Policy Legislation Regulations Supplement Policy Heads of Contracting Activities (HCAs ) are responsible for effectively implementing the small business programs within their ac tivities, including achieving program goals. Legislation Additionally, HCAs must ensure that contrac ting and technical personnel maintain knowledge of small business program requirements and take all reasonable action to Regulation (FAR) increase participation in their activities' contracting processes by these businesses. In order to effectively implement the small business programs, HCAs may create policy directives, instructions and/or a series of policy memos and guidance documents, as necessary, to effect desired small business program policy outcomes. They may also elect to supplement the FAR/DFARS if they are authorized to have DoD Component supplemen ts. However, it was determined that Section 811 of the Act needed to be effected in the FAR sooner than the normal rule making process allows. In this instance, Section 811 was implemented by publishing an " interim rule" in the Federal Register. The interim rule (76 FR 14559) was issued to implement the requirement of section 811 to require a Justification & Approval (J&A) prior to awarding a sole source contract in an amount over $20 million under the 8(a) Program ( 15 U.S.C. 637 (a)). 21 Lesson The Purpose of FAR/DFARS RESOURCES 1 PRINT I HELP Evolution of t he FAR The FAR is a substantial and complex set of rules governing the Federal Government's purchasing. The FAR is issued and maintained jointly under the statutory au thorities granted to the Secretary of the Department of Defense (DoD), Administrator of General Services (GSA) and the Administrator for the National Aeronautics and Space Administration (NASA). Statutory authorities to issue and revise the FAR have been delegated to the Federal Acquisition Regulation Council made up of representatives from DoD, GSA and NASA. The FAR applies to most agencies in the Executive Branch. The Legislative and Judicial branches are not required to comply with the FAR, but tend to follow it in spirit and content. In addition, Executive Branch agencies (such as the DoD) issue supplemental regulations (the Defense Federal Acquisition Supplement DFARS) that include purchasing rules unique to these agencies.... For example, EAR 19.SOSCbl states the following: "The SBA procurement center representative (or, if a procurement center representative is not assigned, see EAR Cal), may appeal the Contrac ting Officer's rejection to the head of the contracting activity (or designee) within 2 working days after receiving the notice. The head of the contracting activity (or designee) shall render a decision in writing, and provide it to the SBA representative within 7 worlcing days.
