizations related to industrial process security Distribution, storage and transportation of oil, petroliferous and natural gas.
10 Functions transferred to ASEA (scheme of collaboration) Environmental and Natural Resources Ministry (SEMARNAT) Federal Environmental Protection Agency (PROFEPA) Grant licenses, permits and authorizations of environmental protection exclusively for the hydrocarbons sector; Includes land use for industrial and management disposals. Management of files and attributions including supervision, investigation and penalties of the activities within the hydrocarbon sector.
11 Environmental Responsibility Include international practices over the responsibility of any contractor developing activities of exploration and exploitation. The secondary laws established with precision that oil companies are responsible of any affectation to the environment. The Energy Reform will provide the Mexican State the faculty to demand companies with the sector to comply with their obligations.
12 Technology Development & Infrastructure Access to preferential Green Credits within the Financial Sector The Mexican Centers for Energy Innovation will be in charge of training specialized human resources and strengthen R & D. The Centers will be created with co-investment Public- Private Partnerships (PPP) of 2,000 millions of pesos ($135 million US dlls) distributed as shown: Geothermic Energy, coordinated by the CICESE, Ensenada, Baja California. Solar Energy, leadered by the Institute of Renewable Energies, UNAM. Eolic Energy, coordinated by the Institute of Electric Research.
13 Inclusion of Alternative Energy Development and adoption of new technologies is important to mitigate the impact of energy generation over the environment. This diversification it is expressed in the secondary laws: Creation of Geothermic Law, take advantage of hot groundwater of volcanic origin Round Zero with CFE Tender with private enterprises in geothermic zones not allocated to CFE Certificates of Clean Energies to reduce the costs of transaction Fiscal Reform (2013) Special Tax for the use of fuels that generate CO2; ISR Tax Deduction to whom uses clean energies.
14 Challenges & Opportunities México has 253 electric centrals based in Renewable Energies. Full Development of Renewable Energy in Mexico. International Examples: Denmark, Germany, Spain, China, USA and Italy. Solar Energy has a potential growth of 1,000%, passing from 59.4 MW in 2012 to MW until the year Great opportunities for investing, employment and economic development. The Energy Reform establishes a goal of 35% in primary clean energies for electric generation until 2024.
15 Challenges & Opportunities The cost of Renewable Energies has lowered in 70% in the last 10 years. Accessibility and promotion through secondary laws, becomes more attractive. The Reform allows participation of new actors in energy generation. More offer of electricity at lower cost for homes and Small & Medium Businesses México has a potential for Renewable Energy looking forward 2020 of 57 thousand MW. Reforms to Article 27 allows participation of particulars in electricity generation. 1/3 of Electric Energy of the country it is currently produced by the private sector..
