2 Recommendations one required. Consultancy Opinion Current Land Use Groundsure has been advised by the client (or their advisers) that the property is currently used as offices. The.11 ha site has been identified to comprise several adjoining buildings throughout the plot with a courtyard situated in the centre. The site is situated within a commercial setting with similar properties adjacent to the south and west. Colmore Road lies to the north and Bennett's Hill is located to the east of the study area. Historical Land Use On ite Historically, the site was developed prior to c.1888 and mapping from c. identified the site to comprise several adjoined buildings throughout with courtyards located in the centre. Covered entrance ways were also located in the east of the study area at this time. The plot underwent minor reconfigurations between c.189 and c.1937 but remained in much the same layout and use. By c.1954 a building in the south had been extended towards the south west. A review of historical mapping revealed no further changes until c.1992 by which time the study area had been redeveloped to match the current site layout. Historical Land Use urrounding Area Historically, no potentially contaminative land uses have been identified in the vicinity of the property. nvironmental Permits and Register ntries o nvironmental Permits of concern have been identified in proximity to the property. o entries on the Local Authority's Contaminated Land Register have been identified within 5m of the site. nvironmental Damage Regulations ensitivity Assessment The site has been assessed in relation to relevant receptors under the regulations, and is noted to have a moderate sensitivity. As the site does not appear to be in current industrial use, there is unlikely to be a significant risk of nvironmental Damage at the property. However, if you require an assessment of operational risk at the property, please contact Groundsure for further advice. ite etting and Overall nvironmental ensitivity The site is situated on geology comprising superficial Mid Pleistocene Glaciofluvial deposits underlain by bedrock layers of the Helsby andstone Formation. Groundwater mapping indicates the superficial deposits to be classified as a econdary A aquifer and bedrock layers to be classified as a Principal aquifer. Potentially vulnerable receptors have been identified including the site users and the aforementioned aquifers, noted to lie within ource Protection Zone 2. In addition, a potable groundwater abstraction licence has been identified 1848m to the north. Groundsure considers that the property has a high environmental sensitivity. 3 Conclusion Groundsure has not identified a potential contaminant-pathway-receptor relationship that is likely to give rise to significant environmental liability. The study site is considered unlikely to be subject to individual statutory investigation, and Groundsure therefore concludes that the site represents an Acceptable nvironmental Risk. 5 Flood Recommendations It is recommended that several insurers are contacted to confirm the availability of reasonably priced insurance for the property. The purchaser may wish to make specific enquiries of the vendor regarding the history of flooding at the property. JBA urface ater (Pluvial) Flooding As the site lies within an area considered to be at moderate risk of surface water flooding (with a predicted depth of flooding between.3m and 1.m in a 1 in 2 year rainfall event), some insurers may charge increased premiums for the provision of household insurance. e would recommend that comparative quotes are sought to confirm the presence of competitive cover. A prudent purchaser may wish to obtain a more detailed flood risk assessment. The detailed flood risk assessment will further quantify the risk of flooding at the site as well as examining the history of flooding at the site, reviewing the standard of protection afforded to the site and providing a quote for a Full Flood Risk Assessment to meet the requirements of PPF, if required. 15 Groundsure Risk Assessment Methodology nvironmental Risk Framework This report is designed to provide a basic environmental liability risk assessment for the purposes of transaction due diligence, financing arrangements and similar circumstances. The report comprises a basic risk assessment within the general principles of the contaminant-pathway-receptor pollutant linkage model and with due regard for relevant publications issued by the Department of nvironment, Food and Rural Affairs (and predecessor government departments) the British tandards Institute and the uropean Union. xplicit opinion is provided with regard to potential liability for the property to be identified as Contaminated Land in accordance with the meaning set out in Part 2A of the nvironmental Protection Act 199. Consideration and due regard is also made of associated legislation that may lead to related statutory or third party environmental liability, including but not limited to the ater Resources Act 1991,the ater Act 214, the Contaminated Land Regulations 26, nvironmental Permitting Regulations 21, the nvironmental Damage (Prevention and Remediation) (ngland) (Amendment) Regulations 215 in ngland and the nvironmental Damage (Prevention and Remediation) (Amendment) (ales) Regulations 215 in ales. This report does not contain a detailed Conceptual ite Model as required in the ational Planning Policy Framework, however, it may prove highly effective in determining whether such further assessment is appropriate. This response considers the risk of legal liability arising through ownership or occupation and use of the property through statutory or other third party claims. Consideration is given to the suitability of the property as robust financial security for the purposes of secured lending facilities. An assumption is made here that the subject property is being considered in isolation and that normal commercial lending loan to value ratios are being considered. Groundsure may in certain circumstances be able to make a specific lender liability assessment based on a full view of financial arrangements and hence the commercial context of the environmental risks. Is there a risk that the property value may be impacted due to environmental liability issues? This response sets out to advise whether environmental liabilities are likely to materially impact upon a standard Royal Institution of Chartered urveyors valuation of the property necessitating further assessment. hat is the potential for environmental risk associated with property ownership i.e. that a prudent purchaser may wish to consider further? 17 Land, if contamination of the land results in a significant risk of adverse effects on human health The regulations are based on the 'polluter pays' principle and ensures that those responsible for causing environmental damage are those responsible for paying to prevent and remedy such damage. 'nvironmental Damage' has a specific meaning within the Regulations, and covers only the most serious cases. 18 Flood Risk Framework The Flood Risk Assessment section is based on datasets covering a variety of different flooding types. o inspection of the property or of the surrounding area has been undertaken by Groundsure or the data providers. The modelling of flood hazards is extremely complex and in creating a national dataset certain assumptions have been made and all such datasets will have limitations. These datasets should be used to give an indication of relative flood risk rather than a definitive answer. Local actions and minor variations, such as blocked drains or streams etc. can greatly alter the effect of flooding. A low or negligible modelled flood risk does not guarantee that flooding will not occur. or will a high risk mean that flooding definitely will occur.
