3 NFTA Property, 929 Main Street April 2, 2013 Buffalo, Erie County, New York Page INTRODUCTION This report presents the results of a Phase II Environmental Site Assessment (ESA) conducted by Fisher Associates, P.E., L.S., P.C. (Fisher Associates) for the University at Buffalo Foundation Services, Inc. (UBFS) and the State University Construction Fund (SUCF). It is our understanding that UBFS and SUCF are proposing to purchase the parcel located Along the east side of Main Street between High Street and Carlton Street (#929 Main Street). The subject site is located in the City of Buffalo, New York, as shown on Figure No. 1 Project Location Map. 1.1 Site Background The property at 929 Main Street, is currently being used as a transit station for the Niagara Frontier Transportation Authority (NFTA), and was originally a number of properties (seven in all) of mixed commercial and residential housing properties until approximately 1940 when it became the Up Town Grill Restaurant. Located within the row of properties was a paint and varnish store that is shown only on the 1951 Sanborn Fire Insurance Map. The restaurant remained, although at some times vacant, until approximately 1984 when the parcels were combined and were converted into the transit station. The surrounding neighborhood contains a mix of retail shops, restaurants, and medical buildings associated with Roswell Park Cancer Institute and Buffalo General Hospital. Properties immediately adjacent to 929 Main Street are generally of commercial and residential use including the First Niagara Bank located immediately adjacent to the north, and the Roosevelt Apartments located immediately to the south. Parking for the bank and for the apartments is along the eastern limits of the property, and Main Street is immediately to the west. 1.2 Purpose and Scope The purpose of the Phase II ESA was to determine the potential for encountering contaminated soils, contaminated groundwater within the site, characterize subsurface conditions, and to determine if historic use of the properties impacted the subject property. The Phase II ESA involved performing one (1) soil boring and analytical laboratory testing. 2.0 FIELD INVESTIGATIONS 2.1 Soil Borings On February 26, 2013 representatives of Fisher Associates and Nature s Way Environmental Consultants & Contractors, Inc. (Nature s Way), advanced one (1) soil boring using hollowstemmed augers driven by a truck-mounted rotary drill rig at a location just east of the NFTA concourse as shown on Figure 2 Soil - Exploration Plan contained in Appendix A. The boring was advanced to a depth of approximately 74.5 feet below ground surface. During drilling, the soil samples retrieved were monitored at 2.0 foot (ft.) to 5.0 (ft.) intervals using a RAE Systems MiniRAE 2000 photoionization detector (PID).

4 NFTA Property, 929 Main Street April 2, 2013 Buffalo, Erie County, New York Page 2 The soil samples were scanned for the presence of organic compounds, and the subsurface conditions were documented during the investigation. A copy of the soil boring log prepared by Fisher Associates and Nature s Way Environmental are contained in Appendix B. A representative soil sample was taken from the boring at a point from which had the highest PID reading above background (i.e., 5 ppm), at a depth where groundwater was encountered. Since there were no elevated PID readings during the collection of samples, the laboratory sample was taken from the boring at a depth of ft. where the soil became wet. The soil sample was placed in laboratory grade glass jars and then submitted under standard chain-of-custody protocol to Paradigm Environmental Services (Paradigm), a New York State Department of Health (NYSDOH) approved laboratory for analysis. The sample was analyzed for volatile organic compounds (VOCs) via United States Environmental Protection Agency (USEPA) Method 8260B Target Compound List (TCL) and NYSDEC STARS Compounds. The samples were also analyzed for semi-volatile organic compounds (SVOCs) via USEPA Method 8270C. In addition to analyzing the soil sample collected from the soil boring for petroleum compounds, the sample was analyzed for concentrations of heavy metals and PCBs. The sample was analyzed for the eight (8) RCRA metals via USEPA Methods 3050/6010B/7471B and PCBs via USEPA Methods 8082A/3550C. The results of the sample headspace scanning are shown on the soil boring logs contained in Appendix B. 3.0 INVESTIGATION AND ANALYTICAL TEST RESULTS 3.1 Soil Borings The soil sample collected at boring MR-5 was analyzed by Paradigm for VOCs via USEPA method 8260B TCL plus STARS, SVOCs via USEPA Method 8270C, RCRA Metals via USEPA Methods 3050/6010/7471, and PCBs via USEPA The analytical laboratory results and chain-of-custody form is contained in Appendix D. The NYSDEC Department of Environmental Remediation (DER) publication DER-10 contains cleanup guidelines for various types of existing or proposed land use. The DER 10, Section 1.12 Use of Site guidelines for the property indicate that commercial use includes health care facilities, including hospitals. Therefore, the laboratory analysis results were compared to the NYSDEC Part Remedial Program Soil Cleanup Levels ( Restricted Commercial Use). As shown in Table 1 in Appendix C, no VOCs were detected at levels above the laboratory method detection limit (MDL) in the sample collected from soil boring MR-5. The sample collected from soil boring MR-5 also did not contain SVOCs at levels of compounds that were above the laboratory method detection levels (MDLs) as shown in Table 2. In addition to analyzing the soil sample collected from the soil boring for petroleum compounds, the sample was analyzed for concentrations of heavy metals and PCBs. The sample was

5 NFTA Property, 929 Main Street April 2, 2013 Buffalo, Erie County, New York Page 3 analyzed for the eight (8) RCRA metals and PCBs to determine potential soil management/disposal procedures during construction. As shown in Table 3 in Appendix C, several RCRA metals were detected above the laboratory MDL in the sample collected. The metals Arsenic, Barium, Chromium, Lead, and Silver were detected in the sample. The metals detected in these samples do not exceed NYSDEC Part 375 Unrestricted Use Guidance. No PCBs were detected in soil borings MR-5 as shown on Table 4 in Appendix C. 3.3 Monitoring Wells No monitoring well was installed in the soil boring MR-5 at the NFTA property. 4.0 CONCLUSIONS AND RECOMMENDATIONS 4.1 Subsurface Soils The purpose of the deep subsurface investigation was to determine the potential for encountering petroleum, heavy metal, or PCB-contaminated soils and/or groundwater within the property limits from on-site or off-site sources. To accomplish this, one (1) soil boring was advanced. The soils recovered were monitored for the presence of VOCs on site, sampled, and analyzed by Paradigm for VOCs, SVOCs, RCRA metals, and PCBs. The analytical laboratory results and chain-of-custody form are contained in Appendix D. Soils found in MR-5 contained detectable levels of the heavy metals Arsenic, Barium, Chromium, Lead, and Silver. While the levels do not exceed NYSDEC Part 375 Clean-up Guidelines as outlined in DER-10, there is concern involved with moving the soils with these compounds, and a Soil Management Plan (SMP) will be required to be followed by a contractor to prevent exposure from airborne dust concentrations. No PCBs were found in the soil sample taken at the MR-5 boring location. Other boring locations adjacent to the property indicate acetone (VOC) and Chromium (RCRA metal) as common contaminants. In most samples collected from those properties, these levels exceed guidance values. Therefore, based on the laboratory data, PID data, and field observations, it is anticipated that special excavation methods will be required during construction excavation, and excavated materials will require landfill characterization before disposal. In addition, it is recommended that a soil management plan (SMP) be implemented during excavations or other intrusive work that will define the handling methods and outline the requirements for characterization prior to disposal. 4.3 Groundwater No monitoring well was installed in the soil boring MR-5 at the NFTA property. Therefore, it could not be determined if there are groundwater issues associated with this site.
